The Grantor(s),as named above,for and in consideration of mutual benefits,do by these presents,grant,bargain,sell,
convey,and warrant unto the above named Grantee,its successors and assigns,a non-exclusive easement for public sanitary
sewer with necessary appurtenances over,under,through,across and upon the following described property(the right-of-
way)in King County,Washington,more particularly described in Exhibit A:
For the purpose of constructing,reconstructing,installing,repairing,replacing,enlarging,operating and
maintaining sanitary sewer utilities and utility pipelines,together with the right of ingress and egress thereto
without prior institution of any suit or proceedings of law and without incurring any legal obligation or liability
therefor. Following the initial construction of its facilities,Grantee may from time to time construct such
additional facilities as it may require. All facilities shall be underground. This easement is granted subject to the
following terms and conditions:
1. The Grantee shall,upon completion of any work within the property covered by the easement,restore the surface of
the easement,and any private improvements disturbed or destroyed during execution of the work,as nearly as
practicable to the condition they were in immediately before commencement of the work or entry by the Grantee.
Grantee shall indemnify,defend and hold harmless Grantor,its successors and assigns,from any damage,liability,
claim,lien,or loss,including attorney's fees and costs,arising out of use of the easement by Grantee,its agents,
contractors,successors in title,assigns,authorized persons,and/or all others acting on its behalf,except to the extent
such damage,liability,claim,lien,or loss,is due to the negligence or intentional misconduct of the Grantor or an
agent,contractor,successor in title,authorized person,assign of Grantor.
2. All construction and installation of improvements within the easement and the operation and maintenance thereof shall
be performed(a)in accordance with applicable laws,regulations and permits,(b)in a lien-free,professional and safe
manner,and(c)with due diligence at reasonable times and in a reasonable manner to minimize interference with other
uses on the property. Prior to entry onto the easement for repair or maintenance,Grantee shall provide reasonable
notice to Grantor,except to the extent of an emergency.
3. Grantor shall retain the right to use the surface of the easement,and to grant utility easements to other utility providers,
as long as such use or additional easements do not interfere with the easement rights granted to the Grantee. Grantee
will cooperate with Grantor for the location of additional utilities within the easement area.
Grantor shall not,however,have the right to:
a. Erect or maintain any buildings or structures within the easement;or
b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or interfere with the
utilities to be placed within the easement by the Grantee;or
c. Develop,landscape,or beautify the easement area in any way which would unreasonably increase the costs to
the Grantee of restoring the easement area and anyprivate improvements therein.
d. Dig,tunnel or perform other forms of construction activities on the property which would disturb the
compaction or unearth Grantee's facilities on the right-of-way,or endanger the lateral support facilities.
e. Blast within fifteen(15)feet of the right-of-way.
4. This easement is located within a Federal Superfund Site regulated by the U.S.Environmental Protection Agency.
Any work by the Grantee or other person in the easement area shall be done in compliance with requirements of the
U.S.Environmental Protection Agency,the Washington State Department of Ecology,or any other agency with
authority pursuant to state or federal environmental laws("Environmental Agencies"),and only after 30-day notice to
the appropriate Environmental Agency,and Grantee and any other person using the easement shall indemnify and
hold Grantor harmless from any cost,liability or obligation relating to construction in or use of the easement area by
Grantee or any other person,including but not limited to compliance with requirements of any of the Environmental
Agencies. Grantor reserves a right of access over the easement for Environmental Agencies and their authorized
contractors in connection with its regulation of the Federal Superfund Site. Grantee shall be solely responsible for the
management and disposal if any waste generated as a result of the installation,operation or maintenance of
improvements within the easement and shall be the generator of any waste resulting from those activities. Grantee
shall indemnify,defend and hold harmless Grantor,its successors and assigns,from any damage,liability,claim,lien,
or loss or any costs of expenses,including attomey's fees and costs,associated with the generation,management,
disposal of hazardous substances by Grantee or contact with or exposure to hazardous substances resulting from
subsurface activities authorized or permitted by Grantee within the easement.
This easement shall run with the land described herein,and shall be binding upon the parties,their heirs,
successors in interest and assigns. Grantors covenant that they are the lawful owners of the above properties and
that they have a good and lawful right to execute this agreement.
By this conveyance,Grantor will warrant and defend the easement granted hereby to the Grantee against all and
every person or persons,whomsoever,lawfully claiming or to claim the same. This conveyance is subject to all
existing easements,reservations,restrictions,covenants,encumbrances,and all other matters of record.This
conveyance shall bind the heirs,executors,administrators and assigns forever.

