King Subregional David Clemens, Director of the Planning Department,
Plan Revisions presented revisions to the King Subregional Plan, which
included the definition of Secondary/Metropolitan Center
amendment and a new Business/Industrial Area designation
proposal ; also, authorization request for the City's
representative to support the proposed revisions. Council
concur.
Writ of Mandate A writ of Mandate has been filed by Washington State
Local 21R vs. City Council of County and City Employees, Local 21R
vs. City of Renton, to proceed to arbitration on the
grievance of Ronald Lyons. Refer to City Attorney.
Consent Agenda MOVED BY STREDICKE, SECOND TRIMM, ACCEPT THE CONSENT

the renewal of FAA Lease No. FA4-1486, Remote Transmittal
Receiver and Rotating Beam Ceilometer, for a period of
ten years with an option to renew for ten years. It
was MOVED BY CLYMER, SECOND ROCKHILL, TO CONCUR IN THE
RECOMMENDATION OF THE AVIATION COMMITTEE. CARRIED.
UTILITIES COMMITTEE The Utilities Committee recommended that the Council
REPORT concur in the report of the Public Works Department
regarding the Talbot Hill Pipelines, CAG 019-81 , contract
adjustment and that the Public Works Director be authorized
to execute said change order on the report recommendations.
It was MOVED BY SHANE, SECOND CLYMER, THAT THE UTILITIES

Dear Mr. Hanis:
The appeal period for the referenced application expired on April 15,
1981 , and the matter will be finalized at a future City Council meeting
upon approval by that body. However, several conditions were attached
to the plat approval which should be reflected on a revised plat map
and submitted to this office. These include dedication of the access
right-of-way, provision of a 15-foot utility easement along the west
side of Lots 10 and 11 , and prohibition of access from the plat to
N.E. 23th Street. It is our understanding that location of utility
lines are reflected on the plat (Conclusion No. 8 of the report) , and
construction plans including road configurations may be submitted to
the Engineering Division at a later date.
If you require further information regarding this matter, please do
not hesitate to contact this office. The Examiner's report will not
be submitted to the City Council for approval until receipt of the
above required data.

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Mark Hecock (Eden Estates) FILE NO: PP-079-80,

LOCATION: On N.E. 28th Street between Kennewick Place N.E. and Aberdeen
Avenue N.E.
SUMMARY OF REQUEST: The applicant requests approval of an 11-lot preliminary plat
together with variance requests for cul-de-sac length, cul-de-
sac width, and pipestem lots for Lots No. 4, 6 and 10.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on March 17, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows :
The hearing was opened on March 24, 1981 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:

Exhibit #2: Preliminary Plat Map with staff comments
Responding to staff comments contained in Section C. , History/Background, of the Planning
Department report, which state that a previous preliminary plat submitted for the subject
site had been denied by the Hearing Examiner on December 28, 1979, the Examiner noted that
the City Council had subsequently approved the application, but the plat approval has
since lapsed. The Examiner asked if the site is located within the boundaries of the
moratorium which has been established in the Highlands area because of incapacity of .
sewers. Mr. Blaylock stated that the subject site is not located within the service area
of the Sunset Lift Station. Responding to the Examiner's earlier comments , Mr. Blaylock
corrected Section L.3 of the report which refers to the denial of the previous preliminary
plat application on the site.
Mr. Blaylock advised that the abutting property owner has joined in the application and
is a co-signer of the affidavit of ownership, but property for the proposed roadway has
not yet been officially dedicated by him. He also noted that a 15-foot wide sewer easement
has been requested by the Utilities Division along the western edge of Lots 10 and 11 to
provide access to a new manhole created on N.E. 28th Street.
The Examiner requested testimony by the applicant. Responding was:

