• WHEREAS under Chapter VII , Title IV (Building Regulations)

of Ordinance No• 1628 known as the `Code of General Ordinances
of the City of Renton" , as amended , and the maps and reports adopted
in conjunction therewith , the property hereinbelow described has
heretofore .been zoned as Residence District (R-2) ;' and
WHEREAS a proper petition for change of zone classification
. of said property has been filed with the City Clerk on or about
October 4 , 1972 ' , 'which petition was duly referred to the Planning
Commission for investigation, study and public hearing ; and a public

DECLARATION OF RESTRICTIVE COVENANTS

O
CO , WHEREAS, Oscar Schmuland and Wanda Schmuland are the
owners of the following real property in the City of Renton,
' County of King, State of Washington, described as follows :
Lots 25 and 26 , Block 6 of Renton Farm Plat,
according to plat recorded in volume 10 of
plats , page 97 , County of King, State of
Washington
AND, WHEREAS, the owners of said described property
desire to impose the following restrictive covenants running
with the land as to use, present and future, of the above-
described real property;
NOW, THEREFORE, the aforesaid owners hereby establish,
grant and impose restrictions and covenants running with the land
as to the use of the land hereinabove described with respect to
the use by the undersigned, their successors, heirs and assigns,
as follows :
HEIGHT RESTRICTION
No building or structure shall be constructed
exceeding a maximum height of twenty-five (25)
• feet.
OCCUPANCY
Occupancy of the building constructed on said
property shall be limited to separate or combined
offices for a maximum of four (4) doctors and/or
dentists.
CONSTRUCTION START
Construction shall commence within three years and
be completed within one year thereafter. In the
event that construction is not undertaken within
the three-year period, said property shall revert
to former R-2 zoning, and said restrictive covenants
shall become void, without further action or hearing
thereon.
These covenants shall remain in full force and effect, unless
otherwise changed or amended by the parties in writing, for a
period of twenty (20) years from date hereof.
Any violation or breach of any of these restrictive covenants may
be enforced by proper legal procedures in the Superior Court of
King County by either the City of Renton or any property owners
adjoining subject property who are adversely affected by said
breach.

Legislation Committee report recommended first reading with referral back to
Lotto-O'Neil committee on Lotto-O'Neil property rezone changing classification from rest-
Rezone dential R-2 to business B-1, property located on Garden Ave. N. Mr. M. Lotto,
7812 S.Sunnycrest Rd. explained property planned for Valu Village facility
who were anxious to start construction. Planning Director Erickson explained
set back requirements. Clerk read letter from Erickson reporting contacting
property owner to the north, Mrs. Vera 0. Ausman, who submitted letter
objecting to rezone. Mrs. Ausman, 222 Meadow Ave. N. , being present explained
her objection was to parking lot next to her apartment. MOVED BY SCHELLERT,
SECONDED BY PERRY, AND CARRIED ORDINANCE BE PLACED ON FIRST READING ONLY.
Following reading, it was MOVED BY STREDICKE, SECONDED BY GRANT, ORDINANCE
BE REFERRED BACK TO LEGISLATION COMMITTEE AND SUBJECT BE REFERRED TO THE
COMMUNITY SERVICES COMMITTEE. CARRIED.
Retirement Age Legislation Committee report recommended resolution be read and adopted
setting mandatory retirement age for non-uniform personnel at age 65. MOVED
BY CLYMER, SECONDED BY GRANT, AND CARRIED THAT THIS MATTER BE REFERRED TO
THE COMMITTEE OF THE WHOLE.