and shorelands adjoining lying westerly of the Northern Pacific Railroad Right of Way and
southerly of a line described as follows:
Beginning at the Quartet Corner on the south line of said Section 29;thence
North 89°58'36"West along the South line of said Lot 5,a distance of 1,113.01 feet to the
westerly line of said Northern Pacific Railroad Right of Way;thence North 29°44'54"East,

Policy 540A Enforcement
This policy applies whenever the depai talent intends to issue Model Toxics Control Act orders
requiring a Potentially Liable Person (PLP)to provide remedial action or pay for cleanup costs or
natural resource damage assessments. This policy is intended to supplement requirements specified in
statute and rule. Regional Directors should be kept informed about enforcement actions against local
governments.
1. Emergency Orders May Be Issue At Any Time During The Cleanup Process
In general, emergency orders should be used only in situations when the normal process of
issuing an enforcement order would be longer than the deadline necessary for initiating
remedial action.
2. The Toxics Cleanup Program Generally Attempts To Negotiate Or Have Discussions
With PLPs Prior to Issuing Orders.
Prior to issuing orders, TCP staff is encouraged to attempt negotiations for a consent decree
or discussions for an agreed order with PLPs, whenever possible. However, there are cases
where potential delays in the cleanup process make negotiations impracticable or not in the
public interest; for example, emergency conditions, the time required for negotiations or
discussions would be longer than the deadline necessary for initiating remedial action, PLP
unresponsiveness, or a PLP request for an enforcement order.
Attempts to negotiate a consent decree or discuss an agreed order should be documented in
the site file.
3. The Site Manager May Withdraw From Negotiations Or Discussions.
The site manager may withdraw from negotiations for a consent decree or discussions for
an agreed order if it is determined that:
A. Reasonable progress'is not being made toward the consent decree or order
acceptable to the department, see WAC173-340-520(1)(1), WAC 173-340-
520(2)(e), and WAC 173-340-530(6); or

B. The consent decree or order is no longer appropriate based on new information or
changed circumstances.
Decisions to withdraw should be made in consultation with the assigned Assistant
Attorney General.
The site manager may begin enforcement action after notifying the PLP in writing, of its
intent to withdraw from the negotiations or discussions. See WAC 173-340-520(1)(1),
WAC 173-340-520(2)(e), and WAC 173-340-530(6).
4. Generally, TCP Issues Orders Requiring PLPs To Conduct Remedial Actions Before
Using Funds From The Toxics Account.
When attempts at negotiations or discussions are unsuccessful, TCP site managers
generally will issue an order before proceeding with cleanup work utilizing state toxics
control account monies. Toxics account funds may be used prior to issuing orders if
emergency conditions exist at the site.
5. Site Managers Shall Use The Boilerplates As A Basis For Drafting Orders.
The Boilerplates for Agreed Orders and Enforcement Orders can be found on the Toxics
Cleanup Program's intranet site. Use of the documents shall be in accordance with the
provisions of WAC 173-340-130 and Part V of Chapter 173-340 WAC. Significant
deviations from these boilerplates should be discussed with the assigned Assistant
Attorney General.
6. Generally, TCP Will Not Take Enforcement Actions Against Residential Landowners.
Although residential landowners are PLPs, in the exercise of its enforcement discretion, •
TCP generally will not pursue enforcement actions toward residential landowners to •
require such an owner to take response actions or pay response costs unless:
A. The residential homeowner's activities lead to a release or threatened release of
hazardous substances which results in the need for remedial actions at the site;
B. The property owner fails to comply with any MTCA obligations (e.g., reporting the
release of a hazardous substance);
C. The property owner fails to provide access to the site or information, or fails to
cooperate with TCP's investigation or cleanup at the site;
D. The property owner develops or improves the property in a manner inconsistent
with residential use, or the development of the property leads to a release or
threatened release of hazardous substances; or
E. The property owner fails to comply with any institutional controls established at the
site.

