Downtown & Economic Development Update Date Committee of the Whole August 14,2017 A G E N D A I T E M # 3 . 200 Mill Avenue Request for Proposals –Background November 2016: City Council selected Winson Investment of Bellevue as the preferred developer and directed staff to begin exclusive negotiations with its team Winson proposal included elements of senior housing, restaurants, retail space, and a large public plaza opening onto the Cedar River, plus an international school and dormitory; school element was to be developed and owned by Chinese national investor January 2017: While discussing ENA terms with City, Winson team began process of finalizing its development concept; conducting due diligence and site planning; facilitating transfer of foreign assets to begin the project; and establishing proper legal entities necessary to develop, finance, own and operate the project April 2017: Winson’s team advised the City that the primary investor would no longer be investing in the project and proposed changes to the scope of the project, including removal of the international school and dormitory; investor related a different version of events; those changes led City staff to conclude that it no longer had authority to proceed with an ENA without bringing changes back to City Council for direction A G E N D A I T E M # 3 . 200 Mill Avenue Request for Proposals –Background May 2017: Council asked staff to establish a date certain for responses from the parties as to whether the team intends to proceed with the project as planned; City Attorney sent a letter to Winson and its primary investor representatives, requesting that the two parties determine whether they can reach mutual agreement and clarify their intent in moving the project forward by June 6, 2017 June 6, 2017: As of this deadline, responses were received from attorneys representing both parties, with each expressing interest in moving forward with a project on the site but clearly indicating that they have not reconciled their differences and will not be working together in the future; given this situation, staff suspended negotiations with both parties at that time Staff notified Council members that it would come back before Council in the near future with alternatives to move forward A G E N D A I T E M # 3 . 200 Mill Avenue Proposed Next Steps •Staff reviewed several options for next steps, including issuing a new RFI/RFQ for the site or holding at this time on any action on the property •Staff believes the area’s development market remains very strong; we are encouraged by the rate of residential lease-up and rental rates at the Second and Main project; and we have received informal requests about the site and whether the previous project is moving forward •Staff believes that by streamlining the interest and proposal processes, we can begin a second round of solicitation that will allow us to more quickly determine level of interest and move into discussions with interested parties A G E N D A I T E M # 3 . 200 Mill Avenue New RFI/RFP Process 1.Revise, refresh and expand the list of developers to contact, as well as determine appropriate on-line or print media to promote the RFI 2.Revise the original RFI document as a “Public/Private Partnership for Development of the 200 Mill Property” with the City 3.Within the new RFI, require a streamlined/limited amount of information to be submitted by interested parties: a.What is your interest? b.What is your vision for the project? c.What is your development experience, especially similar to this project? d.Have you worked in a public-private partnership before? 4.New RFI will specify certain elements important to the City as part of a future project, including: a.Public amenities, access to river b.Residential, office and street level retail (some combination) as potential uses c.Entire site must be part of any consideration (building and surrounding land) d.Interested parties must be prepared to engage current tenants in discussions about future development A G E N D A I T E M # 3 . 200 Mill Avenue New RFI/RFP Process 5.Based upon RFI responses, staff and consultant will review submittals and meet with each interested party to learn more about its interest and background 6.Staff and consultant will develop a list of qualified interested developers 7.Qualified developers will have the opportunity to respond to a new RFP where they can provide additional details as to their qualifications and vision on how they wish to develop the project and structure a public/private partnership 8.Upon review of the proposals, a selection committee comprised of City staff and elected official(s) will meet with each developer to discuss their qualifications and vision 9.Selection committee will then place the developers in rank order and present to City Council 10.City Council will review the finalists and select a preferred developer; upon acceptance by the developer, the City will move forward to enter into an ENA to negotiate a development agreement with the developer A G E N D A I T E M # 3 . 200 Mill Avenue New RFI/RFP Process Timeframe •Committee of the Whole Update and Agreement on new RFI/RFP process – August 14th •Advertise and release the RFI as early as possible •Target completion of new RFI/RFP process with executed ENA by end of 2017 A G E N D A I T E M # 3 .
