DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS , Robert J . Kingen and Martha C . Kingen , his wife,
are the owners of the following real property in the City of Renton ,
County of King , State of Washington , described as follows :
Lots 9 to 2.0 inclusive , block 35 , lots 7 to 17 inclusive ,
block 36 , all of block 39 and lots 12 to 24 inclusive ,
block 40 , all in Bryn Mawr Addition including portion of
alleys and streets adjacent to .
WHEREAS , the owners of said described property desire to
impose the following restrictive covenants running with the land
as to use , present and future , of the above described real prop-
erty
NOW , THEREFORE , the aforesaid owners hereby establish , grant
and impose restrictions and covenants running with the land here-
inabove described with respect to the use by the undersigned ,
their successors , heirs , and assigns , as follows :
OPEN SPACE
The existing stream and the hillside area west of the stream
shall be retained in their natural state .
SITE DEVELOPMENT PLANS
All site development plans shall be •properly submitted to
the Renton Planning Commission and reviewed and approved
by that body through the Special Permit process as per
section 4-722 ( B ) of the Renton Zoning Code .
SETBACKS
Setback and buffer areas shall be maintained to provide
suitable buffering of adjacent properties and to enhance
and maintain the natural character of the site.
INGRESS/EGRESS
All ingress and egress to and from the site shall be
limited to ,Rainier Avenue North .
DURATION
These covenants shall run with the land and expire on'
December 31 , 1999.
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of
King County by either the City of Renton or any property owners
adjoining subject property who are adversely affected by said
breach .

Schneider Mr. Tilton submitted letter from Walter C, Mioduszewski , 2428 N.E.
Rezone 6th St. , Mr. and Mrs. Hunter 3504 6th N.E. and Tilton, requesting
Continued that an engineering survey be taken of the area of N. E. 6th St. and
Olympia Ave. to determine best storm drainage system, claiming danger of
flooding without proper precautions. Mr. John Thompsont 3718 N.E. 10th
Lane, objected to overcrowding area. Mr. Roger Knott, 3805 S. 180,
representing the Gerald E. Schneider interest, noted 140 units planned -as
owner occupied with Home Owners Assoc. MOVED BY" STREDICKE, SECONDED
BY CLYMER, REFER MATTER TO THE COMMUNITY SERVICES COMMITTEE TO REPORT
BACK. Following further discussion, MOTION CARRIED.*(Motion to com-
mittee has preference). Further discussion ensued regarding the devel-
opment with individual ownerships and need for platting, and thatnumber
of proposed units discussed at Commission meeting wars 250. Community

Gentlesnen:
Photogeologic examination of the two enclosed aerial photos
indicates the following:
The area adjacent to the subject property is underlain by
varved (minutely and rytluaically bedded) silts and clays,
shown in green; overlain by 10 to 12 feet of sand and gravel
glacial outwash, shown in orange.
At the property in question, much of the overlying sand and
gravel has been removed by erosion so that two to three
feet renain. Exposed varved silts of the cut behind the
- Bryn Mawr Tavern are much more silty or very fine sandy and
• are not as clayey as varved material at other- localities in
Seattle.
The MP-shaped area, outlined in black, has some of the
physiographic characteristics of an ancient landslide, but
probably has been caused by minor sloughing and erosion of
overlying sand and gravel. Major,recent landsliding appears
not to have occurred.
•, ' At other localities in Seattle, where permeable sand and
gravel overlies impermeable varved clays, considerable land-
sliding has occurred. The fact that major sliding has not
occurred at the subject property is probably due to low clay
content in the varved silts.

