Claim for Damages Claim for damages was filed by Ronald D. Bauer, 1151
Shelton Avenue N.E. , in the amount of $262.45 for damage
to automobile, alleging street flusher sideswiped the
left side of automobile while parked. Refer to City
Attorney and Insurance Carrier.
Short Course on The Planning Commission is sponsoring "Short Course on
Local Planning Local Planning" to be held at 7:00 P.M. on June 25, 1981 ,
in the Council Chambers. The Mayor and City Council
Members are invited along with other jurisdictions .
King Subregional David Clemens, Director of the Planning Department ,
Plan Revisions presented revisions to the King Subregional Plan, which
included the definition of Secondary/Metropolitan Center
amendment and a new Business/ Industrial Area designation
proposal ; also, authorization request for the City' s
representative to support the proposed revisions . Council
concur.
Writ of Mandate A writ of Mandate has been filed by Washington State
Local 21R vs. City Council of County and City Employees , Local 21R
vs. City of Renton, to proceed to arbitration on the
grievance of Ronald Lyons. Refer to City Attorney.
Consent Agenda MOVED BY STREDICKE, SECOND TRIMM, ACCEPT THE CONSENT
Approval AGENDA AS PRESENTED. CARRIED.
CORRESPONDENCE AND CURRENT BUSINESS
Annual Western Letter from Toni Nelson, President , of Renton Merchants

OLD BUSINESS
AVIATION COMMITTEE Aviation Committee Chairman Stredicke recommended the
REPORT Council authorize the Mayor and City Clerk to sign
the renewal of FAA Lease No. FA4-1486, Remote Transmittal
Receiver and Rotating Beam Ceilometer, for a period of
ten years with an option to renew for ten years. It
was MOVED BY CLYMER, SECOND ROCKHILL, TO CONCUR IN THE
RECOMMENDATION OF THE AVIATION COMMITTEE. CARRIED.
UTILITIES COMMITTEE The Utilities Committee recommended that the Council
REPORT concur in the report of the Public Works Department
regarding the Talbot Hill Pipelines, CAG 019-81 , contract
adjustment and that the Public Works Director be authorized
to execute said change order on the report recommendations.

Resolution #2407 The Ways and Means Committee recommended the reading and
Transfer of Funds adoption of a resolution transferring funds from the

Improvement/ Systems Improvements/Hospital Account in the total
Hospital Account amount of $521 ,825.96. It was MOVED BY CLYMER, SECOND
HUGHES, TO ADOPT THE RESOLUTION AS PRESENTED. CARRIED.
NEW BUSINESS
"Accessory/ Councilman Hughes, City representative to the Puget
Mother-in-Law Sound Council of Governments , reported PSCOG discussion
Rentals" of Add-a-Rental accessory units to alleviate housing
shortage, local jurisdictions requested to review possible
benefits. MOVED BY ROCKHILL, SECOND HUGHES, TO REFER THE
SUBJECT OF ADD-A-RENTAL UNIT TO THE PLANNING DEPARTMENT
FOR ANALYSIS AND RECOMMENDATION. CARRIED.
Proposed Energy A letter from Mayor Lorraine Hines, Chairperson, Puget
Management Program Sound Council of Governments, was presented in regard to
participation in a proposed Energy Management Program
sponsored by the King Subregional Council (of PSCOG) .
Bonneville Power Administration will make available
approximately $100 million per year to local entities
in the Northwest states. These funds are to implement
local projects that conserve or generate electrical
energy. It was MOVED BY HUGHES, SECOND CLYMER, THAT MAYOR
HINES LETTER BE REFERRED TO THE PLANNING DEPARTMENT.

The subject site was annexed into the City by Ordinance
No . 1835 of August 23, 1960 . It was rezoned from P-1
to G-7200 on May 20 , 1974, by Ordinance No . 2852 . A
six-lot subdivision was approved on the site in May
of 1976, File No . PP-838-75 by the Renton City Council .
This preliminary plat has elapsed. . On December 28 ,
1979, the Hearing Examiner denied another request for
preliminary plat approval (8 lots) .
D. PHYSICAL :ACRSCRBONS:
1. Topography: The subject site rises from west to
east at slopes ranging from 12 to 16 percent.
2 . Soils : Alderwood and Kitsap soils ; ;very steep
(ArF) . Slopes . are very steep. Drainage and perme,
ability vary. Runoff is rapid to very rapid, and
the erosion hazard is severe to very severe. The
slippage potential is severe. These soils are
used for timber . Indianola Loamy Fine Sand ( InC) .
This soil has rapid permeability, available water
capacity is moderate, runoff is slow to medium
and the erosion hazard is slight to moderate.
This soil is used for timber and for urban develop-
ment .
3 . Vegetation : The subject site is heavily wooded
with numerous evergreens and some deciduous inter-
mixed.
4. Wildlife : Existing vegetation on the site provides
suitable habitat for birds and small mammals .
5. Water : No surface water was observed on the subject
site (February 20, 1981) .
6 . Land Use : The subject site is undeveloped with
scattered single family homes located to the south,
east and west .
E . NEIIGH 1:;®RBHfl®®R4 CHARACTERISTICS: •
The surrounding properties are principally single family
residential in nature.
F . PU1LIC SERVICES:
1 . Water and Sewer : An 8" water main extends east-west
on N.E . 27th Street within 200 feet to the south
of the subject site and a 12" main runs north-south
on Kennewick Place N. E. approximately 200 feet
to the west . A 12" sanitary sewer is also located
on N .E . 28th Street .
2 . Fire Protection : Provided by the Renton Fire Depart-
ment per ordinance requirements.
3 . Transit : Metro transit Routes No . 142 and 144
operate along N.E . 27th Street .
4. Schools : Kennydale Elementary School is within
4 mile to the west of the subject site while McKnight
Junior High School is approximately one mile to
the south and Hazen Senior High School is within
3 miles to the east .
2 . All of the proposed lots meet or exceed the minimum
requirements of the subdivision ordinance for size
and frontage except lots 4 ,6 , and 10 for which
pipestem exceptions have been requested.
3 . In 1975 and 1976 a residential subdivision of 10
lots was reviewed by the Planning Commission and
the City Council . The final approval placed five
conditions on the preliminary plat and reduced
the number of lots to six . That plat lapsed and
the Hearing Examiner denied a subsequent 8-lot
preliminary plat on December , 1979 .
4. Access to the site has been the primary concern
expressed in past reviews . The applicant proposes
entrance via a +700 foot long cul-de-sac . The
proposal would exceed the maximum 500 feet permitted
by Section 9-1108-23A(5) of the Subdivision. Ordinance.
This cul-de-sac as shown on the proposed plat is
only 25 feet wide for the first +340 feet of length .
Section 9-1108-23A (s ) requires 50 feet . The existing
topography and generally inappropriate alternative
access suggest that there is some justification
for the exception requests ( Section 4-2916A-1 ) .
City departments have expressed no opposition to
the width or length except for the Traffic Engineering
Division . This department has recommended denial
of the exception request for cul-de-sac width .
The Planning and Public Works Departments have
evaluated the street width proposal and have concluded
that a minimum 32 feet curb to curb width and sidewalks
(42 feet right of way is required for safe visibility
and adequate access . )
5. The applicant must provide a deed for the D. W.
Moje property to be used for access as per Engineering
Division comment . Storm water retention-detention
will also be required. Also, no access is to be
permitted via N .E . 28th Street .
6 . The Fire Department notes that the access road
shall consist of at least 20 feet of unobstructed
width with a turning radius of 45 feet from the
center to the curb . The paving and fire hydrant
shall be installed and serviceable prior to any
building construction .
7. Standard hook-up fees for sewer and water ( .01/square
foot ) will apply . A special area assessment of
.03/square foot for sewer will also be charged.
Utilities Engineering further indicates that waste
and sewer plans must be approved.
8 . Traffic Engineering also advises that a street
lighting plan will be required.
9 . Pipestem lots are proposed for lots 4, 6, end 10 .
Given the topography and access problems previously
addressed , these requests appear to be justified.

