Ron, pursuant to our memo with attached letter
dated July 25, 1974 the applicant has not submitted
an appeal to date regarding the Planning Commission
decision to deny his rezone request. The time limit
for such an appeal has expired. Thus it would appear
that further use of the subject property for purposes
other than those allowed under the G-9600 zoning
classification are illegal and appropriate action
should be taken to terminate them.

MOVED BY GIBSON, SECONDED BY SEYMOUR, THAT THE FINAL PLAT FOR
CRESENT VIEW ADDITION BE APPROVED WITH THE INSTALLATION OF SIDE-
WALKS ALONG ALL THE LOTS CONTAINING THE EXISTING HOUSES AND ADDI-
TIONAL HOUSES AS CONSTRUCTION OF EACH IS COMPLETED. MOTION CAR-

Chairman Teegarden requested a description of the application
from the Planning Director .
Mr . Ericksen pointed out the 1 . 2 acre site located in the May'
Creek Valley area on the vicinity map . He indicated the B-1
zoned area contiguous to the property to the north and west
and noted that a G-zoned island of land would be created , should
the request be granted . The applicant has been advised of the
apparent conflict his request presents , since the Comprehensive
Land Use Plan indicates the area as medium density multiple fam-
ily.
The Planning Director advised that present usage is a contrac-
tor ' s office , shop and storage facility and observed that it is
not an acceptable use in the present G-9600 zone . Noting that
the request falls under Shoreline Management jurisdiction , he
indicated that the site is in an area where the matter of con-
flict between the Shoreline Master Program and existing zoning
is being reviewed by the Comprehensive Plan Committee .
Aerial photographs and slides were viewed , and the relation-
ship of the Comprehensive Land Use Plan to the property was
noted .
The Chairman called for comment from the applicant , but there
was no response .
Ross requested that the report from the Comprehensive Plan
Committee regarding its study of the area be made available
prior to any action by the Commission . Humble advised that
he was unable to provide a date for report in view of current
involvement of the committee in extensive meetings and study
of possible amendments to the Comprehensive Plan in the Green
River Valley and Hospital area .
The Chairman recognized Mrs . Helen Schei , 4108 Jones Ave . N . E . ,
owner of property north of the site , who stated that she had
brought the matter to the attention of the Building Division
and Planning Department. She questioned the type of use in a
B- 1 zone. It was indicated by Assistant Planner Smith that
the matter was being reviewed by the Building Division and
the City Attorney , as well as the Planning Department .
Discussion ensued regarding appropriateness of present use
in a B-1 zone. It was then MOVED BY MOLA , SECONDED BY WIK,
THAT THE PUBLIC HEARING BE CLOSED . MOTION CARRIED .

MOVED BY GIBSON, SECONDED BY SEYMOUR THAT THE APPLICATION BY
G.V.R. , INC. FOR REZONE FROM G9600 TO B-I BE DENIED FOR THE

Noting that Puget Sound Power and Light Company is apply-
ing for both a special permit to fill and site approval ,
the Chairman requested background information from the
Planning Director .
SPECIAL PERMIT
Mr. Ericksen pointed out the 9600 square foot site on
the map and indicated significant development in the
vicinity. Approximately two to three feet of fill , or
2300 cubic yards , are planned . It is the opinion of
the staff that in terms of environmental impact , the
proposed filling and grading constitutes a negative
declaration of impact .
SITE APPROVAL
The site plan was displayed and described by the Plan-
ning Director . The proposal is for construction of a
substation enclosed by a cyclone fence . Landscape
screening will be provided . The existing access road

