CHANGING .THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE• ..CITY OF RENTON FROM
GENERAL .SUBURBAU :.RESIDENCE DISTRICT (GS-1). TO :. .
SINGLE FAMILY 'RESIDENTIAL DISTRICT (R-1)`
WHEREAS under Chapter VII, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances of
the City of Renton" , as amended, and the maps adopted in conjunction
therewith, :.the property hereinbelow described has heretofore been
zoned as General Suburban Residence District (GS-1) , and :
WHEREAS 'a proper petition for change of zone . classification
of said property has been filed with the City Clerk on or about
February 3 , 1971 , which petition was duly referred to the Planning
Commission' for investigation, study and public hearing, and a public
hearing having been held thereon on or about February 24 , 1971, and
said matter having been duly considered by. the Planning Commission,

The. Kampe rezone request was referred to the Committee of
the Whole on May 3 , 1971 . The Committee of the Whole
tabled the rezone request on May 11 and referred the matter
of off-site improvements to the Public Works- Committee for
. a recommendation. At. a subsequent Committee of the Whole
meeting the Kampe rezone request was not taken from the
table . The Public Works Committee , like the Community
Services Committee , met with Mr. Kampe , anri they were
unable to agree to any off-site . improvement s .
According to Robert ' s Rules of Order., if a matter is placed
on the 'table in .a committee and is not taken from the table
at a subsequent meeting of that committee , then that item
is lost. .
I am therefore returning, the proposed ordinance changing
the zoning classification of the kampe property to the
City Clerk and am asking her to notify Yr. Kampe of the
City Council ' s action.

Kampe Rezone delay of time to date , dedications of property to

The Chairman described the application and noted that the ap-
plicant was not present. The Planning Director stated he had
been in contact with Mr. Jensen who had indicated his intention
to be present at the public hearing meeting. The Chairman
stated the Commission would move on to the next item of busi-
ness to allow Mr. Jensen time to arrive and participate in the
discussion regarding his rezone request.
4-- (c) KAMPE CONSTRUCTION CO. , Appl. No. R-670-71; rezone from
t GS-1 to R-1; property located on Pierce Ave. NE between
NE llth St. and NE llth Pl.
The Chairman described the rezone application. The Planning
Director pointed out property location on the zoning map and
stated the applicant proposes to divide the property into four
lots for single family residential purposes . There is approxi-
mately 35 , 000 square feet of land involved. The applicant has
indicated his willingness to dedicate right-of-way for street
purposes . It was the feeling of the staff that in order to
upgrade both Pierce and Queen Avenues that the dedication be
for 20 feet on Pierce and 10 feet on Queen, which would result
in both streets having a right-of-way width of 50 feet, the
minimum width required for residential access streets. The
matter of off-site improvements was reviewed and discussed by
the staff with the applicant who indicated that the financial
consideration involved presents a significant problem, and he
would question whether or not he could make such improvements.
Audience comments were invited. Mr. William Jackson, 3805
NE llth Place, asked if the dedication for right-of-way on
Pierce would go all the way north to NE 12th Street. The
Planning Director stated that while the staff would like to
encourage dedication by the northerly property owner, Mr. Ray
Ball , the dedication pertained only to that property presently
being considered for rezone. Discussion was held with Mr. Ball
regarding dedication of right-of-way on Pierce for street pur-
poses for his property north of subject property. Mr. Ball
stated he had previously dedicated 20 feet of his property
for Queen Avenue NE, and due to the economic situation involved
he does not feel he can make any additional dedication on
Pierce.
Mr. Jackson stated he felt it was the Planning Commission' s
job to see the area is developed properly, and that construc-
tion of four houses without street improvements would not
enhance the looks of the City.
Mr. Leroy Atwood, 1115 Pierce Ave. NE, stated that the whole
area, with a couple of exceptions, has been developed with
curbs and gutters and the major portion paved or finished with

