Village' .requesting that when the property is improved
,that ,a. -six-foot high fence be erected on the property
' 'line, and .that landscaping be provided in a five- foot ,' '. '
wide area adjacent to Mrs Ausman' s property. "
The Community Services Committee believes that ,'there are:.,• ,.
enough restrictions in the building code that will provide '
' for.. the; objections raised by Mrs. Ausman, and that upon ,
applying, 'for a bi,ilding permit the owners and the Building
Department will be aware of the City Council ' s desire to
provide` effective landscaping and screening.

emergency services, having suffered considerable loss due to collison damage

Gentlemen :
I'm writing in protest to business zoning on the ,lot next to my
apartment house located at 129 Garden Ave. N. I have no assurance..
that the lot will not be used as a parking lot or contain a business
requiring mass parking space.
My protest is against having cars parked close to my apartments,
creating noise, gas fumes, and a nuisance that I put up with for two
years or more. My tenants were angry on not being able to get out
of their own driveway, plus it was an eyesore and a terrible
nuisance. I had fiords with the businessman, he insisted on ignoring
everything I aske8 ,not to do. It was then I went to the City Hall
and they discovered that the lot was not zoned for business. He
moved his vehicles out at once, and my tenants had peace and quiet
again.
Once the ordinance is passed there will be few alternatives ;for
the maintenance of a quiet living situation. Please consider this
request as I make a living from my apartments. Unless there is a
specific notice of the intended use of the lot south of my apartments,
I will continue to strenuously object to this commercial zoning.

RESOLUTIONS Legislation Committee ChairMan.Perry requested procedure of reading complete
ordinance for first reading, with second and final readings combined and
Ordinance Reading title only read. Legislation Committee report presented, recommending final
Procedure reading (first reading 12/18/72) and adoption of an ordinance changing the
penalty fee from $100 to $500 maximum amount to comply with the Optional
ORDINANCE 2760 Municipal Code recommendation. Upon reading, IT WAS MOVED BY SCHELLERT,
Penalties SECONDED BY CLYMER, TO CONCUR IN COMMITTEE REPORT AND ADOPT ORDINANCE AS

Sewer Connection Letter from King County Office of Property & Purchasing Manager, Chris J.
Request Loutsis, requested review of facts to grant connection to City sewer, Earling-
ton School line, by King County resident, Mr. and Mrs. Jesse F. Edmundson,
whose home was moved due to street widening of Renton Ave. S. MOVED BY
PERRY, SECONDED BY DELAURENTI, THIS REQUEST BE REFERRED TO THE PUBLIC WORKS

Retirement Age Letter from Mayor Garrett requested referral to Legislation Committee for
City Employees resolution on compulsory retirement of City employees at age 65 except for
elected officials, policy having been adhered to since 1965 for non-uniform
personnel. MOVED BY PERRY, SECONDED BY CLYMER, THIS COMMUNICATION BE

Indianapolis Trip Report to the National League of Cities "Congress of Cities",
Trip Report Indianapolis, Indiana, November 26-30, 1972 by Mayor Garrett, Council Presi-
dent Bruce and Administrative Asst. Lynch, was read, stating 25 officials
from the State of Washington were in attendance.

Bus Service Councilman Clymer reported receiving phone calls regarding new Metro bus
schedule which has eliminated previous service to Winsor Hills area. Mayor
Taxi Service Garrett reported Metro working on Renton service. Clymer inquired re taxi com-
pany responsibility to furnish service to Renton Hill during snow. MOVED BY
CLYMER, SECONDED BY PERRY, TO REFER MATTER OF TAXI CABS TO TRANSPORTATION
COMMITTEE. CARRIED.
Renton/Kent Council President Clymer presented letter from Mayor Garrett asking authori-
Animal Control zation for signing of agreement with City of Kent for joint animal control
program which has proved to be a good working situation for both cities.

MAYOR AND CITY CLERK TO SIGN AGREEMENT. CARRIED.
Metro Transit Councilman Stredicke commended Mayor Garrett for his resolute stand to receive
583-4800 promised bus service for Renton area from Metro Transit. Stredicke inquired
of City Attorney Shellan on Cedar River M&I Fund.

Legislation Legislation Committee Chairman Perry submitted report and asked that letter of
Committee Report Mayor Garrett to Legislation and Public Safety Committee Chairmen and City
Council Members of December 18, 1972 be read, asking review of the sick
Sick Leave leave ordinance and proposed amendment so that Firefighters Union can be
Ordinance notified and all City employees treated equitably regardless of employing
department. Committee report as result of joint meeting of Legislation and
Public Safety Committees recommended that sick leave ordinance with proposed
amendments regarding the Fire Department be referred to the Committee of the
Whole. Stredicke's name was inadvertently omitted from Committee signatures.