5. Recreation : Kennydale Lions.. Park is located approximately
4 mile to the southeast and the North Highlands
Park one mile to_ the southeast .

1 . Natural Systems : Development of the subject site
will remove the vegetation , disturb the soils ,
increase storm water runoff and have an effect
on trafffic and noise levels in the area . Through
proper development controls and procedures, however,
these impacts can be mitigated.
2 . Population/Employment: The proposed plat of 11
lots wip increase the area population by approximately
38 persons (3. 5 persons/home x 11 homes ) .
3. Schools :{ The proposed subdivision will increase
the school population 5 students ( . 5 student/home
x 1 home) .
4. Social : : Development of the subject site. will result
in increased opportunities for social interaction
among the area residents.
5. Traffic The new plat will increase traffic in
the area,lby approximately 110 trips per day (10
i . trips/unit x 11 units) .
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERINIINATI®IN:
Pursuant to the City of Renton 's Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C , a Declaration of Non-Significance was issued
for the subject proposal on February 22, 1981, by: the
Environmental1Review Committee.

Based upon the above analysis , it is recommended that
the preliminary plat for Eden Estates , PP-079-80, be
approved along with the exception requests to allow
(1) pipestem, lots No. 4, 6 and 10 and ( 2) the exception
requested for the cul-de-sac to be in excess of 500
feet . The exception requested for street width should
be approved in accordance with L-4 to assure adequate ,
access and safe visibility .

OLD BUSINESS Councilman Shane inquired regarding the Wes Williams retention
Retention of of farm animals matter and was advised by the City Attorney
Farm Animals that it is not appropriate for Council to discuss a matter that
is pending in Municipal court and further that one Council cannot
bind another except by ordinance or signed contract.
Wells Ave. Councilman Shane inquired regarding the Wells Ave. bridge and
Bridge was advised by Public Works Director Gonnason that determination
was made for environmental assessment , however Federal Highway
Commission may require a full environmental impact statement and
in that event , additional funds will be required.
Improvements for Councilman Shane inquired regarding petition on Garden Ave.
Garden Ave. N. improvements and was advised by Public Works Director that Council
terminated the LID because more than 60% protest received on the
project. Gonnason noted that he had advised PacCar of off-site
improvement requirement with building permit request and their
obligation for improvements in front of the trunk center which
had been previously deferred.
City Shops Councilman Reed inquired regarding negotiations with King County
for proposed shop site. Gonnason noted authorization had been
requested from City Council and referred to the Community Services
Committee. Reed submitted Council Minutes of 8/6/79 and 4/14/80
and explained 9/17/79 Council approval of negotiations . MOVED BY
STREDICKE, SECOND ROKHILL, ADMINISTRATION PROCEED WITH NEGOTI-
ATION PROCESS TO OBTAIN CITY SHOP SITE, 13.5 ACRES EAST OF THE
PRESENT COUNTY SHOP SITE NEAR COUNTY TRANSFER STATION IN RENTON
HIGHLANDS AREA. Gonnason explained 3.5 acres of area is hillside,
possibly unuseable, but it will be included in the appraisal .
MOTION CARRIED. MOVED BY STREDICKE, SECOND REED, THE ADMINISTRATION
MAKE RECOMMENDATIONS TO THE COMMUNITY SERVICES COMMITTEE AS TO
NECESSITY/SELECTION OF ARCHITECTS FOR THE CITY SHOPS PROJECT.
Following discussion wherein Council members called for a sturdy
appropriate structure and not a monument , MOTION CARRIED.
MOVED BY REED, SECOND SHANE, COUNCIL AUTHORIZE THE ADMINISTRATION
TO INVESTIGATE PLACEMENT OF TEMPORARY STRUCTURE ON SHOP SITE WHEN
PROPERTY SECURED. CARRIED.
Councilman Shane left the Council meeting and was excused
by Mayor Shinpoch.
King County Moved by Stredicke, Second Reed, City of Renton notify County of
District Court King of termination of rental space for the Justice Courts in City
Hall . Mayor Shinpoch advised the Court had requested some form
of notification to be better able to seek other space. SUBSTITUTE
MOTION BY ROCKHILL, SECOND STREDICKE, CITY OF RENTON NOTIFY KING
COUNTY OF OUR INTENT NOT TO RENEGOTIATE LEASE AND URGE THEM TO
SECURE SUITABLE SPACE WITHIN THE CITY. CARRIED.
Robertson Transportation Committee Chairman Stredicke noted Robertson
Aircraft Aircraft, sub-tenant of Boeing on airport leased property, will be
leaving the airport at the request of Boeing who will be removing
or remodeling to enlarge the structure on the field. Robertson
plans to relocate at Everett. Committee is investigating effect
of rebuilding on Compass Rose and will be reporting
Planning and Planning and Development Committee Chairman Rockhill submitted
Development committee report re referral of 4/28/80 for completion of plats
Committee in phases (Eden Estates) . The committee determined the present
Plat Development code adequately covered the situation and recommended no Council
action on this item. MOVED BY ROCKHILL, SECOND REED, CONCUR IN
COMMITTEE RECOMMENDATION. CARRIED.
Burnett Street The committee reported L-1 light industry zoning on some property
Linear Park adjoining the Burnett Linear Park and recommended the matter be
referred to the Planning Department for recommendation regarding
appropriate zoning in order to prevent any future problems. MOVED
BY ROCKHILL, SECOND CLYMER, CONCUR IN COMMITTEE RECOMMENDATION.
MOVED BY STREDICKE. SECOND ROCKHILL, AMEND COMMITTEE RECOMMENDA-

The Planning and Development Committee has considered the appeal
of the above mentioned recommendation of the Land Use Hearing
Examiner dated December 28 , 1979 , and recommends that the City
Council-modify the recommendation of the Land Use Hearing
Examiner based upon the following errors of fact and law:
1. Conclusion No . 4 is in error in that except for
the access street to the subdivision,• this preliminary
plat request meets the requirements of the Subdivision
Ordinance and must be .approved subject to the develop-
ment of the access street to satisfy the provisions
of the Subdivision Ordinance.
The Committee recommends that the City Council modify the recom-
• mendation of the Land Use Hearing Examiner to approve the plat
subject to development of N.E . 28th Street to comply with the
provisions of the Subdivision Ordinance .
The Committee further recommends that the City Council affirm
the Land Use Hearing Examiner ' s denial of both exception

