As a result of construction work at the Site,the City of Renton (the “City”)has received information from Adapt Engineering,and other Site representatives,that soils within and beneath the City’s abutting right- of-way have been impacted by contaminants originating from the Site.Specifically,Adapt’s September 14,2018 “Petroleum Impacted Soil Sampling Results Summary”(the “Adapt Report”)found that a sample taken from the City’s right-of-way had a gasoline range TPH concentration exceeding the Model Toxics Control Act’s Method A cleanup level.The Adapt Report observed that a historical gas station had been situated on the Site and reported a 2014 removal of an underground storage tank (UST)with no subsequent soil sampling other than along the bottom and sidewalls of the UST removal excavation. Thus,to date,work by Site representatives has disturbed gasoline impacted soils within the City’s right- of-way in the vicinity of the Site’s historical gas station and UST,but Site representatives have not yet confirmed responsibility for the contamination.For that reason,the City will not allow any soil-disturbing work within the City’s right-of-way to resume until the Site owner meets one of the following two requirements: 1 Pursuant to a lot combination recorded as KC Rec.#20151030000158,the Site consists of a consolidation of former parcels APN 3344500006 and 0823059056. 1055 South Grady Way,Renton,WA 98057 •rentonwa.gov Mr.Cary Fisher Page 2 of 2 September 20,2018 1.The City receives written confirmation from the Site owner that the Site owner will (1)remediate all contamination exceeding Method A cleanup levels within the full extent of the City’s right-of- way that abuts the Site or is otherwise associated with Site work and (2)provide sufficient documentation of such remediation to the City prior to the City issuing a certificate of occupancy for the Site. -OR - 2.The City receives correspondence signed by the Site owner confirming that the Site owner holds responsibility for the contamination located in the City’s right-of-way and that,when and if remediation is required or voluntarily undertaken,the Site owner will perform the work and pay all costs associated with such work without seeking any contribution from the City.