an oil mat surface resulting in a fairly orderly type of neigh-
borhood development. If the Kampe property is allowed to develop
without improvements, it was Mr . Atwood' s contention they would
never have a nice street. Mr. Atwood stated further he felt
Mr. Ball was trying to get around City ordinances by developing
his property in sections rather than as one development which
would require off-site improvements.
Mr. Ray Ball, Sr. , 3607 NE 12th St. , stated he had sold four
lots to Mr. Kampe, the only stipulation being that R-1 zoning
is granted on the property. He stated further that a few years
ago he had applied for R-3 zoning on the entire parcel and had
been offered R-1 without any strings attached. Mr. Ball stated
he has already given to the City of Renton property valued at
approximately $13, 000. Cost to him for sewers was $3500.
Further, he felt it would be unwise to dedicate to the City
the property under his house.
Considerable discussion followed among Commission members, the
Planning Director, Mr. Ball and Mr. Atwood concerning street
improvements, dedication of property, legal ownerships , pre-
vious dedications , etc.
The Chairman requested that Chairman of the Pending Rezones
Committee Mola present his committee report. Committee Chair-
man Mola read his committee report which stated the committee
recommends to the Commission of the Whole approval of the re-
zone subject to a 20-foot dedication to Pierce and a 10-foot
dedication to Queen, and further provided that Mr. Ball dedicate
20 feet to Pierce the entire length of his property.
' With reference to the provision that Mr. Ball dedicate 20 feet
of his property north of subject property, the Planning Director
stated that from a legal standpoint, the Commission must address
itself to the specific property under consideration. The Com-
mission may request or recommend that additional dedication be
made but may not make such request a condition of the rezone
of adjacent property. With reference to off-site improvements,
the Commission may recommend or request such improvements in
this case, but cannot require them.
Discussion ensued concerning who was the actual owner of sub-
ject property. Councilman Stredicke, in the audience, urged
that the matter of legal ownership of subject property be
+ definitely established so as to clarify just who would be
!J legally dedicating right-of-way to the City. Following con-
siderable discussion, it was the consensus of the Commission
that both Mr. Ray Ball, Sr. as owner in fee and Mr. Wynn
Kampe as conditional sale contract purchaser would be required
to sign the quit claim deed for dedication of property for
street purposes with reference to the property under consid-
eration for rezone.
The Planning Director displayed a plan which depicted the area
under discussion and pointed out the specific property in
question. The problem in this area is basically that when
the property was originally divided a half street was developed
on Pierce. A substandard street condition exists on Queen Ave.
which is essentially an alley at this time. At some future
date, when the property owned by the church southerly of sub-
ject property is developed, an effort will be made to get
dedication of right-of-way for the eventual development of
both Pierce and Queen to NE llth Street.

Scholes stated this is a difficult area with many problems.
The committee considered the flow of traffic in the area and
the matter of future expansion.
Following further discussion regarding adequate access to the
property under consideration for development, Mr. Ray Ball
stated he would be willing to dedicate ten feet along the
entire length of his property on the west side of Queen Ave.
NE for right-of-way purposes.
Discussion ensued concerning Queen Ave. NE and whether or not
20 feet on the east side had ever been dedicated to the City.
Mr. Ball was of the opinion that it had and that this dedica-
tion had been encroached upon by a building. The Engineering
Department had advised the staff that a 20-foot dedication on
the east side of Queen had never been made. This matter will
require further research to clarify.
Ross stated he felt the developer should be required to face
his houses on Queen Ave. NE. Humble stated he felt such a
requirement would be pointless inasmuch as in this particular
case access is available from both Pierce and Queen.
Upon query by Scholes, Mr. Kampe stated that requiring his
houses to front on Queen could be a problem due to certain
FHA regulations.
Following additional discussion participated in by all persons
previously mentioned, it was MOVED BY SCHOLES, SECONDED BY
DENZER, THAT THE HEARING BE CLOSED. MOTION CARRIED.

