REPORT AND DECISION
APPLICANT: Berkley Structures, Inc.; SA-072-86

LOCATION: Property located on the southwest corner of the the
intersection of S.W. 39th Street and Lind Avenue
S.W.
SUMMARY OF REQUEST: Application for site plan approval to allow the
construction of 30,000 square foot two story
building on a 5.04 acre parcel of property.
Laboratories will housed on the first and second
floors and 5,350 square feet of office space on the
second floor, files ECF-064-86, SA-072-86.
PROPONENT: BERKLEY STRUCTURES, INC.
SUMMARY OF ACTION: APPROVAL OF MODIFIED APPLICATION.
COMMITTEE REVIEW: The review was conducted at 10:40 a.m. on •
Wednesday, September 24, 1986 in the third floor
conference room of the Renton Municipal Building.
The Committee review was conducted after receiving written comment from all divisions
of the Public Works Department, both divisions of the Building and Zoning Department,
and the Fire, Police, and Policy Development Departments.
The following exhibits were entered into the record:

publication and other documentation pertinent to this request.
Exhibit No. 2 Site/Floor/Building Elevation Plan (received July 3, 1986).
Exhibit No. 3 Landscape Plan (received July 3, 1986).
Exhibit No. 4 Composite Site Plan Including Adjaceent 1,000 Car Parking Lot
(received September 17, 1986).
Exhibit No. 5 Letter from Doug Gardner, dated September 25, 1986, (receive
September 25, 1986) agreeing to modify application.

FINDINGS, CONCLUSIONS AND DECISION
Having reviewed the written record in the matter, and conducted individual on-site
inspections by each member of the Site Plan Review Committee, the Site Plan Review
Committee now makes and enters the following:
Findings:
1. The applicant, Berkley Structures, Inc. has requested site plan approval to allow the
construction of 30,000 square foot two story building on a 5.04 acre parcel of
property. Laboratories will housed on the first and second floors and 5,350 square
feet of office space on the second floor.
The structure will be constructed of tilt up concrete and build to a H6 Building and
Fire Code requirements to handle hazardous wastes in the laboratories.
2. The applicant's file containing the application, the State Environmental Policy Act
(SEPA) documentation,..the comments from various City departments. .the public
notices requesting citizen comment, and other pertinent documents was entered as
Exhibit No. 1. •
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C
1971 as amended), 'a Mitigated Declaration of Non-Significance has been issued for
the subject proposal by the Environmental Review Committee, the responsible
official. The mitigated declaration of non-significance was based upon
commitments submitted by the applicant along with participation in area wide
traffic mitigation. The applicant recognized that changes in occupancy would
require re-evaluation of traffic mitigation in the future.
4. The subject proposal is consistent with the Comprehensive Plan designation of
Manufacturing Park/Multiple Opinion for the subject site and the existing M-P.
Manufacturing Park zoning.
5. Plans for the proposal have been reviewed by all City departments affected by the
impact of the proposal.
6. The site plan as modified by Mr. Gardner's letter of September 25. 1986 complies
with Parking and Loading Ordinance for the number and configuration of parking
spaces in the parking lot.
7. The applicant has modified the application to include:
a. Construction of the building to H6 Occupancy requirements and
accepts the responsibility to modify or revise the building plans to
meet all Governmental Codes required. (The City position is this
includes all local, state, and federal requirements.)
b. Modification of the site plan to eliminate the overhanging of
automobiles in the required perimeter landscaping along S.W. 39th
Street and Lind Avenue S.W..
c. Modify the landscaping plan to include additional evergreen vegetation.
d. Modify the sidewalk at the northeast corner of the subject site to
insure sufficient width not to create a conflict with the proposed

CONCLUSIONS
1. The proposal as modified is a development consistent with policies,
specification, and codes of the City of Renton.
2. Specific design issues raised by various City departments focused on:
a. Building construction type.
b. Handling of hazardous waste materials from the laboratories.
c. Participation in the area wide traffic mitigation plan.
d. Appearance and compatability with adjacent commercial uses to
specifically include type of landscaping materials.
e. Modification of the sidewalk for public safety.
3. The applicant addressed the issues and agreed to modify the application as
set forth above.
DECISION:
The site plan, File Number SA-072-86 for Berkley Structures, Inc. is APPROVED subject
to the following conditions:
1. Approval of landscaping plans by the City's Landscape Architect who will
specifically look at the mixture of evergreen plant materials into the landscaping
theme.
2. Modification of the site plan as part of the building permit for the building shell to
include: (1) elimination of the overhange of automobiles into the required perimeter
landscaping. (2) design change of the sidewalk location at the northeast corner of
the site.
2. Cash payment by the applicant of their portion of the area wide traffic mitigation
at the time of issuance of the building permit in the amount of $39,874.80.
For the purpose of these decisions, the term "should" and "shall" are to be considered
mandatory and the term "may" is considered discretionary.