License GRANT, SECONDED BY SCHELLERT, AND CARRIED THAT THIS BE REFERRED TO THE
PUBLIC SAFETY COMMITTEE WITH POWER TO ACT.
Taxi Service Letter from J. J. Abraham, President of 0 K Cab Inc., re emergency taxi service
was read, letter being in rebuttal to Councilman Clymer's inquiry of last
week on responsibility of taxi company to furnish service to Renton Hill
during snow conditions. Mr. Abraham reported not being in competition with
emergency services, having suffered considerable loss due to collison damage
from snow conditions. MOVED BY STREDICKE, SECONDED BY CLYMER AND CARRIED
THAT THIS LETTER BE REFERRED TO THE TRANSPORTATION COMMITTEE.
AUDIENCE COMMENT Mr. Abraham of 0 K Cab Co. , being present, further explained past experience
J. J. Abraham in being unable to come back down Renton Hill during snow.
APPOINTMENTS Mayor Garrett's appointment of Mrs. Evelyn Carue, 4312 N.E. 4th St, to the
Mrs. E. Carue Planning Commission for a six-year term expiring January 1, 1979, replacing
Planning Mr. Douglas, was read. MOVED BY DELAURENTI, SECONDED BY GRANT, AND CARRIED
Commission THAT THIS MATTER BE REFERRED TO THE FINANCE AND PERSONNEL COMMITTEE FOR
REPORT BACK.
Harold Woodin Reappointment of Mr. Harold Woodin, 10607 112th Ave. S.E., to the Fire Civil
Fire Civil Service Commission for a six-year term expiring January 1, 1979 by Mayor
Service Garrett, was read. Roll Call vote on motion by Delaurenti, second by Grant
to confirm appointment resulted in AYE 2: Delaurenti and Grant, NO 5:
Clymer, Schellert, Perry, Stredicke and Bruce. Motion Lost. MOVED BY CLYMER

Councilman Clymer presented petition representing 75 persons from Windsor Hill:
requesting restoration of bus service to route which existed prior to new
Bus Metro service. Two petitioners were present, Mrs. Agnes Carroll, 574 Bronson
Transportation Way N.E. and Mrs. Phyllis E. McGerry, 551 Windsor Pl.N.E. Mr. Frank Cenkovich
& Routing 2625 Benson Rd. S.urged new schedule be given consideration. MOVED BY PERRY,
SECONDED BY CLYMER, AND CARRIED THAT MATTER OF BUS ROUTING WITHIN THE CITY
LIMITS BE REFERRED TO THE TRANSPORTATION COMMITTEE FOR REVIEW AND RECOMMENDA-
TION.
Committee of Council President Clymer presented Committee of the Whole report concurring
Whole . in recommendation of thelabor Negotiations Committee and ratifying the terms
of the contracts between the City and the Renton Police Guild and the City
Labor and the Renton Firefighters Local #864. MOVED BY GRANT SECONDED BY PERRY
Negotiations TO CONCUR IN RECOMMENDATION OF COMMITTEE OF WHOLE RATIFYING THE AGREEMENTS.

read. Carried." IN MOTION BY STREDICKE, SECOND BY DELAURENTI, AND CARRIED,

Award to Mayor Garrett presented award to Mr. and Mrs. Don Holm for Mr. Holm's 12 years
Mr. Don Holm of service to the citizens of Renton with the Juvenile Court Conference
Renton Attorney Committee. In acceptance Mr. Holm looked forward to further community
service as Renton School Board Member.
Award to Award presented to William .Grant by Mayor Garrett for his service as Renton
Wm. Grant City Council President during year 1971.
Vouchers Finance Committee Chairman Schellert recommended payment of Warrants No.
#2638 - 2916 2638 through 2916 in amount of $171,180.62, having received prior depart-
mental approval. MOVED BY SCHELLERT, SECONDED BY CLYMER, AND CARRIED THAT
COUNCIL AUTHORIZE PAYMENT OF VOUCHERS.
ORDINANCES AND
RESOLUTIONS Legislation Committee Chairrrlan,Perry requested procedure of reading complete
ordinance for first reading, with second and final readings combined and
Ordinance Reading title only read. Legislation Committee report presented, recommending final
Procedure reading (first reading 12/18/72) and adoption of an ordinance changing the
penalty fee from $100 to $500 maximum amount to comply with the Optional
ORDINANCE 2760 Municipal Code recommendation. Upon reading, IT WAS MOVED BY SCHELLERT,
Penalties SECONDED BY CLYMER, TO CONCUR IN COMMITTEE REPORT AND ADOPT ORDINANCE AS

ORDINANCE 2761 IN A MOTION BY CLYMER, SECOND BY DELAURENTI, AND CARRIED Council concurred in
Funds for PEP report of Legislation Committee placing following ordinances on first,second
and final readings: An ordinance appropriating and transferring from the
Surplus Cash, Emergency Employment Fund $53,003.33 into Phase I and II
Salaries for PEP Employees. Following readings, it was MOVED BY CLYMER,
SECONDED BY SCHELLERT TO ADOPT ORDINANCE. Roll Call vote resulted in unani-
mous Council approval and ordinance adopted.

