MINUTES
CALL TO ORDER Mayor Barbara Y. Shinpoch led the Pledge of Allegiance to the
flag and called the meeting of the Renton City Council to order.
ROLL CALL OF RICHARD STREDICKE, Council President; JOHN REED, EARL CLYMER,
COUNCIL ROBERT HUGHES and RANDALL ROCKHILL. Councilmen CHARLES SHANE
and THOMAS TRIMM arrived at 8:02 P.M.

CONSENT AGENDA The following items are adopted by one motion which follows the
business matters included:
Proclamation Proclamation of Mayor Shinpoch declared week of July 13-19, 1981 ,
as Renton Arts and Crafts Festival Week. Council concur.
Appointment Mayor Shinpoch appointed Robert D. Var Horne and Gary S. Ryser to the
Fire Department position of Firefighter effective July 7, 1981 , due to the vacancies
created by Robert Beatteay and Donald Goodwin on disability leave.
Retirement has been indicated. Council concur.
Block Grant Planning Department , Housing and Community Development requested
Funds appropriation of $308,060 Block Grant Funds into General Budget,
Current Fund Planning Department for 1981 projects. The projects/
programs are Housing Assistance Program ($80,000) , Senior Housing/
Pedestrian Corridor Development ($54,851 ) , Liberty Park Community
Center ($25,000) , Planning and Administration ($38,209) , Health Care
($19,500) , Youth Services Program ($15,000) , YWCA Emergency Housing
Study ($3,000) , Senior Transportation Program ($2,500) and Lake
Desire Day Lodge, administration of grant award ($70,000) . Refer to
Ways and Means Committee for ordinance and authorization for Mayor
and City Clerk to sign all necessary contracts.
Normandy Park Police Chief Hugh R. Darby requested Mayor and City Clerk to
prisoners sign agreement with City of Normandy Park to house prisoner ' s in
Renton jail facilities. Refer to Public Safety Committee.
Latecomer Richard Houghton, Acting Public Works Director, requested the
Agreements Mayor and City Clerk to sign latecomer agreements with (1 ) E. K.
Lidzbarski , water and sewer line, Earlington Gardens; and (2) PACE
Corporation, sewer extension, Union Avenue N.E. Council concur.
Damages Claim Claim for Damages was filed by Pacific Northwest Bell in the amount
Pacific N.W. of $259.53 alleging cable damage at 9211 S .E. 192nd, Kent. Refer
Bell to City Attorney and Insurance Carrier.
Six-Year Traffic Engineer Gary Norris requested that July 20, 1981 , be set
Transportation for public hearing for review and adoption of the Six-Year Transporta-
Program tion Improvement Program 1982-1987. The hearing is set and the
'matter referred to the Transportation Committee.
Dick Poitras Hearing Examiner Fred Kaufman requested the preliminary plat of
Preliminary Dick Poitras, PP-121-81 , for three-lot commercial subdivision,
Plat-121-80 south side of N.E. 4th Street , 600 feet west of Union Avenue N.E. ,
be approved as the required submission of the revised map was
received on July 2, 1981 . Council concur.
Consent MOVED BY STREDICKE, SECOND CLYMER, ACCEPT THE CONSENT AGENDA AS

CORRESPONDENCE AND CURRENT BUSINESS
Automatic Letter from Fire Chief Richard Geissler requested operation of
Mutual Aid fire suppression and/or emergency medical aid equipment outside the
Response with normal fire department boundaries of the Cities of Renton and
Tukwila Tukwila. MOVED BY CLYMER, SECOND HUGHES, THAT COUNCIL CONCUR
IN THE RECOMMENDATION OF FIRE CHIEF GEISSLER AND REFER THE MATTER
TO THE PUBLIC SAFETY COMMITTEE AND CITY ATTORNEY. CARRIED.
OLD BUSINESS
Annual 4th of Councilman Stredicke humorously pictured the annual 4th of July
July Baseball baseball game - Senior Citizens vs. City Council . Stredicke,
Game being the only Councilman present, recruited players: former
Mayor Charles Delaurenti , Mayor' s Assistant, Park Director and
Park Department personnel , two on-duty Firemen (uniforms on
field) . Stredicke announced Council won the ballgame - 7 to 5 -
first time since the senior citizen challenge began at the
'76 Bicentennial celebration. Stredicke presented the trophy
and Council Members cheered that their strategy had won the game;
Clymer recalling his '80 injuries. Mayor Shinpoch noted Administrative
Assistant Parness was temporarily disabled and unable to come to
work Monday.

