CITY OF RENTON
REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Kohl Excavating, Inc. FILE NO. PP-008-80,
E-033-80
LOCATION: Property located between 80th Avenue South and S.W. 3rd Place;
north of S.W. Sunset Boulevard.
SUMMARY OF REQUEST: The applicant requests approval of a six-lot preliminary plat
together with an exception to the Subdivision Ordinance for a
pipestem lot in preparation for development as single family
detached housing.

RECOMMENDATION:

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on April 23, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on April 29, 1980 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department staff report. Steve Munson, Planning Department, reviewed the report
and entered the following exhibits into the record:

Exhibit #2: Preliminary Plat as submitted
Exhibit #3: Preliminary Plat with staff comments
Mr. Munson corrected the public hearing agenda to reflect the requested number of lots from
seven to six. The Examiner noted that the word "approval" in the fifth line of Section L.4
of the staff report should be changed to "denial." The correction was confirmed by Mr.
Munson.
The Examiner inquired if the applicant concurred in the recommendation contained in the
Planning Department report. Responding was:

The Examiner requested testimony in support or opposition to the proposal. There was no
response. He then requested general comments. Responding.was:

Mr. Texeira corrected Section F.5, Public Services, Recreation, to denote the existence of
a public park on the site of the old Earlington Elementary School, and requested that city
maps reflect the location of the park. Responding to the Examiner's inquiry regarding the
park location, Mr. Texeira advised the location on Thomas Avenue S.W. between S.W. 3rd Place
and Langston Road to the south and east of the subject site.
The Examiner requested further comments. Since there were none, the hearing regarding File
No. PP-008-80 was closed by the Examiner at 9:20 a.m.

FINDINGS, CONCLUSIONS AND RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval. of a six-lot preliminary plat together with an exception
to allow pipestem access to one of the proposed lots.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents' was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height'
requirements of Section 4-706 (R-1; Single Family Residence, minimum lot size - 7200
square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances..
8. The subject site was annexed into the city in 1975. The current zoning of R-1 was
applied in 1978. A requested reclassification to R-3 (Medium Density Multifamily)
was denied by the City Council.
9. The subject site lies on the north side of S.W. Sunset Boulevard between 80th Avenue
S. and S.W. 3rd Place just within the western limits of the city.
10. The site gently slopes up from Sunset Boulevard at about one to two percent. The
site is undeveloped and 'is covered with brush and grasses. An intermittent creek
probably flowed across the site prior to the grading and filling which has occurred
on the site.
11. The Comprehensive Plan designates the area in which the subject site is located for
both single family and low density multifamily uses.
12. The applicant has proposed developing a six-lot detached single family subdivision
on the site. The applicant has further proposed pipestem access to one of the lots,
Lot 3, and has applied for an exception pursuant to Sections 9-1108.23(F) (3)d and
9-1109.
13. North of the subject site are older single family homes. Single family uses are the
predominant land use surrounding the subject site. Sunset Boulevard located south
of the subject site is a busy arterial.
14. The proposed subdivision in the area is expected to generate approximately 15 new
residences; about three new school age children; and about 60 automobile trips per
day.
15. The impact of Sunset Boulevard with its traffic generating noise, fumes, light and
glare is expected to be significant, and therefore, the Planning Department has
recommended the construction of a landscaped berm along Sunset''Boulevard. The berm
as proposed by the Planning Department would screen out the traffic associated impacts. •
The berm would be integrated into a 20-foot wide landscape easement to cut down on'the
noise, light and glare.
16. The proposal will front along both 80th Avenue S. and 81st Avenue S. and half street
' improvements are required for both of these streets. 'S.W. Sunset Boulevard, State
Route 900, requires the installation of a sidewalk, the only improvement necessary
along this frontage.
17. The applicant indicated that there were no objections to the required improvements
along 80th S. , 81st S. , and S.W. Sunset Boulevard, nor were there objections to
providing the buffer and landscape easement.

CONCLUSIONS:
1. The proposed preliminary plat for a six-lot subdivision appears to serve the public
use and interest. The plan is consistent with the Comprehensive Plan's designation
of the area in which the subject site is located as suitable for single family uses.
2. The plat will be tied in with the existing single family development on the north
and the berm will provide relief •from the traffic impacts of S.W. Sunset Boulevard.
The combination of a berm and a 20-foot wide landscape easement will isolate the
proposed subdivision from the impacts of traffic along S.W. Sunset Boulevard and
will also work to integrate the proposed plat into the existing neighborhood.
3. There are sufficient schools, parks and utilities to serve the proposal without
burdening city services, and the proposal will add to the housing stock of the
city and will increase the tax base.
4. The proposed pipestem access to Lot 3 will not harm the general welfare nor will
it injure neighboring properties. The pipestem permits the applicant to make
reasonable use of the subject property by permitting the development of a sixth
lot. The applicant could have reasonably requested other exceptions since the
acreage would have permitted a seven-lot subdivision. Similar pipestem exceptions
have been permitted to allow access to similarly landlocked parcels. The pipestem
exception should be approved. '
RECOMMENDATION:
Exhibit #3 should be approved by the City Council subject to the following:
1. Improvement of 80th Avenue S. and 81st Avenue S. will full improvements for a half
street.
2. Installation of a sidewalk along S.W. Sunset Boulevard.
3. Creation of a 20-foot wide landscape easement along S.W. Sunset Boulevard and the
incorporation of a four-foot high berm within 'that easement.
The pipestem exception for access to Lot 3 should be approved.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before May 22, 1980. Any aggrieved person feeling that the
decision of the,Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. • This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor_ of City Hall, or same may be purchased at cost in
said department.