Planning and Development Committee requested withdrawal of
appeal with the understanding that the conditions of the

varying degrees of impact or declaration of non-significance.
That most important function of the E.R.C. is to assure depart-

Re: Eden Estates Appeal - Appellants ' request for refund
of filing fee
The Planning and Development Committee. has recommended that
the City Council refer the Appellants ' request for refund
of their exception application fee to the Administration for
recommendation. It appears in this case that application for
an exception from the Subdivision Ordinance at the suggestion
of the Planning Department would not have been necessary in
that N.E . 28th Street is not a cul-de-sac but is a platted
street.
However, it would be our recommendation that the City should.
not refund filing fees once paid. The applicant is responsible
to determine the propriety of any particular application. Any
assistance that the staff may make is given without considera-
tion and solely in an attempt to be helpful to the applicant.
The City incurs substantial expense by way of staff time as
well as advertisement and posting of the. hearing notices ,
which the application fee is intended to reimburse, at least
in part.

NOTICE OF APPEAL
Mark Heacock and Peter Tiersma hereby appeal the Hearing
Examiner' s decision dated December 28 , 1979 on files #PP-430-79 ,
E-449-79, and E-450-79 . This appeal is made for the reason that
there are substantial errors in law and fact in the Examiner' s
decision. The errors include the following:
1. The applicant was required to request an extension
to the ordinance regarding the length of cul-de-sacs.
In fact, based upon the ordinances of the City of
Renton, there was no cul-de-sac violating the length
restrictions under the ordinances, as was pointed out
by the Engineering Department in its report to the
Examiner, and no exception from the subdivision ordi-
nance should have been required.
2. The examiner' s finding that there "are a number of
undeveloped parcels in the area which seem to be
similarly situated as far as access in concerned"
is incorrect. The location of this property, and
particularly the fact it is backed by King County park
property which cannot be developed, make it unique
from any other properties in the area. The property is
most similar to the Werstiuk PUD, in which case a 25 foot
right of way was allowed for access to the property.
The Werstiuk property will have a much higher population
and density than proposed by this applicant. The
Werstiuk project approval was conditioned upon an addi-
tional 25 feet of access being provided upon develop-
ment of adjacent land. In fact, the adjacent land is
county park, and will never be developed. Such a con-
dition on this project would have meaning, and the appli-
cant has proposed it; the Examiner' s decision fails to
consider this alternative.
3. The Examiner concludes that there are no sidewalks,
and therefore there can be no safe pedestrian move-
ment. This conclusion is incorrect. Because of the
location of the property, the mode of development in
the area, and alternate sources of public access,
safe pedestrian movement can be accomplished by the
applicant.
4. The Examiner concludes that the area near the applicant' s
property which has already developed should not be
burdened with additional traffic and safety problems
which development on this parcel would bring. In
essence, the Examiner is concluding that this property
should not be afforded the same treatment as other
property in the area, and the applicant should not be
allowed to use its property consistent with uses by
other property owners in the area. There is absolutely
no evidence in the record to support the Examiner' s
conclusion that there will be additional traffic and
safety problems caused by this eight-lot development.
Any such effect on existing development areas would be
negligible.
5. The Examiner concludes that granting this application
with the exceptions as requested would create precedents
in the area. This is not the case. The property is
so uniquely located that no other property in the area
would be able to assert the same bases for exception to
the ordinances.
6. The Examiner concludes that this development is premature.
In fact, the Planning Commission and the City of Council
determined over four years ago that development of this
property was appropriate. The record shows that the
development was allowed for six lots, and the restriction
to six lots was based largely upon the facts that higher
density development would cause removal of trees in the
area. Those trees have been removed by a prior owner.
This is a substantial change in the circumstances of the
property which would now justify a somewhat higher density
of development.. Further, the property behind, to the
north of this property is now owned by King County, has
been developed by HUD funds, and can now never be used
for private purposes. The concerns about access through
this plat to other properties, and other development of
that property in the area no longer exsist. No changes
in the circumstance of the property have occurred which
would indicate a lesser density of development, or denial
of the application.
7. The Examiner stated that removal of trees from the
property by a prior owner was a case of an applicant
creating its own hardship, and therefore an increase in
lots based upon the change in circumstance of the property
would not necessarily be justified. In fact, removal
of the trees created no hardship. The property owner
at the time who removed the trees had every legal right
to do so as owner of the property. The fact that the
owner did remove the trees to the possible chagrin of
other persons is not a valid reason for refusing to
consider the changed nature of the property. The
property should be examined, and decisions made regarding
it, based upon its character at the time of application.
In conclusion, all justification for development of the
property that existed in 1975 continues to exist today. Those sub-
stantial changes in the property which have occurred would justify
greater density development. The applicant has proposed eight
lots, each to be over 15,000 square feet, well over double that
required by the zoning in the area. The intent of the city' s ordi-
nances regarding access and safety can be met by the applicant as
the application is proposed, in spite of the fact that there will
not be letter-of-the-law compliance with ordinances. This is
exactly the type of situation that justifies exception from the
ordinances. The tenor of the Examiner' s decision is that an
exception cannot be granted because the development would then
not be in compliance with the ordinances. In fact, the exception
procedure is for the specific purpose of allowing property to be
developed, although not strictly in compliance with ordinances,
when the circumstances justify, and the public good can be promoted.
Such is the case of this application.
It is respectfully requested that the decision of the
Examiner be modified or overturned, and that this plat and the
exceptions necessary thereto be approved as requested by the applicant.

SUMMARY OF REQUEST: The applicant requests preliminary plat approval of an eight

PLANNING DEPARTMENT The Planning Department preliminary report was received by
' REPORT: the Examiner on November 2, 1979; a supplementary report was
received on December 14, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened. on November 6, 1979 at 9:12 a.m. in the Council Chambers of the
Renton Municipal Building.
Roger Blaylock, Associate Planner, advised the necessity to continue the public hearing
to allow application for exceptions for access width and cul-de-sac length•. The Examiner
subsequently continued the hearing to December 4, 1979 at 9:00 a.m. in the Council Chambers.
. CONTINUANCE:
The hearing was opened on December 4, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. Being advised that additional time was required in order to
complete application for necessary exceptions to the Subdivision Ordinance, the Examiner
continued the hearing to December 18, 1979.
CONTINUANCE:
The hearing was opened on December 18, 1979 at 9:30 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, dated November 6, 1979 as well as a supplementary report,
dated December• 18, 1979. The reports were entered into the record as Exhibits #1 and 2,
respectively.