Noting the applicant was present in the audience, the Commission
returned to consideration of above-noted item. The Planning
Director pointed out property location on the zoning map and
stated the property contains approximately 62 ,000 square feet
(1. 4 acres) . Present zoning is G, present use is single family
residential and undeveloped. Proposed use is R-3 which would
allow construction of apartments and other miscellaneous uses
allowable in the R-3 zone. Proposed zoning would permit ap-
proximately 60 apartment units.

Pending Rezones Committee Chairman Mola reported his committee
had met on March 3, 1971. The Jensen rezone request was re-
viewed and discussed, but no decision had been reached. Fur-
thermore, a letter has just been received from the applicant
withdrawing the proposals for dedication of right-of-way for
access to subject property made at the meeting of February 24 ,
1971. As an alternative to the dedication of right-of-way at
this time, the applicant proposes to provide utility and drain-
age easements consistent with his site development plan at such
time as the City Engineer can determine the City' s requirements;
and to develop an additional access to the property through the
35 ' by 175 ' strip along the north property line and thence
westerly to Union Ave. ,NE at the time of project development.
The applicant' s letter requested favorable Commission consid-
eration of his rezone application.
(b) KAMPE CONSTRUCTION CO. , Appl. No. R-670-71; rezone from
GS-1' to R-l; property located on Pierce Ave. NE between
NE llth St. and NE llth Pl.
Scholes stated that he and the Planning Director had field
checked subject property and measured the streets and side-
walks in the area to determine the effect the Kampe rezone
request would have in the neighborhood. It was noted that
only a portion of the street on the west side of Pierce Ave.
NE had sidewalks and those existing were 3 ' 8" in width. It
was found that NE llth St. has a paved section of 36 ' which
appeared to be more than necessary for a residential street.
Olympia Ave. NE to the west of Pierce has differing street
widths; north of NE llth St. the street width is 34 ' and to
the south it is 26 ' curb to curb. Measurement was made of the
distance from the southern end of the Kampe property to the
southern curb of NE llth St. , . which was found to be 90' . It
appeared that it might be desirable that the Commission request
the St. Andrew Presbyterian Church to dedicate right-of-way for
the completion of Pierce Ave. NE which would be identical to
the right-of-way to be dedicated by the applicant. It would
be most feasible to request dedication of right-of-way all the
way to NE 12th St. , 'not necessarily improved, but at least
dedicated. There was some discussion regarding requesting
additional right-of-way to assist the City in improvement of
Pierce Ave. NE as 30 ' is not quite adequate for a 32 ' .improve-
ment.
Scholes stated further that the Jensen property was also field
checked. There appeared to be very specific points that the
Commission might deem desirable for a possible ndrth-south
avenue extending from NE 4th St. The crown of the hill is at
the eastern edge of the Jensen land which does limit sight.
It was evident that it would be desirable to limit the number
of streets running north and south in the area.
Committee Chairman Mola stated he would be calling another
meeting of his Pending Rezones Committee prior..to the public
hearing on March 24 , 1971; time and place to be announced
later.
5 . NEW PUBLIC HEARING ITEMS FOR PLANNING COMMISSION CONSIDERATION

