, for right-of-way use permits. Meetings for the permit application are held on Wednesdays before the
Board of Public Works and the applicant will be notified and is invited to attend the meeting. An
application is scheduled for the Board within two weeks tune if received prior to the Wednesday two

C. Project Description/Background:
US West proposes to locate 6 wireless communication antennas on the rooftop of the US West Renton
Central Office building. The existing building is a 3 stories, 43 feet 3 inches in top of roof slab height, with a
rooftop penthouse of 52 feet 3 inches. Each antenna is approximately 42 inches long, 5 inches wide, and 4
inches deep. The maximum height of the antennas would be 50 feet 9 inches, which is lower than the top
height of the existing penthouse.
The 6 antennas would be separated into 3 pairs and placed in separate locations on the building. One pair of
antennas would be attached to the north face of the existing penthouse and will face true north. The second
pair of antennas, facing southwest, would be attached to the west face of the existing penthouse. The third
pair, facing southeast, would be mounted on poles and attached to the east wall of the building, facing
Williams Avenue South.

screen would shield the cabinets from public view.
Three pairs of coax cables would run from the cabinets to the three pairs of antennas. In some areas, the
cables would be covered in an aluminum shroud in order to shield them from view.
Power and telephone service would be routed to the facility. Deck top traffic pads will protect the roof. The
building's drainage system would not be changed or affected by the proposal.
The facility would be unattended. US West expects maintenance visits to the site to be no more than once
per month. Therefore, no additional parking is proposed. The property currently includes six to ten parking
spaces in the alley.

FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter,the City now makes and enters the following:
G. Findings
1) CONSISTENCY WITH CONDITIONAL USE CRITERIA
Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant
information, in making a decision on a Conditional Use application. These include the following:
A. CONSISTENCY WITH THE COMPREHENSIVE PLAN,ZONING CODE&OTHER ORDINANCES:
The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan,
the Zoning Ordinance and any other plan,program, map or ordinance of the City of Renton.
(1) COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES
The proposed project is consistent with the elements and policies contained within the
Comprehensive Plan.
Policy U-1: Utility facilities and services should be consistent with the growth and development
concepts directed by the Comprehensive Plan.
The proposed Personal Communication System (PCS) system would provide wireless
communication services to all present and future users in the City and near region. Residential,
commercial and industrial users will benefit from the infrastructure necessary for a quality mobile
communication system.
Policy U-4: Strive to protect the health and safety of Renton citizens from recognized harmful
effects of utility generated environmental hazards.
There is some public concern about the potential health impacts of low level radio signals.
However, at this point the evidence of potential risk is inconclusive and the City has not
established policies or regulations regarding these facilities. The applicant contends that the
radio signals emitted from the PCS antennas do not contain any known health risk to the public
and the facility would operate at extremely low power levels, only a fraction of the power used by
television and radio broadcasters.
The FCC is responsible for regulating health hazards associated with PCS facilities and has
ruled that local jurisdictions have only limited authority to regulate facilities, according to criteria
adopted by the FCC. The proposed equipment would meet adopted State and Federal standards
regarding radiation emissions.
Policy U-100: Require that the siting and location of telecommunications facilities be
accomplished in a manner that minimizes adverse impacts on the environment and adjacent land
uses.
The facility is proposed to be located on the rooftop of the US West local telephone switching
office. The rooftop is located in the Center Downtown (CD) zone and is surrounded by
commercial uses and CD zoned properties. Antennas are frequently mounted to commercial
rooftops. The proposal will also be required to comply with airport zoning and the FAA
regulations regarding safety of aircraft and efficient use of navigable airspace by aircraft. The
proposed siting is able to meet the design demands for the PCS facility while minimizing impacts
on the environment and adjacent uses.
Policy U-101: Require that cellular communication structures and towers be sensitively sited
and designed to diminish aesthetic impacts, and be collocated on existing structures and towers
wherever possible and practical.