Mr. Hanis expressed concurrence in the Planning Department recommendations with the
exception of acquisition of an additional 17.5 feet for provision of roadway width on the
first 340 feet of the access to the proposal . He noted that the abutting property owner's
garage is located within the required 17.5 feet. Mr. Blaylock indicated that the garage
could be relocated. Mr. Hanis advised that the Canyon Oaks Condominium development had
been required to provide a 50-foot wide access road, but it had been possible to provide
only a 25-foot width. He stated that the current roadway provides adequate access to the

30 units contained within the Canyon Oaks development and the subject proposal will add
traffic from only 11 additional dwelling units. He suggested that future development of
the abutting property be conditioned upon provision of a full 50-foot width. The Examiner
asked why the adjoining property owner would be required to develop a full width street .
and the applicant would not. Mr. Hanis indicated that the applicant should not have the
responsibility of carrying the full burden of development of the street the full length
of 340 feet for an 11-lot plat to benefit the adjoining property owner. He also felt
that although an access that narrow may be inappropriate all the way to the end of the
road without adequate turnaround space, the applicant proposes to provide a full width
cul-de-sac with substantial turnaround area. He suggested that the full width improvement
of that additional access be deferred until development of the adjoining property. The
Examiner advised that the Board of Public Works has responsibility for review of deferral
requests. The Examiner inquired regarding access to the King County park located to the
north of the subject site. Mr. Blaylock stated that the park abuts the end of the street
and a parking lot may or may not be developed in that location depending upon the ultimate
park design and function.
The Examiner requested testimony in support or opposition to the proposal . There was no
response. He then inquired regarding the grade of the access road and the driveways in
the plat since certain topographical constraints exist on the site. Mr. Blaylock advised
that although some of the lots contain steep grades, the roadway is relatively level , but
compliance with ordinance grade provisions would be required. Mr. Hanis stated that the
road is straight and contains a level surface.
The Examiner requested final comments . Since there were none, the hearing regarding File
No. PP-079-80 was closed by the Examiner at 9:27 a.m.
FINDINGS, CONCLUSIONS 6, RECOMMENDATIONS: Having reviewed the record in this matter., the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of an 11-lot preliminary plat on approximately 2.9 acres
together with requests for variances from the maximum cul-de-sac length and width and
variances from the prohibition on pipestem lots.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee, responsible
official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject property is located on N.E. 28th Street between Kennewick Place N.E. and
Aberdeen Avenue N.E. The site has slopes ranging from 12 to 16%. The site was
cleared of vegetation but regrowth has occurred to some extent.
6. The subject site was annexed into the city in 1960 by Ordinance No. 1835.. The zoning
of G-7200 (General ; Single Family Residential ; Minimum lot size - 7,200 square feet)
was applied in 1974. A six-lot subdivision, which expired, was approved for the site
in 1976. (File No. PP-838-75) . A second preliminary plat of eight lots was approved
in early 1980 and that plat was also permitted to expire (File No. PP-430-79) .
Both of the earlier preliminary plats conditioned the platting on the provision of
adequate access to the site. The applicant was unable to secure sufficient access via
N.E. 28th Street to the south.
7. The applicant currently proposes providing access to the revised plat from the west.
The plat would contain eleven lots. The lots all contain more than the minimum
7,200 square feet required in the G-7200 zone.
8. The plat would be served by a cul-de-sac off of Kennewick Place N.E. which is
approximately 700 feet in length. Section 9-1108(23) (A) (7) provides that cul-de-sacs
may not exceed 500 feet in length.
The cul-de-sac as it crosses onto the subject site would be 50 feet in width as
required by Section 9-1108(23) (A) (7) . Prior to entering the subject site, about 340
feet of the cul-de-sa.7 is approximately 25 feet in width.