Resolution 1830 Resolution transferring $37,453 from the general UAB Account to Current
Transfer Funds Fund for the purpose of reimbursing Engineering salaries for regular
city employees who worked on various UAB Projects, was read. MOVED BY

Resolution 1831 A resolution levying a service charge on the City's Utility. Dept. in the
Service Charge - amount of 1% of the gross value of the Utilities Plant improvements
Utilities Plant including its capital assets with control of said department, was read.

It was further moved to amend the motion to include a height
restriction of 25 feet., as well as limiting the occupancy of
the building to a maximum of four offices . This recommenda-
tion is incorporated into the motion recommending approval
of the special permit application , as noted below.

In reference to a petition submitted to the Planning
Commission on October 25, 1972, we are requesting that the members
of the Renton City Council either deny or modify the rezone and
special permit request of Dr, Oscar Schmuland to build a Medical-
Dental Clinic at North Third and Pelly Avenue. -
Our main objection is the rezoning of this area from the
present R-2.zoning to R-4. We believe the building can be modified
to meet with R-2 zoning provisions.
The opposition stated at the Planning Commission Hearing
that only this particular property would be rezoned, but we know full
well, once this request is granted, anyone else may request the same.
In view of the fact that nearly 100% of the homeowner's that
signed this petition have paid taxes in this city and state for over
- a half century, we believe these people's wishes should be considered
as the top priority in this matter.

The Chairman described the application . He noted that
the applicants are also asking for a Special Permit to
• allow them. to build a medical clinic on this property .
•
The Planning Director pointed out that _ the Property is
presently .zoned R-2 -- the designation for the low
density multiple residence zone which allows duplexes
and apartments . The long range use , as indicated on
the Comprehensive Plan , is high density multiple . The
adjacent property is indicated as commercial , and there
is .presently some commercial to the east. The property
is approximately 1 /4 acre .
The Planning. Director noted that a medical clinic would •
• be allowable in a multiple residential zone by Special
Permit , with • approval by the Planning Commission and
• establishment of special controls which might apply .
Dr . Schmuland had requested rezoning of the property
to an R•-4 classification since the front yard setback .
would be ten feet rather than twenty feet as required
under the R-2 classification .
The Planning Director then reviewed the property char-
acteristics . Vicinity map and site plan were displayed ,
and slides of the property were shown . The architect •
then submitted elevation drawings as requested by the
Planning Commission Chairman on the field trip . Mr.
Ericksen noted that the proposed structure would be
approximately the same height as the house located to

the north of the subject property . In response to a
question raised by Commissioner Scholes" on the field
trip , Planning Director stated that the Parking and
Loading Ordinance would require improvements and up-
grading of the alley for the access and parking as
proposed. Scholes asked if parking requirements for this
facility had been met . Planning Director stated that the
plan provides fo.r one space for each two hundred square
feet of gross floor area as required by 'ordinance . . .. .
Commissioner Scholes asked if there has been a precedent
setting case that would allow exception from the front
yard depth limitations in the R-2 and R-3 Zones . The
Planning Director replied that he knows of no recent ex-
ceptions . Some other clinics built in the past have
utilized their front yards for parking and , therefore,
have maintained a.. larger setback than as shown by appli-
cant.. . . .
A petition signed by 16 adjacent property owners raising
objections to. the proposed rezoning was presented to the
Chairman . Chairman asked that the petition be entered
into the record. .
Chairman asked for audience comments in favor of the
application
Mr. Vern "Shansby , 4206 Stone Way 'North Seattle , repre- " :
senting ' th.e applicant, stated that applicant has been a
dentist for . 18 years in Renton at his, present location . '.
The floor" space to be used for dental office facilities
is approximately 3 ,000 square feet , of which approximately :
50% would be for the applicant ' s own practice . Rezone was
requested due to the front yard setback . To permit 19
parking spaces required , the building " was raised to two •
stories to accommodate parking on the ground level be- {
neath the structure . Mr. Shansby stated that the existing
plantings will be retained , if possible , and other land-
scaping and plantings will be provided . He stated further
that the setback is actually as much as 13 feet rather
than the .10 feet as required by code in an R-4 Zone . ,
Chairman Teega'rden said he was under the impression a
medical clinic had to have at least an , R-3 zoning category . .
to qualify for Special Permit. ' Mr. Ericksen noted that. '
R-2 does allow apartments , hotels , professional offices
and mobile home parks by Special Permit upon examination
and public hearing . R-3 ' and , also , R-4 ' does include the
word "clinics " ; however, setback requirements must be met
in the particular zoning requested . He noted also that
the use of the setback area for parking has been a problem
in the past.
Commissioner Scholes asked about improvements of the alley .
The applicant ' s architect stated that the applicant will
provide the improvements on the alley as required by the
City.
Dr. Schmuiand then noted that the .City of -Renton would
not only benefit from the usage of the clinic for dental
health , etc. , but tha.t the proposed building would beautify
the area as well .

