DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT PLANNING DIVISION CERTIFICATE OF EXEMPTION FROM CRITICAL AREAS REGULATIONS EVALUATION FORM & DECISION DATE: June 12, 2023 PROJECT NUMBER: LUA18-000678 PROJECT NAME: Thunder Hills Sewer Interceptor Rehabilitation PROJECT MANAGER: Jill Ding, Senior Planner APPLICANT/CONTACT: Jesse Newman, City of Renton, 6th floor, 1055 S Grady Way, Renton, WA 98057 PROJECT LOCATION: Gated site entrance at Grant Ave S and S 18th St and runs the length of Thunder Hills Creek north just up to before it goes under I-405 PROJECT DESCRIPTION: The applicant is requesting a Critical Areas Exemption for improvements to approximately 2,050 lineal feet of sewer main. The sewer line would be improved through a mix of parallel HDPE pipelines and rehabilitation of the existing line using a cured-in-place lining technology. In addition, improvements are proposed to the 37,574square foot maintenance access road and slope stability measures are proposed to alleviate erosion in the future. The project site includes sensitive and protected slopes, Thunder Hills Creek, a type Np stream with a 75-foot buffer, and seven tributary streams, all classified as Type Ns streams with 50-foot buffers. There are six wetlands (Wetlands A-F). Of the six wetlands, four (Wetlands B, D, E, and F) would have a standard buffer of 100 feet, Wetland A would have a standard buffer of 75 feet, and Wetland C would have a standard buffer of 50 feet. The proposal would include 20,703 square feet of temporary wetland and stream buffer impacts, 1,332 square feet of wetland impacts (Wetland E and F), and 41,000 square feet permanent buffer impacts including the removal of 36 trees. The project site includes RM-F and R-8 zoning designations. Access to the site would be provided via a gated entrance off of Grant Ave S and S 18th St as well as an existing entrance at the cleared PSE easement access along S 18th St. The existing maintenance access road totals 27,780 square feet, the proposed improvements would result in approximately 1,000 square feet of impacts or a four percent (4%) increase in area within the protected slope areas. The impacts to the stream buffer would largely be confined to the existing maintenance access road and would be temporary in nature. CRITICAL AREA: Protected slopes, sensitive slopes, wetlands and streams. EXEMPTION JUSTIFICATION: Renton Municipal Code (RMC) 4-3-050 Critical Areas Regulations Subsections C.3.e.ii Normal and routine maintenance, operation and repair of existing parks and trails, or the construction of new trails, streets, roads, rights -of-way and associated appurtenances, facilities and utilities where no alteration or additional fill materials will be placed other than the minimum alteration and/or fill needed to restore those facilities or to construct new trails to meet established safety standards. The use of heavy construction equipment shall be limited to utilities and public agencies that require this type of equipment for normal and routine maintenance and repair of existing utility structures and rights-of-way. In every case, critical area and required buffer impacts shall be minimized and disturbed areas shall be restored during and immediately after the use of construction equipment. And C.3.e.iv Modification of Existing Utilities and Streets by Ten Percent (10%) or Less. Staff Comment: As discussed in the attached Environmental Review Committee Report (ERC Report), the submitted Geotechnical Report included recommendations to reduce the potential for landslide activity in the future. The recommended measures included gravity retaining walls or rock buttresses to support the access roadway. The majority of the work in and adjacent to protected slopes would occur within the existing maintenance access road corridor, with the addition of some slope stabilization measures as discussed above. The work proposed would qualify as an exemption to the Critical Areas Regulations, as the work proposed is not anticipated to result in an expansion of the maintenance access road corridor by more than 10 percent, see RMC 4-3-050C.3. The existing Thunder Hills sewer interceptor and maintenance road are located parallel to Thunder Hills creek and are within wetland, stream, and associated buffer areas. Construction associated with the proposed sewer interceptor rehabilitation will result in some disturbance to streams, wetlands, and their associated buffers. Impacts from proposed project activities include temporary impacts from construction, direct wetland impacts f rom access road improvements, and impacts to the combined wetland/stream buffers from access. The sewer interceptor rehabilitation work itself does not include in -water work and would not result in adverse stream impacts. The proposed work would include maintenance to an existing utility and access maintenance road and would be exempt from the City’s Critical Areas Regulations, provided critical area and buffer impacts are minimized and disturbed areas area restored. As discussed in the attached ERC Report, the impacts to wetlands, wetland buffer, and stream buffer would be minimized and unavoidable impacts are proposed to be mitigated in accordance with RMC 4-3-050L. FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-3-050C.2.d: i. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulation; Staff Comment: The proposed work is not prohibited by the Renton Municipal Code or any other law or regulation. ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; Staff Comment: The proposed work would be conducted utilitzing best management practices. iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; Staff Comment: As discussed above, the proposed impacts to critical areas would be minimized by the design of the project and disturbed areas would be restored and or mitigated according. iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; Staff Comment: As proposed in the submitted mitigation plan the pro posed mitigation plantings would include native vegetation. v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. Such determinations will be based upon site and/or chemical -specific data. Staff Comment: The proposed work would not be within a Wellhead Protection Area and is not anticipated to adversely impact groundwater. A. Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS-M with a 14-day Appeal Period. B. Mitigation Measures 1. Project construction shall comply with the recommendations outlined in the Geotechnical Report, prepared by Stantec, dated February 13, 2015. C. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Earth Impacts: A Geotechnical Report, prepared by Stantec, dated February 13, 2015 (Exhibit 2) was submitted with the project application materials. Subsurface explorations were conducted and included four (4) hollow stem auger borings that extended 5 to 25 feet below existing grade. Disturbed soil samples were obtained by using a 140-pound hammer free falling a vertical distance of 30 inches for the borings. Within Boring B-1 approximately 6 inches of topsoil and vegetation were encountered underlain by approximately 5 feet of medium dense to dense, silty-fine to medium grained sand with variable amounts of gravel and debris (fill). This layer was underlain by stiff to very stiff silt with variable amounts of sand and woody debris (fill). The silt layer was underlain by stiff silt with variable amounts of sand, gravel, and trace amounts of woody debris (Highly Weathered Renton Formation). These materials were underlain by medium dense, silty-sand with clasts of weathered sandstone (Weathered Renton Formation), which continued to the termination depth of the boring. In Borings B-2 and B-3, approximately 10 to 12 inches of vegetation and topsoil were encountered, underlain by approximately 5 feet of medium dense, silty-fine to medium grained sand with variable amounts of gravel (fill). This layer was underlain by dense to very dense, silty-fine to medium grained sand with variable amounts of gravel (Glacial Till), which continued to the termination depths of the borings. This layer was underlain by hard sandstone (Renton Formation), which continued to the termination depth of the boring. Groundwater was encountered in Boring B-4 at approximately 4.5 feet below grade. Groundwater was not encountered in any other boring locations. The Geotechnical Report (Exhibit 2) included recommendations to reduce the potential for landslide activity in the future. The recommended measures included gravity retaining walls or rock buttresses between the access roadway and stream as well as in the vicinity of Station 4+70 to 5+40 to support the access roadway. The report mentions that some walls may be over 8 feet in height, which would exceed the maximum permitted retaining wall height of 6 feet within residential zones. Any proposal to exceed the maximum 6-foot height for retaining walls would require a modification (see RMC 4-9-250D). According to the applicant the majority of the work in and adjacent to protected slopes would occur within the existing maintenance access road corridor, with the addition of some slope stabilization measures as discussed above. The work proposed would qualify as an exemption to the Critical Areas Regulations, as the work proposed is not anticipated to result in an expansion of the maintenance access road corridor by more than 10 percent, see RMC 4-3-050C.3. Based on the work proposed and the potential impacts to sensitive and protected slope areas in Proximity to Thunder Hills Creek and other stream and wetland areas, staff recommends as a SEPA mitigation measure that project construction be required to comply with the recommendations outlined in the Geotechnical Report, prepared by Stantec, dated February 13, 2015. Mitigation Measures: Project construction shall comply with the recommendations outlined in the Geotechnical Report, prepared by Stantec, dated February 13, 2015 Nexus: SEPA Environmental Regulations. 