9. The applicant proposed providing access to three of the subject lots, Lots 4, 6 and
10, via pipestem driveways. The pipestem in each case would be 20 feet wide and less
than 150 feet long.
10. Variances from the provisions requiring cul-de-sacs to be no longer than 500 feet and
not less than 50 feet in width were requested by the applicant pursuant to Section
9-1109. Similarly, variances from the prohibition against pipestem access were applied
for pursuant to Sections 9-1109 and 9-1108(23) (F) (3) (d) .
11 . The creation of 11 new lots would increase the population of the city by about 38
persons (3.5 per unit) ; increase the school age population by six students (.5 per
unit) ; and increase the traffic by about 110 trips per day (10 trips per unit) .
12. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of single family residential development.
13. The Traffic Engineering Division recommended that the cul-de-sac related variances
be denied. The Planning and Public Works Departments recommended that a 42-foot wide
roadway be provided with a 32-foot curb to curb width. No information on the final
grade of the cul-de-sac or individual driveways was furnished.
14. Information which should have accompanied the plat was the square footage of the lots,
the profiles and grades of streets, the sewer and water plan, and the percentage of
land contained in the streets. This information was not submitted (Section 9-1106(2) (I ) ) .
15. The subject site does not abut upon the public right-of-way which is proposed for access.
The applicant claims that the right-of-way required by the city agencies, whether 50
feet or 42 feet, is unavailable.
16. The area in which the subject site is located is predominantly single family, especially
south of the subject site. The area south consists of single family homes built along
a series of substandard, 25-foot wide roadways. To the north is an area designated
for a proposed King County park. Canyon Oaks, a 30-unit plat/PUD located northwest
of the site also provides access via Kennewick Place N.E. and the unnamed cul-de-sac
roadway extension along the old railroad right-of-way.
17. The Utilities Department requires a 15-foot easement along the west side of Lots 10
and 11 .
18. The Planning Department recommended that no access be provided south along N.E. 28th
Street.
CONCLUSIONS:
1 . The preliminary plat proposed by the applicant appears to serve the public use and
interest. The subdivision will enable the construction of 11 new units of single
family housing to be developed, increasing the housing stock of the city and also
increasing the tax base of the city.
2. Each of the lots meets or exceeds the minimum lot area of the G-7200 zone and the
creation of a single family plat is compatible ,with the Comprehensive Plan which
designates the area as suitable for single family housing.
3. Access, which proved a major drawback in the previous plats on the subject property,
will not prove as great a concern in this case. The easterly extension off of
Kennewick Place N.E. passes only one single family residence and the 30-unit multi-
family Canyon Oaks development, whereas in the past, access was through a developed
single family neighborhood which already had traffic congestion on substandard streets.
4. The applicant will provide the standard road configuration within the plat and
sufficient turning radius for emergency vehicles. The right-of-way beyond the plat
is, once again, outside the control of the applicant as it was in the previously
approved plats. In addition, development on these lots is located in such a manner
as to require removal in order to provide a standard street width.
5. The additional 11 units proposed to be served by the road will not adversely affect
traffic situations on the road and would provide the applicant relief similar to
that granted to Canyon Oaks which was allowed to develop using this same substandard
right-of-way.
6. The pipestem lots proposed by the applicant will enable the applicant to make reasonable
use of the subject property and will not adversely affect either the public welfare or
the neighboring properties. Similar pipestem driveways have been permitted in other
areas with difficult site configurations and topographical constraints. The variance