The proposed PCS facility is sited on the rooftop of an existing structure with a similar use, a
local telephone switching office. Four of the six antennas are proposed to be mounted to the
face of the existing penthouse. The other two antennas would be mounted on the east wall of
the building, extending above the roof parapet and highly visible facing the street frontage of
Williams avenue South. None of the antennas would exceed the maximum height of the
existing penthouse. The antennas are relatively small in size. The equipment cabinets would be
screened from public view. With the possible exception of the antennas placed on the building
wall facing Williams Avenue South, the facility has been sensitively sited and designed to
minimize aesthetic impacts.
(2) ZONING CODE
The project site is zoned Center Downtown (CD). Telecommunication facilities are considered
"medium utilities"which require approval of an Administrative Conditional Use Permit. The
maximum height of the antennas would be 50 feet 9 inches, which is lower than the top height of
the existing penthouse at 52 feet 3 inches, and well within the 95 foot maximum height allowed
in the CD zone.
SETBACKS: A pair of antennas is proposed to be mounted on the east wall of the building
facing Williams Avenue South. The existing building is located adjacent to the front property
line, and is nonconforming to the setback requirements of the zone. The code requires that
portions of a building over 40 feet in height be setback 10 feet for each story. The antennas are
not considered a building and therefore are not subject to the setback requirements. However,
the antennas proposed on the east wall of the building would project into the public right-of-way
and therefore would require approval of a right-of-way use permit by the Board of Public Works.
The code does not require screening telecommunication equipment located on roof-tops. The
applicant has proposed to screen the equipment cabinets which would be located along the east
portion of the rooftop facing Williams Avenue South. Details of the screening were not included
In the application submittal.
B. COMMUNITY NEED:
There shall be a community need for the proposed use at the proposed location. In the
determination of community need, the Hearing Examiner shall consider the following factors,
among all other relevant information:
(1) The proposed location shall not result in either the detrimental over concentration of a
particular use within the City or within the immediate area of the proposed use.
The applicant contends that the location of the proposed PCS facility is necessary to provide
coverage for uninterrupted service for customers. The proposed wireless facility would operate
in the 1.9GHz frequency range. The Federal Communications Commission (FCC) regulates the
use of this frequency range and limits the number of licenses issued to operate. This would
prevent a detrimental overconcentration of the particular use.
(2) That the proposed location is suited for the proposed use.
The proposed location is desirable for the applicant because the existing building is owned and
operated by US West. The need for a new base station site is dictated by capacity and coverage
requirements; with considerations of local topography, compatibility, and cost determining
specific site selection. The proposed use would be analogous to the current use on the site. The
proposed facility would receive and transmit wireless communication, just as the telephone
switching office inside the building routes land line communications.

The proposed use at the proposed location shall not result in substantial or undue adverse effects on
adjacent property. The following site requirements shall be required:
(1) LOT COVERAGE Lot coverage shall conform to the requirements of zone in which the
proposed use is to be located.
Not applicable to proposal.
(2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is
to be located. Additions to the structure shall not be allowed in any required yard.
A pair of antennas is proposed to be mounted on the east wall of the building facing Williams
Avenue South. The existing building is not setback from the front property line. The antennas
would project out from the building approximately 1 foot, extending into the public right-of-way.
A right-of-way use permit, approved by the Board of Public Works,would be required for these
antennas.
3) Height: Building and structure heights shall conform to the requirements of the zone in
which the proposed use is to be located. Spires, belltowers, public utility antennas or
similar structure may exceed the height requirement upon approval of a variance.
Building heights should be related to surrounding used in order to allow optimal sunlight
and ventilation, and minimal obstruction of views from adjacent structures.
The maximum height of the antennas would be 50 feet 9 inches, which is well within the 95 foot
maximum height allowed in the CD zone. The existing penthouse on top of the building has a
maximum height of 52 feet 3 inches. The applicant contends that the project would comply with
FAA Part 77 Regulations regarding the safety of aircraft and efficient use of navigable airspace
by aircraft.
D. COMPATIBILITY:
The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82)
The subject site and the surrounding area are zoned and developed with commercial uses so there is not
an issue of residential compatibility. Antennas are frequently mounted to commercial structures and the
facilities are generally compatible with commercial uses and commercial districts.
E. PARKING:
Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five
percent (75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided
underground or within the structure. (Ord. 3903, 4-22-85)
The facility would be unattended. US West expects maintenance visits to the site to be no more than once per
month. Therefore, no additional parking is proposed. The property currently includes six to ten parking spaces in
the alley. Additional spaces are rented across the street.
F. TRAFFIC:
Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be
reviewed for potential effects on, and to ensure safe movement in the surrounding area.
The PCS facility would not generate a significant amount of traffic. After construction, approximately one vehicle
per month would need to access the site for maintenance of the facility.
G. NOISE, GLARE:

Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the
location of on-site parking areas, outdoor recreational areas and refuse storage areas.
The proposed antennas would not result in noise, light, or glare impacts.
H. LANDSCAPING:
Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional
landscaping to buffer adjacent properties from potentially adverse effects of the proposed use.
Not applicable to proposal.
/. ACCESSORY USES:
Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers,
convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and
shall be subject to the provisions of the use district in which they are located.
The proposed antennas may be considered an accessory use to the primary use of the site as a central
telephone switching station. The proposed telecommunication facility is permitted in the zone as a medium
utility, subject to approval of a conditional use permit. The proposal has been considered in this report subject to
the provisions of the CD zone.
J. CONVERSION:
No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is
brought into compliance, with the provisions of this Chapter.
Not applicable to proposal.
IC PUBLIC IMPROVEMENTS:
The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements,
facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee
by the applicant of necessary public improvements, facilities, utilities, and/or services.
The proposal would not generate the need for additional public improvements beyond those which exist on the
site.
2) Request: The Applicant, The Walter Group, has requested approval for an Administrative Conditional Use
Permit for the US West Office PCS, a wireless base station.
3) Administrative Conditional Use: The applicant's administrative conditional use application complies with
the requirements for information for a conditional use. The applicant's site plan and other project drawings are
entered as Exhibits No. 2 thru 7.
4) Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation of
Center Downtown.
5) Zoning: The Conditional Use as presented, complies with the zoning requirements and development
standards of the Center Downtown (CD) zone.
6) Existing Land Use: Land uses surrounding the subject site include: North: Commercial uses - law office,

H. Conclusions
1) The subject proposal complies with the policies and codes of the City of Renton.
2) The proposal complies with the Comprehensive Plan designation of Center Downtown; and the Zoning
designation of Center Downtown.
3) The proposed facility would be located in a commercial zone and surrounded by commercial uses. The proposal
is generally compatible with commercial uses and would not adversely impact adjacent properties.
1. Decision
The Administrative Conditional Use Permit for US West Office PCS, File No. LUA-96-154,ACU, is approved
subject to the following conditions.
1. For the pair of antennas proposed to be located on the east wall of the building and projecting into the public right-
of-way,the applicant shall obtain approval of a right-of-way use permit from the Board of Public Works, prior to the
issuance of a building permit.

Land Use Action Appeals it Requests for Reconsideration
The administrative land use decision will become final if the decision is not appealed within 14 days of the date of the decision. An
appeal of the decision must be filed within the 14 day appeal period(RCW 43.21.C.075(3);WAC 197-11-680).
REQUESTS FOR RECONSIDERATION must be filed in writing on or before February 6, 1997. Any aggrieved person feeling that
the decision is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could
not be reasonably available at the prior meeting, may make a written request to the Zoning Administrator for review within fourteen
(14)days of the decision. This request shall set forth the specific errors relied upon by such appellant, and the Zoning Administrator
may, after review of the record,take further action as it deems proper. If an appeal is made to the Hearing Examiner, requests for
reconsideration will be forwarded to that office for consideration at the same time as the appeal.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 4-8-11.B,which requires that such appeals be filed
directly with the Hearing Examiner. Appeals must be made in writing before 5 p.m.on February 6, 1997. Any appeal must be
accompanied by a$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte(private one-on-one)communications may occur
concerning the land use decision. The Doctrine applies not only to the initial committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner. All communications after the decision date must be made in writing
through the Zoning Administrator. All communications are public record and this permits all interested parties to know the contents
of the communication and would allow them to openly rebut the evidence in writing. Any violation of this doctrine could result in the
invalidation of the request by the Court.