R ECJOMM ENDATIONS:
Preliminary exploration for classification of excavation
material should be done along the northerly-trending ridge top.
Two test holes should be sufficient to classify materials. After
excavation is completed, additional shallow test holes should be
drilled within proposed building outlines to determine safe allow-
able soil pressures.
During excavation, minimum slopes at embankments should not
exceed 2:1, horizontal to vertical. This precaution will aid in
control of slope ravelling and will considerably raise safety
factors against landslide.

hillside area to multiple family dwellings. This change is consistent with
the comprehensive plans of the City of Renton, the increase of population
would stimulate local business community and add to other potential business
opportunities along the appropriate zoned Rainier Avenue corridor.

exists. Post construction drainage will be channelized and collected, and

We the undersigned respectfully request that the Renton City
Planning Commission deny the request for zoning change as
applied for by Mr. Robert J. Kingen. Application No. R-833-
75, to rezone from G600 to R-3, property located between
87th Ave. and Rainier Ave. No. in vicinity of vacated portion
of S. 119th St.
We believe the request should be denied for any of the follow-
ing reasons.
1. High rise buildings will definitely have adverse =ir
detramental affect on adjacent homeowners view. j
2. Soil conditions and embankments are not suited to !
adequately handle excavation, as would be required for roads
and buildings without potential threat of earth erosion and I
land slides. (Which has happened already in this area. ) i
3. Not adequately suited for proper entrance or exit {
roads; because of extremely steep. hillsides.

4. Low cost transient housing will not compliment •
existing homeowners property.
5. Existing homeowners in Bryn Mawr will not benefit t
from having low income type transients as neighbors.
6. Residential neighborhood atmosphere will be dest-_;ed.
7. New through streets for the proposed development vl1
have to be created thus causing an unwanted heavy and po Em +

West Side of Rainier Avenue (Kingen Application) -

The following comments are pertinent to the proposed development :
1 . Rainier Ave. is a major arterial with sufficient curb to curb
width in the vicinity of the proposed development to accommodate
a medial turning lane in addition to the four existing through
lanes.
2. We would recommend that access to the site be confined to
Rainier Ave. and that a street-type driveway be provided. There
should be no substantial access problems if this condition is
met.
3. The City should consider revising traffic channelization on
Rainier Ave. to provide left-turn lanes. This is a logical
revision even for today's condition and could be incorporated
with a left-turn lane for southbound access to the Renton
Airport.
4. We do not foresee that the. proposed development will have any
secondary adverse impact on the City's transportation system.
Please advise us if you require any further information on this
project.

as entire water district is served off of an 8" Seattle meter.

The Committee began with a progress report on the two subject rezone
requests;
Gerald Schneider, Application #R-802-75 , and
Robert J. Kingen, Application #R-803-75
Mr. Smith discussed the March 6 , 1975 meeting between the staff and
applicant. A letter to the applicant from the staff was presented
outlining the general discussion which took place at that meeting.
The specific items were then reviewed by the Committee:
GERALD SCHNEIDER; Rezone #R-802-75
The Committee reviewed the various items of concern listed by the
staff. The applicant was asked to comment, he indicated that he
would be agreeable to ascending his application to an R-2 rezone
request. Comments were asked of the people in the audience. Many
were concerned with the traffic, noise, and utility problems that
the eventual development of the site miyht cause. Alternative
access locations were discussed, •and it was the concensus that
access to N.E. 6th Street would not be desirable. It was further

