Council Salaries salaries of Councilmen, increasing salary from $400 to $550
for future elected officials. MOVED BY CLYMER, SECOND REED,
ADOPT THE ORDINANCE WAS READ. ROLL CALL 5-AYES: ROCKHILL,
HUGHES, CLYMER, TRIMM, REED; ONE-NO: SHANE. CARRIED.
Ordinance #3515 An ordinance was read estab.lishing .a fee schedule for Building
Building 6 Public Regulations and Public Ways and Property of Code of General
Way Fee Ordinances, including plats, PUD, Mobile Home Parks, Environmental
Schedule Impact Review, Shoreline Management, Rezone, etc. MOVED BY

LID #321 An ordinance was read ordering construction of LID #321 sanitary
sewer main, laterals and side sewers in the vicinity of Duvall
Ave. NE and NE Sunset Blvd. MOVED BY CLYMER, SECOND ROCKHILL,
REFER ORDINANCE BACK TO WAYS AND MEANS COMMITTEE FOR ONE WEEK.
CARRIED.
The Ways and Means Committee recommended reading and adoption
of the following resolutions:
Resolution #2382 A resolution was read authorizing transfer of $3,469.77 from
Fund Transfer Cumulative Reserve Fund 2104 to Park Facilities for purchase of
Sprayer John Bean Sprayer. MOVED BY CLYMER, SECOND HUGHES, ADOPT THE
RESOLUTION AS READ. CARRIED.
Resolution #2383 A resolution was read transferring $8,000 from Unemployment
Fund Transfer Compensation/Cumulative Reserve Fund 3278 for unemployment
Unemployment 1981 benefit for the year 1981 . MOVED BY CLYMER, SECOND HUGHES,
ADOPT THE RESOLUTION AS READ. CARRIED.

OLD BUSINESS
Utilities Utilities Committee Chairman Shane presented committee report
Committee recommending Council concurrence with the Public Works Depart-
Eastr ge ment to deny the Eastridge Apartments water main Latecomer's
Latecomer's Agreement. MOVED BY SHANE, SECOND TRIMM, APPROVE COMMITTEE
Denied REPORT. CARRIED.
Latecomer.'s The Utilities Committee report recommended Council concur
Agreements for with Public Works Department to approve the granting of Late-
Completed comer's Agreements for Azalea Lane sanitary sewer lift station
Installations and ,force main (8/20/79 referral ) and Superior Fast Freight
water main (3/10/80 Council referral ) . The report recommended
the Mayor and City Clerk be authorized to sign agreements.
MOVED BY SHANE, SECOND TRIMM, APPROVE THE COMMITTEE REPORT.
CARRIED.
S Talbot Hill The Utilities Committee report stated low bid for 1/28/81
Pump Station South Talbot Hill Pump Station W-600 was submitted by Teem
Contract Award Ventures, Inc. in amount of $203,634 basic bid plus $54,318
for the recommended Byron Jackson pumps for subtotal of $257,952
plus sales tax $13,929.40; Total : $271 ,881 .40. The Committee
report recommended Council concur with the Public Works Depart-
ment and accept the low bid of Teem Ventures, Inc. , awarding
the contract accordingly. The report also recommended the Mayor
and City Clerk be authorized to sign the contract. MOVED BY
TRIMM, SECOND CLYMER, CONCUR IN COMMITTEE REPORT. CARRIED.
Maplewood Addition The Utilities Committee report recommended that the Council .
Water Co-op concur with the Public Works Department and approve the Maple
wood Addition Water Cooperative request for emergency intertie.
The report recommended the Mayor and City Clerk be authorized
to sign the agreement; also that the Maplewood Addition Water
Co-op meet with the Utility Staff to arrange for the design
of this connection. MOVED BY TRIMM, SECOND CLYMER, CONCUR IN
THE COMMITTEE REPORT. CARRIED.
Garbage Collection Utilities Committee Minority Report from Chairman Shane regarding
Rates letter from Louis Kwan 2/23/81 objecting to garbage rate for
multi-family units, noted that the City will derive $360,000
garbage collection fees in 1981 . The report stated that if
errors are made in individual customer charges, it is recommended
that these cases be investigated and adjustments be made on
the merits of each individual case. Mayor Shinpoch noted that
the Staff has authority to correct any errors. No action was
taken.
AUDIENCE COMMENT Peggy Cummins, 1811 Grant Ave. S, Human Rights Commission,
inquired regarding scheduling for the Committee of the Whole
meeting. (See meeting schedule) Council President Pro tem
Clymer noted further scheduling would need to be arranged with
Council President. Stredicke or inquire of Council Secretary.
Bruce McKay, Citizens Advisory Committee for Study of Council
Salaries, inquired and was advised ordinance was adopted this
date. Mayor Shinpoch expressed thanks for committee work.
Executive Session MOVED BY CLYMER, SECOND HUGHES, COUNCIL HOLD EXECUTIVE SESSION
FOR PURPOSE OF DISCUSSION OF LABOR NEGOTIATIONS. CARRIED.

