SUMMARY OF REQUEST: The applicant proposed to subdivide +21 acres into 84 single family
lots. Also requested is an exception to the requirement for
cul-de-sac length, an exception to provide for pipestem lot
arrangements, and a waiver of the requirement' for off-site
improvements on N.E. 4th Street. •

PLANNING DEPARTMENT The 'Planning ,Department'preliminary report was received 'by the
REPORT: Examiner on October 12, 1979.
PUBLIC HEARING: After reviewing the Planning- Department .report, examining
available information On file with the application, and field
checking the property and surrounding area, the Examiner
• conducted .a public hearing on the subject as follows:
The hearing was'opened on October 16, 1979 at 9:05 a.m. in the Council Chambers of the
Renton Municipal Building. •
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, and the report was entered into the record• as Exhibit #1.
The Examiner referenced exception application, File No. E-421-79, which originally had
been requested to allow length of the cul-de-sac in excess of ordinance requirements. • Due
to subsequent construction of the Cul-de-sac in compliance with requirements, the request
is no longer necessary and the Examiner requested the applicant to withdraw the
application. Responding was:

The Examiner asked the applicant if he concurred in the recommendations contained in
Exhibit #1. Mr. Strother indicated concurrence, noting that the plat has been under
. construction for some time in compliance with previously approved conditions.
The Examiner requested .further testimony in support or Opposition, or final comments from
the Planning Department staff. Since. there were no further comments, the hearing regarding
File No. PP-420-79, E-421-79, E-422-79', and W-423-79 was closed by the Examiner at 9:17 a.m.'

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a preliminary plat of +21 acres to be subdivided into
84 single family lots, together with an exception for four pipestem lots,' an exception
for a cul-de-sac of greater than 500 feet in length, and a waiver of the requirements
for off-site improvements.

2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this 'matter, and is hereby
attached as Exhibit #1 and incorporated in this report by reference as set forth in
full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and 'the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance .
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.

6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section '4-703 (SR-1, Single Family Residential) of Title IV, Ordinance
No. 1628, Code of General Ordinances.
8. • The subject property is located in the northeast section of the City of Renton just
east of Windsor Hills.
9. The subject application is necessary because a previous approval of the preliminary
plat together with the pipestem exceptions (File No. PP-236-78) had expired on
June 18, 1979.
10. Construction is already underway on the subject site and both on-site and off-site
improvements are being installed.

11. The applicant has redesigned the plat and the exception for the cul-de-sac is no longer
necessary; the exception request has. been withdrawn.
12. The subject proposal contains a centrally located area of approximately one acre for
open space.
13. The' four pipestem• lots contain the required amount of buildable lot area exclusive of
• the pipestem extensions.
14. The applicant has proposed no access to or from the subject site via N.E. 4th Street.
Access from the subject site will be via Edmonds Avenue N.E. and N.E. 5th Place.
15. Each of the city agencies contacted recommended that off-site improvements be installed.
An apartment complex in the vicinity has been required to improve N.E. 4th Street. The
roadway has become a major link between the northeast quadrant of the city and the
downtown area and I-405.
16. The property was subject to a previous plat which was vacated by Ordinance No. 3341
adopted by the City Council on July 23, 1979.
CONCLUSIONS: '
1. The subject proposal appears to serve the public use and interest. The proposal as
conditioned will provide a safe, esthetic residential development for the potential
residents.
2. The four pipestem lots each provide the•required buildable area without the pipestem
extension. The pipestems are a reasonable method of providing access for their
respective .lots. The elimination of the pipestem would require creation Of larger
lots which would be out of scale and. character in this development.
3. The pipestems provide the applicant the only reasonable method of making reasonable
use of the subject property without granting the applicant a special privilege. Similar
pipestems have been approved when to deny them would cause the applicant undue hardship
in developing lots with the necessary access,. .