stated that suitable access must be provided and approved by the
City at the time of actual development of the site. The Committee
asked for a report from the Traffic Engineer, Fire Department, and
Utility Department.
The allowable uses of the R-2 zone were explained. It was stated
that a public hearing would be required whether the applicant built
individual duplex units, apartments, or offices. The height limit
and other minimum requirements of the R-2 zone were explained to
the applicant and citizens present. It was the general feeling of
the Committee that granting of R-2 zoning would be mutually beneficial
to all concerned. It would give the City the development controls
that it would need to relieve the impacts on the adjacent properties ,
while allowing the applicant reasonable development of the property.
ROBERT J. KINGEN; Rezone #R-803-75
The Committee then discussed the Kingen rezone proposal. The various
concerns listed by the staff were reviewed including retention of the
hillside and natural characteristics of the site, proper setbacks,
buffering, height, design and placement of buildings , access, parking
lot design, and landscaping. The various alternatives listed in the
February 26 , 1975 staff report were then discussed. The applicant
and members of the audience were asked to make any comments they might
have regarding the proposal. The applicant was in agreement with the
concerns of the staff, except for the matter of setback from the
existing stream. It was stated by the staff .that the thirty foot
figure stated was merely an average setback and was meant for a general
guideline, although a unique design might allow more flexibility in the
setbacks. The citizens were concerned about possible traffic, noise,
visual, safety and environmental problems.
After further discussion regarding the various requirements of the R-2
and the R-3 zones, and the applicant' s intentions for development, the
Committee requested a report from the Traffic Engineer, Fire Department,
and Utilities Department. The also felt that R-3 zoning may be accept-
able with restrictive covenants pertaining to the entire development
(6 .1 acres) . These covenants would require Planning Commission approval
of the site development plans via the special permit process, retention
of the hillside west of the existing stream and the stream in their
natural state, and the confinement of access to Rainier Avenue North.
The Committee instructed the staff and applicant to meet to work out
a proposal that would be mutually agreeable to all concerned.
The meeting was then adjourned.

Noting that these rezone applications had been continued to
the March 26th public hearing , the Vice Chairman invited
staff comment .
The Planning Director reminded the Commission that both of
these items will be considered at a work session to be held
in the Council Chambers at 7 : 30 p . m. , March 19th . He stated
that the staff has met with the applicant on both items to
discuss alternatives . Representatives of the applicant have
advised that they will take these suggestions under consid-
eration and will be prepared to comment at the work meeting .
With reference to the Kingen property , Mr. Ericksen reported
that retention of the stream and hillside areas , provision
for setbacks from adjacent properties , and another look at
the soil conditions and drainage system will be included in
the report from the applicant.
Vice Chairman Scholes invited questions and comments from the
members . Mr. Scholes requested a traffic engineering report
on the Kingen site access problems . Commissioner Teegarden
expressed concern that the applicant was considering access
through another' s property. Mr. Ericksen stated that he be-
lieved the area under consideration was a platted street , and
the matter would be reviewed .
Commissioner Teegarden asked that the effects of rezoning the
the property to R-2 rather than R-3 be investigated by the
. staff. He also stated a desire to see some firm development
plans . Mr. Ericksen indicated that these matters and also
consideration of the R-3 zone with restrictive covenants
would be reviewed by the staff.
With regard to the Schneider rezone request , Commissioner
1 Scholes inquired if R-2 would be feasible . Commissioner
Teegarden also asked for a traffic engineering report con-
cerning access to the Schneider site , with particular empha-
sis on fire protection services .

The March 1975 administrative meeting of the Renton Plan-
ning Commission was called to order at 8: 03 p .m . by Vice
Chairman Scholes . The Pledge of Allegiance was led by
Commissioner Slough . The Vice Chairman requested that
Commissioner Teegarden call the roll in the absence of
Secretary Gibson .
1 • ROLL CALL was taken by Commissioner Teegarden . All
members responded present with the exception of
Gibson (business commitment) , Mola ( illness) , and
Ross (delayed due to business commitment) .

3 . OLD BUSINESS:

Way at Talbot Road .
Acting Secretary Teegarden introduced the rezone appli -
cation , noting that the item was included on the agenda
for Planning Commission reconsideration . Vice Chairman
Scholes asked for comment from the Planning Director .
Mr. Ericksen advised that Puget Power has indicated that
while they wished to appeal the Planning Commission ' s
denial of their requested rezone , they would request
that the City Council hearing on the appeal not be held
until after proposed changes in the L- 1 section of the
Zoning Ordinance have been adopted . In a meeting be-
tween the applicant and the staff , it was suggested that
the matter be referred back to the Planning Commission
for possible reconsideration . Puget Power indicated
they would also like another opportunity to review the
restrictive covenants on existing L- 1 zoning that had
been discussed earlier.

mental assessments . Mr. Ericksen advised that the
applicant may be requested to provide environmental

The Vice Chairman reminded the Commission that both

5 . NEW BUSINESS :
The Vice Chairman invited a staff report with reference to
new business items . The Planning Director pointed out the
locations of the five new applications and advised that a
brief review would be made by Assistant Planner Smith . Mr .
Ericksen suggested a field trip , noting a very full agenda
for March 26th , which would require extra preparation .