The subject site and the surrounding area was annexed
into the City of Renton by ordinance 2913 dated February
10, 1975. It was rezoned to the present R-1 classification

by Ordinance 3206 on April 15, 1978. An application
to rezone the property from R-1 to R-3 was filed in
September, 1979 , and denied by the Hearing Examiner.
D. PHYSICAL BACKGROUND:
1. Topography: The site has a gentle slope of approxi-
mately one to two percent from the north to the
south.
2. Soils : The site consists of Beausite gravelly
sandy loam (BeC) . Permeability is moderately rapid.
Available water capacity is low. Runoff is medium,
and the hazard of erosion is moderate . This soil
is used for timber and pasture and for urban develop-
ment .
3. Vegetation : The majority of the site consists
of light brush and grass. Minor amounts of scrub
brush and bushes are also evidenced on the site .
4. Wildlife : The existing vegetation of the site
is sufficient to provide a suitable habitat for
birds and small mammals.
5. Water : Prior to filling the site it appears that
an intermittent stream crossed from north to south
near the easterly one-third of the site . It appears
that surface drainage has been controlled as part
of the fill operation. Even though there is no
sign of a stream) or surface water on the site at
the present time , a high ground water table is
probable because there were no drainage improvements
constructed with the fill .
6. Land Use: The site is currently in an undeveloped
state . To the southwest, it abuts S.W. Sunset
Boulevard, an extremely busy arterial . The sur-
rounding area consists primarily of older single
family residences .
E. NEIGHBORHOOD CHARACTERISTICS:
The subject site is located in a marginal older single
family residence neighborhood. The development of the
site may have potential spill-over effects in helping
to upgrade the surrounding area.
F . PUI:LIC SERVICES :
1. Water and Sewer : An. existing 6-inch water main
is located, along N.W. 3rd Place near the northeast
corner of the subject site. An 8-inch sewer main
exists along S.W. Sunset Boulevard.
2. Fire Protection : Fire protection is provided by
the Renton Fire Department as per ordinance require-
ments . Any future development of the site will
be subject to the City of Renton standards.
3 . . Transit : Metro Transit Route #107 operates along
S.W. Sunset Boulevard within one block of the subject
site.
4. - Schools : The site is within one-half mile of Earling-
ton Elementary School, three-quarters of a mile
of Dimmitt Middle School, and within one mile of
Renton High Sch000l .

I . IIMPACT OF THE NATURAL OR HUMAN ENVIRONMENT :
1 .. Natural Systems : Development of the subject site
will disturb soils, remove the vegetation, increase
storm water runoff, and have an effect .. on traffic
and noise levels in the area. Through proper develop-
ment controls and procedures, however , these impacts
can be mitigated.
2 . Population/Employment : The proposed plat of 6
lots will increase the population by approximately
15 persons (3.5 persons/home x 6 homes) .
3. Schools : The proposed plat will increase the school
population by approximately 3 students ( . 5 student/home
x 6 homes ) . These new pupils are likely to be
scattered throughout the. grades .and not significantly
impact existing services .
4. Social : Increased opportunity for social interaction

L . PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the Compre-
hensive Plan and zoning designations of single
family residential use nf the site and surrounding -
area.
2. The land uses surrounding the site are basically
single family residential to the north, east, and
west . On the south side is S.W. Sunset Boulevard ,
also known as State Route #900. The subject site
is the same level as S.W. Sunset Boulevard , while
the residential land uses adjoining the site are
at higher elevations .
3. This would suggest that the site is impacted directly .
by the present traffic volumes and noise. levels
generated along S.W. Sunset Boulevard . The six
new residences should be buffered from the noise
• impacts by the creation of a berm and landscaping
barrier. The scope of the buffer is hard to calculate
to determine what would be adequate. However ,
it would appear that ;.a 20-foot wide bermed landscaping
• area along S.W. Sunset Boulevard could provide
the necessary separation to suggest that the resi-
dential plat is a portion of the established resi-
dential community instead of an area separate and
distinct from those because of the topographic
elevations.
4. The pipestem lot complies with the length requirement
of 150 feet under Section 9-1108.23 .F . 3 .d . The
actual shape and location of the proposed plat
does not allow for the normal lot configuration .
Approval of the pipestem would not deprive the
applicant, of the allowed use of the: property.
It would deprive the applicant of the maximum use
of the property. The site can.. accommodate six
lots by utilizing the pipestem. Without the pipe-
stem, the lots would be increased in area ; and
only five lots would be created . The granting
of the exception will not increase the density
of the development to a point where it would be
detrimental to the public welfare or injurious
to the adjacent properties. It appears that the
exception is the sole result of the physical
boundaries of the site.
5. The proposal will be required to include half-street
improvements on 81st Avenue South and 80th Avenue
South. In addition, a sidewalk will be required
along S .W. Sunset Boulevard. Improvements would
include the installation of necessary fire hydrants .

This is to confirm our telephone conversation of
March 27 , 1980 , regarding the Preliminary Plat of Kohl-
Christiansen Addition. During our review of the survey
as submitted by Kenneth Oyler, it was discovered that
proposed lot 3 is a "pipestem" lot. Its width of 20 '
does not meet the minimum lot width requirement of 60'
as outlined in Section 9-1108-23F(3-c) of the Subdivi-
sion Ordinance. It will be necessary, therefore, for
you to file an Exception application with the Planning
Department in order to complete your file . Please
respond with your application and letter as discussed
on the telephone by 5 : 00 p .m. , April 1, 1980.

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires •
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS' be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

you believe an explanation would be helpful to government decision makers , include your