Finance Committee Finance Committee Chairman Schellert submitted report recommending the
Report Purchasing Agent accept the high bid on surplus equipment from the December
Surplus Equipment 13, 1972 bid opening. MOVED BY PERRY, SECONDED BY DELAURENTI, PURCHASING
AGENT BE AUTHORIZED TO SELL THIS MATERIAL TO HIGHEST BIDDER. CARRIED.
Stredicke noted every effort had been made to sell this surplus equipment
with more than adequate advertising, and MADE MOTION, SECONDED BY DELAURENTI
THAT PURCHASING AGENT BE AUTHORIZED TO SEL5REMAINDER OF EQUIPMENT TO BEST
ADVANTAGE OF CITY AND TO REPORT BACK TO THE FINANCE COMMITTEE. MOVED BY
PERRY AND SECONDED BY SCHELLERT AND CARRIED THAT MOTION INCLUDE WORDS
"SELL OR DISPOSE OF". ORIGINAL MOTION AS AMENDED CARRIED.
Public Works
Committee Report Public Works Committee Chairman Grant submitted committee report recommending
concurrence with Acting Director of Engineering McHenry to award Earlington
Bid Award on Garden Sanitary Sewer project to A&M Construction Equipment Co. in the
12/9/72 Bid revised amount of $92,013.50, that contractor meeting all requirements of
Opening the affirmative action statement. Grant requested reading of McHenry's
letter to the Public Works Committee,dated 12/29/72, explaining reduced
scope of project to take advantage of time requirements on existing Washington
State Economic Assistance and HUD funding, prior to availability of LID
funds as public hearing for formation of LID scheduled 2/26/73. Grant
explained low bidder on project had not filed affirmative action and was
therefore not acceptable to HUD. MOVED BY SCHELLERT, SECONDED BY DELAURENTI
TO CONCUR IN COMMITTEE RECOMMENDATION. CARRIED.
Councilman Grant asked that more regular police patrols be made in the
Earlington Flats area because of discharge of firearms. Grant also asked
Sign Code for information on date of compliance with City Code for existing businesses.
Upon inquiry of Grant, City Attorney Shellan advised existing businesses
Conformity cannot be made to comply with retroactive ordinances on matters that would

The Chairman described the application , after which the
Planning Director gave a brief run-down and showed slides
of the property and pointed out property location on the
vicinity map and Comprehensive Plan map . It consists of
4 lots , presently zoned for duplexes , and is located
directly to the north of the Value Village Store . The
Comprehensive Plan indicates the area as commercial , and
the request for a rezone to B-1 is therefore in agreement
with the Comprehensive Land Use Plan .
Mr . Ericksen noted that a portion of the alley on the west
side of the property is only 10 feet wide , and that the
Engineering Department has requested that the west 5 ' of
Lot 4 and west 5 ' of the north 40 ' of Lot 5 be dedicated
to the City of Renton for right-of-way purposes to improve
access .
Mr . Mike Lotto , 7812 S . Sunnycrest Road , Seattle , one of
the applicants , stated that he had been contacted in this
regard . He indicated it was not a problem as they are
willing to deed that 5 ' to the City .

Following further discussion regarding screening and front
and side yard requirements , Chairman Teegarden asked for
further audience comments . As there were none , it was
MOVED BY ROSS , SECONDED BY MOLA , THAT THE PUBLIC HEARING
BE CLOSED . /
On the question , Scholes inquired if any plans had been
submitted . Chairman Teegarden said no plan had been sub-
mitted . Scholes indicated he was concerned that a building
40 ' high could conceivably be built within 5 ' of the property
line , and that there was a need for screening and landscaping .
Mr . ' Lotto stated they planned a one-story building .
PENDING Chairman called for a vote on the motion : MOTION
CARRIED .
ACTION :
MOVED BY ROSS , SECONDED BY DOUGLAS , THAT THE PLANNING
COMMISSION APPROVE THE REZONE APPLICATION OF LOTTO AND
O ' NEIL AND FORWARD IT TO THE COUNCIL FOR THEIR CONSIDERA-
TION AS IT AGREES WITH THE COMPREHENSIVE PLAN .
On the motion , Scholes stated he would like to amend the

motion to include a requirement for additional setback
on the northerly boundary to 15 feet , with landscaping
requirements to be in agreement with the - Planning staff
recommendations . There was no second to this amendment
to the motion .
Commissioner Mola questioned the legality of approving
the rezone with these stipulations . The Planning Director
noted that according to the City Attorney he did not think
it legal .