CORRESPONDENCE AND CURRENT BUSINESS
Public Meeting Letter was read from David R. Clemens, Acting Planning Director,
Northeast Quadrant that the Renton Planning Commission andthe Northeast Quadrant
Comprehensive Comprehensive Planning Committee will hold a public meeting
Plan on the Northeast Quadrant of the Comprehensive Plan on March
11th at 8:00 P.M. in the Council Chambers.
Assignment of Council positions for the upcoming 1981 elections were designated
Council Positions by Delores A. Mead, City Clerk. #1 - Councilman Shane's position,
#1-2-3 #2 - Councilman Clymer's position, and #3 - Councilman Reed's
position.
OLD BUSINESS
Cat Problem Councilman Stredicke presented letter to be read from Jessie G.
Leendertsen re uncontrolled freedom and increasing population
of cats.
Zoning Code- Councilman Stredicke inquired regarding position of the City
Airport Use re the P-1 zoning use limitation on the airport; noting resulting
conflicts with regard to development provisions of existing leases .
(Fancher Flyways). Ensuing discussion revealed the matter is
presently in the Planning & Development Committee awaiting
Aviation Committee recommendation and is also being pursued
administratively.
Interest Councilman Rockhill noted the $2,136,455.23 received in investment
Earned interest last year commending Acting Finance Director, Ted Bennett.
Houser Way N. Councilman Rockhill inquired re the status of converting Houser Way N.
to one way traffic. Richard Houghton, Acting Public Works Director,
noted they were. waiting for dry weather to paint the street markings.

Firemen who have just completed a three year program to become
journeyman firemen. Congratulations were extended.
Gwen Marshall Mayor Shinpoch noted the recent passing of Gwen Marshall ,
Finance Director, and funeral Wednesday, 2:00 P.M. at
Faull 's Mortuary. Ted Bennett has been appointed Acting
Finance Director. -
PUBLIC HEARING This being the date set and proper notices having been posted,
published and mailed according to law, Mayor Shinpoch opened the
LID 321 public hearing to consider L. I .D. 321 to construct and install
Sanitary Sewer sanitary lateral ,side sewers to property lines and appurtenances
NE Sunset Blvd. in the vicinity of NE Sunset Blvd. and Duvall Ave. NE. Letter was
and Duvall NE read from Richard Houghton, Acting Public Works Director, that no
protests had been received against the LID. Mr. Houghton explained
Preliminary the project and noted contact had been made with K.C. Boundary
Assessment Roll Review Board, State Attorney General 's Office and AWC as previously
$58,127.79 ordered by council . The proposed LID does not lie within any
other sewer district. Shannon O'Neil , 2259 70th SE, Mercer Island,
noted daughter has property outside the city 'and would like to
annex to get the sewer service. Councilman Trimm noted those
properties in the county will not be allowed to connect to the
sewer until the area is annexed; the city, will assume trunk costs
until that time and a latecomer's charge will be assessed. MOVED
BY TRIMM, SECOND ROCKHILL, TO CLOSE THE PUBLIC HEARING. CARRIED.
MOVED BY TRIMM, SECOND ROCKHILL, TO AUTHORIZE CONSTRUCTION OF LID
321 AND REFER TO WAYS AND MEANS COMMITTEE FOR ORDINANCE. CARRIED.
Councilman Stredicke noted for the record that this is the first
sewer LID that has come before the council in over two years that
has not had any protests from the property owners, based on the
fact that the Public Works Dept. extended the effort to meet with
the people. The administration was commended.
AUDIENCE COMMENT Louis' Kwan, 611 Smithers Ave. S. , noted he had been paying for
Garbage Rates garbage pick-up of four cans, when in fact he only had two. Mr.
Kwan's main concern was the difference in charges for single
family and a higher rate for multi-family units - even though
their garbage is no different. MOVED BY REED, SECOND STREDICKE,
TO REFER THE MATTER OF GARBAGE RATES TO THE UTILITIES COMMITTEE.
CARRIED.
Request for Shannon O'Neil , 2259 70th SE, Mercer Island, requested a latecomer's
Latecomer's agreement for his property on Sunset Blvd; Delores A. Mead,