for the pipestem lot should be granted.
7. The applicant will have to construct .roads and driveways within the project to city
standards; therefore, the grades of roadsin this parcel will have to be consistent
with city standards.
8. Plans for the utilities, road configurations and other information required by Section
9-1106(2) (I) will be required to be submitted to this office two weeks from the date
of publication of this recommendation as a condition of approval .
9. The lot is located in an area which has few through public roads. No other reasonable
access to the site, other than the proposed 700-foot cul-de-sac, is available. Access
from the south presents similar cul -de-sac problems along with congested, substandard
roadways. Such a variance will not adversely affect the public welfare nor
neighboring properties.
10. The applicant lacks frontage on the public right-of-way over which access is proposed.
Such frontage must be acquired and right-of-way leading to the frontage dedicated to
the city as a condition of approval for the subject site. The applicant indicated
that such right-of-way is available.
11 . The applicant must provide a 15-foot utility easement along the west side of Lots 10
and 11 .
12. In order to prevent traffic from the proposed subdivision from traveling through the
single family neighborhood south of N.E. 28th Street, no access should be permitted
to that street.
RECOMMENDATION:
The City Council should approve the preliminary plat together with the variances for
cul-de-sac length and width and the variance for pipestem access subject to:
1 . Dedication to the city of the right-of-way which provides access to the subject site.
2. Submission by April 15, 1981 of the information required by Section 9-1106(2) (I ) .
3. Compliance with the codes and regulations of the city which includes road grade.
4. Provision of a 15-foot utility easement along the west side of Lots 10 and 11 .
5. Prohibition of access from the plat to N.E. 28th Street appearing on the face of the
plat. -

The subject site was annexed into the City, by Ordinance
No . 1835 of August 239 1960 . It was rezoned from P-1
to G-7200 on May 20 , 1974, by Ordinance No . 2852 . A
six-lot subdivision was approved on the site in May
of 1976, File No . PP-838-75 by the Renton City Council .
This preliminary plat has elapsed. On December 28 ,
1979, the Hearing Examiner denied another request for
preliminary plat approval (8 lots) .
D. PHYSICAL BACKGROUND:
1 . Topography: The subject site rises from west to
east at slopes ranging from 12 to 16 •percent.
2 . Soils : Alderwood and Kitsap soils ; very steep
(ArF) . Slopes are very steep. Drainage and perme:.
ability vary. Runoff is rapid to very rapid, and
the erosion hazard is severe to very severe. The
slippage potential is severe. These soils are
used for timber . Indianola Loamy Fine Sand ( InC) .
This soil has rapid permeability, available water
capacity is moderate, runoff is slow to medium
and the erosion hazard is slight to moderate.
This soil is used for timber and for urban develop-
ment .
3. Vegetation : The subject site is heavily wooded
with numerous evergreens and some deciduous inter-
mixed.
4. Wildlife : Existing vegetation on the site provides
suitable habitat for birds and small mammals .
5. Water : No surface water was observed on the subject
site (February 20 , 1981 ) .
6 . Land Use : The subject site is undeveloped with
scattered single family homes located to the south,.
east and west .
E . HR<IGW®RBHOOD CHARACTERISTICS:
The surrounding properties are principally single family
residential in nature.
F . PUBLIC SERVICES:
1 . Water and Sewer : An 8" water main extends east-west
on N .E . 27th Street within 200 feet to the south
of the subject site and a 12" main runs north-south
on Kennewick Place N . E. approximately 200 feet
to the west . A 12" sanitary sewer is also located
on N .E . 28th Street .
2 . Fire Protection : Provided by the Renton Fire Depart-
ment per ordinance requirements.
3 . Transit : Metro transit Routes No . 142 and 144
operate along N.E. 27th Street .
4. Schools : Kennydale Elementary School is within
a mile to the west of the subject site while McKnight
Junior High School is approximately one mile to
the south and Hazen Senior High School is within
3 miles to the east .
5. Recreation : Kennydale Lions.. Park is located approximately

increase storm water runoff and have an effect
on trad'f4c and noise levels in, the area . Through
proper development controls and procedures, however,
these impacts can be mitigated.
2 . Population/Employment : The proposed plat of 11
lots will increase the area population by approximately
• 38 persons (3 . 5 persons/home x 11 homes ) .
3. Schools : The proposed subdivision will increase
the sch6o1 population 5 students ( . 5 student/home
x ,1 home) .
4. Social : 1 Development of the subject site. will result
in increased opportunities for social interaction
among th'ie area residents.
5. Traffic : ' The new plat will increase traffic in
the area by approximately 110 trips per day (10
trips/unit x 11 units) .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton 's Environmental Ordinance
and the State' 'Environmental Policy Act of 1971, as amended,
RCW 43-21C, a Declaration of Non-Significance was issued
for the subject proposal on February 22, 1981, by the
Environmental ,Review Committee.