( b ) NEWMAN , ARTHUR H . , Appl . No . R-715-72 ; rezone from
R-2 to R-4 ; property located on Pelly Avenue North between
North Second and Third Streets .
Chairman Teegarden described the application , and the
Planning Director pointed out the property location on
the vicinity map and Comprehensive Plan map and showed
slides of the property . He stated the intent of the
applicant is to convert the existing single family resi -
dence on the northeasterly portion of the property to a
duplex . Also , while the existing zoning (R-2 ) allows
duplexes , the applicant can not conform to .the setback
requirements in the R-2 standards . The proposed rezone
is in conformance with the Comprehensive Land Use Plan .
The property owners have filed restrictive covenants on
the southerly property which insure that parking will be
provided for the building on the northerly property . The
covenants also provide screening and landscaping along
the southerly line of the property , adjoining a single
family residence .
The applicant , Mr . Arthur Newman , made a statement on
behalf of the rezone request indicating that he is trying
to update and make the property worthwhile and attractive
for the community. He stated he could see no problem as
far as parking is concerned , since only one of his tenants
has an automobile .
A discussion followed between the staff and Commission
members regarding the feasibility of granting a Special
Permit within the existing zoning that would permit the
applicant to convert the dwelling to a duplex . Mr .
Newman stated he would be willing to comply with the
Commission ' s request and have the hearing continued until
January 10 , 1973 , for further study regarding issuing a
Special Permit rather than the rezone to R-4 .
ACTION
MOVED BY SCHOLES , SECONDED BY MOLA , THAT THE HEARING ON
THE ARTHUR H . NEWMAN REZONE APPLICATION BE CONTINUED TO
JANUARY 10 , 1973 , FOR ADDITIONAL CONSIDERATION BY THE

the committee held a brief meeting just prior to the

NOVEMBER 29 , 1972
STAFF REPORT
Elisabeth Rivil_y has applied for a rezone from G and T to
L-1 light industrial classification for the property located
north of Longacres Race Track and east of Oakdale Avenue S .W. ,
lying both north and south of FAI 405 .
The Comprehensive Plan Committee has reviewed the rezone re-
quest and has made the following recommendations :
1. The property in question consists of three separate
parcels of land divided by public rights-of-way,
namely, FAI 405 and Grady Way.
2 . The two parcels of property located north of FAI 405
are presently designated Light Industrial or M-P on
the Comprehensive Land Use Plan. The applicant' s re-
quest is, therefore, not in conflict with the subject
Plan.
3. The parcel of land located south of FAI 405 and north
of SW 16th Street is designated Commercial on the
Comprehensive Land Use Plan. The request of the
applicant is, therefore, in conflict with said Plan
and would in the opinion of the Committee require a
Comprehensive Land Use Plan revision.
M. W. Lotto and Wm. J. O'Neil have applied for a rezone from
R-2 to B-1 on property located on Garden Avenue North between
Bronson Way North and North Second Street.. •
This property is located immediately north of the existing
Value Village store on Bronson Way. The proposed rezone is in
conformance with the Comprehensive Land Use Plan. The property
is intended for future expansion of Value Village.
The alley adjacent the east property line, which extends from
Bronson Way N. on the south to N. 2nd Street on the north, is
15 ' wide except for that portion abutting lots 1, 2 , 4 and the
north 40 ' of lot 5 . Therefore, the Engineering Department re-
quests that the West 5 ' of lot 4 and West 5 ' of the North 40 ' of
lot 5 be dedicated to the City of Renton for right-of-way pur-
poses in conjunction with this rezone. Mr. Lotto has been
contacted about such right-of-way dedication, but has not
committed himself as yet.
Arthur H. Newman has applied for a rezone from R-2 to R-4 for
the property located at the southeast corner of the intersection
of No. 3rd Street and Pelly Avenue North.
The property consists of two platted lots , total dimensions :
being 95 ' x 107 . 5 ' . There are now three single family resi-
dences and one duplex residence on the property. It is Mr.
Newman' s intention to remove one of the single family resi-
dences and convert another to a duplex residence. The proposed
rezone is in conformance with the Comprehensive Land Use Plan,
and the property owners have filed restrictive covenants on
the southerly property which insure that parking will be pro-
vided for the building on the northerly property.
