Dear Roger :
Dan Kellogg and I have met on your request on the Malesis
Rezone. As I understand the facts , the Ordinance has been
passed rezoning the property subject to . the Examiner ' s
findings., conclusions and decision..dated February 11 ,
19.81 . You now inquire as to whether or not the property
has been rezoned if one of the conditions of the rezone
has not been met. The answer to your inquiry is that
the ordinance speaks for itself and the rezone is a
conditional rezone. No one will be able to obtain a
building permit to use the property at the higher zoning
classification until the conditions have been met .
You then inquire as to what is the meaning of the condition..
concerning improvement of N.E. 16th Street . You want to know
whether or not this means just the short stub of N.E. 16th
Street , or perhaps more. I think it clear that the rezone
is conditioned upon improvement of the short stub of N.E.
16th Street only, as that is all of the street that would
accommodate potential development and provide access to the
site. Improvements to the street through the site itself
would normally wait until the site was developed so that .
the development itself could be taken into consideration when
the streets were designed.
I would suggest that the City write Mr. Malesis a letter
and indicate that he will not be able to obtain a building
permit until such time as the conditions to the rezone are
met. You might also consider discussing with Dave Clemens
if there is not some good method to indicate on the zoning
map when there are unfulfilled conditions to the various
rezones . That is a topic that will need some discussion in
the future.

You should also be aware that this office has represented
Mr. Malesis off and on for many years . Mr. Malesis came
in to speak to me about this particular rezone and I told
him that I could not represent him or give him any legal
advice on this topic.. If the City believes that there
is a conflict of interest which might affect my ability
to render legal opinions to the City, then the City should
so indicate and we can obtain a substitute . City Attorney
for this topic . If the. City feels satisfied with the
precautions this firm has taken, then the disclosure of
the potential conflict is sufficient and I need not
disqualify myself.

CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
GENERAL CLASSIFICATION DISTRICT (G) TO RESIDENCE

WHEREAS under Chapter 7 , Title IV (Building Regulations) .
' of Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith , the property hereinbelow described has
heretofore been zoned as General Classification District (G) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department on or .
about December 3 , 1980 , which petition' was duly referred to the Hearing
Examiner for investigation, study and public hearing , and a public
hearing having been held thereon on or about January 27 , 1981 , and
said matter having. been duly considered by the Hearing Examiner and
said zoning request being in conformity with the City ' s Comprehensive

department and is considered to be accurate. A vicinity
map of the site is forwarded for inclusion with the
ordinance .

OLD BUSINESS - Continued
SR-515 (New Councilman Hughes thanked the Administration for correspondence
Benson Highway) to the State Department of Transportation on SR 515. Hughes
also noted receipt of information from State House Transportation
Committee that present revenue provides only 56% for all trans-
portation needs of entire state including new construction, main-
tenance, park and ride, ferry system and state patrol ; that a
committee is looking into providing the 35% shortfall .
Appointment Ways and Means Committee Chairman Clymer presented committee
Municipal Arts report asking Council concurrence in the Mayor's appointment of
Commission Dr. Harold E. Kloes to the Municipal Arts Commission to complete
the term of Pauline Kirkman, who has resigned. Term of Dr. Kloes
is effective through 12/31/82. MOVED BY CLYMER, SECOND ROCKHILL,
CONCUR IN APPOINTMENT. CARRIED.
Utilities Utilities Committee report was presented recommending Council
Committee concurrence in the requested rate increase for garbage collection
Garbage to be implemented with the 4/1/81 collections, The report noted
Collection that the City has been paying General Disposal at the increased
Rates rate effective 1/1/81 in accordance with the contract; that imple-
Increased mentation of the increase effective with the 4/1/81 collections
will generate approximately the same amount of revenue as esti-
mated in the 1981 budget. Referral to the Ways and Means Committee
was recommended. MOVED BY TRIMM, SECOND CLYMER, COUNCIL CONCUR
IN THE REPORT. CARRIED. Upon inquiry from Councilman Stredicke,
Acting Finance Director Bennett noted the garbage collection con-
tract specifications were under review by the Utilities Committee
Bid Call in order to go out for bid at the earliest date.
Talbot Hill The Utilities Committee presented committee report concurring
Pipe Lines with the Public Works Department to waive the informality of the
Bid Award unbalanced bid and award the contract to the low bidder, Renton
Construction Co. ; that all schedules be awarded for a contract
award of $582,759.70, plus 5.4% sales tax in the amount of
$31 ,469.02; total award: $614,228.72. The report recommended
the Mayor and City Clerk be authorized to sign the contract.
MOVED BY CLYMER, SECOND TRIMM, COUNCIL CONCUR IN THE COMMITTEE
REPORT. Councilman Trimm noted the competitive market as bids
were submitted at 52% of the Engineer's estimate. Upon inquiry,
City Attorney Warren explained the unbalanced bid, being informal
but legal , noting performance bond protection. MOTION CARRIED.