Green River Councilman Shane inquired re Green River Valley P-1 Channel program
Valley P-1 and was advised of public hearing with Kent/Tukwila 7/8. Councilman
Channel Stredicke inquired re conflict of interest due to ownership of
property in the area. City Attorney Warren called attention to
the large area of Renton and Kent involved including hillsides,
noted various problems of direct ownership and direct impact.
Public Safety The Public Safety Committee recommended approval of Renton Western
Committee Days and Sidewalk Sale on July 30, 31 , and August 1 , with South Third
Report Street being closed to traffic hour at 10:30 a.m. , August 1 for
Chairman Hughes parade and bed roll and Williams Avenue South between South 2nd
and South 3rd Street being closed August 1 from 10:00 a.m. to
6:00 p.m. for street market and entertainment events. The Committee
also recommended that the parade permit fee be waived. MOVED BY
ROCKHILL, SECOND TRIMM, CONCUR IN COMMITTEE REPORT RECOMMENDATIONS.

REED, SHANE. CHAIR VOTED AYE. MOTION CARRIED. Councilman Clymer
abstained from voting, being a member of the Renton Merchants

been filed for the improvement of N.E. 4th between Union and
Monroe to create a fifth lane for left turns. May we respectfully
request that the fee for trip generation as stipulated in your
findings be submitted to the City of Renton in the form of a
bond guaranteeing the payment in the event that the local
improvement district improvements cannot be materialized.

CITY OF RENTON
REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Dick Poitras FILE NO. PP-121 -80
LOCATION: South side of N.E. 4th Street approximately 600 feet west of
Union Avenue N.E.
SUMMARY OF REQUEST: The applicant seeks to replat the existing Mastro Short Plat
(File No. Short Plat 352-79) into a three-lot commercial
subdivision.
SUMMARY OF Planning Department: Approval with conditions.
RECOMMENDATION:

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on January 6, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows :
The hearing was opened on January 13, 1981 at 9:25 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, presented the report, and
entered the following exhibits into the record:

The Examiner advised that the original large lot containing multifamily housing may be
required to be included in the preliminary plat and an opinion would be obtained from the
City Attorney.
The Examiner requested testimony by the applicant. Responding was :

Mr. Runnels submitted a site plan indicating proposed curb cuts for access to the subject
site. The map was entered as follows by the Examiner:

Mr. Runnels explained that two curb cuts, 30 feet in width, are proposed onto N.E. 4th
Street with several others located on the western boundary onto the driveway leading
from the Mastro Apartment complex. The Examiner inquired if access easements have been
obtained by the applicant from Mr. Mastro for the proposed joint access. Mr. Runnels
advised that the property had been purchased from Mr. Mastro and acquiring access easements
should be feasible. Mr. Blaylock stated that if a determination is made to include the
site of the Mastro Apartments into the replat, access easements could be reviewed and
designated on the face of the plat. The Examiner also noted that if access is desired to
the other driveway on the east leading from the Mastro complex, a variance would be required
to provide joint access because driveway curb cuts are not allowed to abut the side property
lines. He then requested review of the site plan and testimony by the Traffic Engineer.

Mr. Norris indicated initial concern regarding the access from the subject site to N.E. 4th

Street due to concurrent development on the northern side of that arterial , and impending
improvements on the roadway to include a two-way left turn lane. He noted that it is of
significant importance that the driveways are not located in conflict with each other, and
advised the department 's general policy to minimize access to promote free flowing traffic
conditions on a major arterial such as N.E. 4th Street. Mr. Norris advised that discussion
has occurred with Mr. Tsao who is also the engineer for the property to the north, and the
two driveways as proposed do not appear to create an adverse situation.
The Examiner requested further comments from the Planning Department. Mr. Blaylock
indicated concern regarding the function of the shopping center facility which contains
individual lots with common parking areas. He noted that the Planning Department had
requested site plan approval due to concerns about ultimate design and use of the site
and whether access and parking easements to each of the lots for the entire parking area
should be required.
The Examiner advised that provision of a joint driveway on common property lines to the
east and west of Lot 2 would require application for a variance. Due to several unresolved
questions regarding the application, he felt it necessary to continue the public hearing
to allow application for a variance and submittal of a site plan to determine the actual
impact of the proposal , particularly location of curb cuts and access onto driveways within
the Mastro complex. He also stated that an interpretation of the State Enabling Act would
be obtained from the City Attorney regarding the requirement for inclusion of the large lot
containing the multifamily complex in the plat request. Mr. Runnels reviewed procedures
utilized by King County for replatting through preliminary and final phases of individual
lots previously short platted. The Examiner indicated that the necessity for application
for a variance still remains as well as possible requests for exceptions from the Parking
and Loading Ordinance to ensure that each lot provides adequate parking on the primary
lot. He suggested that the Planning Department be contacted to clarify these issues prior
to the continued public hearing.
The Examiner requested further comments . Since there were none, the hearing regarding
File No. PP-121 -80 was closed by the Examiner at 9:47 a.m. and continued to February 10,
1981 at 9:00 a.m. in the Council Chambers.

