HomeMy WebLinkAboutD_Fence_TUP_FINALDEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT D_Fence_TUP_FINAL PLANNING DIVISION TIER 1 TEMPORARY USE PERMIT EVALUATION FORM & DECISION DATE OF DECISION: July 18, 2023 PROJECT NUMBER: LUA23-000232, TP PROJECT NAME: Park Ave N Security Fencing TUP PROJECT MANAGER: Jill Ding, Senior Planner APPLICANT/OWNER/ CONTACT: Cailin Hunsaker, City of Renton 1055 S Grady Way, Renton, WA 98057 PROJECT LOCATION: 130 and 140 Park Ave N (Parcel Nos. 7224000190 and 7224000200) DATE OF EXPIRATION: December 31, 2025 PROJECT DESCRIPTION: The applicant is requesting a Temporary Use Permit (TUP) for the installation of a chain link security fence with razor wire at the top. The maximum height of the fence to the top of the razor wire would be eight feet (8') and the fence would be installed around the perimeter of 140 Park Ave N (Exhibit 2). The fence would be located within the front yard setback along the property line and would be in place for approximately two (2) years, until December 31, 2025. The proposed temporary fencing would be in place to facilitate the removal of the existing single-family residence and allow for the future expansion of the Parks Department maintenance shop and yard onto the project site. The project site is located within the Commercial Arterial (CA) zone. Fences located within the front yard setback are limited to a maximum height of forty-eight inches (48"). The project site is mapped within a seismic hazard area and a zone 1 wellhead protection area. Pursuant to RMC 4-9-240J, the Administrator may approve, deny, modify, or condition an application for a temporary use permit, based on consideration of the following factors: 1. The temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity of the temporary use; and 2. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use and any existing uses on the site; and 3. Hours of operation of the temporary use are specified, and would not adversely impact surrounding uses; and 4. If applicable, the applicant has obtained the required right-of-way use permit. Staff Comment: Based on the temporary nature of the fencing, staff determined that the temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity. No reduction to parking or change to ingress/egress would occur as a result of the temporary fencing installation and the fencing is not anticipated to cause nuisance factors such as noise, light, or glare. No right- of-way use permit is required as the temporary fencing would be located on private property. The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions:: *CONDITION OF APPROVAL: 1. The security fencing shall be removed on or before December 31, 2025. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on August 1, 2023. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4- 8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one-year expiration, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator.