Final Assessment Letter from Public Works Department presented the final roll in
Roll - LID #315 amount of $16,318.04 for LID #315 sidewalks on Burnett Ave. S,
Sidewalks/Burnett S Tobin St. to S 2nd St. and recommended Public Hearing 4/13/81 .

Tax Revenue Letter from the Finance Department requested resolution be drafted
53,269,632.84 to transfer the utility tax revenue from Current Fund to Park,
Transfer Street and Library Funds along with property tax to Current
to Current Fund from Park, Street and Library Funds ill order to
facilitate cash flow. Property tax payments of substantial
amounts are received in June and December and by replacing part
of the property tax revenue with utility tax revenue received
monthly, the cash flow is helped. Refer to Ways and Means Committee.

OLD BUSINESS Council President Stredicke noted report of his recent trip to
Travel Washington, D.C. to the National League of Cities had been distri-
buted to Council Members for comment . Mayor Shinpoch called
attention that Councilman Stredicke had stayed with friends in
that area and his expenses were kept to a minimum.
Aviation Aviation Committee Chairman Stredicke submitted committee report
Committee stating agreement with the Planning and Development Committee and
P-1 Zoning for the Planning Department in the revision of the Zoning Ordinance,
Airport Facility P-1 District, Section 4-710(J) to cover Conditional Uses by
Permit. The report recommended this matter be referred to the
Ways and Means Committee for revision of the ordinance.
Planning and Planning and Development Committee Chairman Rockhi;ll presented
Development committee report which recommended that the P-1 zontnq on the
Committee Municipal Airport be modified to permit; Facilities to service
Zoni—g n the and store airplanes, facilities to service aPrport patrons and
Municipal incidents essential to the operation of an airport, along with
Airport accessory uses such as aircraft and aircraft parts manufacture.
The designated responsible Renton Administrative authority shall
be notified of all requests for permits affecting the airport.
The committee recommended referral to the Ways and Means Committee

Court Case Summons and Complaint 81-2-02679-6 has been with Superior Court
Right to Keep by the Second Amendment Foundation, Dale and George F. Collier,
and Bear Arms Arnold Gottschalk and Emery Wolfe, vs. the City alleging pre-emption
by State law and constitutional conflict with the City ordinance
prohibiting possession of certain weapons where alcoholic beverages
are dispensed by the drink. Refer to the City Attorney.

Burnett Ave. S Letter from Planning Department, Housing and Community Development
Improvements Coordinator, Ed Hayduk, reported results of a door-to-door survey
Parkway of single family resi'dentE , multiple family and commercial to deter-
Trees and Sod mine resident feeling on installation of both sod and street trees
in the parking strip on South Burnett between South 4th and 6th
Streets. Hayduk reported that overall the sod and trees were accepted
as an improvement to the neighborhood. Only two residents expressed
strong objection: Mary Brown 500 S Burnett and Mr. and Mrs. Holt,
505 S Burnett, as they had previously provided hard surface for
the parkway. Hayduk reported all residents were advised they would
have a voice in the exact location of the trees. The letter recom-
mended the project be completed and suggested the City concede to
the two property owners that documented payment of original hard
surface parkway as it would avoid any adverse publicity for future
street improvements, Community Services Committee Chairman Reed
explained meeting with residents regarding tree placement in parking;

Short Plat 100-80 of Hearing Examiner's Decision of 12/30/80 re roadway system
and E-122-80 development charge imposed as a Condition for granting of
Appeal by Short Plat 100-80 and Exception 122-80; property located on the
Puget Sound north side of SW Grady Way between Lind Ave. SW and Rainier Ave S.
Power and Light Councilman Trimm was excused from the Council Chambers
due to possible conflict of interest and took no part in this