CONTINUATION:
The hearing was opened on February 17, 1981 at 9:09 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Associate Planner, entered the following exhibit into the record:
Exhibit #4: Revised Site Plan

Utilizing Exhibit #4, Mr. Blaylock explained revisions to lot lines which had been skewed
in order to provide the appropriate number of parking spaces on each lot. He noted that
although the Subdivision Ordinance would have allowed three accesses to N.E. 4th Street ,
the Environmental Review Committee had limited the project to two accesses due to heavy
traffic volumes on the arterial . Mr. Blaylock advised that the Planning Department feels
that the proposal meets requirements of the Parking and Loading Ordinance for the
individual lots in providing a total of 61 parking spaces, although 66 spaces would be
required if the proposal were considered as a shopping center. In conclusion, he stated
that the preliminary plat should include the fourth lot which contains the existing
apartment complex.
The Examiner requested testimony by the applicant. Responding was:

Lt. Persson indicated support of the development of the area, but expressed concern regarding
driveway widths onto N.E. 4th Street. He advised that existing narrow driveways along the
arterial are 28 to 30 feet wide which causes drivers to stop in order to turn tightly into
parking lots resulting in traffic congestion along N.E. 4th. He felt that a width of
40 feet should be provided to allow easy access into the shopping areas.
The Examiner requested testimony in opposition to the proposal . There was no response.
He then requested final comments from the Planning Department. Mr. Blaylock indicated
that if the driveways were widened to 40 feet, the possibility exists that two parking
spaces would be eliminated which would result in the necessity of reducing building size.
Mr. Kussman stated that because landscaping strips are proposedion each side of the
driveways, uncertainty exists regarding accommodation of 40-foot widths. He indicated
willingness to review plans with the Planning Department, but he would be reluctant to
reduce square footage of the buildings because two of the three are already leased.
The Examiner requested further comments. Since there were none, the hearing regarding
File No. PP-121-80 was closed by the Examiner at 9:20 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a preliminary plat. The property proposed for division
is part of an existing short plat which was approved in June of 1979. Pursuant to
Attorney General Opinion (AGO) 1980 No. 5 and Section 9-1105(8) (B) , property which
has been short platted within five years can be further divided only by filing a final
plat. A preliminary plat must precede a final plat. This application followed.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located on the south side of N.E. 4th Street approximately
600 feet west of Union Avenue N.E. The site is essentially level although sloping
slightly upward toward the east. The site is undeveloped and is covered with scotch
broom.
8. The applicant has proposed a three lot preliminary plat on a parcel which was short
platted in 1979 (File No. Short Plat 352-79) . Under the construction of the statute
of the Attorney General 's Office for the State of Washington and further advice from
the City Attorney, the applicant must include all property which was part of the
original short plat in the current proposal (Section 9-1105(8) (B) ; RCW 58. 17.060) .
Therefore, the lot containing the Mastro Apartment complex, Lot 1 , of the Mastro
short plat must be included within this proceeding.
9. The subject property is currently zoned B-1 (Business/Commercial) and the Comprehensive
Plan designates the area in which the subject property is located as suitable for the
development of commercial and greenbelt uses .
10. As indicated, the Mastro Apartment complex is located on the southern portion of the
subject site. The Greenwood Cemetery is to the west, separated from the site by a
power transmission line. The applicant proposes developing a small shopping center
on the northern lots fronting on N.E. 4th Street. A site plan review hearing was
held and the site plan was conditionally approved on February 20, 1981 .
11 . The three southerly lots each exceed 15,000 square feet. Each of the lots fronts on
N.E. 4th Street. To minimize curb cuts, the three lots included within the small
shopping center will share two driveways pursuant to site plan approval . The lot
lines have been staggered to provide sufficient site area for buildings and required
parking for each lot.

