Dear Mr . Johnson :
The above landscape project has been inspected and meets the
requirements as specified in the special permit and approved
landscape plan , with the understanding that the remaining
hydro-seeding will be completed within ten days .
It is important that a regular watering schedule be established
to insure healthy plant material during this first growing sea-
son . The first two years are the critical maintenance times
in establishing mature root growth and vegetative cover .
The city appreciates your cooperation in providing an apart-
• ment house complex which is an asset to the community . Please
contact this department if we can be of further assistance .

Dear Tom :
As we discussed in our phone conversation of September 19 ,
1975 , the City is concerned about the continued logging of
trees by outsiders on the Green Tree site . As indicated
to you , it was suggested to the construction foreman approxi -
mately two weeks ago that he post the area with signs pro-
hibiting unauthorized trespassing and tree cutting . This
has not been accomplished to date . Friday this Department
prepared and delivered such signs to the foreman for posting
around the site . It is hoped that this will help to deter
any further cutting of trees except that which is absolutely
necessary for site development .
Controlling the amount of tree cutting and vegetation removal
will serve to reduce the amount of additional landscape
material needed as prescribed by the Special Permit approval ,
landscape plan , and restrictive covenants .

On September 10 , 1975 , I walked through the CHG site with the
foreman for the purpose of discussing with him the following :
A. As regards the proximity of one tree near the south-
east entrance adjacent to the proposed roadway , it was
suggested he did have room to maneuver the road loca- "
tion closer to the tree without much fear of damage .
It was also suggested since a cutting condition was
necessary around the tree that a rock retainer be
built in order to protect the tree .
•
B . Two other trees in question would be left until a
determination could be made as to whether parking
could be shifted in order to save them.
C . CHG is concerned about neighboring property owners
logging firewood in the greenbelt area to the north
and west of the site .
On September 12 , 1975 , in phone conversation with the CHG fore-
man it was decided that if parking could be altered to pick up
another stall somewhere else , one tree in question could be.
saved . The other tree seems to fall in the roadway between
two parking areas so may have to be eliminated in order to
give the required 24 feet of maneuvering space for automobiles .
As regards the greenbelt area , the Police Department has been
notified of the problem and it has been suggested to CHG that
they post signs immediately prohibiting logging on private
property.

AN ORDINANCE OF THE CITY OF RENTON, 'WASHINGTON ,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM GENERAL
CLASSIFICATION DISTRICT (G 7200 ) TO RESIDENTIAL
DISTRICT (R-2 )
WHEREAS under Chapter VII, Title IV (Building Regulations)+,
of Ordinance No . 1628 known as the "Code of General Ordinancesof
the City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has has
heretofore been zoned as General Classification District (G .7200) ;and

WHEREAS a proper petition for change of zone classificatidn of
said property has been filed withthe City Clerk on or about March 31 ,
1975 , which petition was duly referred to the Planning Commission
for investigation, study and public hearing, and a public hearing.

Recreation Funds youth between 6 and 14 years of age living in Renton Housing authority
facilities and the Royal Hills apartments. The letter noted the Park
Department has requested. $500 to cover costs; the 1974 program received
a $3,000 grant to provide transportation and admission to the Municipal
swimming pool . The letter noted the program will operate through the

The Planning Department has received the items necessary to
fulfill the conditions • of the Special Permit approval and
approved them subject to the corrections noted in red on the
revised plans .
The items reviewed and approved or approved with conditions
include :
1 . A detailed landscape plan for the entire site includ-
ing existing vegetation to be retained .
2 . A revised site plan corresponding to the setbacks
stated in the restrictive covenants and depicting
certain changes in building and parking area orien-
' tation .
3 . Revised plans showing a fence along the north pro-
perty line and the north 550 ' of the west property
line .
4 . Posting of performance bond in the amount of 150%
of the landscaping installation and a three-year
maintenance period . (The maintenance bond will be
posted prior to occupancy) .
We therefore recommended that the restrictive covenants be
filed and that the Council give final approval of rezone re-
quest #R-811-75 by C . H . G . International .