G-7200 to R-2 ; property located on Union Ave . N . E . '
between N . E . 15th St . and Glencoe Subdivision .
Assistant Planner Smith noted the 1 . 27 acre site , pre-
sently zoned G-7200 , on the vicinity map . He advised
that the Comprehensive Land Use Plan designated the
area for medium density multiple family development.
Proposed use is for a duplex-type dwelling . In response
to Commissioner Teegarden ' s inquiry regarding future
plans for subdivision , it was noted that construction
of the duplex dwelling is planned for the near future
in addition to the existing single-family residence
and that an R-2 designation would allow construction
of a duplex without Planning Commission review. Ad-
ditional units would require subdivision .
B, WILLIAM MONTGOMERY , EXECUTOR ( Estate of Beulah
Edwards deceased) ; Appl . No . R-806-75 ; rezone from
B-P to R-3; property located on Williams Avenue
So . between So . 4th St. and So . 5th St.
The site on the northeast corner of Williams Ave. So .
and So . 5th St. , presently zoned B-P and proposed for
R-3 , was pointed out on the vicinity map . The .26
acre site is presently undeveloped ; the Comprehensive
Land Use Plan indicates high density multiple family
usage . The Assistant Planner noted an existing home
to the north on a lot already zoned R-3 . Property
to the west is zoned L- I .
SPECIAL PERMIT:

SP-808-75,; special permit to construct a medical
clinic in an R-3 zone ; property located approxi -

Noting that the proposal is for a special permit to
construct a medical clinic in an R-3 zone , Mr. Smith
pointed out the .72 acre site on the vicinity map .

He reported that there are single-family residences on the
site which are planned for removal . He cited R-3 zoning
to the east and north of the property and noted a convales-
cent center to the east of the site . A blow-up of the site
plan was displayed and described . The setback from Spring-
brook is planned to be approximately 70 feet ; landscaping
and parking plans were reviewed generally . Elevation draw-
ings were viewed : An exposed aggregate structure , approx-
maTely 23 feet in height is planned .
It was noted by the Planning Director that access and right-
of-way requirements would be reviewed by the staff . Commis-
sioner Teegarden , referring to a recent news article rela-
tive to a planned sports complex south of the property in
King County , requested that the staff attempt to obtain
information concerning the proposal so that its relation-
ship to the Kay/Hubbard application can be determined .
SITE APPROVAL:

site plan approval for office addition to a warehouse
in an L-1 zone ; property located at 1120 S .W . 16th St .
The 1 . 48 acre site just north of the proposed Group Health
Clinic complex and east of Springbrook Creek was noted on
the vicinity map . The proposal is for construction of an
office addition to the front of the existing warehouse .
Mr. Smith stated that the landscaping plan will remain the
same , but additional parking will be required . The add-
ition was described as a brick-faced structure and the
landscaping in front of the building . Mr. Smith advised
that the applicants are in the process of vacating Pacific
Ave . S . W. The proposal will be reviewed in view of re-
strictive . covenants on the property . It was noted in
discussion that followed that the proposed P- 1 channel ,
which will be located on property directly to the west , will
have no effect on planned parking .

facility and rehabilitation of an existing hangar facility
and office facility . The proposal will be under Shoreline
Management jurisdiction due to its proximity to the Cedar
River . Site development plans were viewed and described .
Mr. Smith advised that landscaping is planned for the front
of the building and the area between the buildings and areas
near the hangar . Responding to Commissioner Scholes , the
Assistant Planner indicated that the setback from the peri -
meter road is approximately 10 feet.