When this site was first visited by construction and A&E, the 120 degree sector
antennas where proposed to be on the penthouse. However,this location was
rejected by radiofrequency engineers because the rooftop between the
penthouse and the street would have a"shadow"effect (interference) on the
signal to the street below. Therefore,the engineers required the antennas to be
placed on the east edge of the roof to avoid signal interference.
Two locations at the east edge of the roof were considered: (1) a Microflect skid
mount which stands five feet tall could beoplaced on top of the roof, or(2)the
current location, on the side of the building,where the antennas are mounted
flush to the building and painted the same color as the building.
The current location,the second choice, was chosen primarily for aesthetic
reasons. A simple mount to the side of the building would blend the antennas
with the building better than a skid mount which could be seen from the street.
USWEST wishes to aesthetically design its system to the greatest extent
possible. There are technology limitations, network demands and cost
constraints that dictate the location and design of each facility, but USWEST
recognizes that communities prefer designs which minimize visual impact.
An additional consideration that may arise is structural support. The current
location of the antennas is structurally sound. Should USWEST be required to
move the antennas to a skid mount, a structural analysis would be required to
determine if the roof at the east edge could take the load of a weighted skid.
(This of course assumes the you would allow a weighted skid as opposed to a
skid with roof penetrations.)

PROJECT NAME:USWEST RENTON CO PCS SITE[SEA154]
OVERVIEW
USWEST proposes to locate a wireless communication facility on the rooftop of its Renton Central Office.
The Renton CO is located at 225 Williams Avenue South in the City of Renton:
PROPOSED FACILITY
USWEST will locate six wireless communication antennas on the roof. Each antenna is approximately 42
inches long, five inches wide and four inches deep. The six antennas will be separated into three pairs and
located in three locations.
One pair of antennas will be attached to the north face of the existing penthouse and will face true north.
The top of this pair of antennas will measure approximately 50 feet 9 inches above ground level. The
second pair,facing southeast,will be attached to the wall of the building. They will be mounted on poles so
that the top of the antennas are approximately 50 feet 9 inches above ground level and the bottoms are
approximately 3 feet above the roof. The third pair of antennas, facing southwest, will be attached to the
west face of the existing penthouse. The top of the antennas will be 50 feet 9 inches above ground level. At •
52 feet 3 inches above ground level,the existing penthouse is higher than the top of all the antennas.
Two equipment cabinets will be mounted on the roof and screened from public view. The equipment
cabinets are approximately 5 feet tall. A 15 foot by 1 foot 8 inch steel frame will support the two cabinets
and have room for an additional growth cabinet. A view obscuring screen will shield the cabinets from
public view.
Three pairs of coax cables will run in an orderly fashion from the cabinets to the three pairs of antennas. In
some areas, the cables will be covered in an aluminum shroud in order to shield them from view. Also, a
geostationary positioning system antenna, a few inches in length, will be conveniently attached to the
facility.
Power and telephone will be routed to the facility. The buildings drainage system will not be changed or
affected. Deck top traffic pads will run along all aspects of the facility to protect the roof.
This facility is unattended. USWEST expects the maintenance visits to the site to be no more than once a
month, as little as once a quarter. Due to the infrequent visits, no additional parking will be added.
Currently, the property includes approximately six to ten spaces in the alley. Additional spaces are rented
accross the street. There is also on street public parking available.
CURRENT USE OF SITE
The building is currently used as a local central switching office composed of switching machines, frame
equipment,battery power and diesel power generating equipment. Up to a dozen personnel work on site.