May Creek Letter from Public Works Director Gonnason presented late-comers agreement
Interceptor between the City and Metro for joint usage of the May Creek Interceptor,
Phase I Phase I , being similar to other joint-use agreements with Metro. The
L.C.A.G. letter recommended Council approval and authorization for the Mayor and
Clerk to execute said agreement, noting advantage to City by relief of
the necessity of constructing duplicating facilities, will be maintained
by Metro and allows Metro to recover a portion of their investment. MOVED
BY DELAURENTI, SECONDED BY SCHELLERT, COUNCIL CONCUR IN RECOMMENDATION

height limits and density in units per acre. The letter explained C.H.G.
International , Inc. has also applied for a special permit to construct a
low density apartment complex on this property, which has been approved
by the Planning Commission subject to the applicant submitting a revised
plot plan in accordance with conditions in agreement with the Commission,
C- adjacent property owners and C.H.G. International , Inc. The letter noted
ordinance publication will be withheld pending consummation of special
permit. MOVED BY SCHELLERT, SECONDED BY CLYMER, COUNCIL CONCUR IN RECOM-

Comprehensive Letter from Planning Director Ericksen presented Planning Commission
Plan Revision recommendation for adoption of revision to the City' s Comprehensive
Green River Plan as relates to the Green River Planning Area within the City, located
Valley Planning between the Green River on the West and the Valley Freeway and the base
Area of Talbot Hill on the East, S.W. 43rd St. (S.180th St. ) on the South
and the Burlington Northern - Milwaukee Road Tracks (North of Earlington
Industrial Park) on the North. The letter noted unanimous Commission
recommendation for approval at its June 25, public hearing, noting exten-
sive study and public hearings. The letter presented the Comprehensive
Plan for the Valley area and also the Environmental Impact Statement on
the Plan revisions being in accordance with the State Environmental Policy
Act. The letter noted the Commission revisions included further recom-
mendation that City, seek the means to set aside in a natural state
those areas designated "greenbelt" on the Land Use Element, in order to

AUDIENCE Mrs. Patricia Seymour, 2534 Burnett Court S.., urged adoption of the P.U.D.
COMMENT (Planned Unit Development) Ordinance as it would allow greater efficiency,
retention of existing vegetation by developer, as pertains to rezones
and preliminary plats such as two earlier agenda items. Mrs. Seymour also
urged Council to reconsider action concerning revision of Comprehensive
Plan and set public hearing. Mr. Mike Smith, 3402 N.E. 7th, inquired re
drawing of numbers for Council positions and was given copy of applicable
State law by the City Clerk, advising filing period commenced July 28.
Mr. L. Traverso, 519 Cedar Ave. S. , inquired re action taken on complaint
filed against 518 and 504 Cedar Ave. S. properties being overrun with
blackberries, weeds, etc. and dilapidated. Public Works Director Gonnason
explained processing under Dangerous Building Code, that foreclosure
procedure pending on one of the properties, however, assured action being
taken.

POLICY ON PIPE STEM LOTS TO THE COMMUNITY SERVICES COMMITTEE TO REVIEW
AND REPORT BACK TO COUNCIL. CARRIED. Upon inquiry by Councilman
Stredicke, history of the P.U.D. ordinance was discussed.
Aviation Aviation Committee Chairman presented Chairman's report regarding the
Committee Report regular 6/24 committee meeting recommending the Council authorize
execution by Mayor and Clerk of proposed lease agreement with Airport
Eastside Specialties to lease 85,200 feet of property on the east side of Renton
Development Municipal Airport, remove three existing dilapidated hangar structures
Proposal , for ultimate replacement with 29 units. The proposed lease agreement
Airport would provide for 20-yr. term commencing 8/1/75, 10-yr. renewal option,
Specialties rental rate of $.08 per sq. ft. per year with five year adjustments ,
Phase I construction to begin within 150 days from execution date, three
year total completion date. The committee further recommended posting
of performance bond during each phase, improvement of adjoining taxiways, ;
participation in total cost of providing sanitary sewer facilities to
leased premises in the event deemed necessary, and Planning Department
•
review of site plan and setbacks . The report noted approval by consul-
tant preparing Airport Master Plan and approval of developer's financial
statements by Finance Director. MOVED BY SCHELLERT, SECONDED BY BRUCE,

Bonds recommended referral to the Legislation Committee for ordinance and
Mayor and City Clerk be authorized to sign agreement. Letter agreement
from Seattle-Northwest Securities Corporation, Seattle, offered to pur-
chase $121 ,344.19 Local Improvement District No. 274, Bond Issue with
bonds dated 8/1/75 maturing on or before 8/1/87 annual interest 7 1/2%.

Dear Mr. Magstadt:
In accordance with my telephone conversation with the
City Attorney, Gerard M. Shellan, and you on Tuesday,
June 24 , 1975 relevant to the Rezone Application of
the Rhoda L. Weger property, on behalf of my client,
Rhoda L. Weger, I am enclosing herein the executed
Declaration of Restrictive Covenants required by the
City of Renton if the Rezone Application is to be
granted. As discussed, our concern is that until the
entire project has been approved, which even after
the rezone will require a special permit, as well as
the approval of the Renton Planning Department as
expressed in the Declaration of Restrictive Covenants,
we do not want the Declaration recorded and permanently
encumbering the property until we have met all require-
ments to proceed with the project. Accordingly, this
executed Declaration of Restrictive Covenants is de-
livered to you under the following conditions :
1. That the Rezone Application will be presented
to the Renton City Council at their regular
meeting on July 7, 1975 . That if the Council
approves the rezone, that the Application will
then proceed normally up to the point in time
where only publication of the Ordinance is
necessary to finalize the rezone. At that