REQUESTS FOR RECONSIDERATION must be filed in writing on or before 5 p.m. on
Monday October 13, 1986. Any aggrieved person feeling that the decision of the Site
Plan Review Committee is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available prior
to the meeting date of Septebmer 24, 1986 may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen (14) days of the
decision, which is Monday, September 29, 1986. This request shall set forth the specific
errors relied upon by such appellant, and the Committee may, after review of the record,
take further action as it deems proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B)(1),
which requires that such appeals be filed directly with the Hearing Examiner. Appeals
must be made in writing before 5 p.m. on Monday, October 13, 1986.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private
one-on-one) communications may occur concerning land use decisions. This means that
parties to a land use decision may not communicate in private with any decision-maker
concerning the proposal. Decision-makers in the land use process for site plan approvals
include: (1) the Public Works Director, (2) the Building and Zoning Director, (3) the Policy
Development Director, (4) the Hearing Examiner, and (5) members of the City Council.
All communications after the decision date must be made in writing through the Zoning
Administrator. All communications are public record and this permits all interested
parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine would result in the invalidation of
the request by the Court.
The Doctrine applies not only to the initial Committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner.

In regards to our telephone conversation on September 24, 1986 I am providing
you with the following information and commitments.
Pertaining to our conversation on the H6 requirements Berkley Structures accepts
the responsibility to modify or revise our plans as necessary to meet all
Governmental Codes required under the H6 occupancy requirements, such as fire
department, utilities, traffic, etc. . . .
Pertaining to the site plan Berkley understands the following revisions are
necessary:
L. Modify the parking along the perimeter of the site which Overhangs landscaping.
2. The addition of evergreen type plants to provide more year round seclusion.
3. Traffic signal pole which will be installed will conflict with the sidewalk.
We will modify the sidewalk to insure sufficient width.
Pertaining to the traffic mitigation required by the City of Renton Berkley
Structures calculates and understands the fee to be as follows:
1. Office Area - 5,350 s.f. @ 15 trips/1000 80.24 vehicle trips
2. Research Area - 22,150 s.f. @ 5.3 trips/1000 117.40 vehicle trips

FINDINGS, CONCLUSIONS AND DECISION
Having reviewed the written record in the matter, and conducted individual on-site
inspections by each member of the Site Plan Review Committee, the Site Plan Review
Committee now makes and enters the following:
Findings:
1. The applicant, Berkley Structures, Inc. has requested site plan approval to allow the
construction of 30,000 square foot two story building on a 5.04 acre parcel of
property. Laboratories will housed on the first and second floors and 5,350 square
feet of office space on the second floor.
The structure will be constructed of tilt up concrete and build to a H6 Building and
Fire Code requirements to handle hazardous wastes in the laboratories.
2. The applicant's file containing the application, the State Environmental Policy Act
(SEPA) documentation, .the comments from various City departments, the public
notices requesting citizen comment, and other pertinent documents was entered as
Exhibit No. 1. •

3. Pursuant to the.City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C
1971 as amended), 'a Mitigated Declaration of. Non-Significance has been issued for
the subject proposal by the Environmental Review Committee, the responsible
official. The mitigated declaration of non-significance was based upon
commitments submitted by the applicant along with participation in area wide
traffic mitigation. The applicant recognized that changes in occupancy would
require re-evaluation of traffic mitigation in the future.
4. The subject proposal is consistent with the Comprehensive Plan designation of
Manufacturing Park/Multiple Opinion for the subject site and the existing M-P,
Manufacturing Park zoning.
5. Plans for the proposal have been reviewed by all City departments affected by the ,
impact of the proposal.
6. The site plan as modified by Mr. Gardner's letter of September 25, 1986 complies
with Parking and Loading Ordinance for the number and configuration of parking
spaces in the parking lot.
7. The applicant has modified the application to include:
a. Construction of the building to H6 Occupancy requirements and
accepts the responsibility to modify or revise the building plans to
meet all Governmental Codes required. (The City position is this
includes all local, state, and federal requirements.)
b. Modification of the site plan to eliminate the overhanging of
automobiles in the required perimeter landscaping along S.W. 39th
Street and Lind Avenue S.W..,
c. Modify the landscaping plan to include additional evergreen vegetation.
d. Modify the sidewalk at the northeast corner of the subject site to
insure sufficient width not to create a conflict with the proposed
traffic signal pole.
e. Participation in the plan for area wide traffic mitigation in the
amount of $39,874.80.