Roger Blaylock, Associate Planner, reviewed Exhibits #1 and 2, and entered the following •
additional exhibit into the record:

Mr. Blaylock corrected Section B.3, Agencies/Departments Contacted, of Exhibit #2, and
noted that a response has been received from the Traffic Engineering Division and is
attached to the report. He also noted that one of five conditions placed on the plat
i,n 1976 relating to. retention of existing vegetation has been modified due 'to removal
of trees by the .property owner at that time. Responding to the Examiner's inquiry regarding
whether N.E. 28th Street is open west of Aberdeen, Mr. .Blaylock advised that the roadway
contains a width of 25 feet and is unimproved at that point. He also indicated that design
problems due to proximity of existing residences near Kennewick Avenue N.E. would create
difficulties in widening the roadway. Mr. Blaylock corrected the Planning Department

recommendation from approval of both exceptions to denial of the exception relating to
right-of-way width.
The Examiner requested testimony by the applicant. Responding was:

Mr. Hanis, attorney for the applicant, reviewed the prior preliminary plat application
which had been approved by the Planning Commission and City Council in 1976 subject to
conditions. He noted that the purpose of reduction in density from ten to six lots by
the Commission and Council was to protect existing trees on the property, but that
following final action on the matter, the property owner had removed all of the trees,
and this action had substantially changed the physical characteristics of the site. The
Examiner noted that because an applicant may not create his own hardship, increasing the
number of lots from six to eight is not necessarily justified. Mr. Hanis advised that
the property has changed ownership twice since that time.
Mr. Hanis also noted that an additional circumstantial change has occurred since the
previous plat approval pertaining to status of property located north of the site which
is now owned by King County. He advised that because the county is restricted from
granting access, the previous questions regarding provision of access for future
development of that property no longer exist. He also indicated that the. previous
reduction to six lots rendered the project economically infeasible and the proposal for
eight lots provides twice the lot size required by ordinance since the property can be
divided into a maximum of 16 residential lots.
Mr. Hanis indicated concurrence in the Planning Department recommendation to approve
Exception No. 2 for cul-de-sac length, but requested a refund for exception fee if the
Examiner concurs in the Engineering Division opinion that an exception is not necessary.
He noted that denial of Exception No. 1 would preclude development and reasonable use
of the property, and the residents desire to maintain the rural, wooded character of
the area which would be destroyed by improvement of N.E. 28th Street to full right-of-way
width. He also advised that acquisition of adjoining property is not possible; the City
Council and Planning Commission had previously approved a 22-foot right-of-way; the
Engineering Division, which will be responsible for maintaining the roadway, has
recommended a 22-foot width; and traffic from only eight residences would be utilizing
the right-of-way. Responding to the Planning Department concern for provision of
pedestrian access, Mr. Hanis advised that King County plans includer:provision of a trail
and bicycle system within county-owned property which will provide appropriate pedestrian
access. The Examiner inquired how pedestrians will access to the.western half of N.E.
28th Street if sidewalks are not developed in the area of the proposed plat. Mr. Hanis
advised that the applicant has no objection to development of sidewalks abutting the
proposed plat and would agree to execute restrictive covenants for such installation as
well as dedication of 25 feet along the south property line upon development and extension
of N.E. 28th Street. He also referenced a recently approved Planned Unit Development,
Werstiuk PUD, west of the subject site, which had been granted approval subject to
provision of a 25-foot right-of-way with .a condition that the roadway would be widened
upon availability of an additional 25 feet of property, which Mr. Hanis indicated would
not occur under existing circumstances.
Regarding widening and development of Aberdeen Avenue N.E. , Mr. Hanis referenced minutes
of the City Council meeting of May 24, 1976, public hearing regarding Kennydale Firs
Preliminary Plat, during which the City Attorney advised that it is illegal to require
an applicant to improve a street which does not abut his property. The Examiner noted
that if review reveals the inability to require improvement of Aberdeen Avenue N.E. ,
the subject application may be premature in regard to the number of lots requested.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then requested final comments from the Planning Department staff.
Referencing earlier comments by Mr. Hanis regarding provision of access for Kennybrook
Townhouses (Werstiuk) , west of the subject site, Mr. Blaylock advised that the 25-foot .
right-of-way provides limited access for only residents of the development, and differs
in that manner from the subject plat in which residents will utilize N.E. 28th Street,
already serving existing residents. Regarding the requirement for improvement of
Aberdeen Avenue N.E. , Mr. Blaylock clarified the recommendation which states that the
roadway must be improved prior to development of the site, but' does not necessarily
relegate responsibility for improvement to the applicant.
Mr. Blaylock entered by reference the previous preliminary plat file, File No. PP-838-75,
Kennydale Firs, as Exhibit #4, and reiterated information contained in the Special Studies
Committee, Report of the Planning Commission, dated March 30, 1976, to clarify the
original rationale of the Council and Commission for reduction of density in the plat

to six lots because it was determined that any greater number of lots would produce
traffic congestion, safety hazards and limited access for emergency vehicles on a
substandard right-of-way which serves other existing residences in the area. The
Examiner requested clarification of the Planning Department recommendation for approval
of the preliminary plat but denial of an exception request necessary to proceed with
development. Mr. Blaylock indicated the departmental opinion that the exception request
for street width is not warranted, and the economic hardship incurred by the applicant
in providing the necessary street improvements does not justify approval of the
exception request.
The Examiner noted that the applicant does not own frontage along N.E. 28th Street from
the subject site to Aberdeen Avenue N.E. , and therefore, that property should be developed
prior to approval of a preliminary plat on the subject site. Mr. Blaylock indicated that
the preliminary plat is consistent with the Comprehensive Plan and other development in
the area, and could be approved subject to provision of appropriate access improvement.
Mr. Hanis advised that the access could be feasibly developed only on the condition that
the density of the plat be increased to 16 lots which would be detrimental to the area,
' in his opinion. He noted that the inability to widen and improve the roadway is not
due to economic hardship, but is due to unwillingness of the property owner to the east
to allow access. He indicated that the departmental recommendation allows an increase
from six to eight lots in the plat as a result of examination of the area and existence
of substantial differences from the original approval.
The Examiner requested final comments. Since there were none, the hearing regarding
File No. PP-430-79, E-449-79 and E-450-79 was closed by the Examiner at 10:00 a.m.
FINDINGS,. CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of an eight-lot single family preliminary plat together
with exceptions for a right-of-way of less than the required width and a cul-de-sac
of greater than the permitted length.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
and departmental recommendations in this matter, and is entered as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the; State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (G-7200, General; Single Family Residential; minimum
lot size, 7200 square feet) of Title IV, Ordinance No. 1628, Code of General
Ordinances.
7. The subject property is approximately 2.9 acres. The applicant proposes developing
an eight-lot single family subdivision on the subject property and each lot would be
approximately 15,800 square feet.
8. The City Council, in 1975, approved a preliminary plat of six lots for the subject
property after a recommendation of the Planning 'Commission. The applicant had applied
for 10-lot plat at that time. . The plat was scaled down at that time because of
various factors including natural vegetation on the site and because of the area's
location in terms of access problems (see below) . The preliminary plat has lapsed.
9. The subject property rises from west to east at slopes varying from about 12 to 16%.
The site is wooded and covered with natural vegetation. The previous owner cleared
the site of the old growth timber.
10. The subject property fronts on N.E. 28th Street which is not a through street. The
access to the property actually begins at N.E. 27th Street; then north on Aberdeen
N.E. to N.E. 28th Street. The Planning Department indicates that this access is
analogous to a cul-de-sac of 1020 feet in length since there is no outlet to the west
from N.E. 28th Street.