posed rezone . •

• Mr... A. J . Brattus , 323 Pelly N . , stated that many people .
in the area are retired . and on a fixed income and are
concerned about the value of the property being increased
and taxes being raised . Discussion then followed with
comments by Commission and staff members , and Mr .
Stredicke of. the City Council , regarding possible in-
creases in the assessed valuation of property adjacent
to property being rezoned.
' iMrs . Lavina Kessler , 310 Pelly Ave . N . , owner of the
adjacent property (to the north ) went on record as being
opposed to the rezoning . She objected to the height of
. the proposed building and the ten foot setback .
Further discussion ensued regarding interpretation of
the code in reference to "clinics " and "professional
offices " , and Planning Director stated he felt that
• basically the difference would be determined by intensity
of use as well as the density. Mr . Shansby indicated
that the . applicant' would be willing to specify that the
• clinic would be used by no more than four doctors or
• •
•
dentists if intensity was . a matter that concerned, the •
• Commission . Scholes inquired as to the feasibility of
moving the building .forward or backward . The architect ,
William Rigg , 4208 Stone Way North , Seattle , indicated
it could be moved back to twenty feet ; however , the
building is restricted by the parking requirement .

Frank Sankovich , Renton , of the American Association of
Retired Persons , spoke on behalf of the nearby residents
urging that the rezone be denied .

At the conclusion of the discussion ; it was MOVED BY

• Discussion followed regarding the legality and advisa-
bility of suggesting alternatives . Mola noted that if
the rezone were denied , then the applicant could possi -
bly have to put the parking in the front yard and he
felt that the landscaping as proposed in the front yard
would be more desirable . Humble stated that the Compre-
hensive Plan shows the area as R-4 , the applicant is
applying for an R-4 rezone , the property is abutting
B-1 zone ; therefore , the rezone would be hard to deny.
Chairman stated that in his opinion the neighbors are
opposed to the clinic regardless if it is built on the •
• requested R-4 or - a modified R-2 as suggested by Seymour
and Scholes . Seymour stated her opinion that the Com-
prehensive Plan is a guide to future growth of the
area and does not mean that a- requested rezoning would
be automatically given just because it agrees with the
• - Comprehensive ' Plan . • She -felt that the 'proposed rezone
may be premature and , therefore , should be denied at •
• this time .

_ In reference to a. Petition submitted to' the Planning
Commission on October 25, 1972, we are requesting that the members
of the Renton City Council either deny or modify the rezone and
special Permit request of Dr. Oscar Schmuland to build a Medical-
Dental Clinic at North Third and Pelly Avenue.
Our main objection is the rezoning of this area from the
present R-2 zoning to R-4. tie believe the building can be modified
to meet with R-2 zoning provisions.
The opposition stated at the Planning Commission Hearing
that only this particular property would be rezoned, but we know full
well, once this request is granted, anyone else may request the same.
In view of the fact that nearly 100% of the homeowner's that
signed this petition have paid taxes in this city and state for over
a half century, we believe these people's wishes should be considered
as the top priority in this matter.