The antennas and equipment cabinets are lower than the overall height of the building. In addition, each
antenna is no wider than 5 inches. Further, the equipment cabinets will be screened from public view. The
applicant is unable to identify any structure, existing or potential, which will have its view obstructed as a
result of this project. The building is located in the downtown core. Commercial buildings surround the

APPLICANT'S JUSTIFICATION FOR CONDITIONAL USE PERMIT
REQUEST
The applicant, USWEST Communications-Wireless, requests a conditional use permit to install a wireless
communication facility, consisting primarily of panel antennas and equipment cabinets, on the roof of its
Renton Central Office(CO). This use, defined as a medium utility, will provide communication services to
the City of Renton and give the City of Renton access to the wireless network.
JUSTIFICATION FOR CONDITIONAL USE
A. COMPREHENSIVE PLAN
USWEST's proposal is compatible with the general purpose, goals, objectives and standards of the
comprehensive plan and the ordinances of the City of Renton.
Policy U-100 Require that the siting and location of telecommunications facilities be accomplished in a
manner that minimizes adverse impacts on the environment and adjacent land uses.
Topography greatly affects the siting of wireless communication facilities to a greater degree than mapped
land use designations. This facility is a medium utility. Within the City of Renton,the Comprehensive Plan
does not specify an area for medium utilities or any other utility.
The facility is located on the rooftop of USWEST's local telephone switching office. This rooftop is
located in the center downtown zone (CD) and is surrounded by CD zoned properties, all of which are
commercial uses. Antennas are frequently mounted to commercial rooftops. This site meets the height,
yards and screening requirements of the zoning ordinance. Further, it complies with FAA Part 77
regulations regarding safety of aircraft and efficient use of navigable airspace by aircraft. Therefore, the
site is able to meet the network design demands while minimizing adverse impacts on the environment and
adjacent land uses.
Policy U-101 Require that cellular communication structures and towers be sensitively sited and designed
to diminish aesthetic impacts, and be collocated on existing structures and towers wherever possible and
practical.
This facility is sited on an existing structure with a similar use. It is located on the rooftop of USWEST's
local telephone switching office. Four of the six antennas will be mounted to the face of the existing
penthouse. Two others will be mounted above one wall of the building, but will not exceed the overall
height of the building. The antennas are relatively small in size. In addition,the equipment cabinets will be
screened from public view in accordance with the City of Renton's requirements. The facility is located in
a commercial district away from residential uses. Admittedly, one of the major reasons this location was
chosen was because it is owned and operated by USWEST. But, the match is well made, because the uses
are very similar. Both provide communication services by routing telephone calls. The facility has been
sensitively sited and designed to diminish aesthetic impacts.
B.COMMUNITY NEED
The proposed location will not result in either the detrimental overconcentration of wireless services within
the City or within the immediate area of the proposed location. The proposed wireless facility will provide
wireless Personal Communication Services (PCS) using frequencies in the 1.9GHz range. The Federal
Communications Commission regulates the use of this frequency range and limits the number of licenses for
this region to provide PCS services using the 1.9GHz frequency range. Existing cellular carriers provide
similar wireless services,but they are also limited in number due to the limited number of licenses issued by
the FCC. Therefore,the number of similar utilities is regulated so as to not be detrimental to the market and
the community.
In addition, this facility will provide state of the art communication services to the surrounding community.
Wireless communication is becoming integrated into more uses. Particularly at this location,in the mids/913% r,
downtown Renton, this location will not result in a detrimental overconcentration of Comm
services. Rather,it will compliment,and in some cases supplant,other communication services.

use. The facility will receive and transmit wireless communications,just as the telephone switch inside the
building routes land line communications.

C. EFFECT ON ADJACENT PROPERTIES
This communication facility, to be located on the rooftop of USWEST's local telephone switching office at
225 Williams Avenue,will not result in substantial or undue adverse effects on adjacent properties. The six
antennas will be discreetly attached to the existing building. The equipment cabinets will be screened from
public view. The facility meets all setback and height limitations. This use is similar to the current use and
will provide communication services to the surrounding adjacent properties.
D.ADDITIONAL REVIEW CRITERIA
Lot Coverage This facility will not add additional lot coverage as it is located on the rooftop of the
existing building.
Yards As reviewed in the pre-application meeting,setbacks are not impacted by this facility as it
is located on the building itself.
Height The height limit of the CD zone is 95 feet. The top of the antennas are 50 feet 9 inches
above ground level. The existing building is 52 feet 3 inches at the top of the existing penthouse.
The site also complies with FAA Part 77 Regulations regarding the safety of aircraft and efficient
use of navigable airspace by aircraft. (See attached letter from Jim Verseman,Federal Regulatory