Dear Mr. Schneider:
This is to acknowledge our meeting of March 6 , 1975 ,
at which we discussed the abovementioned proposals. Those
present were Gordon 'Y. Ericksen, Planning Director; Michael
Smith, Assistant Planner; Gerald Schneider, Pura Development
Corporation; Ernest (Coleman and Roger Rnotts , Pasco Realty.
We initially discussed the rezone proposal #R-802-75
located on Monroe Avenue N.E. and south of N.E. 6th Street.
We outlined the various alternatives stipulated in the staff
report, and it was the general concensus that R-2 zoning
would serve your purposes adequately. A Special Permit from
the Planning Commission would, however, be required.
We then discussed the Kingen proposal, #R-803-75 ,
located between 87th Avenue South and Rainier Avenue North
in the vicinity of the vacated portion of South 119th Street.
We indicated that R-,3 zoning may be possible, given certain
developmental standards in terms of the total site develop- _
ment plan. It was agreed that we should list some of our
concerns regarding the proposal.
These include:
•
1. Retention of the stream and hillside area in its
natural state. The area from a point 30 feet
east of the existing stream to the existing

western property line should be free from any
structures , parking lots , or roads.
2 . Maintenance of setback areas suitable for
buffering adjacent properties .
3 . Development plan review by the Planning Commission.
4 . Submittal of a total site landscaping plan com-
prised of a combination of trees, shrubs , ground-
cover, and ,retention of natural areas . This plan
should sufficiently provide for screening and
buffering, separating large expanses of blacktop,
, softening the impacts of structures, and enhances
its compatibility with the site .
5 . Building and. parking lot, placements should be
diversified so that large parking lots or rows of
units are not created. These areas should also be
located' so !as to retain the natural characteristics
of the site as much as possible .
6. Building height should also vary to reduce impacts
so as not to obstruct view of adjacent property
owners.
7. Ingress and egress to be limited to Rainier Avenue
North.
8 . The drainage system should be designed to connect
to the City, storm system and not impact the site
or adjacent: properties.
We hope that, this has been helpful to you and your
architect in determining our concern with the proper develop-
ment of both the subject properties. Hopefully these are
considerations that will be acceptable both to you and the
community. •

In reply to Commissioner Rivily , Mr. Newell stated
that the residences planned are permanent and will
be offered for sale .
Discussion ensued with regard to the items considered
by the Commission as part of their decision making
process : input from from the people , appropriateness
of the complex plan at this time , appropriateness of
the requested zoning , etc . Mr. Ericksen advised that
any alternative to the R-3 zoning would require con-
currence of the applicant.
Mr. Wonio inquired further regarding fire , police
and noise protection .
Mr . Pappas stated that he felt two-story construction
was inappropriate for the property .
Mr. Ericksen responded that there would be no change
in police and fire protection services and that buf-
fering of adjoining neighborhoods could be obtained
through design control .
In response to Commissioner Gibson ' s question , Mr.
Ericksen indicated that providing fire protection
could present a problem with respect to access . An
alternate means of access could have some impact on
some adjacent properties . It was then

Secretary Gibson introduced the rezone request to the
Commission . The Planning Director described conditions
in the vicinity of the 6 . 1 acre site located off Rainier
Ave . No . westerly of the Renton Municipal Airport . He
noted that the property , presently zoned G-6000 , is
situated in an area contiguous with the Renton/ King
County boundary lines on the south , west and north .
He delineated topographical aspects of the site , which
includes a very steep ravine . It was noted that the