Mola raised a question regarding access to subject property,
and Mr. Jensen displayed a plan representing stage one of a
twenty-year development plan. He noted that subject property
presently has access to Union Ave. NE and NE 4th St. through
contiguous properties under his ownership. It was noted by
Commission members that sale of any of the applicant' s proper-
ties could alter accessibility to subject property.
Ross stated that as no real plans for development are available
• it was his opinion that the application for rezone was premature
at this time. It is his understanding that plans are underway
• for annexation of land east of 138th Ave. SE, and Ross stated
further he felt the Jensen rezone request should be held until
such annexation is accomplished. Humble stated he felt this
was unreasonable as such annexation could take years to complete.
The applicant reaffirmed his request for R-3 zoning, stating he
felt it was a logical extension of the existing R-3 zoning east
and west of subject property and in agreement with the Compre-
hensive Land Use Plan.
Following further discussion regarding development plans in the
area, possible annexations, and access problems, it was MOVED
BY SCHOLES, SECONDED BY DENZER, THAT THE HEARING BE CLOSED.
Ross, on the question, asked if closing of the hearing would
permit continuation of the matter. The Planning Director
stated that •the Commission could continue discussion after
closing the public hearing, but further input from the appli-
cant would be barred. . Teegarden stated that closing the hearing
now could postpone a decision indefinitely and there would be
no further testimony from the public; further, if the hearing
is closed now, the Commission could (1) continue deliberation
on the subject, (2) approve the application, or (3) deny the
application. •
Scholes stated it was his intention to close the hearing for
this evening only and that he would withdraw his motion to
close the hearing; Denzer withdrew his second of the motion.
MOVED BY DENZER THAT THE JENSEN REZONE APPLICATION BE CONTINUED
FOR •THIRTY DAYS OR UNTIL THE APPLICANT SUBMITS A MORE COMPRE-
HENSIVE PLAN OF THE STREET PATTERN FOR HIS PROPERTY. Motion
died for lack of second following discussion.
Mr. Jensen suggested that the rezone application be tabled
until after the next item of business to allow him time to
make notations on his development plan indicating access to
subject property. This was agreeable to the Planning Commis-
sion. The Chairman declared a brief recess at 9 : 30 p.m.
The meeting was reconvened by the Chairman at 9 :40 p.m. Upon
roll call, all previously listed Planning Commission members

:. feet in area and is presently undeveloped. The applicant is
willing to dedicate 30 feet of right-of-way for street purposes.
Minimum lot size is approximately 6800 square feet.
The matter of right-of-way was previously discussed by the staff
with the Planning Commission relative to Pierce Ave. NE and
, Queen Ave. NE. During the layout of the Studebaker Addition
on the west side of Pierce Ave. NE, a sixty-foot right-of-way
was authorized. The staff does not feel that a sixty-foot
right-of-way is necessary on Pierce Ave. NE, and it is recom-
mended that both Pierce Ave. NE and Queen Ave. NE be established
at fifty feet by adding twenty feet of the applicant' s property
to Pierce and ten feet on the easterly property line to Queen.

from the Engineering Department which stated that office would
concur with the reduction in right-of-way width of Pierce Ave.
NE from sixty to fifty feet, the connection of NE llth St. to
Queen Ave. NE and the widening of Queen Ave. NE from forty feet

Audience comments were invited. Mr. Leroy Atwood, 1115 Pierce
Ave. NE; Mr. William Jackson, 3508 NE llth P1. ;; and Mr. Jon
Nelson, 3515 NE 12th St. , spoke in opposition to the reduction
of right-of-way width on Pierce Ave. NE, stating 'they had
dedicated thirty feet for street purposes to insure that the
street would eventually be widened to a full sixty feet and
they were all unwilling that the street be developed to any
less than a sixty-foot right-of-way width. Mr. Nelson also
asked if the applicant would develop the street on his side
with curbs, gutters and sidewalks. The Planning Director
stated that according to the off-site improvements ordinance
the applicant would not be required to improve the street;
however, the Engineering Department feels right--of-way should
, be improved prior to acceptance by the City. Mr. Houk of the
; Engineering Department stated it has been the policy of his
department to concur with state law requiring that streets
dedicated be improved. The Engineering Department will request
street improvements from the developer.
Mr. Ray Ball, Sr. , 3607 NE 12th St. , present owner of subject
property under contract purchase agreement to Kampe Construc-
r tion Company, spoke on behalf of the rezone request.