11. N.E. 28th Street has a 25-foot right-of-way which is not maintained in the vicinity
of the subject property.
12. Pursuant to Section 9-1108.7(H) , the right-of-way must be a minimum of 50 feet in
width, whereas the applicant proposes a 25-foot right-of-way. The applicant has
applied for an exception to this provision under Section 9-1109.
13. Because N.E. 28th Street is unopened, access to the site has been treated as if it
were a cul-de-sac, and therefore, the applicant has applied for an exception to
Section 9-1108.7 (D) , which limits the length of cul-de-sacs to 500 feet.
14. The area in which the subject property is located is designated in the Comprehensive
Plan as suitable for single family development.
15. The area surrounding the subject property is developed almost primarily with single
family homes. There are scattered residences to the south, west and east. Lot
sizes in the area vary, but many are in excess of the minimum 7200 square foot lot
size, usually two to three times that size.
16. The Planning Department recommended that the cul-de-sac exception be granted and
that the right-of-way exception be denied. They recommended that the preliminary
plat be approved, therefore, subject to the improvement of the access corridor
beginning at N.E. 27th Street.
17. The applicant indicated that property for right-of-way is unavailable. They
indicated that the improvement of the access would be too costly for a subdivision
of this size and that is why the previous plat was allowed to lapse.
18. There are a number of undeveloped parcels in the area which seem to be similarly
situated as far as access is concerned.
CONCLUSIONS:
1. The subject property is located in an area which has seen scattered and sporadic
development. The roads in the area are not developed to the required standards now
in force in the City of Renton and in some instances there are no developed roadways 1
at all.
Further development of the area without concomitant improvement of the access
corridor would burden the existing roads, create probable safet .y. problems and
endanger the public health and welfare.
2. The roadways in the area are generally substandard. There are no sidewalks for
safe pedestrian movement. The roadway itself is generally less than 25 feet wide.
The Planning Department has recommended that the preliminary plat be approved
subject to the improvement of the corridor including that portion of Aberdeen
Avenue N.E. from N.E. 27th Street to N.E. 28th Street as well as N.E. 28th Street
from Aberdeen Avenue N.E. to the subject parcel.
While such a conditional approval would permit the applicant to develop the plat
at the time the right-of-way is developed to safely accommodate the additional
traffic in the area, it is obvious that such approval would be fruitless because
of the inordinate expense involved in purchasing right-of-way and improving it to
standards.
3. The record indicates that the previous plat of six lots expired because the
improvement of the right-of-ways was too costly. At the same time, that area already
developed should not be burdened with additional traffic and safety problems which
development on this parcel will bring.
Approval of the subject proposal with the exception is unwarranted and would create
a precedent in the area. There are a number of undeveloped parcels and if each
were to be similarly treated, the stage would be set for more development in areas
which are not capable of handling such development. New subdivisions in other areas
of the city have been required to meet standards for their various access roads,
and to permit this applicant to develop the subject parcel without the required
improvements would be to grant the applicant a special privilege not afforded to
other property owners in similar situations.
The Subdivision Ordinance was amended to provide safer, wider, fully improved
right-of-ways including sidewalks, curbs and gutters.
4. Denial of the request is more appropriate than conditioning development at this
time on certain road improvements which are not immediately achievable. The further

development of the area in which the subject property is located without the
necessary road improvement is premature, would unduly burden the existing roadway,
endanger the public health, safety and welfare, and grant the applicant a special
privilege and create the precedent for other development in less than adequately
' serviced areas of the city without benefit of the provisions and protections of
the Subdivision Ordinance.
Approval of the plat and denial of the exception, as recommended by the Planning
Department in this case, is tantamount to denial, only the means are different.
If and when the access in the area is improved by whatever means or agency, the
applicant may reapply for a preliminary plat based-on the changed circumstances.
At the same time, it, is not up to the Hearing Examiner to redesign this plat without
a formal submission and outside of the hearing process.
RECOMMENDATION:
The City CoUncil should deny the preliminary plat of Eden Estates as premature and
unprecedented.

C. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #1835
of August 23, 1960. It was rezoned from P-1 to G-7200 on May
20, 1974 by Ordinance #2852. A six-lot subdivision was approved
on the site in May of 1976, File Number PP-838-75 by the Renton
City Council.
D. PHYSICAL BACKGROUND:
1 . Topography : The subject site rises from west to east at
slopes ranging from 12-16%.
2. Soils : Alderwood and Kitsap soils , very steep (AkF) . Slopes
are very steep. Drainage and permeability vary. Runoff
is rapid to very rapid, and the erosion hazard is severe to
very severe. The slippage potential is severe . These soils

are used for timber. Indianola Loamy Fine Sand (InC) . This
soil has rapid permeability, available water capacity is
moderate, runoff is slow to medium and the erosion hazard is
slight to moderate . This soil is used for timber and for
urban development .
3. Vegetation : The subject site is heavily wooded with numerous
evergreens and some deciduous intermixed.
4. Wildlife : Existing vegetation on the site provides suitable
habitat for birds and small mammals.
5. Water : No water was observed on the subject site although
the drainage basin of Honey Creek is located along the northerly
portion (October 26 , 1979) .
6. Land Use : The subject site is undeveloped with scattered
single family homes located to the south, east and west .
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family residential
in nature.
F. PUBLIC SERVICES :
1 . Water and Sewer: An 8" water main extends east-west on NE
27th Street within 200 feet to the south of the subject site
and a 12" main runs north-south on Kennewick Place NE approxi-
mately 200' to the west . A 12" sanitary sewer is also
located on NE 28th Street .
2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements.
3. Transit : Metro Transit Routes #142 and 144 operate along
NE 27th Street .
4 . Schools : Kennydale Elementary School is within 4 mile to the
west of the subject site while McKnight Junior High School
is approximately one mile to the south and Hazen Senior High
School is within 3 miles to the east .
5. Recreation : Kennydale Lions Park is located approximately
mile to the southeast and the North Highlands Park one mile
to the southeast .

I . IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT: .
1 . Natural Systems : Development of the subject site will remove
the vegetation , disturb the soils , increase storm water runoff
and have an effect on traffic and noise levels in the area.
Through proper development controls and procedures , however,
these impacts can be mitigated.

2. Population/Employment : The proposed plat of 8 lots will
increase the area population by approximately 28 persons
(3. 5 persons/home times 8 homes) .
3. Schools : The proposed subdivision will increase the school
population by approximately 45 students ( . 5 student/home times
8 homes) . These new pupils will likely be scattered throughout
the grades and not significantly impact the existing services.
4. Social : Development of the subject site will result in
increased opportunities for social interaction among the area
residents.
5. Traffic : The new plat will increase traffic in the area by
approximately 80 trips per day (10 trips/unit times 8 new
units) .
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental. Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
a declaration of non-significance has been issued for the subject
proposal.