4. N.E. 4th Street has become a major thoroughfare and carries a large volume of traffic
from the northeast corner of the city to the downtown area and 1-405. Other developments
in the general vicinity have also been required to install off-site improvements and the
granting of the requested waiver would be inappropriate. The improvement of the
streets in this area is progressing as new development occurs. Further, the applicant
has already begun to install the improvements under the previous approval and they
should be completed.
5. The open space should be properly maintained and the applicant should provide for a
management association to maintain that area.
RECOMMENDATION:
Exhibit #3 should be approved subject to:
1. Restrictive covenants provided by the developer for the establishment of a Management
Association to maintain the "open space";
2. Restriction on the plat certificate precluding direct access to N.E. 4th Street from
the plat or individual lots.
The pipestem exception is approved.
The waiver of the required off-site improvements is denied.

decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to, the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be purchased at cost in said
department.

C. PURPOSE OF REQUEST :
The proposal is to subdivide 21± acres into 84 single family lots
conforming to the SR-1 zoning district (7500 square feet minimum
lot size) . In order to achieve the proposed _layout , the applicant
has requested an exception to the 500 ' maximum length for a
cul-de-sac, an exception to provide for pipestem lot arrangement
for lots 4, 10 , 60 and 64. The applicant has also requested •
waiver to the requirement for off-site improvements for N.E. 4th
Street .
D. HISTORY/BACKGROUND:
The subject property was annexed by Ordinance 1789 of September 9,
1959 . The current SR-1 zoning was approved by Ordinance 2497 of
August 31, 1964.

On December 18, 1978, the Renton City Council concurred with the
approval of the preliminary plat (PP-236-78) . After six months ,
their approval expired. This application was made to reactivate
that original preliminary plat approval. Required on-Site and
off-site improvements are under construction.
E. PLANNING DEPARTMENT ANALYSIS :
1. The preliminary plat that was submitted, basically complies
with the conditions of approval of the first preliminary
plat application. The streets are presently under construc-
tion.
2. The exception request (E-421-79) for a 614 foot cul-de-sac
is no longer relevant . The cul-de-sac on N.E. 4th Court,
has been replaced with a looped drive.
3. The exception request (E-422-79) to allow five pipestem lots
has been revised by the preliminary plat plans, which show
only four. Therefore, only lots 4, 10 , 60 and 64' are pro-
posed to be pipestem lots. If the exemption is granted, all
of the lots within the plat will conform to all requirements
of the SR-1 district and Subdivision Ordinance.
4. The applicant has requested Waiver 423-79 to eliminate the
public street improvements along N.E. 4th Street on the basis
that the development is designed toward interior streets and
that no benefit would be gained by this development . Build-
ing, Engineering and Traffic Engineering Divisions have all
recommended against the proposed waiver.
F. DEPARTMENTAL: RECOMMENDATIONS :
Based upon above analysis , it is recommended that the Hearing
Examiner approved the Preliminary Plat , File PP-420-79 , as sub-
mitted, and the Exception request , E-422-79 , to allow four
pipestem lots. The request for a waiver of off--site improvements
on N.E . 4th Street , W-423-79 , and the Exception request , E-421-79 ,
should be denied.

We request three exceptions in our Highbury Park Plat.
0 The first exception is to have a cul-de-sac 614 . 85 feet
�;11 long on proposed N.E. 4th Court. This is necessitated
4, by topography and road system lay-out and would in my
opinion serve the best Interests of the furture home
owners in Iighbury Park.
The second exception is to have pipe stem lots for lots
four (4) , ten (10) , sixty (60) , sixty-four (64) , and
seventy-seven (77) per Section 9-11108-23-F (3) (D) of
�41 the City of Renton code. The physical constraints of the •
• ZZ property such as topography, access , and the property
;/ configuration precludes the development of these lots with-
out use of pipe stem access.
The third exception is on development and improving N.E.
4th St. . We request that an exception be granted on pav-
ing, curbs, gutters and side walks on N.E. 4th St. . Per
directions of the City of Renton Planning staff the pre-
341 liminary Plat was revised to restrict access on to N.E.
4th St, from the thirteen (13) adjoining lots , numbers
#71 - #84 . As a result roads will have to be developed
within the Plat to serve these lots. Construction of a
sidewalk on N.E. 4th St. could not be used by residents

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment..
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
