On-site BMPs include dispersion and infiltration devices, biaretention, permeable pavements, rainwater harvesting systems, tree retentian credit, reduced imperviaus surface footprint, vegetated roofs and ather measures designed ta mimic pre-developed hydralogy and minimize stormwater runaff an the Property. 2. City of Renton shall have the right to ingress and egress over thase portions af the Property necessary to perform inspections of the stormwater facilities and BMPs and conduct maintenance activities specified in this Declaration of Cavenant and in accordance with the Renton Municipal Code. City af Rentan shall provide at least thirty (30) days' written notice ta the Owners that entry on the Property is planned for the inspection of drainage facilities. After the thirty (30) days, the Owners shall allaw the City of Renton to enter for the sole purpose of inspecting drainage facilities. In lieu of inspection by the City, the Owners may elect to engage a licensed civil engineer registered in the state of Washington who has expertise in drainage to inspect the drainage facilities and provide a written report describing their canditian. If the engineer aption is chosen,the Owners shall provide written notice to the City of Renton within fifteen (15) days of receiving the City's notice af inspection.Within thirty(30) days of giving this natice,the Owners, or engineer on behalf of the Owners,shall pravide the engineer's repart to the City of Renton. If the report is not provided in a timely manner as specified abave,the City of Renton may inspect the drainage facilities without further notice. 3. If City of Renton determines fram its inspection, ar fram an engineer's repart provided in accordance with Paragraph 2, that maintenance, repair, restaratian, and/or mitigation warl< is required to be dane to any af the drainage facilities, City of Renton shall natify the Owners of the specific maintenance, repair, restoratian, and/or mitigation work ("Work") required pursuant ta the Renton Municipal Code. The City shall also set a reasonable deadline for the Owners ta complete the Work, ar ta pravide an engineer's repart that verifies compietian of the Worl<. After the deadline has passed, the Owners shall allow the City access to re-inspect the drainage facilities unless an engineer's report has been provided verifying completion of the Work. If the Work is not completed within the time frame set by the City, the City may initiate an enforcement actian and/or perfarm the Wark and hereby is given access ta the Praperty for such purpases. Written notice will be sent ta the Owners stating the City's intentian to perform such Work.This Worl<will not commence until at least seven(7) days after such natice is mailed. If, within the sole discretion af the City, there exists an imminent ar present danger, the seven (7) day notice periad will be waived and Work will begin immediately. 4. The Owners shail assume all responsibility for the cost of any Work, ar any measures taken by the City to address conditions as described in Paragraph 3. Such responsibility shall include reimbursement to the City within thirty(30)days of the receipt of the invoice far any such Worl< performed. Overdue payments will require payment af interest at the maximum legal rate allowed by RCW 19.52.020 (currently twelve percent (12%)). If the City initiates legal actiari ta enforce this agreement, the prevailing party in such action is entitled to recover reasonable litigation casts and attorney's fees. 5. The Owners are required to obtain written approval fram City of Renton prior to filling, piping, cutting, ar removing vegetation (except in routine landscape maintenance) in open vegetated starmwater facilities (such as swales, channels, ditches, ponds, etc.), or perfarming any alterations or madificatians ta the drainage facilities referenced in this Declaration af Covenant. With regard ta the matters addressed herein,this agreement constitutes the entire agreement between the parties, and supersedes all priar discussions, negotiatians, and all agreements whatsoever whether oral or written. �. You should plan to complete a checklist for�II system components an the following schedule: (M) Monthly from October (or Novernber) through April (A) Once in late summer(preferably September) (C) Qnce in mid summer(late July or early August) (S) After any major starm (use 1 inch in 24 hours as a guideline) (B) Biannually (twice per year- refer to individual checklist for timing) (Q) Quarterly Use photocopies of these pages and check off the problems you laoked for each tirne you did an inspection. Add comments on problems found and actions taken. Keep these "checked" sheets in your files, as they will be used to write yaur annual report. Some items do not need to be looked at every time an inspectian is done. The facility-specifie maintenance standards cantained in this section are intended to be conditions far determining if maintenance actions are required as identified thraugh inspection.They are not intended to be measures af the facility's required condition at all times between inspections. In other wards, exceedance of these canditions at any time between inspections and/or maintenance does not automatically constitute a violation af these standards. Hawever, based upon inspection abservations, the inspection and maintenance schedules shall be adjusted ta minimize the length of time that a facility is in a condition that requires a maintenance actian. A TESC certified prafessional will be designated priar to canstruction and will conduct inspections as well as identify a maintenance program for any erasion control measures.