7. Effect Of Policy
This policy does not affect any other obligations required of owners of contaminated
property under the MTCA or other federal, state and local laws. It provides guidance for
the exercise of Ecology's enforcement discretion. It is intended only for Ecology's internal
use and may not be relied upon by any person to create a right or a benefit, substantive or
procedural, enforceable at law or in equity. The policy is not a covenant not to sue any
person and does not affect or negate the liability or defenses any person may have under
the MTCA or other law. Ecology may withdraw or change this policy at any time.
Ecology may act at variance with this policy.

indemnify,defend and hold harmless Grantor,its successors and assigns,from any damage,liability,claim,lien,or loss or
any costs of expenses,including attorney's fees and costs,associated with the generation,management,disposal of
hazardous substances by Grantee or contact with or exposure to hazardous substances resulting from subsurface activities
authorized or permitted by Grantee within the Dedication after the Dedication.
Grantor hereby reserves the temporary right to use the dedicated area to complete any environmental testing,remediation or
other activities required by the U.S.Environmental Protection Agency,the Washington State Department of Ecology,or any
other agency with authority pursuant to state or federal environmental laws("Environmental Agencies"),without the
requirement for a street use permit or other approval from the City and without payment of any fee to the City. Grantor
reserves a right of access over the dedication area for Environmental Agencies and their authorized contractors in connection
with its regulation of the Federal Superfund Site. Any work by the City or other person in the dedication area shall be done
in compliance with requirements of the Environmental Agencies and only after 30-day notice to the appropriate
Environmental Agency,and Grantee shall indemnify and hold Grantor harmless from any cost,liability or obligation relating
to construction in or use of the dedicated area by Grantee or anyone authorized by Grantee,including but not limited to
compliance with the requirements of any of the Environmental Agencies.

Grantors, Conner Homes at Barbee Mill, LLC, and the City of Renton, hereby bind Grantors, its
successors and assigns to the land use restrictions identified herein and grants such other rights
under this environmental covenant (hereafter "Covenant") made this day of 4(J2 / /7
2008 in favor of the State of Washington Department of Ecology, and its successors and assigns
("Ecology"). Ecology shall have full right of enforcement of the rights conveyed under this
Covenant pursuant to the Model Toxics Control Act,RCW 70.105D.030(1)(g), and the Uniform
Environmental Covenants Act,2007 Wash. Law ch. 104,sec. 12.
, This Declaration of Covenant is made pursuant to RCW 70.105D.030(1)(f) and (g) and WAC
173-340-440 by Conner Homes at Barbee Mill, LLC, its successors and assigns, the City of
Renton, its successors and assigns,and Ecology.
An interim remedial action (hereafter "Remedial Action") occurred at the property that is the
subject of this Covenant. The Remedial Action conducted at the property was designed and
constructed as described in the documents listed in attached Exhibit E-5:
The Remedial Action will also be the subject of a proposed Agreed Order No. 5396, a copy of
which will be on file at Ecology's Northwest Regional Office located at 3190 160th Avenue SE,
Bellevue, WA 98008. The Agreed Order will describe the Remedial Action in detail and provide
for ongoing remedial actions at the Site.

This Covenant is required to protect the integrity of the Remedial Action on the property,
because the Remedial Action may have resulted in concentrations of the following remaining
at the Barbee Mill Site:
• Confirmed arsenic in ground water exceeding the MTCA preliminary cleanup
level protective of surface water.
• Suspected arsenic in soil exceeding the Model Toxics Control Act (MTCA)
preliminary cleanup level for protection of ground water.
• Suspected arsenic in sediment located West and Northwest of the Conner at
Barbee Mill uplands exceeding the preliminary freshwater sediment criterion.
• Suspected zinc in ground water exceeding the MTCA preliminary cleanup level
protective of surface water
• Suspected diesel-range petroleum hydrocarbons in ground water exceeding the
MTCA preliminary cleanup level protective of potable use

The undersigned, Conner Homes at Barbee Mill, LLC, is the fee owner of real property
(hereafter "Property") in the County of King, State of Washington,

Covenant. The additional undersigned, City of Renton, possesses
dedicated rights of way. The Property is legally described in E-1 of this Covenant and made a
part hereof by reference. Exhibit E-2 also includes a figure showing Property boundaries.
Conner Homes at Barbee Mill, LLC, and the City of Renton,make the following declaration as
to limitations, restrictions, and uses to which the Property may be put and specifies that such
declarations shall constitute covenants to run with the land, as provided by law and shall be
binding on all parties and all persons claiming under them, including all current and future
owners of any portion of or interest in the Property(hereafter"Owner")
Section 1.
A. No groundwater may be taken for any use from the Property.
B. Soil exceeding MTCA Method A cleanup level for unrestricted use for arsenic
remains on the Property at a depth approximately eighteen feet below the ground surface as of
December, 2007, at elevations of approximately between 8 and 10 feet North American
Vertical Datum 1988 (NAVD878), within the area of the original arsenic excavation as shown
in Exhibit E-2. This contamination is below the depth at which direct contact exposure would
typically be expected. However, Ecology recommends refraining from conducting any activity
in these areas that would disturb the contamination at depth, such as: drilling, digging,
bulldozing or earthwork or otherwise altering
the soil constructionlow a depth as of December approximately007 with grade
feet below ground surface at time of home
elevations of approximately between 26 through 30 NAVD88.
C. Groundwater, and soil exceeding potential cleanup oundwate protection

