ED23875 CASE# 22-13860 OF COLLISION 12/29/22 10:50 OF CbLLI510N NARRATIVE 22-13860 On 12/29/2022 at approximately 1051 hours, I was dispatched to an unknown-if-injury vehicle into a building collision at O'Reilly Auto Parts, located at 4350 NE 4th ST, within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised that a maroon Ford SUV (Unit#1) had been seen driving erratically prior to it leaving the roadway and colliding into a commercial building which was open for business with customers inside. Several Officers responded to this collision with witnesses describing two people in the maroon SUV prior to the collision. Witnesses identified a male in the driver's seat and a female in the front passenger seat. Upon Officers arriving in the area, the female passenger had fled on foot and failed to identify herself to Officers. The female also had not been evaluated by Renton Fire following a serious collision and refused to return to the scene. Upon my arrival, 1 was directed to the driver of the SUV that Officers/Witnesses had pointed out to me. The driver of Unit#1 was identified via DOL photo as Sullivan, Kevin P (DOB 04/30/1985). The driver of Unit#1 stated that prior to the collision, he was traveling eastbound in about the 4200 block of NE 4th Street and stated he was trying to make a "U-turn" when he lost control and collided into the O'Reilly's building located on the north side of the roadway. As a result, Unit#1 suffered significant damage to the front of the vehicle. I was informed by a witness that upon approaching Unit#1 immediately after impact, a witness identified as Charles Kuney, stated he smelled a strong odor of marijuana coming from the vehicle. The driver of Unit#1 stated he had not been drinking alcohol nor had he had any marijuana for "months". I asked the driver of Unit#1 if he would be willing to conduct voluntary Standardized Field Sobriety Tests (SFSTs) to determine if marijuana was a factor in today's collision. The driver of Unit#1 agreed to complete the SFSTs. Upon performing the Horizontal Gaze Nystagmus (HGN) tests, 1 determined that the driver of Unit#1 did not appear to be impaired at the time of test but there were signs of marijuana use based on green remnants on Sullivan's tongue. Officer M. Leverton, a Drug Recognition Expert (DRE) later responded to the scene and evaluated Sullivan. Officer Leverton concurred with my conclusion. The driver of Unit#1 was evaluated by the Renton Regional Fire Authority and declined to be transported to the hospital. Multiple witnesses remained on scene, identified as Zachariah Jacobs, Karie Delano, and Charles Kuney. Witnesses described Unit#1 traveling erratically eastbound on NE 4th Street prior to the collision. Witnesses said that Unit#1 appeared to have lost control, drove over the center median, across at least two oncoming lanes of travel, jumped up and onto the sidewalk, went through a pillar supporting an outdoor awning, and into an occupied business. Based on the above statements, 1 believe the driver of Unit#1 (Sullivan) violated RCW 46.61.525 - Negligent driving—econd degree. Per the RCW, Negligent in the second degree is defined as a person is guilty of negligent driving in the second degree if, under circumstances not constituting negligent driving in the first degree, he or she operates a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property. Negligent means the failure to exercise ordinary care, and is the doing of some act that a reasonably careful person would not do under the same or similar circumstances or the failure to do something that a reasonably careful PAGE 3 OF 5 REPORT NO. The driver of Unit#1 (Sullivan) did not exercise ordinary care while operating a motor vehicle and his statement was not consistent with the driving behavior witnessed. Even with the damages incurred, this collision still had far more potential to cause injury and/or death if the vehicle had collided with another vehicle head on, or if Sullivan's vehicle contacted a pedestrian on the sidewalk. I cited the driver of Unit#1 via mail for Negligent in the second degree and for operating a motor vehicle without insurance as Sullivan was unable to provide insurance and claimed that he had just bought the vehicle and had not obtained insurance yet. Unit#1 had to be impounded due to extensive damage. I notified Renton Front Counter to alert City Code Enforcement to evaluate the damages to the structure integrity of the involved building. An exchange of information was printed and provided to the driver of Unit#1 as well as to the on-duty Manager at O'Reilly Auto Parts.
