PROJECT DESCRIPTION: The applicant, Castle Auto Sales, LLC, is requesting a Tier 1 Temporary Use Permit
pursuant to Renton Municipal Code (RMC) 4-9-240 to operate a used car dealership at 805 SW 10th St (APN
3423049025). The used car dealership hours of operation would be Monday through Saturday from 9:00 a.m.
to 8:00 p.m. and Sundays from 10:00 a.m. to 6:00 p.m. (Exhibit 1). External vehicle sales display areas are
proposed in the existing paved areas of the lot (Exhibit 2). Five (5) parking stalls for customer and employee use
are located abutting the eastern façade of the existing building. No revisions to the site and existing 4,196-
square foot building are proposed. Additionally, no work is proposed within the right-of-way.
The project site is located in the Medium Industrial (IM) zone and Auto Mall Area B overlay. The purpose of the
Medium Industrial Zone (IM) is to provide areas for medium-intensity industrial activities involving
manufacturing, processing, assembly, and warehousing. Uses in this zone may require some outdoor storage
and may create some external emissions of noise, odor, glare, vibration, etc., but these are largely contained
on site. Compatible uses that directly serve the needs of other uses permitted within the district are also
allowed zone-wide. A used car dealership is classified as a small vehicle sales. Vicinity uses include warehousing,
auto sales, automotive repair facilities and office space. A minimum and maximum of 1.0 parking stalls per
5,000 square feet is required for small vehicle sales.
Small vehicle sales is a permitted use within the IM zone. Castle Auto Sales would be the only use on the site.

The used car dealership is contained to the existing site and is similar to the other uses within the vicinity. Staff
found no evidence that it would be materially detrimental to the public health, safety or welfare nor injurious
to property or improvements in the vicinity. The existing building is 4,196 square feet, so one (1) parking stall is
required per parking standards. Five (5) stalls for the use of customers and employees are proposed. The site
has three (3) driveway access points from SW 10th St. Two (2) will be blocked because of on-site vehicle sales
display areas. The third will act as the ingress and egress point for the site. The five (5) parking stalls can be
accessed straight from the open access point. The drive aisle in this area will remain unhindered by vehicle
display areas and will remain at the existing width of approximately 22 feet (22’) between parking stalls. Hours
of operation have been specified. Hours are similar to other car dealerships in the vicinity and Auto Mall Area
B. For example, Car Pros Kia Renton, at 200 SW Grady Way, hours of operation are 9:00 a.m. to 9:00 p.m.
Monday through Saturday and Sundays from 10:00 a.m. to 9:00 p.m. With similar hours of operation to other
car dealerships, the applicant’s use will be operating at an expected time for vehicle sales to occur. Staff has
seen no evidence that this would adversely impact surrounding uses. The use will be contained to the site. The
applicant has not proposed to install additional lights. Noise from vehicles is to be expected as the use is auto
oriented. Previous uses on the site were a state emission testing facili ty and drive through COVID-19 testing
facility. Both are auto oriented uses that would have vehicles coming and going during hours of operation. The
use is an auto oriented use located in the Auto Mall Area overlay. The use is intended to be located in this area
and with similar hours of operations as other vehicle sales uses will be operating at similar times. Staff has not
seen evidence that the use would cause nuisance factors which would adversely impact surrounding areas.
Of note, the applicant opened for business without applying for and receiving the necessary permits for a
change of use from a COVID-19 testing facility to small vehicle sales with the City of Renton. A code case
(CODE23-000149) was opened April 28, 2023. At a minimum a Land Use Permit for Environmental (SEPA) Review
and a building permit for the change of occupancy is required. To ensure that compliance is completed in a
timely manner, staff recommends as a condition of approval that the temporary use perm it date of expiration
be 90 days from the date of decision unless otherwise determined by the Current Planning Project Manager.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions::

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal

appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on July 27, 2023. Appeals
must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor
Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be
collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be
paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-
110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless
the Community & Economic Development Administrator or designee establishes a shorter time frame or an
applicant can request that a permit be valid beyond the one-year expiration, for up to five years at the time of
application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit
expiration to the Department of Community & Economic Development Administrator.

Dear Mr. Van Gordon,
As authorized agent on behalf of Castle Auto Sales LLC, I request a Temporary Use Permit for a used car
dealership located at 805 SW 10th St in the City of Renton. The subject property is located within the
Medium Industrial Zone (IM) zoning classification in Auto Mall Area B. Small vehicle sales is a permitted
use within the IM zone, per RMC 4-2-060 Zoning Use Table.
Please see below in italics, Castle Auto Sales’ response to the City of Renton’s Decision Criteria for
approval of a Temporary Use Permit:
1. The temporary use will not be materially detrimental to the public health, safety, or welfare,
nor injurious to property or improvements in the vicinity of the temporary use.
Confirmed, the temporary use will not be materially detrimental or injurious to people or property
in the surrounding area. Small vehicle sales is an established use in the Auto Mall Area; business
activities will be conducted on-site, in an orderly and safe manner.
2. Adequate parking facilities and vehicle ingress and egress are provided to serve the
temporary use and any existing uses on the site.
The property has 16 parking stalls and two access driveways for ingress and egress. This is
adequate for the needs of the business to both serve the public and its employees for all business
activities.
3. Hours of operation of the temporary use are specified, and would not adversely impact
surrounding uses.
Hours of operation, specified on Google’s search engine are as follows: Monday – Saturday 9 AM
– 8PM, Sunday 10 AM – 6PM. These hours will not adversely impact surrounding Medium
Industrial Zone uses.
4. The temporary use will not cause nuisance factors such as noise, light, or glare which
adversely impact the surrounding uses.
Confirmed, the temporary use will not cause nuisance factors. Small vehicle sales is a quiet
business which includes spoken conversation and vehicles entering and leaving the site
intermittently. Expected lighting will include interior office lighting emitted through office windows

and vehicle headlights intermittently visible during hours of operation after sundown. All noise and
light will be minimal, appropriate to the zoning use, and does not adversely impact the
surrounding uses.
5. If applicable, the applicant has obtained the required right-of-way use permit.
Not applicable, no additional right-of-way use permit is necessary for this business activity.