groundwater remains on the Property at or below the maximum gr

of the original arsenic excavation as shown in E-2. Any activity on the Property that may
result in the release or exposure to the environment of this contaminated soil or groundwater,
or that creates a new exposure pathway, is prohibited. Some examples of activities that are
prohibited in these areas include: drilling, digging, bulldozing or earthwork or otherwise
altering the soil below the maximum groundwater elevation of approximately between 19
through 23 feet NAVD88. This restriction shall not apply to maintenance or repair work by the
City of Renton or its contractors or agents on the existing sewer main located in the easement
recorded under King County Recording no. 7212190390, because the sewer line lies
hydraulically upgradient of the area of excavated arsenic contaminated soil.
D. A passive attenuation zone (hereafter PAZ) is present on the Property as shown
on Exhibits E-2 and E-3. The top of the PAZ is protected with a geotextile layer covered with
quarry spalls.The Owner shall not alter,modify,or remove the PAZ or the protective covering,
and any activity on the Property that may damage or reduce the effectiveness of the attenuation
zone is prohibited. Some examples of activities that are prohibited in the area of the PAZ
include: drilling,digging,bulldozing or earthwork, or placing a heavy object or running heavy
equipment on the PAZ causing stress beyond load bearing capacity. This restriction shall not
apply to normal construction activities required to build structures on Lots 19, 20, 21, 22, 23,
and 24 above the PAZ that are installed in accordance with plans on file with and approved by
the City of Renton Department of Community Development, provided that this construction
activity does not disturb the PAZ or its protective covering other than through the installation
of driven pin piles. Landscaping within the top two feet of existing grade (as of December
2007) shall be allowed above the PAZ.
E. A network of ground water extraction wells linked by piping to a remediation
system vault ("hereafter Extraction System") is present on the Property as shown on Exhibits
E-2 and E-3. The Extraction System has been designed to pump arsenic-contaminated ground
water from beneath the Property and discharge it directly to the sanitary sewer. Any activity
that may damage or reduce the effectiveness of the Extraction System is prohibited. Some
examples of prohibited activities include digging around the well locations and along the
Extraction System pipe runs, blocking the discharge of the Extraction System to the sanitary
sewer, or allowing the Extraction System to discharge to Lake Washington, the storm water
detention pond,Mill Creek,or any other surface location.
F. A network of ground water monitoring wells is present on the Property as
shown on Exhibits E-2 and E-3. Any activity that may damage or reduce the ability of the
monitoring wells to be used for their intended purpose is prohibited. Some examples of
prohibited activities include covering, sealing, or otherwise obscuring the tops of monitoring
wells to reduce access, placing any solid or liquid into a well except as necessary for
authorized sampling,digging or otherwise piercing the ground around well locations,storing or
placing heavy loads near or on the monitoring wells, or allowing surface water to collect in
standing pools of water over monitoring well locations.
G. A storm water detention pond is present within the Property to collect and
discharge storm water runoff. The base of the pond is close to the water table, and has a
protective liner to prevent mixing of ground water with surface water and loss of surface water.
The location and design of the protective liner is presented in Exhibit E-2. Any activity that
may damage or reduce the effectiveness or longevity of the protective liner is prohibited.