property has been subject to mud slides . Slides and 'aerial
photographs of the area were viewed . Mr. Ericksen stated
that the Comprehensive Land Use Plan designates the area
4 for medium density multiple family use . Property directly
to the east of the site is zoned B- 1 and is planned to be
included in the proposed development . Single family devel -
opment in the vicinity , above the property , was noted.
Assistant Planner Smith gave a brief review of a meeting
with the applicant and staff, in which it was indicated
that R-3 zoning was being sought to allow three-story
structures on the property. It is proposed that 120 to
150 units will be constructed .
The Chairman invited comment from the applicant . Ernest
Coleman , 1100 N . 36th , Renton , describing the site as
difficult to develop , due to its topography , stated that
it allows for only a limited number of units . Mr. Coleman
said that the applicant does not consider opening up Rain-
ier Ave . No . to commercial use and noted that he cannot
utilize any portion of the site lying across the creek
that flows through it . Parking is planned on the street
level , and it is proposed to leave the site in its natural
state as much as possible . A site plan was offered for
Planning Commission review.
Roger Newell , 21062 N . E . 65th , Seattle , 98115 , architect
on the project , described the site plan , indicating that
the area on the hillside on the west side of the creek
would be difficult to develop and , therefore , is planned
as natural area . He stated that their proposal is in
agreement with the Comprehensive Land Use Plan , noting
that the plan for construction of 132 units is below
allowable standards . In response to a request from Com-
missioner. Teegarden , Mr . Newell outlined plans for access
to the site , which is proposed from Rainier Ave No . on
the north , winding up to the back of the property . It
was noted that only one entrance and exit is planned .
Mr. Newell indicated that the matter of access was still
under study . In response to Commissioner Scholes with
regard to soil samples , Mr. Newell indicated that it is
their intent to obtain a soils study .
The Chairman invited comment from the audience .
Dr. C. P . Ambrose , 11914 87th So . , Seattle , noting that he
is located adjacent to the site , inquired regarding access
to the property. Mr . Newell indicated access would be
from the north portion of the property , via Rainier Ave .
No . Dr. Ambrose cited noise emanating from the Airport and
clay on the sidewalk on Rainier Ave . No . He also questioned
plans for the creek .
Albert Abbott , 8925 So . 121st , Renton , asked if the B- 1
portion of the plan was included in the rezoning . He was
advised by the Planning Director that only the G6000 area
was being considered , inasmuch as the applicant already
has the right to develop the B- 1 portion . Mr. Abbott
inquired further with regard to height restrictions in
the R-3 zone and was informed that they include three
story or 40 foot structures . He stated his concern that
establishing R-3 zoning would set a precedent for granting
additional R-3 zoning in the vicinity. To this Mr. Erick-
sen noted that the site is on the city limits , with no
further City jurisdictions . Noting that he lived on a
deadend street , Mr. Abbott inquired , if there are any plans

to put in a road from 119th down to Rainier Ave . No .
and was advised that there were not . In response to
Mr. Abbott ' s concern with regard to liability , should
slides occur , the Planning Director indicated that
this aspect would be reviewed .
Robert Stoutenberg , 8904 S . 121st , Renton , noting
that he moved into the area to get away from apart-
ments in Seattle and into a single family residential
neighborhood , stated that it is his opinion that the
City has enough apartments and no. more are needed .
Jerry Pfieffer , 8907 S . 121st , Renton , indicated his
concern about the number of people that would be mov-
ing into the area . He stated he would expect another
entrance to be located at 120th and felt it would re-
sult in an increase in traffic and hazard to school
children . He noted his concern with regard to soil
conditions and erosion .
John Toman , 12006 87th Ave . So . , Seattle , also noted
erosion and water run-off problems in the area .
Mr. Abbott asked , of their view would be obstructed
by the proposed construction .
Mr . Coleman stated that it was not his intention to
sell property that has faults in it and stated that
the problem would be reviewed. With regard to access ,
Mr. Coleman noted that he is currently negotiating for
an additional entry to the site .
Mr. Newell , noting public concern relative to the creek
and ravine , stated that those areas will remain in their
natural state . He said it is their intention to buffer
the development as much as possible from the houses on
the hillside.
Chairman Ross called for comment from the Commission .
Commissioner Rivily inquired as to how far above the
property on the south the apartments would project .
Mr. Ericksen estimated that the apartments would be
approximately five feet higher than the level of the
yards above the site . He noted that it was a differ-
ent situation on the. west side , however.
Following further discussion , it was

Commissioner Teegarden , noting that the plans were
in agreement with R-2 zoning requirements , suggested
that the application be revised and approved for an
R-2 zone designation .
Mr. Newell objected , indicating that both pieces of
property (the B- 1 and G-6000 ) should be considered
together.