2. Water a. Wetlands and Streams Impacts: The applicant submitted a Critical Areas Report, prepared by The Watershed Company, dated April 2018 (Exhibit 3). Thunder Hills Creek, which is classified as a Type Np stream with a standard buffer of 75 feet flows through the project site. In addition, there are 7 tributaries to Thunder Hills Creek within the project area, all have been classified as Type Ns streams with standard buffers of 50 feet. Six wetlands (Wetlands A-F) have been classified and delineated on the project site. Wetlands A, B, and D-F have been classified as Category III wetlands, Wetland C has been classified as a Category IV wetland. Due to a lower habitat score, Wetland A would have a standard buffer of 75 feet, Wetlands B and D-F have higher habitat scores and would have standard 100-foot buffers and Wetland C would have a standard 50-foot buffer. The existing Thunder Hills sewer interceptor and maintenance road are located parallel to Thunder Hills creek and are within wetland, stream, and associated buffer areas. Construction associated with the proposed sewer interceptor rehabilitation will result in some disturbance to streams, wetlands, and their associated buffers. Impacts from proposed project activities include temporary impacts from construction, direct wetland impacts from access road improvements, and impacts to the combined wetland/stream buffers from access. The sewer interceptor rehabilitation work itself does not include in-water work and would not result in adverse stream impacts. Temporary combined wetland and stream buffer impacts will occur adjacent to the access roads throughout the project area, for a total of 20,703 square feet. These direct wetland impacts total 1,332 square feet. Permanent wetland and stream buffer impacts would occur as a result of the improvements to the maintenance access road. To reduced and mitigate for impacts to streams, wetlands, and associated buffer areas CIPP technologies will be used, where the sewer line crosses the stream, for sewer rehabilitation in order to ensure no direct stream impacts. Temporary impacts would be mitigated on-site. Permanent buffer impacts will be mitigated on-site at a one-to-one ratio (for a total of 42,945 square feet) through buffer enhancement, while permanent wetland impacts will be mitigated through purchase of credits from the City of Renton’s Springbrook Creek mitigation bank. Additionally, large wood would be installed in the creek bed to enhance fish habitat should fish use be restored in the future. It is anticipated that all impacts to wetlands, streams, and associated buffer areas would be addressed and mitigated through the City’s adopted Critical Areas Regulations (RMC 4-3-050) and would be reviewed through the Construction Permit process; therefore no further mitigation is recommended at this time. Mitigation Measures: None recommended. Nexus: N/A b. Storm Water Impacts: The applicant submitted a Drainage Review Memo, prepared by Stantec, dated October 2, 2018 (Exhibit 4). The project is vested to the requirements of the 2009 King County Surface Water Design Manual, as a complete Construction Permit application was submitted prior to the adoption of the 2017 City of Renton Surface Water Design Manual. The memo concludes that the activities proposed would meet the definition of maintenance under the 2009 King County Surface Water Design Manual and would therefore be exempt from drainage review. Mitigation Measures: None recommended. Nexus: N/A 3. Vegetation Impacts: Vegetation would be removed from the improved maintenance access road/trail areas, at the turnaround areas, and along the maintenance access road. Most of the vegetation to be removed consists of ivy, blackberries, ferns, salal, grasses and other shrubs. Additionally, 40 trees, that are located directly in grading or maintenance access path areas are proposed to be removed. Approximately 0.9 acres of vegetation will be removed throughout the project area. However, temporary and permanent impacts to wetland and stream buffers will be mitigated on site and would include the planting of various native groundcover, shrubs, and 124 trees, resulting in approximately 42,945 sf of buffer mitigation through vegetation re-planting. The site consists of an existing sewer interceptor alignment through the Thunder Hills Creek valley along with a gravel improved access roadway located adjacent to the existing stream. CODE REQUIREMENTS SURFACE WATER 1. A geotechnical report, dated February 13, 2015, completed by Stantec, for the site has been provided. The submitted report describes the site is a Severe Erosion Hazard area. Erosion control measures will need to be in place prior to starting grading activities on the site. Geotechnical recommendations presented need to be address within the project plans. 2. Temporary erosion and sediment control plans are required and shall be in accordance with the City of Renton Surfacewater Design Manual. 3. A Construction Stormwater General Permit from Department of Ecology will be required since grading and clearing of the site exceeds one acre. 4. A Stormwater Pollution Prevention Plan (SWPPP) is required for the project site and shall be submitted with the Civil Construction Permit Application. 5. Wet Season requirements found in Appendix D of the 2017 City of Renton Surface Water Design Manual (RSWDM) shall be adhered to for construction occurring between October 1st and April 30th. 6. All work proposed outside of the applicant’s property will require a temporary construction easement prior to any permits being issued.