Dear Gordon:
At your request, I have reviewed with Jack our right-of-way requirements
for Pierce Avenue N.E. and discussed with him your suggestions for street
circulation in this area. Your proposal to reduce the width of Pierce Avenue
N.E. to 50 foot width from proposed 60 foot right-of-way and increase the width
of Queen Avenue N.E. from 40 to 50 feet adjoining the Kampe property is satis-
factory from our point of view. As I mentioned at the last Planning Commission
Administrative meeting, the chances of acquiring additional right-of-way for
Queen Avenue N.E. from the property at the S.E. corner of Queen Avenue N.E. and
N.E . 12th Street would be difficult at this time, since a. garage sits within
the area prepared for right-of-way and is a substantial structure. It should be
possible to- reserve the easterly 10 feet immediately north of the Kampe property
since the property is at the present time undeveloped.
Your suggestion of continuing Northeast 11th Street easterly from Pierce
Avenue N.E . to intersect with Queen Avenue N.E . would create a no-man's land of
property in between the south end of Kampe property and the proposed northerly
Line of the right-of-way . This piece would be too small to build on, and
probably only be valuable to the adjoining property to the north for an additional
lot area. This property is presently owned by the church. Since the church
already has access to N .E. llth Street, it would probably be opposed to providing
any of the street improvements that would be requi red for such a street. This
office, however, would concur with the continuation of N .E. 11th Street to connect
with Queen Avenue N.E.
In summation this office would concur with the reduction in right-of-way
width of Pierce Avenue N.E. from 60 to 50 feet, the connection of N.E. 1Rth Street
to Queen Avenue N.E. ; and the widening of Queen Avenue N.E. from N.E. llth Street
to N.E. 12th Street.
Please let us know if we can be of any further assistance to you in this
matter.

Teegarden stated he had one more suggestion to make concern-
ing the proposed Subdivision Ordinance. He recommended that
on page 25, Section 9-1108 . 7.J, the sentence be changed to
read: . "The City may require that street widths in commercial
areas be increased to provide for traffic movement and to
reduce or eliminate traffic congestion" .
ACTION:
MOVED BY TEEGARDEN, SECONDED BY HUMBLE, THAT THE PLANNING
COMMISSION APPROVE THE PROPOSED SUBDIVISION ORDINANCE AS
CORRECTED BY THE ITEMIZED LIST DATED FEBRUARY 5, 1971 , AND
THE SUGGESTION STATED ABOVE, AND THAT THE CORRECTED DOCUMENT
BE FORWARDED TO THE CITY COUNCIL FOR ITS CONSIDERATION.

3 . NEW BUSINESS
REZONE APPLICATION
(a) KAMPE CONSTRUCTION CO. , Appl. No. R-670-71; rezone from
GS-1 to R-1; property located on Pierce Ave. NE. between
NE llth St. and NE llth Pl.
The Planning Director described the rezone application and
pointed out property location on the zoning map. The appli-
cant is requesting rezone to R-1 to allow construction of four
single family residences and has indicated his willingness to
dedicate right-of-way for street purposes. The minimum size
of the lots will be 6 , 840 square feet. Slides of the property
and surrounding area were shown.
Discussion ensued concerning the necessity for the proposed
widening of Pierce Avenue NE to 60 feet. The Planning Director
stated this matter will be researched in depth and report made
to the Commission at the public hearing meeting on February 24.
SITE APPROVAL APPLICATION
(b) AERO DYNE CORP. , Appl. No.. SA-669-71; site approval in
P-1 zone; property located on Renton Airport
The. Planning Director stated the Commission had previously ap-
proved site plans for hangars in this area at which time
esthetic considerations and landscaping, etc. were discussed.
The applicant proposes to construct a new hangar to the east
of the previously approved hangars which would constitute an
extension of his development.' Slides of the property were
shown.
4. ADMINISTRATIVE
(b) COMPREHENSIVE LAND USE PLAN REVIEW
The Chairman stated that he and the other officers of the Com-
mission had reviewed some of the items pending before the
Commission. Particular concern was felt regarding the three
requests for changes to the Comprehensive Land Use Plan. The
Chairman felt the Commission should have a plan to act on these
requests as soon as possible. The Commission officers felt it
would be desirable to set up a policy to review such requests
on an annual basis hereafter.