Some examples of prohibited activities include piercing or otherwise driving objects through
the liner, using backhoes or other heavy equipment for excavation purposes near the liner, or
placing sharp heavy objects at the base of the pond. Conner Homes at Barbee Mill, LLC and
its successors in interest and assigns shall be responsible for future maintenance and any
repairs or upgrades for the pond liner.
Section 2. Any activity on the Property that may interfere with the integrity of the Remedial
Action and continued protection of human health and the environment is prohibited.
Section 3. Any activity on the Property that may result in the release or exposure to the
environment of a hazardous substance that remains on the Property as part of the Remedial
Action, or create a new exposure pathway, is prohibited without prior written approval from
Ecology.
Section 4. The Owner of the Property must give thirty (30) day advance written notice to
Ecology of the Owner's intent to convey any interest in the Property. The written notice shall
be in substantially the form attached as Exhibit E-4. WAC 173-340-440(9)(c) provides that
"no conveyance of title, easement,lease,or other interest in the Property shall be consummated
by the Owner without adequate and complete provision for the continued monitoring,
operation, and maintenance of the cleanup action". At the time of signature to this
Environmental Covenant, it is expected that the necessary ongoing remedial actions required
by Ecology for this Site, other than those described in this Environmental Covenant, will be
implemented by named potentially liable persons under an Order or Decree with Ecology. It is
further expected that financial assurances intended to ensure the ongoing remediation will be
posted by the named potentially liable parties. The requirement for "adequate and complete
provision" in this Section shall be deemed to have been satisfied by compliance with the terms
of the Order or Decree and this Environmental Covenant. Nothing in this Section shall be
construed to require Ecology's approval of any conveyance of title, easement, lease, or other
interest in the Property.
Section 5. The Owner must restrict leases to uses and activities consistent with the Covenant
and notify all lessees of the restrictions on the use of the Property.
Section 6. The Owner must notify and obtain approval from Ecology prior to any use of the
Property that is inconsistent with the terms of this Covenant. Ecology may approve any
inconsistent use only after public notice and comment.
Section 7. The Owner shall allow authorized representatives of Ecology the right to enter the
Property at reasonable times for the purpose of evaluating the Remedial Action; to take
samples, such as from monitoring and extraction wells and from sediments;to inspect remedial
actions conducted at the Property; to determine compliance with this Covenant; to inspect
records that are related to the Remedial Action; and to take any other action necessary under
MTCA. Ecology does not anticipate needing internal access to residential buildings or other
residential structures on the Property.

Section 8. The Owner of the Property reserves the right under WAC 173-340-440 to record an
instrument that provides that this Covenant shall no longer limit use of the Property or be of
any further force or effect. However, such an instrument may be recorded only if Ecology,
after public notice and opportunity for comment, concurs.
Section 9. The remediation at this Site is still in progress, and thus certain contaminants are
listed above as"suspected"rather than"confirmed." As the remediation progresses,if Ecology
concludes that the list of"confirmed" or"suspected" contaminants at the Site has changed, the
Owner or the Owner's representative may request in writing that Ecology issue a written
notification of such new information. Upon written request,Ecology will issue a written notice
to the Owner confirming the updated information. The Owner may seek to file Ecology's
written notice with the county auditor's office, and may, in such a filing, cross reference this
Environmental Covenant. However, such notice shall have no effect on the Owner's
obligations in this Environmental Covenant, and the terms of this Environmental Covenant
shall remain in effect unless Ecology consents, after public notice and comment, to amend or
terminate the Covenant pursuant to WAC 173-340-440 and in accordance with the procedure
described in RCW 64.70.100.

This Declaration of CovenantikInade pursuant to RPW*70:105D.030(1)(f)and(g) and WAC
173-340-440 by Conner Homes at Barbee Milt LLC, its successors and assigns, the City of
Renton,its successors and assigns,anci:fcology.
An interim remedial action (hereafter"Remedial Action") occurrei at the property that is the,
subject of this Covenant The Remedial Action conducted at the.0ropetly"Wai'd9signed and
constructed as described in the documents listed in attached Exhibit E-5

The Remedial Action will also be the subject of a proposed Agreat Order No 5396,:a copy of
which will be on file at Ecology's Northwest Regional Office idea:tett at 3190 160 .Avenue SE, .......
Bellevue,WA 98008. The Agreed Order will describe the Remedial lictioiritto01 provide
for ongoing remedial actions at the Site.