Continued Planning and Development Committee Chairman Rockhill presented
committee report regarding consideration of the Appeal by the
Puget Sound Power and Light Co. regarding SP 100-80,E-122-80
and found no error, recommended by a vote of 2 to 1 , that the
Council concur in the recommendation of the Hearing Examiner
as set forth in his decision of 12/30/80. The report further
stated that the Committee Chairman voted to recommend that the
matter be remanded to the Hearing Examiner for re-hearing con-
cerning the fee to be charged for mitigation of vehicle trips.
Discussion followed. Attorney Kenneth Shellan emphasized three
points: Hearing Examiner has imposed roadway systems development
charge affecting all roadways in the City. Shellan claimed no
ordinance has been adopted which would permit fees to be assessed
and suggested assessment could be imposed at the time of site
approval hearing following adoption of the systems development
charge ordinance; further claiming imposing fees is illegal
without an ordinance. Upon Council inquiry, City Attorney Warren
explained authority for establishing fees for mitigation of
environmental impact is granted with the National and State
Environmental Policy Act. MOVED BY CLYMER, SECOND REED, COUNCIL
CONCUR IN COMMITTEE REPORT APPROVING DECISION OF HEARING EXAMI-
NER OF 12/30/80. CARRIED. Councilman Trimm returned to the

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Lazzetti-Malesis (Stonebridge Company) FILE NO. R-127-80
LOCATION: East end of N.E. 16th Street and east of Kirkland Avenue N.E.
SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from G to R-2
for the purpose of future development as townhouse apartments.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on January 21 , 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on January 27, 1981 at 9:22 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, presented the report, and
entered the following exhibits into the record:

Mr. Blaylock displayed a conceptual design of the site for illustrative purposes only,
noting that a special permit to allow 11 units per acre would be required if the number
of units shown were allowed.
The Examiner requested the applicant to identify herself. Responding was:

The Examiner requested testimony in support of the application. There was no response.
He then requested 'testimony in opposition. Responding was:

Mrs. Morrill was affirmed by the Examiner. She indicated the location of her residence on
the corner of Monroe and N.E. 17th Place, the location of the proposed access from the
subject site. She advised that the neighborhood consists of approximately 30 residences
on Newport Avenue N.E. , N.E. 17th Street, N.E. 17th Place and a section of Monroe Avenue
N.E. Concerns of the neighborhood regard impact to existing wildlife within the site,
elimination of an acceptable play area for children, and elimination of a greenbelt which
serves as a noise barrier from the shopping center. Mrs. Morrill objected to extension
of a roadway from the subject site to N.E. 17th Place and requested that a cyclone fence
be installed to prohibit pedestrian access to the. neighborhood as well .
The Examiner requested further testimony. Responding was:

Mr. Malesis was affirmed by the Examiner. Mr. Malesis, owner of the property, indicated
that the subject site is located quite a distance to the south from existing residences with
the remainder of the county property owned by other parties. He advised that power lines
exist to the east which provide a buffer from single family homes and on the northeast,
no homes exist due to a decline in topography. Responding to earlier testimony regarding
elimination of the subject site for a play area, Mr. Malesis stated that the rezone to R-2
is a reasonable request since the Comprehensive Plan designates the area for low to medium
density multifamily use, and a higheri intensity could have been requested.
The Examiner requested testimony by the Public Works Department. Responding was:

Mr. Houghton was affirmed by the Examiner. The Examiner inquired regarding the capacity
of the existing sewer system in the area. Mr. Houghton advised that the sewer capacity
would not be exceeded by the proposal if the developer utilizes the existing sewer in
N.E. 16th Street and Kirkland Avenue N.E. Responding to the Examiner's inquiry regarding
the impact to the Sunset Lift Station, Mr. Houghton advised that development on the site
would not utilize that facility. The Examiner inquired regarding the impact of the proposed
access connection. Mr. Houghton stated that he is not prepared to discuss the matter of
connection of access between N.E. 16th and N.E. 17th Place during rezone review. The
Examiner noted that access is not necessarily an issue of the rezone procedure, but should
logically be discussed during site plan review or a special permit request.
Cindy McLaughlin noted her appreciation of the fact that the subject site is an attractive
parcel of property and provides certain natural amenities to the area. However, she advised
that the site is privately owned, and other play areas and schools exist in the area to
provide recreational facilities for children. Also discussed was the Planning Department
recommendation to provide additional screening to supplement existing vegetation to buffer
existing single family homes in the area.
Responding in opposition to the proposal was:

Mrs. Zable was affirmed by the Examiner. She reiterated concerns regarding potential
access into the existing neighborhood since it would provide a short cut from Sunset
Boulevard N.E. and increase already heavy traffic in the area. She also indicated the
desire for provision of a fence or barricade from the subject site, and inquired when the
matter would again be scheduled for public hearing. The Examiner advised that if the
applicant wishes to increase the allowable density of two units per acre in an R-2 zone
to 11 units per acre allowed by special permit, a public hearing would be held to review
the special permit, or application for building permit would require review of the
environmental impact which would address access for the site. Mrs . Zable supported
approval of a zoning classification to restrict the site to single family residential
development.
The Examiner requested further comments . Roger Blaylock clarified that the proposal
would require an additional public hearing to review a special permit request, although
such an application has not yet been submitted, and all parties could be notified of that
hearing date by the Planning Department.
The Examiner requested 21 days in lieu of the standard 14-day period in which to publish
a recommendation regarding the matter due to upcoming staff vacations. Since there was
no objection, the hearing regarding File No. R-127-80 was closed by the Examiner at
9:40 a.m.
FINDINGS, CONCLUSIONS AND RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately 3. 16 acres from G
(General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to R-2
(Duplex Residential) .
2. The application file containing the application,. SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit //1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
r/11.

Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee, responsible
official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development. •
5. All existing utilities are available and in close proximity. ,
6. The subject property is located at the eastern end of N.E. 16th Street, east of
Kirkland Avenue N.E. and just within the city's eastern boundary. The site is
currently undeveloped.
7. The subject site is generally level with a slight slope to the northeast. While some
of the site is cleared, the remainder of the site is covered with a mixture of
evergreen and deciduous trees.
8. The subject property was annexed into the city in February, 1980, and the current G
zoning was applied at that time.
9. Development in the area is a mix of duplex residential and single family. East of the
site is undeveloped property and east of this is the Puget Sound Power and Light
Company transmission line. Further east is the Honey Creek Subdivision.
10. The Comprehensive Plan designates the area in which the subject property is located
as suitable for the development of low and medium density multifamily development.
11 . Immediately to the south of the site there is an R-3 (Medium Density Multifamily) zone.
A large R-2 zone is located west of the subject site and within the R-2 zone is the
P-1 (Public/Quasi-Public) zone containing the Hillcrest Elementary School and the North
Highlands Park. There are some scattered one and two lot R-3 districts west of the
subject site. Just north and east the zoning in King County is suburban residential ,
a single family designation.
12. The applicant prepared a conceptual site plan for a 30-unit apartment complex for the
site. If the reclassification to R-2 is approved by the City Council , a Council
approved special permit would be required to establish 30 units on the subject site.
The site plan was presented for illustrative purposes and is not binding on the city
or the applicant.
13. The subject site is composed of four legal lots upon which eight units could be
constructed if the property were reclassified to R-2. Such reclassification and
subsequent development would increase the population by about 20 people (2.5 persons
per unit) ; increase the school age population by about two students (.25 students per
unit) ; and increase the traffic by about 44 vehicle trips per day (5.4 vehicle trips
per unit) . Further subdivision of the subject property or special permit approval
could result in approximately 15 7,200 square foot lots (allowing about 20% of the
site area for roads and improvements) . Fifteen duplex buildings containing 30 units
could be constructed which would yield a similar result as the conceptual special
permit. Thirty units would increase the population of the area by about 75 persons;
increase the school age population by about eight students; and increase the daily
traffic count by about 162 trips. This latter figure represents a 3% increase in
traffic for N.E. 12th Street , the nearest street for which counts are maintained.
14. N.E. 16th Street deadends in the vicinity of the subject site and is poorly graded
and improved. If N.E. 16th were extended directly eastward, it would intersect N. E
17th Street which currently is an unopened street right-of-way serving the Honey
Creek development .
15. The property directly east of the subject site within King County is zoned for
residential purposes, but is deprived of access onto a public right-of-way from
either the City of Renton or the county.
16. Concern was expressed by residents of the Honey Creek Subdivision about any connection
between N.E. 16th an.d N.E. 17th Streets which would direct traffic through their
residential community. The reason for the concern was the Planning Department 's
comment that such connection may he appropriate in the future.
CONCLUSIONS:
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3010 which provides in
part that:

a. The subject site has not been ,considered in a previous area-wide rezone or land
use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the necessary criteria have been met to permit
the reclassification of the subject property.
2. The proposed reclassification to R-2 is compatible with the Comprehensive Plan
designation of the site for either low density or medium density multifamily
residential purposes.
3. The area directly south of the site is zoned R-3 which permits medium density
multifamily development. West of the site is a large R-2 district with some embedded
R-3 parcels. The proposed reclassification of the subject site to R-2 would be
compatible with both of these adjacent zones and would serve as a buffer for the
single family uses north of the subject site and is a logical easterly extension
of the westerly R-2 zones.
4. Access to the site is via a short stub of N.E. 16th Street east of Kirkland Avenue N.E.
and this roadway should be improved to accommodate the potential uses of the property.
Further, in order not to thoroughly landlock the areas east of the subject site,
provision for access to the easterly properties will be required.
5. These easterly properties are sandwiched between the subject site and the Puget
Power transmission lines but are zoned for single family residential purposes by
King County, and, therefore, they should be afforded protection from the more
intense R-2 zoning proposed by the applicant by provision of a dense 15-foot
landscape buffer on the eastern property line. Fifteen feet is slightly more than
one-half of the required 25-foot rear yard and will provide adequate separation.
6. The current G zoning was applied automatically as a statutory consequence of
annexation and no specific consideration of the area's or subject property's zoning
was considered at that time. The subject proposal is therefore the first
consideration of a zone change and it is an appropriate request.
7. While access should be provided for these easterly properties, any connection of
N.E. 16th Street with N.E. 17th Street would provide direct access from the
extensive residential areas north and west of Sunset Boulevard to Sunset via N.E.
17th Street/N.E. Newport Avenue which are local access streets only. Such a
connection would therefore impose a large traffic volume on the N.E. 16th Street/
N.E. 17th Street connector and intrude in the existing single family Honey Creek
Subdivision. Through access should not be permitted without further study of the
impacts of such a street opening on the integrity of the Honey Creek community.
RECOMMENDATION:
The City Council should approve the request to reclassify the subject property from G
to R-2 subject to:
1 . Improvement of N.E. 16th Street to accommodate the potential development. .
2. Provision of a 15-foot landscape buffer along the east property line.

the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner' s decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department , first floor of City Hall , or same may be purchased at cost in
said department.

The subject site was annexed into the City by Ordinance
3401 of February 20, 1980, at which time the present
zoning classification was applied.

1 . Topography: The subject site is relatively level
with a slight slope to the northeast.
2 . Soils : Indianola Loamy Fine Sand (InC) . Permeability
is rapid; available water capacity is moderate;
runoff is slow to medium; and the erosion hazard
is slight to moderate. This soil is used for timber ,
and for urban development.
3 . Vegetation: The subject site consists of a mixture
of evergreen and deciduous trees , although a portion
has been cleared.
4 . Wildlife: The existing vegetation provides suitable
habitat for birds and small mammals.
5 . Water: No surface water was observed on the subject
site (January 15 , 1981 ) .
6 . Land Use: The subject site is presently undeveloped
as is the land to the east. Properties to the
north and south contain existing duplexes. Development
to the west is single family residences.

The surrounding properties are a combination of some
low density multiple family, single family, and undeveloped
uses.
F. Pill ILIC SERVICES :
1 . Water and Sewer: A 6-inch water main extends east-west
on N.E. 18th Street, and an 8-inch main runs north-south
on Kirkland Avenue N.E. An 8-inch sanitary sewer
is also located on Kirkland Avenue N.E.
2 . Fire Protection: Provided by the Renton Fire Department
as per ordinance requirements .
3 . Transit: Metro Transit is available in close proximity
to the area along the major arterials (Routes 107 ,
108 , 240) .
4 . Schools : Hillcrest Elementary School is within
one-fourth mile to the west of the subject site,
while McKnight Middle School is approximately the
same distance to the southwest , and Hazen High
School is approximately one and a half miles to
the east,
5. Recreation: The North Highlands Park is within
one-fourth mile to the west of the property, while
Kennydale Lions Park is approximately one mile
to the northwest. The Hillcrest School facilities
also provide certain open space and recreation
for the area.