The Chairman described the application . He noted that;
• the applicants are also asking . for a Special Permit to .
allow them to build a medical clinic on this property .
• The Planning Director pointed out that the property is
presently .zoned R-2 -- the designation for the low
- density multiple residence zone which allows duplexes
and apartments . The long range use , as indicated an
the Comprehensive Plan , is high density multiple . The
adjacent property is indicated as commercial ,• and there
is presently some commercial to the . east. The property
is approximately 1 /4 acre . •
. • The jlanning Director noted thatfa medical clinic would
be allowable in a multiple residential zone by Special
. Permit, with • approval by the Planning Commission and
• establishment of special controls which might apply .
Dr. Schmuland had requested rezoning of the property
to an R-4 classification since .the front yard setback
would be ten feet rather than twenty feet as required •
• under the R-2 classification .
The Planning Director then reviewed the property char-
acteristics . Vicinity map and site plan were displayed ,
and slides of the property Were shown : The architect
then submitted elevation drawings as requested by the - .
Planning Commission Chairman on the field trip . . Mr .
Erickson noted that the proposed structure would be
approximately the same height as the house located to
!ry .

the north of the subject property . In response to a
question raised by Commissioner Scholes on the field
trip , Planning Director stated that the Parking and
Loading Ordinance would require improvements and up-
grading of the alley for the access and parking as
proposed. Scholes asked if parking requirements for this
facility had been met . Planning Director stated that the
plan provides for one space for each two hundred square
feet of gross floor area as required by ordinance .
Commissioner Scholes asked if there has been a precedent-
setting case that would allow exception from the front
yard depth limitations in the R-2 and R-3 Zones . The
Planning Director replied that he knows of no recent ex-
ceptions . Some . other clinics built in the past have
utilized their front yards for parking and , therefore ,
have maintained a larger setback than as shown by appli -
cant. .
A petition . signed by 16 adjacent property owners raising
objections to the proposed rezoning was presented to the
Chairman . Chairman asked that the petition, be entered

Chairman asked for audience comments in favor of the

Mr. Vern Shansby , 4206 Stone Way North ,' Seattle , repre-
senting the applicant , stated that applicant has been a
dentist for 18 years in Renton at his present location .
The floor space to be used for dental office facilities
is approximately 3 ,000 square feet , of which approximately
50% would be for the applicant ' s own practice . Rezone was
requested due to the front yard setback . To permit 19
parking spaces required , the building was raised to two
stories to accommodate parking on the ground level be-
neath the structure . Mr. Shansby stated that the existing
plantings will be retained , if possible , and other land-
scaping and plantings will be provided . He stated further
that the setback is actually as much as 13 feet rather
than the 10 feet as required by code in an R-4 Zone .
Chairman Teegarden said he was under the impression a .
medical clinic had to have at least an R-3 zoning category
to qualify for a Special Permit . Mr. Ericksen noted that
R-2 does allow apartments , hotels , professional offices
and mobile home parks by Special Permit upon examination
and public . hearing . R-3 and , also , R-4 does include the

word " clinics " ; however, setback requirements must be met
in the particular zoning requested . He noted also that
the use of the setback area for parking has been a problem
in the past.
Commissioner Scholes asked about improvements of the alley .
The applicant ' s architect stated that the applicant will
provide the improvements on the alley as required by the
City .
Dr. Schmuland then noted that the .City of -Renton would
not only benefit from the usage of the 'clinic for dental
health , etc . , but that the proposed building would beautify
the area as well . .'

Mr. A. J . Brattus , 323 Pelly-N . , stated that many people
in the area are retired and on a fixed income and are
concerned about the value of the property being increased

and taxes being raised . Discussion then followed with
comments by Commission and staff members , and Mr .
Stredicke of the City Council , regarding possible in-
creases in the assessed valuation of property adjacent .
to property being rezoned. . •
Mrs . Lavina Kessler, 310 Pelly Ave . N . , owner of the
adjacent property (to the north ) went on record as being

opposed to the rezoning . She objected to the height of
the proposed building and the ten foot setback .
Further discussion ensued regarding interpretation of
. the code in reference to "clinics " and "professional
- offices" , and Planning Director stated he. felt that •
basically the difference would be determined by intensity '
of use as well as the density . Mr . Shansby indicated
that the applicant' would te willing to specify that the
clinic would be. used by no more than four doctors or
dentists if intensity was a matter that concerned the
Commission . Scholes inquired a's to the feasibility of
• ' moving the building forward or backward . The architect ,
William Rigg , 4208 Stone Way North , Seattle , indicated
it could be moved back to twenty feet ; however , the • .
building is restricted by the parking requirement.
Frank Sankovich , Renton , of the American Association of
Retired Persons , spoke on behalf of - the , nearby residents
urging that the rezone be denied .
At the conclusion of the discussion , it was MOVED BY
HUMBLE , SECONDED BY SEYMOUR , THAT THE HEARING ON THE .
REZONE APPLICATION BE CLOSED . MOTION CARRIED UNANI