This Covenant is required to protect the integrity of the Remedial Action on the property,
because the Remedial Action may have resulted in concentrations of the following remaining
:at the Barbee Mill Site:
• _: Confirmed arsenic in ground water exceeding the MTCA preeliminary cleanup
level protective of surface water.
• .:• .;Suspected arsenic in-soil exceeding the Model Toxics Control Act•(MTCA)

The undersigned, Conner Homes at Barbee:Mill, LLC, is:"the fee,..owner of real property
(hereafter 'Property") in the County of King, State-of Washington, that is, subject to this
Covenant.:' The additional undersigned, City of„Renton,;:possesses 'a,street easement in the
dedicate4rights of Way. The Property is legally described in.,l -i:'of thi"s"CovenaneV antemade a
part hereof by reference. Exhibit E-2 also includes a figure,shiowing:Property boundaries.
Conner Homes at Barbee Mill,LLC,and the City of Renton,make they followin g declaration as
to limitations,restr etions,,:aud uses to which the Property may be"put and specifies that such
declarations,shall::constitute`covenants to run with the land, as provided lay law and shall be
binding on all parties and:.:all persons claiming under them, including all''•current and future
owners of anY:ISortion of or`interest in,the Property(hereafter"Owner")
Section 1.
• A. No groundwater may be'taken.for any use from the Property.
•
B. Soil exceeding.. M:T• CA..Method.:�A cleanup level for unrestricted use for arsenic.
remains on the Property at a depth approximately eighteen feet below the ground surface as of
December, 2007, at elevations of'apprximately between $''and 10 feet North American
Vertical Datum 1988 (NAVD878), within the".area of the original arsenic,excavation as shown
in Exhibit E 2. This contamination is below.tile depth at which direct contact exposure would
typically be expected. However,Ecology recommends refraining from conducting any activity
in these areas that would disturb the contamination:at depth'; such as.. dulling, digging,
bulldozing or earthwork or otherwise altering the siiit below a depth approximatelyi.,eighteen
feet below ground surface at time of.home construction:'.as,.of December "2Qq.7 nth::grade
elevations of approximately between 26 through 30 NAVDS8
C. Groundwater, and soil exceeding potential cleanup levels`for' protection''of
groundwater remains on the Property at or below the maximum groundwater elevation:of
approximately between 19 and 23 feet NAVD88,within,around,and downgradient of the area::
of the original arsenic excavation as shown in E-2. Any activity on the Property that may
res•
ult in the release or exposure to the environment of this contaminated soil or groundwater,
or that`creates a new exposure pathway, is prohibited. Some examples of activities that are
::prohibited iii'these areas include: drilling, digging, bulldozing or earthwork or otherwise
altering the•.soil below the maximum groundwater elevation of approximately between 19
•
hough 23 feet NAVD88.,..This restriction shall not apply to maintenance or repair work by the
City Renton or its'contractors or agents.on the existing sewer main located in the easement
recorded under- in/County >;,ecording no. 7212190390, because the sewer line lies
hydraulically upgradient of the area of excavated:.arsenic contaminated soil.
D. '`•:: Ac.passive attenuation,zone(hereafter•PAZ) is present on the Property as shown
on Exhibits E-2 and E-3. -' he:top of PAZs protected with a geotextile layer covered with
quarry spans.The Owner shall nor alter,modify,or:remove the PAZ or the protective covering,
and any activity on the Property;that may*age of reduce the effectiveness of the attenuation
zone is prohibited. Some'exainples`of activities:'that••are•.prohibited in,,the area of the PAZ
include: drilling,digging,bulldozing or,earthwork,:or placing:a heavy object or running heavy
equipment on the PAZ causing stress beyond loa :bearing capacity._.:This restriction shall not
apply to normal construction activities required to build structures on Lots 19,20,21,22,23,
and 24 above the PAZ that are installed iri accordance with plans on`file.with..and approved by
the City of Renton Department of Community`Development;`provided. that tiffs construction
activity does not disturb the PAZ or its protective•:covering other than through the installation
of driven pin piles. Landscaping within the top two 'feet of existing grade".(as of,December
2007)shall be allowed above the PAZ.
. ::E. A network of ground water extraction wells linked>hy piping°to:s remediation
system vault ("hereafter gxtraction System") is present on the Properly as,shown on Exhibits
E-2.snd E-3,The Extraction System has been designed to pump arsenic:eontiimWated ground
water::from beneath the Property'.:and discharge it directly to the sanitary sewer, Any activity
that may:;damage or reduce::the:effectiveness of the Extraction System is prohibited. Some
examples orprohibite4 act vities.Aclude,:digging around the well locations and along the
Extraction System pipe roes,bloeking:the discharge of the Extraction System to_the sanitary
sewer, or allowing the Extraction System. to (*harp to Lake Washington, the storm water
detention pond,Mill Creek,or any other surface location.
F. A network of ground water monitoring wells,is present on the Property as
•
shown on Exhibits E-2 and E-3: Any'activity that may damage..or reduce the ability of the
monitoring wells to be used for their intendedpurpose:'is prohibited. Some examples of
prohibited activities include covering, sealing, or otllerwise.obscuring..the.:tops of monitoring
wells to reduce access, placing any solid ors'liquid,:into' a Well.except:_as necessary for
authorized sampling,digging or otherwise piercing:the ground around well locations,storing or
placing heavy loads near or on the monitoring wells, or allowing surface'water to"collect in
standing pools of water over monitoring well locations.'''
G. A storm water detention pond is present within the Property to collect ands
discharge storm water runoff The base of the pond is close to..the water table, and hass;;a •• : :''
protective liner to prevent mixing of ground water with surface water and loss of siigrfaee water
The location and design of the protective liner is presented in Exhibit E-2:.:..Any'activity that
may damage or reduce the effectiveness or longevity of the protective liner is;�prohibited. ::
Some examples of prohibited activities include piercing or otherwise driving objects through
the liner,using-backhoes or other heavy equipment for excavation purposes near the liner, or
:,:.:'placingiharp`hea.'i y objects at the base of the pond. Conner Homes at Barbee Mill, LLC and
its successors. in interest and assigns shall be responsible for future maintenance and any
repairs o 'upgrades for the Bond liner. •
SeOtion 2. .Any activily-on the Property that may interfere with the integrity of the Remedial
Action and continued;protection,of human health..and the environment is prohibited.
Section 3. `':Any activity on the Property'that.:nnay result in the release or exposure to the
environment of a::.hazardo s substance:that re iains._on the Property as part of the Remedial
Action, or create a new''exposure�pathway,.,is�prohibited without prior written approval from
Ecology.