L. PLANNING DEPARTMENT ANALYSIS :
1. The subject proposal is consistent with the Comprehensive Plan
and zoning designation of single family residential use for
the site and surrounding area.
2. In 1975 and 1976 a residential subdivision of 10 lots was
reviewed by the Planning Commission and City Council . The
final approval placed 5 conditions on the preliminary plat
and reduced the number of lots to 6. The situation has not
been modified substantially since that time .
3. Access to the site was the principal point of concern
expressed in the original review. Section 9-1108(23)A(5)
states that residential access street rights-of-way shall not
be less than 50 feet wide. The present access to the subdivision
is supplied by an existing 25' right-of-way, which extends
from Aberdeen Avenue NE to Kennewick Place NE , along the south
boundary of the subject property.
4. The applicant has not submitted a request for an exception
to this requirement .
5 . The access question is complicated by the fact
that Aberdeen Avenue NE is not improved and is
actually a cul-de-sac, with this development further
extending the cul-de-sac to 1020 feet , in conflict
with 9-1108-23A which specifies an 800 foot maximum
length.
M. DEPARTMENTAL RECOMMENDATIONS :
The public hearing cannot be completed without the exception
being heard for both access width and cul-de-sac length.
Therefore, it is recommended that the public hearing be
continued until December 4, 1979 to allow the applicant time to
submit the appropriate exception, requests.

A. SUMMARY AND PURPOSE OF REQUEST:
The applicant request preliminary plat approval of an 8-lot
single family subdivision and two exceptions to the subdivision
ordinance. The first exception request is from the 50-foot width
of residential access street rights-of-way, Section 9-1108. 23A(5) .
The applicant proposes use of the existing 25-foot wide public
right-of-way. The second exception is for the length of the
cul-de-sac (Section 9-1108-23A(7) ) which physically extends from
the intersection of Aberdeen Avenue NE and NE 27th Street a distance
of approximately 1020 feet .

C. PLANNING DEPARTMENT ANALYSIS :
1. The, subject proposal is consistent with the Comprehensive Plan
and zoning designation of single family residential use for the
site and surrounding area.
2. In 1975 and 1976 a residential subdivision of 10 lots was reviewed
by the Planning Commission and City Council . The final approval
placed 5 conditions on the preliminary plat and reduced the number of
lots to 6 (copy attached) . The situation has not been modified
substantially since that time.
EXCEPTION 1 :
3. Access to the site was the principal point of concern expressed in
the original review. Section 9.-1108(23)A(5) states that residential
access street rights-of-way shall not be less than 50 feet wide. The
present access to the subdivision is supplied by an existing 25 '
right-of-way , which extends from Aberdeen Avenue NE to Kennewick
Place NE, along the south boundary of the subject property. The
responses received from other departments vary from those received
in 1975. At that time, the Fire and Public Works Departments
specifically required that the development be limited to 6 single
family residential lots.
The Public Works Department recommends approval of the request for
exception with the construction of a 22-foot wide street from
Aberdeen Avenue NE to the subdivision site . In addition the
right-of-way for NE 28th Street should only be increased to 30 feet
in width adjacent to the subdivision . The Fire Department has
stated that if the roadway is less than 30 feet in width, that it
shall be marked exclusively for fire lanes.

The construction of a 22-foot wide street does not address
pedestrian access. In 1975 , the Planning Department recommended
that the minimum right-of-way should be 35 feet. It would appear
that granting of the exception would be detrimental to the
public welfare or injurious to other property in the vicinity.
(Section 9--1109(1) (C) . Even though the exception may appear to
be necessary to insure such property the rights and privileges
enjoyed by other properties in the vicinity and under similar
circumstances(Section 9-1109(1) (A) , those rights are potential
until adequate public services can be provided.
Applying the domino theory to land use planning, the development
of a parcel is dependent upon the development of the preceding
parcel. However, economics short circuits this system if the
developer is willing to pay the costs getting around the other
pa:cel . The hardship may be one of economics which should not be
considered as justification for an exception.
EXCEPTION 2 :
4. The proposed cul-de-sac is only 200 feet within the boundaries
of the proposed preliminary plat . However, the end of the physical
cul-de-sac that extends from the intersection of Aberdeen Avenue
NE and NE 27th Street is approximately 1020 feet . This is in conflict
with Section 9-1108-23A(7) of the Renton Municipal Code which
specifies an 800 foot maximum length.
The Public Works Department has commented that an exception is not
necessary in this case since NE 28th Street is a through street.
It is a substandard dead end street . Using this interpretation
it would appear that one cul-de-sac of legal length could be added
onto another one of legal length without end.
In fact , a cul-de-sac of this length (approximately 1 ,000 feet)
would not be detrimental to the public welfare or injurious
to other property in the vicinity, Section 9-.1109(1)C if an
adequate turn around for emergency vehicles was provided and
the street was constructed to normal street standards . Aberdeen
Avenue NE north of NE 27th Street is substandard and not fully
improved. Normal development patterns in the area have used both
dead end and permanent and temporary cul-de--sacs to provide access
as outlying parcels were developed. Allowing the exception would
only grant the property owner privileges that other adjacent
properties had already enjoyed, Section 9-1109(1)B. In addition ,
the property could not obtain access in any other manner that would
not require this exception to cul-de-sac length. 'The property to
the north of the subject parcel is owned by King County Parks
Department . The property cannot be purchased nor an easement
obtained through the parcel because of federal funds used in the
purchase of the park. This is a special physical circumstance which
would deprive the applicant of reasonable use of his property (Section
9-1109(1)A) .
D. PLANNING DEPARTMENT RECOMMENDATION:
Based on the above analysis , it is recommended that the preliminary
plat of Eden Estates , File Number PP-430-79, and Exceptions E-450-79
E-449-79 be approved subject to the following conditions :
1. Construction of NE 28th Street to a standard width to include .
sidewalks from Aberdeen Avenue NE west .
2. The improvement of Aberdeen Ave . NE north from the intersection of
Aberdeen Avenue NE and NE 27th Street.
3. The cul-de-sac shall be a minimum of 45 feet in radius with an
additional 12 feet of easement for sidewalks and landscaping.

Dear Council Members :
The Planning Commission completed its review of the Kennydale
Firs preliminary plat and request for exception to the Subdi -
vision Ordinance at its April 14 , 1976 , meeting . The plat
has the , following characteristics :
, otal Area -- 12 . 92 acres
Principal Access -- N . E . 28th St .
Existing Zone -- G-7200
Existing Use -- undeveloped wooded area
Proposed Use -- single family residential subdivision
Comprehensive Plan -- South one-half is single family
residential ; north one-half is
greenbelt .
After considerable study and deliberation , the Planning Com-
mission recommended to the City Council -approval of the Kenny-
• dale Firs preliminary plat of six lots and the granting of an
exception to the required 50 foot access road subject to the
following conditions :
1 . The provision of a 22 foot wide blacktopped
access on the existing 25 foot right-of-way
( N . E . 28th St . ) to the subject site . Adequate
. storm drainage shall be provided . Final street
improvements shall be subject to Public Works
Department approval .
2 . That portion of N . E . 28th St. along the appli -
cant ' s property shall be a minimum of 50 feet .
in width with adequate turnaround space pro-
vided . Improvements and storm drainage shall
be required subject to final approval of the
Public Works Department .