L . PLANNING DEPARTMENT ANALYSIS:
1. The subject proposal is consistent with the Comprehensive
Plan and zoning designations of single family residential
use for the site and surrounding area .
2 . All of the proposed lots meet or exceed the minimum
requirements of the subdivision ordinance for size
and frontage except lots 4,6, and 10 for which
pipestem exceptions have been requested.
3. In 1975 and 1976 a residential subdivision of 10
lots was reviewed by the Planning Commission and
the City Council . The final approval placed five
conditions on the preliminary plat and reduced
the number of lots to six . That plat lapsed and
the Hearing Examiner denied a subsequent 8-lot
preliminary plat on December , 1979 .
4. Access to the site has been the primary concern
expressed in past reviews . The applicant proposes
entrance via a +700 foot long cul-de-sac . The
proposal would exceed the maximum 500 feet permitted
by Section 9-1108-23A(5) of the Subdivision Ordinance.
This cul-de-sac as shown on the proposed plat is
only 25 feet wide for the first +340 feet of length .
Section 9-1108-23A(s ) requires 50 feet . The existing
topography and generally inappropriate alternative
access suggest that there is some justification
for the exception requests (Section 4-2916A-1) .
City departments have expressed no opposition to
the width or length except for the Traffic Engineering
Division . This department has recommended denial
of the exception request for cul-de-s4c width .
The Planning and Public Works Departments have
evaluated the street width proposal and have concluded
that a minimum 32 feet curb to curb width and sidewalks
(42 feet right of way is required for safe visibility
and adequate access . )
5. The applicant must provide a deed for the D. W.
Moje property to be used for access as. per Engineering
Division comment . Storm water retention-detention
will also be required . Also, no access is to be
permitted via N . E . 28th Street .
6 . The Fire Department notes that the access road
shall consist of at least 20 feet of uhobstructed
width with a turning radius of 45 feet from the
center to the curb . The paving and fire hydrant
shall be installed and serviceable prior to any
building construction .
7. Standard hook-up fees for sewer and water ( .01/square
foot) will apply . A special area assessment of
.03/square foot for sewer will also be charged.
Utilities Engineering further indicates that waste
and sewer plans must be approved.
8 . Traffic Engineering also advises that a street
lighting plan will be required.
9 . Pipestem lots are proposed for lots 4, 6, end 10 .
Given the topography and access problems previously
addressed , these requests appear to be ,justified.

Based upon the above analysis, it is recommended that
the preliminary plat for Eden Estates , PP-079-80, be
approved along with the exception requests to allow
(1) pipestem lots No. 4, 6 and 10 and ( 2) the exception
requested for the cul-de-sac to be in excess of 500
feet . The exception requested for street width should
be approved in accordance with L-4 to assure adequate ,
access and safe visibility .

City of Renton Subdivision Ordinance.
Exception 1. regarding the width of the access road
is actually only a request for a temporary exception. The
road is to be widened as soon as the property to the south
of it develops further. At present, it is not possible to
widen it to full width because of the location of a house.
This is a situation over which the applicant has no control.
The road is sufficient to handle the amount of traffic
that will be generated on the subject property, and because of
the layout of the area, no other development can utilize the
road until it is widened.

Without this exception, it will not be possible for
the applicant to make a reasonable use of its property.
•
Exception 2. regarding the cul-de-sac length is
necessary to a reasonable use of the land. Because the property
is bounded by a county park to the North, and by property

which won' t develop for sometime, a cul-de-sac configuration
of the length proposed is the only alternative available to
the parties, while still allowing a reasonable use to be made
of the property.
Exception 3. is for pipe stem lots and the plans submitted

The use of pipe stems allows full, economical utilization of
the property.
None of the exceptions requested will be detrimental
to the public welfare or injurious to other property in the area.