Section 4. The Owner of the Property.;imust dVe.:thirty (30) day.:advance written notice to
Ecology of the Owner's intent to convey any interest in t1 a Property:`•~ 'he written notice shall
be in substantially the form attached•°as Exhibit;E-4.;' WAC:1173-340-440(9)(0 provides that
"no conveyance of title,easement,lease,or•:o#he.interest in the Propertx..shall,.be consummated
by:the Owner`without adequate and complete provision.;°for :the°'continued monitoring,
operation, and maintenance of the cleanup action"./At the` time'tirsignature'to this
Environmental covenant, it is expected that the necessary::ongoing remedial actions required ,
by Ecology foly tliis Site, other than those described in this,Environmental Coventint,.will be
implemented>y natnedpotentially liable persons under an Order or Degree with Ecology. It is
further::..expected thatiancial assurances intended to ensure the'Ongoing remediation will be
posted by the nained.potcntially liable parties. The requirement for "adequate and complete
provision":in,this Section shalfbe deemed to have been satisfied by compliance with the terms
of the.,.Order or 1?ecree gnd:.;thi :Environmental Covenant. Nothing in thisi'Section shall be
construed..to require Ecology's approval.of any conveyance of title, easement, lease, or other
interest in thie.Property.
Section 5. The Owner mustietrict:,leases tti uses..and activities consistent with the Covenant
and notify all lessees of the eslrictions on the use of the Property.

Section 6. The Owner must notify and obtain approval fronl•:Ecology prior to any use of the
Property that is inconsistent with,,.the��•terths of this Covenan. ,:..Ecology may approve any
inconsistent use only after public notice and
Section 7. The Owner shall allow authorized.repreaentativers oftcology the right to enter the
Property at reasonable times for the purpose' of::evaluating.the:Remedial Action; to take
samples,such as from monitoring and extraction wells.ancf from sediments,toy inspect:remedial
actions conducted at the Property; to determine compliance with this covenant; to inspect
records that are related to the Remedial Action; and to take,any other action necessary undeF
MTCA. Ecology does not anticipate needing internal access to residential bnildings.;o other`'-
residential structures on the Property.
.:.• Section 8. The Owner of the Property reserves the right under WAC 173-340-440 to record an
instrument that provides that this Covenant shall no longer limit use of the Property or be of
any further force-.or effect. However, such an instrument may be recorded only if Ecology,
after public notice and opportunity for comment,concurs. . .
.::,,,.,.Section 9: The remediatioh.:at this Site is still in progress, and thus certain contaminants are
listed*eve as"suspectec"rather tha i"confirmed." As the remediation progresses,if Ecology .
concludes that the'list:of"con&&rmei"or"suspected"contaminants at the Site has changed,the
Owner or. the:=Owner's representative••may,,tequest.in writing that Ecology issue a written
notification'of such new•infonnatlon. Upon'writkeh request,Ecology will issue a written notice
to the Owner conflnning pie tipdateir nformation4::: The Owner may seek to file Ecology's
written notice with the county:auditor's:office;>'and;.may, in such a filing, cross reference this
Environmental. Covenant. ::However,:'such•°notice shall have no effect on the Owner's
obligations in this Environtientai Covenant, lnd.the,terms, of this Environmental Covenant
shall remain in effect unless Ecology consents, afterpublic notice and comment,to amend or
terminate the Covenant pursuant tO WAC 1:13-34440..and in::accordance with the procedure
described in RCW 64.70.100.