3 . Within the plat itself a 50 foot right-of-way
shall be provided with adequate width and turn-
around capabilities for fire and emergency
vehicle purposes and adequate traffic circula-
tion . Storm drainage and improvements shall
be required . All utilities and improvements
shall be subject to final approval by the
Public Works Department .
4. The existing trees and natural character of the
site shall be maintained as much as possible .
5 . Vacate N . E . 28th St . west of the turnaround
with provision for utility easements , if
requested by applicant and adjacent property
owners .
In recommending to grant the exception to the Subdivision
Ordinance , it was the Commission ' s finding that special
circumstances do exist affecting the property in question
and that the granting of the exception would not be detri -
mental to the adjacent and surrounding properties . The
proposed development is in conformance with the city ' s
Subdivision Ordinance and is in agreement with the city ' s
Comprehensive Plan.

Cedar River Trail of the citizens of Renton. Mr. Bob Karinen, 1205 Shelton Ave. S.E. ,
System and Master said it appears there will be more people along the river, believe the
Plan residents will have to go along with the plan, but they should be given
a lot of consideration as to closeness of the trail to their residences
and prime consideration should be given to those property owners as to
their right of privacy. Mayor Delaurenti assured the property owners
that the trails would be located further away from their properties so
as to assure privacy. Upon query from Councilman Stredicke about the -
use of motorcycles on the trails , Mr. Ericksen said the trail should
be for pedestrians, for hiking, fishing and things of that nature and
development next to our park sites. Further discussion followed. Mr.
Ericksen said the Planning Commission recommended approval of the •
Comprehensive Plan as it pertains to the Cedar River. MOVED BY PERRY,
SECONDED BY BRUCE, THAT THE HEARING BE CLOSED. MOTION CARRIED. MOVED
BY PERRY, SECONDED BY STREDICKE, TO ADOPT THE COMPREHENSIVE PLAN ON
THE CEDAR RIVER TRAIL SYSTEM AND REFER TO THE LEGISLATION COMMITTEE
FOR PROPER ORDINANCE. MOTION CARRIED. Councilwoman Seymour commented
that the intent of this proposal was to preserve the Cedar River as it
is a vital part of our resources in this community and anyone interested
in following the progress of this plan is welcome to attend the Community
Services Committee meetings and offer input, also, Mr. Ericksen would
be happy to do the same in the Planning Commission. Councilman Stredicke
said he had received complaints from citizens that indicated the river
• bank had been closed to pedestrian access north of the Logan Street
Bridge bya fence orsign that people would not be allowed on the river
bank. Mr. Ericksen said he was not aware of any signing. Councilman
Stredicke announced that on July 4, 1976, a raft race sponsored by the
Jaycees, from the county park area down to the lake and an innertube
race for kids of all ages from the railroad bridge down past the
library would be held.
PUBLIC HEARING ,This being the date set and proper notices having been published, posted
Kennydale Firs ; and mailed as required by law, Mayor Delaurenti opened the public hear-
Preliminary Plat ing to consider application for Preliminary Plat approval and exception
to the Subdivision Ordinance, for property located on N.E. 28th St. ,
between Jones Ave. N.E. and Aberdeen Ave. N. E. , to consist of six (6)
lots, known as Kennydale Firs. Planning Director Ericksen displayed
charts showing a ten-lot plat, and the six-lot plat proposal that was
recommended by the Planning Commission with an exception to the required
50 foot access road. The 10-lot plat was requested by the developer,
4-lot and 8-lot plats had also been considered. Recommendation of the
Planning Commission was to keep the development at a low density as the
access road was not adequate, also in order to preserve the trees on
tie site; the lot sizes vary from about 18,000 square feet to 20,000
square feet. Slides were shown of the area showing other homes in the
vicinity, the access roads and areas for future development. Mayor
Delaurenti invited audience comment. Mr. E. L. Munson, 809 Monroe Ave.
N.E, , developer for the owner, Gordon Irish, said the development would
not be feasible with only six lots, it could be done with eight lots
with the same requirements. Upon inquiry by Councilman McBeth as to
why the Planning Commission after being petitioned for a 10-lot develop-
ment, recommended a 6-lot instead of an 8-lot development, Mr. Ericksen
replied the limitation of access, the nature of the existing residential
development, and specified certain improvements to be installed. The
applicant was requesting an exception from the Subdivision Ordinance
land standards. Councilman Clymer said the cost effectiveness of these
l! lots would prohibit development of this plat at this time with six lots
! and the lots of such large size and inquired what price houses would
have to be built on this plat. Mr. Ericksen replied the general price
! of houses in that area were now $35,000 to $40,000 on up to $60,000 or
170,000, the character of the site lends itself to custom built homes
as lots are 18,000 to 20,000 square feet. Upon inquiry from Councilman
Bruce, Mr. Munson replied the houses he was planning would cost from
$58,000 to $60,000. Further discussion ensued regarding the possibility
of the city participating partially in the cost of paving the access
road; the impact of higher density building in the area; preservation
of the existing woods and green belt and impact on neighboring homes; and
the possibility of vacation of a portion of N. E. 28th St. MOVED BY

WORKS COMMITTEE. Some discussion ensued as to whether the city could
require a developer to improve a street that did not abut his property,
City Attorney Shellan advising that legally you can' t require anyone
to develop a street not adjacent to his property. Inquiries were
' made to Public Works Director Gonnason on the probable cost of such
improvement, being advised it would probably cost around $12,000. *MOTION
CARRIED.

School for appearing before the City Council 's Legislation Committee and/ dis-
playing great wisdom and knowledge involving all matters of government,
national , state and local and further ordering Mr. Putnam Little to
appear before the City Council 's Legislation Committee to undergo
thorough questioning by said Committee as to his knowledge of govern-
mental affairs to determine if .he possessed the same degree of expertise
in these subject matters as his students. MOVED BY PERRY, SECONDED BY
BRUCE, THE RESOLUTION BE READ AS PRESENTED BY THE LEGISLATION COMMITTEE.
MOTION CARRIED. After reading, IT WAS MOVED BY PERRY, SECONDED BY
STREDICKE, THE RESOLUTION BE ADOPTED AS READ. MOTION CARRIED. Council-
man Clymer commented that Mr. Little had sent many of his students to
the committee meetings and has done a fine job in teaching his students.