2 . The property adjacent to the south was rezoned
from GS-1 to R-3 by ordinance 2247 of May 13 , 1966 ,
and was subsequently developed into the Evergreen
Terrace Senior Citizen Housing. Approximately
500 feet to the north another parcel was rezoned
from R-1 and G-7200 to R-2 by ordinance 2462 of
February 14 , 1969. Other properties to the north
and west consist of existing apartments and duplexes
(Sec. 4-3024C-1c) .
3 . Proposed development of the site would include
30 units (28 townhouses and 2 flats) in six buildings.
If the R-2 request is approved, this proposal would
require Special Permit approval through the Hearing
Examiner.
4 . A possible roadway connection between N.E. 16th
Street and N.E. 17th Place may be necessary as
indicated by the Engineering Division. More information
is required on the method of providing for sanitary
sewers . The applicant must also provide on-site
storm water retention/detention.
5. The Fire Department notes that access roadways
and fire hydrants shall be installed and serviceable
prior to any building construction. Fire flow
requirements shall also be met. See other comments.
6 . Standard hook-up fees for water and sewer will
apply and a water plan for fire protection must
be approved.
•
7 . To accommodate the future development proposed
by the applicant, the Traffic Engineering Division
advises that a fee of $20 per vehicle trip generated
will be assessed to cover the cost of improvements.
Improvements to be installed on N.E. 16th Street
between the entrance to the site development and
Kirkland Avenue N.E. include curb, gutters, sidewalks,
and one street light.
8 . Although a degree of vegetation does exist along
the easterly border of the subject site, it should
be supplemented to provide additional screening
for the single family zoned property adjacent to
it. A 10-foot wide strip of dense landscaping
would be appropriate. In the future, development
east of the site will be separated from the existing
single family residences by the Puget Power trans-
mission line.

result in a population increase of approximately
75 persons (2 . 5 persons/unit X 30 units) .

mately eight students with a 30-unit development.
4 . Social : Increased opportunities for social interaction
would result for the residents of the new housing,
if constructed.
5 . Traffic : As many as 162 additional vehicle trips
per day may be realized if future development takes
place at the maximum. density permitted (5. 4 trips/unit
X 30 units) . This would represent a 3% increase
over present levels on the nearest street for which
traffic counts are available (N.E. 12th Street) .

Acting as the Responsible Official, the ERC has determined
this development does not have significant adverse impact
on the environment. An EIS is not required under RCW
43. 21C. 030 (2) (c) . This decision was made after review by
the lead agency of a complete environmental checklist and
other information on file with the lead agency.
Reasons for declaration of environmental non-significance:
Will notadversely impact adjacent properties.
Measures, if any, that could be taken to prevent or mitigate
the environmental impacts to such an extent that the lead
agency would withdraw its declaration of significance and
issue a declaration of non-significance.
For rezone only. Circulation pattern will have to be addressed
in greater detail prior to issuance of any development permits.

Dear Sirs:
Regarding Item (A) :
At the establishment of the currently in force comprehensive
plan, this particular parcel was not annexed to the City of
Renton. Normative procedure in the annexation process, if
a specific useage is not intended at the time of annexation,
is to zone the property General Use. That was the pattern in
this parcel ' s case. In the -most updated version of the Com-
prehensive Plan, this property is designated for mixed use in-
volving higher and lower density multi-family useage and light
commerical usages. This Comprehensive Plan designation appears
to be in: .line with Stonebridge Company' s proposed usage.
(.Low density multi-family)
Regarding Item (B)
The current zoning on the subject property is General Use,
typical in annexation cases. At the time Of annexation, no
specific development or usage was targeted, so the General
Classification was applied. Our proposed use, (R-2) low den-
sity multi-family, is in line with current Comprehensive Plan
directives . The subject property is surrounded by existing
multi-family structures which suggest our proposed zone clas-
sification is appropriate in terms of former development
approvals. The anticipated utility needs and access routes have
all been checked and present no apparent difficulties in for-
warding a multi-family development. The rental need in the
City of Renton is apparent. Because of the unavailability of
vacant land and prohibitive financing terms, recent development
has been minimal. Likewise, the building permit, traffic count,
and population increase has not experienced significant movement.

COMMENTS:
Introduction- The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EI'S be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to, help the agencies involved determine whether or not a
proposal is such a major action.

presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your

handicapped tenants, will be provided. Energy conservation will
be encouraged in the design and 40% of the units will have solar
heat panels.

The total land area to be developed is approximately 137,600

current Renton comprehensive plan. The property is heavily
treed, slopes gently to the South and has access to needed city