by other municipalities to the west and' south . It was
noted that development of the Scarsella site can commence
while the impact statement is in process and being prepared .
The Chairman invited comment from the applicant.
Mr. Alan Austin , lawyer representing Scarsella Brothers ,
stated that Mr: Scarsella wished to fill the property
so he can use the entire site and have the availability
of the railroad trackage . The smaller site development
plan had not been considered , but the matter will be review-
- ed with Mr. Scarsella ; and an amended plan will be submitted
if it is deemed appropriate . The applicant hopes to fill
the site during the summer while he has the material and the
weather is favorable . He stated that they would cooperate
in the preparation of an EIS .
Noting the damage occurs when filling a site , Mr. Teegarden
said he felt the Commission should seriously consider
the implications and investigate alternatives . He then
requested comment from the audience but received none .
ACTION
MOVED BY WIK, SECONDED BY HUMBLE, THAT ACTION ON THE
REQUEST TO FILL BE CONTINUED UNTIL THE ENVIRONMENTAL
IMPACT STATEMENT IS AVAILABLE.
Discussion followed regarding the availability of the
EIS in order to give the applicant an indication of
Planning Commission action . Noting state requirements ,
the Planning Director stated that a minimum of three
of four months would be necessary before a final EIS
could be provided .
Commissioner Ross stated he intended to vote against
the motion , as he did not consider the request for
continuance valid.

4- PUBLIC HEARING ITEMS FOR MEETING OF JULY 24, 1974:
The Planning Director reviewed the following new items of
business , displayed site and vicinity maps and described
filling and landscaping plans where pertinent . It was noted
that the Shell Oil Company application for special permit
to construct a petroleum marketing plant in H- 1 zone ,
a continued item, will also be considered.
FINAL PLAT APPLICATION

The Planning Director noted that this final plat conforms
to the preliminary plat plan previously approved and has
been constructed in accordance with the Subdivision Ordi -
nance .

property located on Jones Ave . N . E . south of the Pro-

2 . The filling and development of properties in
this area as presently being undertaken on a
piecemeal basis could result in significant
impact on adjacent properties and possibly
place the City in liability if filling and
development were not properly conducted due
to water displacement and runoff to adjacent
properties .
3 . The significance of filling the ponding area
and its loss as a wildlife habitat is unknown
in terms of the immediate and longrange effects .
If the ponding area is filled , alternatives
should be reviewed and recommendations made to
Soil Conservation Service .
4. There is a significant need for a coordinated
approach in the development of said property and
adjacent areas in terms of a total concept which
would meet the requirements of the Soil Conserva-
tion Service Green River Drainage Plan .
Mr. Ericksen advised that the City Council is considering
the adoption of a resolution to concur in the Soil Conser-
vation Service proposed Green River Drainage Plan . He stated
that in view of the pending adoption of a resolution by
City of Renton , the staff felt it was necessary that an
EIS be prepared and that all of the questions be addressed .
Staff recommendation for partial development of the prop-
erty was noted by the Planning Director , who stated that
the site included 2 . 3± acres , or 100 , 000± square feet of filled
area in the westerly end ( total area 5 . 8 acres less 3
acres of pond and . 5 acre in NE corner) . He described
the proposed site development plan , which includes 1500
sq . ft. for the office , 14 , 000 sq . ft. for the warehouse ,
and 7500 sq . ft . for parking . With 80 , 000 sq . ft . for
exterior storage , the area to be developed totals
103 ,000 sq . ft . , which seems to offer a reasonable oppor-
tunity for development under M/P standards . He stated
that an application for site plan approval has not been
submitted by the applicant at this time . He recommended
that a plan for the westerly portion be developed and
offered staff assistance .
The Chairman invited comment from the Commission . Commis-
sioner Humble , noting that the decision to request an EIS
precluded any action by the Planning Commission , advised
the members of the forthcoming public hearing on July 31
regarding possible changes to the Comprehensive Land Use
Plan , especially as it relates to the Green River Valley .
He stated that they should be able to act on the revised
plan , which will allow for state and federal requirements ,
and provide a basis for total rather than piecemeal action . 1
Responding to Commissioner Morrison , Mr. Ericksen pointed
out the pond on the map and indicated that it covers approxi -
mately 5 . 5 acres in total and extends onto property to the
south .
Commissioner Ross stated that he believed the pond is the
result of an unfinished construction program and noted that
construction permits in the Valley are being issued

Noting the location in May Creek Valley adjacent to a
B- 1 zone , Mr. Ericksen advised that the request is not
in agreement with the Comprehensive Land Use Plan .
The applicant presently has a painting operation at his
residence which he wishes to convert to a painting
contractor' s office , shop and storage . Area involved is
approximately 1 . 2 acres .
Discussion ensued regarding application of the proposal
to B- 1 zoning and future requirement for shoreline manage-
ment action . Commissioner Ross asked that results of the
pending study of commercial zoning in the May Creek area
by the Comprehensive Plan Committee be made available
for Commission information .