hensive Plan shows the area as R-4 , the applicant is •
applying for an R-4 rezone , the property is abutting
B-1 zone ; therefore , the rezone would be hard to deny .
Chairman stated that in his opinion the neighbors are
opposed to the clinic regardless if it is built on the
requested R-4 or a modified R-2 as suggested by Seymour •
and Scholes . Seymour stated her opinion that the Com-
prehensive Plan is a guide to future growth of the
area and does not mean that a-. requeste.d • rezoning• would
be automatically given just . because it agrees with the

STAFF REPORT
Dr. and Mrs. Oscar Schmuland have applied for a rezone from R-2
to R-4 on property located at the northeast corner of the inter-
section of N. 3rd Street and Pelly Avenue N. The proposed rezone
is in compliance with the Comprehensive Land Use Plan and has been
requested in conjunction with a Special Permit application to allow
a medical clinic in a residential zone. A medical clinic could be
allowed by Special Permit under the existing R-2 zoning classifi-
cation; however, Dr. Schmuland has requested rezoning of the property
to an R-4 classification because of the front yard setback requi-re .
ment which- -would be ten feet rather than twenty feet as required
under the R-2 classification.
Andover Investment Company has applied for Site Plan Approval of
a proposed warehouse in Earlington Industrial Park located north
- of .'S.W.. 7th Street'and .west. of Seneca. Avenue S.W. extended norther-
ly. The proposed warehouse would be adjacent to the existing
Hormel Packing Company. The proposed plan is in conformance with
ordinance requirements, however some revisions to the landscape
plan were requested. by Commissioners on the October 21st field trip.
The request was that landscaping, be provided along the railroad
right-of-way. ., The staff. recommendation is to provide- a three foot
wide planting strip along the railroad right-of-way and plant 26 .:
Lombardy poplar trees at 15' on center with gravel groundcoverr.
This three feet, when combined with the graveled railroad right-
of-way, will provide adequate space for tree growth. The poplar
trees are columnar trees which will grow to 50 - 75 feet tall with.
' an approximate spread of - 6 ' - (these trees are planted around the .
High School Stadium) . . They have provided a screened area near the .
rear of the building for garbage container storage.
B & H Leasing have applied for Site Plan Approval for an office - .
building for the fixed-base operations and scheduled air taxi -
services of Fancher Flyways to be located at the southwestern
corner of the Renton Municipal Airport. The proposed plan is in
conformance with ordinance requirements, however we have requested
that landscaping be included on the west side of the proposed
building and: that the westernmost driveway be moved easterly. The
owners have agreed to both suggestions and will be discussing these
with their designers. and with the Commission at the Public Hearing. -
meeting.
John D. O'Donnell has applied for, Site. Plan Approval for two ' .
proposed warehouses' in Earlington Industrial Park, located north
of SW 10th 'Street and between Thomasand Powell Avenues SW. The
proposed plan is in conformance with ordinance requirements, how-
ever we have requested additional landscaping along the north .
property line. The architect has agreed to discuss the possibili-
ty with the owners 'and give the Commission an answer at' the Public'
Hearing meeting. We also recommend, that the railroad right-of-way
be screened with a 3 ' wide planting strip planted with Lombardy
poplars as in the case ofthe Andover Investment Company, and that
the southerly end of the railroad right-of-way be landscaped. to
within 20 ' of the southerly line of the westerly building.

Chairman Teegarden announced that the commission will delay
approval of the minutes of the public hearing of September 27,
1972 until the commission members have had a chance to review
them.

A discussion was held on the dumping of refuse and the location of
dumpsters in the Earlington Industrial Park Area . The staff was
asked to check on the storage requirement in the ordinance and to
determine whether the commission could require these areas to be
screened.