The Examiner requested testimony by the applicant. Responding was:

Mr. Potter concurred with the report and stated that approval of the proposal would provide
additional open space within the project and allow wider spacing of buildings to improve
aesthetics on the site. The Examiner inquired regarding disposition of a previous rezone
on the property for which an appeal is pending before the City Council . Mr. Potter advised
that a meeting with the Planning & Development Committee of the City Council is scheduled
for Thursday, January 22, 1981 , and disposition would be made at the following City Council
meeting.
The Examiner requested testimony in support or opposition to the application. There was no
response. He then requested final comments from the Planning Department staff. Mr. Blaylock
suggested that the hearing be continued or additional time allowed in which to publish a
decision pending the outcome of the ,City Council 's action on the previous rezone. Following
consideration, the Examiner determined that a continuance would not be necessary.
Since no further comments were offered, the hearing regarding File No. R-131-80 was closed
by ;the Examiner at 9:41 a.m.

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately .064 acres from
R-1 (Single Family Residential ; Minimum lot size - 7200 square feet) to R-2 (Duplex
Residential) ; . 189 acres from R-1 to R-3 (Medium Density Multifamily) ; and 2.092
acres from R-2 to R-3.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, an Environmental Impact Statement
prepared for areas immediately adjacent was determined to be sufficient for the
subject proposal by the Environmental Review Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. Utilities will have to be extended to the subject site.
7. The subject site is located west of Stevens Avenue S.W. at the intersection of
S.W. 6th Place. The site was annexed into the city in July of 1948 by Ordinance
No. 1320. In July, 1978, a portion of the site was reclassified R-2.
8. The R-1 portion of the subject site was one of three parcels which remained classified
R-1 when adjacent property was rezoned to R-2 and R-3 to accommodate a ,Planned Unit
Development proposed for approximately 46 acres. This R-1 portion of the subject
site was buffered from higher density R-3 property by land classified for less
intense R-2 uses. The petitioner has requested that the subject site be classified
to R-2 and R-3 (See map for proposed areas of reclassification) . The single family
home which occupied the site was moved to another location.
9. The Comprehensive Plan designates that the area in which the subject property is
located is suitable for the development of high density multiple family uses.
10. The areas surrounding the subject site are currently zoned R-3 to the east and west
of the subject site, and R-2 south and north of the subject site. There is a B-1
district to the east of the subject site. Most of the R-2 zoning in the vicinity
of the subject site was classified as such to buffer the single family uses and
zoning (R-1) located just north of the Milwaukee Railroad tracks and those single
family uses in the vicinity of S.W. Sunset Boulevard.
11 . Most of the area surrounding the subject site is proposed to be developed as the
Earlington Woods Planned Unit Development (PUD) . East of the proposed residential
complex is a proposed business/commercial PUD. The Sears/Renton Shopping Center,
is located along Rainier Avenue S. east of the subject property. The former
Milwaukee Road Railroad right-of-way is located just south of the subject site, and
to the north is S.W. Sunset Boulevard.
12 . The areas surrounding the proposed rezone site have been extensively graded and
cleared in preparation of the proposed PUD. The subject site would be
incorporated into the PUD if the rezone is approved by the City Council .
13. The areas which comprise the PUD were conditionally rezoned. The contingents were
based on timely filing of the PUD and progress towards the overall construction on
the site. A subsequent petition for rezone is currently pending before the City
Council which would remove certain of the restrictions from the property including
the possibility that the zoning would revert to earlier single family classification.
14. The proposal maintains a lower R-2 classification around the remaining southerly
single family uses to serve as a buffer between these uses and the R-3 uses proposed
in the PUD.
CONCLUSIONS:
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3010 which provides in
part that:

a. The subject site has not been considered in a previous area-wide rezone or land
use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstahces in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the necessary criteria have been met to permit
the reclassification of the subject property.
2. The proposed classification is compatible with both the Comprehensive Plan, which
designates the area in which the subject property is located as suitable for high
density multifamily use, and the surrounding zoning, which is also a combination
of R-3 and R-2, the classification proposed by the petitioner.
3. The proposed PUD which has received initial approval and for which extensive grading
and filling has occurred is a considerable change in circumstances in the area in
which the subject site is located. Also, the removal of the single family residence
which was located on part of the subject site and was buffered by the remainder of the
subject site demonstrates a significant change in the area justifying the proposed
reclassification of the subject property.
4. The proposed -R-2 and R-3 zoning requested by the applicant will maintain a reasonable
buffer between the remaining R-1 properties which are still occupied by single, family
uses while at the same time expanding the area on which the applicant can establish
the proposed PUD. The rezoning of the subject property will permit the expansion
of the open space and allow better building separation along the southern end of the
PUD.
RECOMMENDATION:
The City Council should approve the reclassification of the subject site from R-1 and R-2
to R-2 and R-3 as indicated by. the attached map.

The site was annexed into the City on July 8 , 1948 ,
through Ordinance 1320. On July 24 , 1978, a portion
- of the site was rezoned to R-2 by Ordinance 3233 . A
draft environmental impact statement was prepared and
distributed on January 29 , 1979. The final environmental
impact statement addressing all comments on the draft
was issued on March 29 , 1979.

D. Pt:: 'SICAL BACKGROUND:
1. Topography: The site is fairly level.
2. Soils : The subject site is composed of two primary
soil types : Beausite Gravelly Sandy Loam (BeC) ,
and Beausite Gravelly Snady :oam (Bed) . Beausite
(BeC) , permeability is moderately rapid; available
water capacity is low. Runoff is medium, and the
hazard of erosion is moderate. The soil is used
for timber and pasture and for urban;.development.
Beausite (Bed) , runoff is rapid and the hazard
of erosion of severe. This soil is used for timber
and pasture.
3. Vegetation: The site has been graded in preparation
for site development for the P.U.D.
A . Wildlife: Wildlife has been displaced.
5 . Water: Surface water is evidenced on the site.
6 . Land Use: The surrounding area is undeveloped
as a result of the grading. Directly east of the
larger site is Renton Shopping Center, while to
the north a small mixture of commercial and single
family uses exist. The site itself is undeveloped
. land. The existing railroad track line and Earlington
Industrial Park are located directly south of the
P.U.D. site.

in 1948. Therefore, this would appear to comply
with the first criteria outlined in Section 4-3014 (C)
(1 ) (a) .

3 . Section 4-3014 (C) (1 ) (c) states that a rezone request
can be granted if there have been significant public
or private project developments constructed that
affect the subject property. The approval of pre-
liminary plans for the residential planned unit
development along with the actual absorbtion of
the Taylor Property into the proposed project would
suggest that there have been significant and material
changes.
4 . The rezone request has been submitted based upon
the setback conditions imposed in 1978 to buffer
the remaining single family residences . The applicant
has specifically attempted to comply with the intent
of previous recommendations of the Hearing Examiner
and the final rezoning action of the City Council.

5. Rezoning the property will increase the potential development
by 41 units . The preliminary plans proposed by the
developer anticipate increasing the Planned Unit Development
from 458 units to 489 units. The Final EIS evaluated
impacts of 510 units; therefore, the increase has been
specifically considered and the Environmental Review
Committee has concurred that the proposal is within
the original scope of the project.
6. The only possible alternative to the request would be
to deny the request. However, this would serve no particu-
lar purpose since the applicant will comply with original
setback conditions imposed in 1978. On the other hand,
approval of the request will allow the applicant the
opportunity to revise the approved PUD plans and hopefully
provide more appropriate building separations and open
space for recreation.
M. RECO ATION:
Based upon the above analysis , it is recommended that
the Hearing Examiner approved the requested zone change
from R-1 , Residence-Single Family and R-2 , Residence-Two
Family to R-2, Residence-Two Family and R-3 , Residence-
Multiple Family.