CONCLUSIONS
1. The proposal as modified is a development consistent with policies.
specification, and codes of'the City of Renton.
2. Specific design issues raised by various City departments focused on:
a. Building construction type.
b. Handling of hazardous waste materials from the laboratories.
c. Participation in the area wide traffic mitigation plan.
d. Appearance and compatability with adjacent commercial uses to
specifically include type of landscaping materials.
e. Modification of the sidewalk for public safety.-
3. The applicant addressed the issues and agreed to modify the application as
set forth above.
DECISION:
The site plan, File Number SA-072-86 for Berkley Structures, Inc. is APPROVED subject
to the following conditions:
1. Approval of landscaping plans by the City's Landscape Architect who will
specifically look at the mixture of evergreen plant materials into the landscaping
theme.
2. Modification of the site plan as part of the building permit for the building shell to
include: (1) elimination of the overhange of automobiles into the required perimeter
landscaping. (2) design change of the sidewalk location at the northeast corner of
the site.
2. Cash payment by the applicant of their portion of the area wide traffic mitigation
at the time of issuance of the building permit in the amount of $39,874.80.
For the purpose of these decisions, the term "should" and "shall" are to be considered
mandatory and the term "may" is considered discretionary.

REQUESTS FOR RECONSIDERATION must be filed in writing on or before 5 p.m. on
Monday October 13, 1986. Any aggrieved person feeling that the decision of the Site
Plan Review Committee is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available prior
to the meeting date of Septebmer 24, 1986 may make a written request to the Zoning
Administrator for review by the Site Plan Committee within fourteen (14) days of the
decision, which is Monday. September 29, 1986. This request shall set forth the specific
errors relied upon by such appellant, and the Committee may, after review of the record,
take further action as it deems proper.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B)(1),
which requires that such appeals be filed directly with the Hearing Examiner. Appeals
must be made in writing before 5 p.m. on Monday, October 13, 1986.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private
one-on-one) communications may occur concerning land use decisions. This means that
parties to a land use decision may not communicate in private with any decision-maker
concerning the proposal. Decision-makers in the land use process for site plan approvals
include: (1) the Public Works Director, (2) the Building and Zoning Director, (3) the Policy
Development Director, (4) the Hearing Examiner, and (5) members of the City Council.
All communications after the decision date must be made in writing through the Zoning
Administrator. All communications are public record and this permits all interested
parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine would result in the invalidation of
the request by the Court.
The Doctrine applies not only to the initial Committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner.

Dear Roger and Environmental Review Committee:
In regards to our telephone conversation on September 24, 1986 I am providing
you with the following information and commitments.
Pertaining to our conversation on the H6 requirements Berkley Structures accepts
the responsibility to modify or revise our plans as necessary to meet all
Governmental Codes required under the H6 occupancy requirements, such as fire
department, utilities, traffic, etc. . . .
Pertaining to the site plan Berkley understands the following revisions are
necessary:
1. Modify the parking along the. perimeter of the site which dverhangslandscaping.
2. The addition of evergreen type plants to provide more year round seclusion.
3. Traffic signal pole which will be installed will conflict with the sidewalk.
We will modify the sidewalk to insure sufficient width.
Pertaining to the traffic mitigation required by the City of Renton Berkley
Structures calculates and understands the fee to be as follows:
1. Office Area - 5,350 s.f. @ 15 trips/1000 80.24 vehicle trips
2. Research Area - 22,150 s.f. @ 5.3 trips/1000 117.40 vehicle trips
3. Equipment Mezzanine - 2,500 s.f. @ 0 trips/1000 0.0 vehicle trips

In regards to our telephone conversation on September 24, 1986 I am providing

Pertaining to our conversation on the H6 requirements Berkley Structures accepts
the responsibility to modify or revise our plans as necessary to meet all
Governmental Codes required under the H6 occupancy requirements, such as fire
department, utilities, traffic, etc. . . .
Pertaining to the site plan Berkley understands the following revisions are

vehicle trips generated. The City of Renton utilizes the 1982, 3rd Edition, of the Institute