The applicant is undergrounding overhead service lines to
the West Valley Highway and requests approval of construc-
tion of a power substation similar to others previously
approved . Special permit to fill in the substation yard
and access road , approximately 2315 cubic yards , will be
required. The site is in the vicinity of the Glacier Park
site recently rezoned to M/P . Landscaping is included in
the site plan . It was noted that this is an allowable use
in a G zone subject to Planning Commission approval .
SPECIAL PERMIT - SITE APPROVAL:
D. GLACIER PARK CO. ' Appl . No . SP-784-74 ; special per-
mit to allow fillingl and grading in M-P zone ; Appl .
No . SA-785-74 ; site approval for restaurant facility ;
property located on east side of West Valley Highway
at intersection with Strander Blvd .
Noting that the property had recently been rezoned to
M-P , the Planning Director stated that it will be neces-
sary to fill the northwest corner of the site with
approximately 3 ,000 cubic yards of material for ingress
and egress . The site will be developed in accordance
with M-P standards , and landscaping plans for natural
preservation of area meet Soil Conservation Service
specifications .
, SPECIAL PERMIT:
E. SHELL OIL CO. ;Appl . No . SP-734-73; special permit
to construct a petroleum marketing plant in H- 1 zone ;
Highway , midway between Olympic Pipeline - Mobil Oil
site and Longacres Race Track .
The Chairman advised the Planning Commission that it is
the Comprehensive Plan Committee ' s intent to have their
recommendation to the individual members prior to the `July
24 public hearing for their consideration . He urged the
members to read the Shell final environmental impact
statement and staff summary in preparation for the public
hearing on July 24.

A. FIELD TRIP
Field trips to view the sites of items of new business
were scheduled . Members were given their choice of :
1. Saturday , July 13 , 8 : 30 a . m. , Sheraton Inn Coffee
Inn .
2. Monday , July 15 , 7 : 00 p . m. , Municipal Building parking
lot .
B. OLYMPIC PIPE LINE PROPOSAL
Reminding the Commission of their recommendation to
Warren C . Gonnason , Public Works Director, that an
environmental impact statement be required for Olympic
Pipe Line ' s proposal , the Chairman noted that Mr. Gon-
nason was present to make his response .
Mr. Gonnason advised that the permit that the City would
be issuing in connection with. the franchise itself for the
pipeline merely covers public rights-of-way within the City.
The permit gives the Company the right , subject to City
regulation , to install their petroleum pipeline facilities
within the public rights-of-way of the City .
Responding to the concern of the Planning Commission re-
garding the potential impact of a terminus being located
within the City of Renton , Mr. Gonnason indicated that
while he recognized that there could be substantial
impact effects from such development , Olympic Pipe Line
does not actually have a terminus in the City of Renton . .
Transfer. of products through pipelines continues to other
areas . In addition , he stated that the matter of poten-
tial impact does not pertain directly to this application
and that any spinoff impacts , such as petroleum trucking ,
terminal stations , tanks , etc . , should be treated on their
own merits and governed by whatever land use considerations
are involved . He indicated that the City Council , through
its Community Services Committee , had worked with Olympic
and had mitigated a lot of what they considered impacts
within the City itself.
Discussion followed with Commissioner Humble stating that
Olympic had informed Commissioner Scholes , Planning Com-
mission Community Services Committee Chairman , that, the
pipeline would not continue on to Portland . Mr. Gonnason
replied that the Company proposes an operation for, two
"lines to Renton and that the existing line goes to Portland
now. Mr. Farr of Olympic advised him •that regarding terminals
for product delivery to organizations such as Shell they can
hook into these pipelines at any point and establish facili -
ties at any place along the pipeline .
Further discussion ensued regarding• the location of the
Olympic facility in Renton and safety provisions for the •
pipeline. The Planning Director noted that all areas of
potential points of danger have specified valve locations .
Responding to Commissioner Wik ' s comment that the Planning
Commission Community Services Committee had looked upon
the matter from the impact that might evolve from the
whole network , Mr . Gonnason said that from some points of
view the impact of using a pipeline is less than other