trees and vegetation saved; a 15' easement along Puget Drive; wood
fencing along 116th Ave. S. E. for screening; undergrounding of utilities; •
temporary widening of Puget Drive by entrance; stOrm water drainage
and walkways. Mayor Delaurenti invited audience comment. Mr. George
Cook, 14410 -160th Pl , S. E. , Woodinville, representive for Parkwood Homes,
said the developer had gone to great lengths in meeting the concerns of
the elected representatives of the Rolling Hills Homeowners Association,
gone through six consecutive designs at the request of the homeowners,
revised the name to Parkwood Homes and elimination of access to Rolling
Hills No. 3, however, it is impossible to please everyone. We have had
the best redesign that is consistent with the safety of the future resi-
dents of Parkwood. R. Kapur, 2016 Edmonds Drive S.E. , said he represented
the home owners living in the neighborhood of the exit on S.E. 20th St. ,
which is only 100 feet long, this being used as a shortcut by Cascade
and Fairwood and is already carrying a heavy load of traffic and was
very dangerous to the residents , especially children, in the area and
suggested alternate routes. R. E. Sharpe, 2001 Edmonds Drive S. E. , said
he had no objection to the development, but the situation on 116th Ave.
S. E. (Edmonds Ave. S. E. ) was critical . Dines H. Patel , 2004 Edmonds
Drive S. E. , proposed that S. E. 20th St. be vacated and if the city was
agreeable, he was willing to buy it for a playground for the area.
Ruth Williams , 1918 Edmonds Ave. S. E. , said she agreed with the closure
of S. E. 20th St. and that emergency vehicles always came in through
• Puget Drive. Earl Mann, 2409 S. E. 19th St. , said he also felt strongly

On behalf. of Mark Heacock and Peter Tiersma, applicants
on the above-referenced preliminary plat matter, an exception
is hereby requested regarding access width and cul de sac
length. It is requested that the proposed access width of
25 feet and the "cul de sac" length of 1020 feet be approved.
This request is made pursuant to Ordinance 9-1109 , and
is based upon the following circumstances :
1. There are special physical circumstances and
conditions affecting the property. Strict application of the
Ordinance would deprive the applicants of the reasonable use
and development of their land.
The area through which access must be made is almost
a park and has been treated as such by present residents. The
applicants wish to maintain the character of the area. If

they are required to develop to 50 ' wide with thru access, the
B �l character of the area will be destroyed, and strong opposition
'��1*) from present residents will result.
('W Because of the location and topography of this
site, no further development can occur which would be served
by this access. The County owns all the area behind. Therefore,
full compliance is unnecessary, and would in fact be detrimental
to the public interest. Adequate provision can be made for
access by emergency vehicles.
2. This exception is necessary to insure this property
the rights and privileges enjoyed by other properties in the
vicinity.
t The applicants wish to develop consistent with the
area. Compliance with the Ordinance will be inconsistent with
' what is there, and harmful to the character of the area.

- 3.- The exception will not be_ injurious to other property.
On the contrary, to require full compliance would be extremely
injurious to neighboring properties , and would destroy the
unique and highly desirable atmosphere of the area.

This appears to be too late for the Planning Department to
provide you with a suitable supplemental staff report . In
the case of Eden Estates, we received yesterday an applica-
tion for an exception. Therefore, we would request that
Eden Estates be continued until December 18th. No agenda
items are scheduled for December 11th. There will be one

The subject site was annexed into the City by Ordinance #1835
of August 23, 1960. It was rezoned from P-1 to G-7200 on May
20, 1974 by Ordinance #2852 . A six-lot subdivision was approved
on the site in May of 1976, File Number PP-838-75 by the Renton
City ,Council .
D. PHYSICAL BACKGROUND:
1 . Topography : The subject site rises from west to east at
slopes ranging from 12-16%.
2. Soils : Alderwood and Kitsap soils , very steep (AkF) . Slopes
are very steep . Drainage and permeability vary. Runoff
is rapid to very rapid, and the erosion hazard is severe to
very severe. The slippage potential is severe. These soils

are used for timber. Indianola Loamy Fine Sand (InC) . This
soil has rapid permeability, available water capacity is
moderate, runoff is slow to medium and the erosion hazard is
slight to moderate . This soil is used for timber and for
urban development .
3. Vegetation : The subject site is heavily wooded with numerous
evergreens and some deciduous intermixed.
4. Wildlife : Existing vegetation on the site provides suitable
habitat for birds and small mammals.
5. Water : No water was observed on the subject site although
the drainage basin of Honey. Creek is located along the northerly
portion (October 26, 1979) .
6. Land Use : The subject site is undeveloped with scattered
single family homes located to the south, east and west .
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family residential
in nature.
F. PUBLIC SERVICES : -
1 . Water and Sewer : An 8" water main extends east-west on NE
27th Street within 200 feet to the south of the subject site
and a 12" main runs north-south on Kennewick Place NE approxi-
mately 200' to the west . A 12" sanitary sewer is also
located on NE 28th Street .
2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements.
3. Transit : Metro Transit Routes #142 and 144 operate along
NE 27th Street .
4 . Schools : Kennydale Elementary School is within 4 mile to the
west of the subject site while McKnight Junior High School
is approximately one mile to the south and Hazen Senior High
School is within 3 miles to the east .
5. Recreation : Kennydale Lions Park is located approximately
* mile to the southeast and the North Highlands Park one mile
to the southeast .

1 . Natural Systems : Development of the subject site will remove
the vegetation , disturb the soils , increase storm water runoff
and have an effect on traffic and noise levels in the area.
Through proper development controls and procedures , however,
these impacts can be mitigated.

2. Population/Employment : The proposed plat of 8 lots will
increase the area population by approximately 28 persons
(3. 5 persons/home times 8 homes) .
3. Schools : The proposed subdivision will increase the school
population by approximately 45 students ( . 5 student/home times
8 homes) . These new pupils will likely be scattered throughout
the grades and not significantly impact the existing services .
4. Social : Development of the subject site will result in
increased opportunities for social interaction among the area
residents.
5. Traffic: The new plat will increase traffic in the area by
approximately 80 .trips per day (10 trips/unit times 8 new
units) .
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental. Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
a declaration of non-significance has been issued for the subject
proposal .
K. AGENCIES/DEPARTMENTS CONTACTED:

L. PLANNING DEPARTMENT ANALYSIS :
1. The subject proposal is consistent with the Comprehensive Plan
and zoning designation of single family residential use for
the site and surrounding area.
2. In 1975 and 1976 a residential subdivision of 10 lots was
reviewed by the Planning Commission and City Council . The
final approval placed 5 conditions on the preliminary plat
and reduced the number of lots to 6. The situation has not
been modified substantially since that time.
3. Access to the site was the principal point of concern
expressed in the original review. Section 9-1108(23)A(5)
states that residential access street rights-of-way shall not
be less than 50 feet wide . The present access to the subdivision
is supplied by an existing 25 ' right-of-way, which extends
from Aberdeen Avenue NE to Kennewick Place NE, along the south
boundary of the subject property.
4. The applicant has not submitted a request for an exception
to this requirement .
5 . The access question is complicated by the fact
that Aberdeen Avenue NE is not improved and is
actually a cul-de-sac, with this development further
extending the cul-de-sac to 1020 feet , in conflict
with 9-1108-23A which specifies an 800 foot maximum
length.
M. DEPARTMENTAL RECOMMENDATIONS :
The public hearing cannot be completed without the exception
being heard for both access width and cul-de-sac length.
Therefore , it is recommended that the public hearing be
continued until December 4, 1979 to allow the applicant time to
submit the appropriate exception requests.