12. Pursuant to Section 9-1106(2) (E) (2) , the applicant must provide for public streets and
ways. The Traffic Engineer has determined that a fee of $20.00 per vehicle generated
by the development of the subject site is required to help finance improvements to
the roads and streets surrounding the subject site.
13. The Environmental Review Committee conditioned the Declaration of Non-Significance on
the dedication of additional street right-of-way.
CONCLUSIONS:
1 . The subject proposal is currently incomplete and requires the submission of a plat
which includes both lots of the previous Mastro short plat, File No. Sh. P1 . 352-79.
The entire parcel must be included within the preliminary plat and the final plat.
The redivision of land that had been the subject of a short plat within the last
five years pursuant to both the State Enabling Act (RCW 58. 17.060) and the Renton
Subdivision Ordinance (Section 9-1105(8) (B) ) requires the filing of a final plat
which presupposes a preliminary plat. The plat must include all land within that
previous land division.
2. Subject to such submittal the proposal appears to serve the public use and interest.
The lots will all meet or exceed the size required by the Subdivision Ordinance and
the Zoning Code.
3. The lots and proposed uses, a small shopping center, are compatible with the
designation of the area in which the subject property is located as suitable for
commercial development.
4. The applicant has submitted plans which limit the number of curb cuts and therefore
limiting the number of locations for interference with through traffic on N.E. 4th St.
5. The subdivision and subsequent development will generate additional traffic on N.E.
4th Street, and, therefore, the applicant shall be required to pay a trip generation
fee of $20 per daily vehicle trip as determined by the city Traffic Engineering staff.
This fee will help offset the cost of needed improvement to the roads in the area
surrounding the subject site and enable the project to provide for the public streets
as required by Section 9-1106(2) (E) (2) .
Since the apartment complex has already been developed, the fees will not relate
back to that development but shall apply to the three lots proposed to comprise the
small shopping center.
RECOMMENDATION:
Subject to the submission of a plat map of the four lot preliminary plat which shall include
both lots of the Mastro short plat, File No. Sh. Pl . 352-79, and subject to the payment of
the $20.00 traffic generation fee per daily vehicle trip, the City Council should approve
the preliminary plat.

10 . The Police , Fire , and Public Works Departments have
expressed concern about the access to the subject site .
The act of subdivision of the existing lot into three
lots increases the ultimate number of curb-cuts and the
complexity of potential conflicts resulting from the
development of each lot. Even though the applicant has
suggested that the lots will be used for a 7-11 Store ,
a tire shop , and a general retail store ; the uses are
not specific enough to accurately evaluate the develop-
ment , interrelationships and impacts . Therefore , site
plan review should be required by the Hearing Examiner.

Based upon the above analysis recommend approval of the '
replat subject to satisfaction of items L-4 through L-9 .

The subject site was annexed into the City by Ordinance #2249
dated June 22 , 1966 . It was short platted into two lots through
Short Plat 352-79 with approval of the Hearing Examiner on
June 13 , 1979 .
D. PHYSICAL BACKGROUND:
1 . Topography : The site rises from west to east at slightly
over a 7% slope .
2 . Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to medium, and the erosion
hazard is moderate . This soil is used for timber, pasture ,
berries , row crops and for urban development .

3. Vegetation : Much of the natural vegetation on site has been
removed with construction of the apartment complex. Some
Cottonwood and Scotch Broom are present in the northerly
portion fronting on N . E . 4th Street .
4. Wildlife : Existing vegetation on the site provides some
habitat for birds and small mammals .
5 . Water: No surface water was observed on the subject site
(January 5 , 1981 ) .
6 . Land Use : The subject site is undeveloped with Lot #1 of
the previous short plat consisting of a 224-unit apartment
complex . To the west is a power transmission line and the
Greenwood Cemetery . A service station is located to the
north with a tavern and real estate office to the east .
E. NEIGHBORHOOD CHARACTERISTICS :
The area is in transition from scattered single family uses and
undeveloped land to multiple family and higher uses .
F. PUBLIC SERVICES :
1 . Water and Sewer: An existing 12" water main is located along
N . E . 4th Street and an 8" sanitary sewer is situated on the
same street .
2 . Fire Protection : Provided by the Renton Fire Department as
per Ordinance requirements .
3. Transit : Metro Transit Route #107 operates along Monroe
Avenue N . E . approximately one-fourth mile west of the sub-

of the N.E. 4th St. in City of Renton. The East property line
is approximately 650 feet West of the intersection of N.E. 4th
St. and Union Ave. N.E. Fourth Ave. N.E. is currently travelled
by motor vehicles.