Mr. Ericksen reviewed the requirements of R-2 zoning, R-3
zoning with possible restrictive covenants and the need
for an environmental assessment for development of the
site . Further discussion ensued.

Commissioner Mola , Chairman of the Environmental Develop-
ment Committee , stated that the subject would be dis-
cussed at their Committee meeting of March 19 at 7 : 30 p . m.
in the Council Chambers .
At the request of Mr. Coleman , the Planning Director re-
viewed the expected time schedule for possible approval
of the request by the City Council . Mr. Ericksen also
advised that on both sites the developer should anticipate
preparing environmental impact assessments because of the
environmental factors of the sites .
John Harer, Bryn Mawr Towers Apartments and Trailer Park ,
stated his support for the R-3 request in view of the
difficulty in developing the property . He also indicated
that it is his belief that more apartments are necessary
in Renton and that the apartments will not block anyone ' s
view.
WAIVER OF OFF-SITE IMPROVEMENTS

The application was introduced to the Planning Commis-
sion by Secretary Gibson . The Planning Director pointed
out the location on Grant Ave . So . at So . 9th St . on
Renton Hill . The intent of the property owner is to
divide the parcel into two sites , which would provide
for one parcel with an existing structure and one vacant
area , consisting of approximately 10 ,000 square feet
each . The request is in agreement with the zoning of
the area .,
The Chairman invited comment from the applicant .
M. Lynn Thrasher, 2309 Dayton Ave . N. E . , Renton , stated
that a waiver of sidewalks , curbs and gutters was being
requested , because there are no similar improvements
in the neighborhood .

Joan Lankford and I ' met today with Gerald Schneider of
Dura Development Corporation andRoger Knotts of Pasco
Realty regarding the subject rezone request .
We initially asked , lif they could explain their plans
for the site in more detail to us . He did so , explaining
that the R-3 zoningwas needed to allow 3-story apartment
structures in two general areas of the site . These two
areas are the plateau above Rainier Ave . No . in the
southeastern portion of the site and the east side of
the stream along the hillside overlooking the stream and
the natural hillside above it. They indicated they would
be retaining all portions of the site east of the stream
in their natural state. This also included the stream
itself.
They further explained that access would be from Rainier
Ave . No . just north: of the existing tavern , with parking
for the projected 120- 150 units to be located on the
ridge top between the two building location areas . They
also explained that` all drainage would be handled in such
a manner as not to impact the stream. Mr. Schneider indi -
cated that he would; present some site plans of his pro-
posal at the February 26 , 1975 , Planning Commission meeting .

We then explained the various alternatives available to
the Commission in terms of the proposed rezone . These
included use of restrictive covenants to attain certain
developmental controls , the use of R-2 zoning , possible
continuation until the P . U . D . Ordinance is in effect ,
or the denial of the proposal .
We also indicated that we had already received some
initial public response to the proposal and that com-
bined with their presentation of the proposal it would
be a very significant element of the Planning Commission
review process .

Committee ' s suggestions and indicated that the matter would
be reviewed further by the staff. An additional field trip
by the Commission to the site was proposed. The item will

hensive Land Use Plan indicates graduations of use from
commercial along N. E. 4th to multi -family, medium density
and single family residential use at the northerly portion
of the site. He reviewed development in the area and single
family residential uses, abutting the property. The appli -
cant proposes a condominium townhouse complex and is request-
ing. R-3 zoning for the entire site. It was suggested by
Commissioner Gibson that an R-2 buffer zone be considered
along N. E. 6th .

indicated an interest in the potential number of units
that could be developed.

responded present with the exception of Rivily ( illness ) ;
