ED30897 CASE# 23-1372 OF COLLISIONO2/01/23 15:03 NARRATIVE 23-1372 On 02/01/2023 at approximately 1506 hours, I was dispatched to a non-injury and blocking vehicle collision in the intersection 500 block of Rainier Ave South, within the City Limits of Renton, County of King, State of Washington. Upon my arrival, I located both parties and confirmed there were no complaints of injury requiring immediate medical response. Upon arrival, I collected each involved party's information and involvement leading up to the collision. The driver of Unit#1 stated he was the sole occupant of his vehicle and was attempting to exit a private property parking lot located in the 500 block of Rainier Ave South and on the east side of the roadway. The driver of Unit#1 stated that he was intending to make right turn out of the parking lot. The driver of Unit#1 stated he intended to proceed northbound on Rainier Ave South following the turn. The driver of Unit#1 stated that he checked and believed all northbound traffic on Rainier Ave S was clear for Unit#1 to proceed out into the roadway. When Unit#1 proceeded out into the roadway, he was met by what he claimed to be a fast driving vehicle, Unit#2. The driver of Unit#1 stated that he was unable to avoid the collision and that Unit#2 struck the front driver's side door and fender of Unit#1 subsequently causing Unit#1 to spin 180 degrees and facing the opposite direction. Unit#1 suffered significant damage as a result of the collision. The driver of Unit#2 said he was the sole occupant of his vehicle and was traveling northbound in about the 500 block of Rainier Ave S in lane 2 of 3. The driver of Unit#2 stated he was intending to continue north. The driver of Unit#2 stated while approaching the driveway of the private parking lot entrance which Unit#1 was trying to turn out of, he continued going straight ahead. The driver of Unit #2 stated he suddenly noticed Unit#1 turn out into traffic and into the middle lane (lane 2 of 3) which Unit#2 was occupying. The driver of Unit#2 admitted to increasing speed and swerving into lane 3 of 3 in an attempt to avoid the collision. Both vehicles still collided in the roadway subsequently causing significant damage to the front passenger side bumper and fender of Unit#2. A witness, identified by pictured WADL as ZAKEE SHABAZZ, remained on scene to provide his account of what he saw prior to the collision. Shabazz stated that he believed Unit#2 was driving "like an idiot" and recklessly. Shabazz believed that Unit#2 was likely going to cause a collision based on his driving. As soon as Shabazz uttered the words to himself, he said Unit#2 collided into Unit#1. Based on the above statements, I believe that both parties contributed to this collision. Here is my reasoning. Unit#1 is required to comply with RCW 46.61.190(2) which states that every driver of a vehicle approaching the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the roadway, and after having stopped shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time when such driver is moving across or within the intersection or junction of roadways. With that being said, both the driver of Unit#1 and an independent witness claimed that Unit#2 was traveling too fast and that the driver of Unit#1 may not have seen nor been able to predict Unit#2's action. The fact that Unit#1 spun beyond 180 degrees and was facing south in the northbound lanes of travel also revealed to me that Unit#2 was traveling at a high rate of speed to cause that amount of energy. The driver of Unit#2 also admitted to me that he made no defensive maneuvers to avoid the collision but rather admitted to increasing speed and attempted to change lanes instead of slowing PAGE 3 OF 5 TIME REPORT NO. I believe this collision could have been avoided by both involved parties as Unit#1 should have ensured traffic, including fast moving traffic, was not presenting a hazard to his vehicle prior to entering the roadway as indicated in the previously mentioned RCW (46.61.190.2). Unit#1 should have also turned into the closest lane (lane 1 of 3) as defined by RCW 46.61.290(1) - Right turns. Both the approach for a right turn and a right turn shall be made as close as practicable to the right- hand curb or edge of the roadway. Instead, Unit#1 turned into the middle lane of travel (lane 2 of 3). Additionally, I believe that Unit#2 was likely driving beyond a reasonably safe speed and took no defensive driving actions to avoid a collision. I referred both parties to their insurance companies to resolve this matter. Both Unit#1 and Unit#2 had to be impounded due to extensive damage.