ADMINISTRATIVE Chief Administrative Officer Covington reviewed a written administrative
REPORT report summarizing the City's recent progress towards goals and work programs
adopted as part of its business plan for 2008 and beyond. Items noted included:
* On May 19, the Washington State Department of Transportation plans to
repair portions of SR-900, specifically along S. 3rd St. from Whitworth
Ave. S. to Burnett Ave. S. in the eastbound, far left lane; and along Rainier
Ave. S.,between S. 2nd St. and S. 3rd St., at the Pizza Hut in the
southbound curb lane.
* The City, in partnership with the American Red Cross and Renton
Technical College, will present a Business Continuity Workshop on May

Airport: 820 Building Transportation Systems Division recommended approval of a contract in the
Demolition Design, WHPacific amount of$106,275 with WHPacific, Inc. for engineering services related to the

Airport: Runway 15/33 Transportation Systems Division recommended approval to accept a$73,102
Resurfacing Phase II Design, Federal Aviation Administration grant for the design of the Runway 15/33

SUMMARY OF ACTION:
The recommendation is for approval of the dedication of 60 feet of right-of-way on N 42nd P1. This
dedication provides access to the railroad crossing to be constructed at milepost 6.23. This
requirement was triggered by the plat approval process of LUA 02-040.
STAFF RECOMMENDATION:
Accept the Deed of Dedication of the additional right-of-way and authorize the Mayor and City
Clerk to sign and record the Deed of Dedication.

The Grantor,for and in consideration of mutual benefits conveys,quit claims,dedicates and donates to the Grantee(s)as
named above,for public road right of way purposes,the above described real estate situated in the County of King,State of
Washington. This Dedication is located within a Federal Superfund Site regulated by the U.S.Environmental Protection
Agency. Grantee shall indemnify,defend and hold harmless Grantor,its successors and assigns,from any damage,liability,
claim,lien,or loss,including attorney's fees and costs,arising out of use of the Dedication by Grantee,its agents,
contractors,successors in title,assigns,authorized persons,and/or all others acting on its behalf,except to the extent such
damage,liability,claim,lien,or loss,is due to the negligence or intentional misconduct of the Grantor or an agent,
contractor,successor in title,authorized person,assign of Grantor. Grantee shall be solely responsible for the management
and disposal of any waste generated as a result of operation or maintenance within the dedicated area by Grantee or its
authorized representative and Grantee shall be the generator of any waste resulting from those activities. Grantee shall
indemnify,defend and hold harmless Grantor,its successors and assigns,from any damage,liability,claim,lien,or loss or
any costs of expenses,including attorney's fees and costs,associated with the generation,management,disposal of
hazardous substances by Grantee or contact with or exposure to hazardous substances resulting from subsurface activities
authorized or permitted by Grantee within the Dedication after the Dedication.
Grantor hereby reserves the temporary right to use the dedicated area to complete any environmental testing,remediation or
other activities required by the U.S.Environmental Protection Agency,the Washington State Department of Ecology,or any
other agency with authority pursuant to state or federal environmental laws("Environmental Agencies"),without the
requirement for a street use permit or other approval from the City and without payment of any fee to the City. Grantor
reserves a right of access over the dedication area for Environmental Agencies and their authorized contractors in connection
with its regulation of the Federal Superfund Site. Any work by the City or other person in the dedication area shall be done
in compliance with requirements of the Environmental Agencies and only after 30-day notice to the appropriate
Environmental Agency,and Grantee shall indemnify and hold Grantor harmless from any cost,liability or obligation relating
to construction in or use of the dedicated area by Grantee or anyone authorized by Grantee,including but not limited to
compliance with the requirements of any of the Environmental Agencies.