Dear Mr. Gardner:
The Environmental Review Committee (ERC) considered the environmental impacts of
you proposed development of a 30,000 square office and laboratory on a 5 acre parcel
located on the southwest corner of the interesection of Lind Ave. S.W. and S.W. 39th
Street on Wednesday September 10th and 24th, 1986. It was their opion based upon the
recommendations from the Policy Development. Fire, Public Works and Building and
Zoning Departments that there are significant areas of environmental concern.
The ERC find that traffic congestion and the issue of hazardous wastes are significant
environmental concerns. The ERC believes that it can issue a Mitigated Declaration of
Non-Significance if the following specific environmental mitigating measures are included
as a modification to your application:
1. A statement that the building and all of the tenant improvements will comply
with all safety measures imposed for hazardous materials imposed by all levels
of government.
2. Participation in the mitigation of area wide traffic improvements in the Valley
based upon the rate of $188 per daily vehicle trip.
Your response will formally amend your application and those changes which you have
delineated will become conditions which are not appealable.

I had a meeting this afternoon with Mike Dunne and Ed Heavey
regarding the meeting they had with you. There seems to be several
issues that need to be cleared-up.
1. We would appreciate the release of the Building Shell
Permit for the 7N Building on September 24, 1986.
We understand that this approval is not the approval of the ,
H6 Tenant Improvement requirement. Mike, Ed and myself discussed
this in detail , and we understand and accept this permit arrangement.
2. The H6 requirement will be reviewed with the T.I. Permit,
which will be transmitted to the City of Renton on September
24, 1986.
It was also discussed that a meeting be set-up between your
staff and the consultants to discuss the operation of the Lab. Please
advise me as to what time this meeting could take place. I was told
to set it up for Wednesday afternoon September 24, 1986, or Thursday
morning September 25, 1986.

417 parking stalls available.
This project would affect only the parking reserved for Buildings ,6 .and 7 . : . i .
according to the Boeing Electronics Center Parking Analysis dated July 8, 1986.
354 parking stalls are required per code for these buildings of which 210 stalls
are provided on their site and 144 are required on our 7N Building site.

Project Description:
The proposed building will be occupied by Boeing
Electronics Company. It will
house laboratories on the first floor and office space on the second floor. The
building will be constructed of tilt-up concrete with a reflective glass band
around second floor. There will be no windows at first floor. The roof will
have a testing pad and storage roan. Top of parapet will be at approximately
28'-0" above first floor.
The analysis laboratory located on the first floor consists of surface analysis
laboratory, x-ray laboratory, general optical analysis laboratory, special
response laboratory, class IV laser roan and electronic characterization labora-
tory. These will also store and use approximately 70 lbs. of hazardous
material. Most of the lab area will be designated as a class 100 - 400,000
clean roan. Due to testing requirements, portion of the building will be
designed so that it will not vibrate more than 250 microinches/second.
Half of the second floor will be listed as office space, while the rest will
serve as future expansion area.

Dear Mr. Gardner:
The staff of the Renton Building and Zoning Department have done a preliminary review
of the above referenced site plan approval application. Before we will continue on with
departmental review, it will be necessary that we receive some additional information
with the following items in order to proceed:
1. , ,Provide a revised site plan of the property showing all of its boundaries
drawn to scale including the existing parking lot recently constructed.
The new parking lot will also need to be redrawn showing the individual
falls dimensioned.
2. The proposed development is shown overlapping into the parking lot to
the west that was required of the Boeing Aerospace Company to
develop when the seven building complex was converted to electronics
and office space (files CU-057-85. SA-056-85). Because of this and of
the construction of Raymond Avenue being built through the lot, we
will need to have a complete parking analysis for all those uses bound
by the streets of S.W. 39th Street to S.W. 43rd Street and Lind Avenue
S.W. to Oakesdale Avenue S.W. We need assurance that all required
parking needs will be met.
3. Provide a written text of the project describing conditions of features
which cannot be adequately shown on the plans such as the scope of the
project, the proposed uses, and the program for development (including
timing and phasing).

was signed by Edward Heavey.

The State Environmental Policy Act (SEPA), chapter 43,21C RCW, requires all
governmental agencies to consider the environmental Impacts of a proposal before making