2 . At such time as we request the Ordinance to be
published, the Declaration of Restrictive Covenants
enclosed herein shall immediately be recorded
prior to finalization by you.
3 . If favorable action on the Rezone Application is
taken by the Renton City Council on July 7 , 1975 ,
we will immediately prepare complete plans for
the project to be constructed and submit them to
the City of Renton at the earliest possible date
for approval and further, will make immediate appli-
cation for the special. permit. It is our intention
that once we have the City of Renton ' s approval
for the entire project that all matters could then
be concluded at the same time, namely, the rezone
finalized by publication of the Ordinance, recording
of the Declaration of Restrictive Covenants , special
permit granted and the project gotten under way.
We appreciate the City of Renton' s cooperation in this re'-ard
because, as you know, Mrs .. Weger does not wish to have the
property encumbered by the Declaration of Restrictive Cove-
nants unless the project can be completed, and if we were to
finalize the rezone with the filing of the Declaration of
Restrictive Covenants , if the special permit were subsequently
not granted, the developers would probably not proceed with
the project and we would withdraw the Rezone Application,
leaving the property in its present state for Mrs . Weger.
If you have any questions at all regarding this matter, I
trust you will call me. Again, we do appreciate your co-
operation in this matter.

Apartments on Sunset and Union Ave. N.E.
The Utilities Division of the Public Works Department has an interest in the
CHG Project. There are some problems with utilities that remain to be solved.
Water Supply
The City has a 12" C. I . water main along the north side of Sunset Blvd.
N.E. This main, when inter-tied, will have sufficient capacity to supply
this project. There is a City held latecomers fee on this water main.
Sanitary Sewers
There is an existing 8" concrete sanitary sewer along the south side of
Sunset Blvd. N. E. This main, to the best of our knowledge, is overloaded.
Engineering studies made by the firm of Moore, Wallace and Kennedy, in
the winter of 1974-75, indicated that the system tributary to the Sunset
Lift Station is inadequate. There is a considerable problem from infil-
tration/inflow which overloads the existing 8" sanitary sewer trunk.
C.H.G. International Developers should address themselves to this problem. An
engineering study should be developed to determine the optimal method to
convey sewage from the C. H. G. site to the Sunset Lift Station.
There is a latecomers fee, held by the City for sewer service to this area. The
cost amounts to l per square foot of site served.

The May 1975 public hearing meeting of the Renton Planning
Commission was called to order at 8 : 07 p . m. by Vice-Chairman
Scholes in the absence of Chairman Ross . The Pledge of
Allegiance was led by Commissioner Mola . Thirty-five peo-
ple were noted as being present in the audience .
1 - ROLL CALL was taken by Secretary Gibson . Al.l Commis -
sioners responded present with the exception of Ross
(emergency ) , Teegarden ( vacation ) , and Wik ( illness ) .

At the direction of Vice-chairman Scholes , the Secretary
introduced the continued public hearing item. And a pres -
entation from the staff was requested .
The Planning Director noted that the applications for
rezone from G-7200 to R-2 and special permit for construc-
tion of an apartment complex had been continued from the
April public hearing , pending additional information
from the applicant . He advised that a meeting of the
Planning Commission Environmental Development Committee
had been held on May 7 , 1975 , at which residents. of the
area had attended and submitted a letter with
regard to ten items of concern . These recommendations
had been submitted to the applicant for review and
response . In addition , the C . H . G . International company
has prepared an Environmental Impact Assessment , which
was received May 26 by the Planning Department . Mr .

Ericksen stated that the Environmental Impact Assessment had
been reviewed by the staff; a meeting had been held with the
applicant , and further information had been requested with
specific reference to neighboring residential concerns . He
stated also , in response to the :Vice-chairman , that the
subject of restrictive covenants should be addressed prior
to action on the part of the Commission . The Planning Direc-
tor then reviewed the approximate twelve acre site and sur-
rounding areas , noting existing zoning and uses , and the
proposed development plan for the Commission . He then re-
quested a brief review by Assistant Planner Smith of the
meeting between the applicant ' s and staff representatives
•
relative to the Environmental Impact . Assessment .
Mr . Smith stated, that members of the staff had met with
Messrs . Johnson and Dininger of C. H . G . International to
discuss the need for additional input with regard to items
referred to by adjacent property owners and some of the
mitigating measures in the proposed plan , such as fencing
around the property , particularly on the north and west ;
retention of the large evergreen trees ; and the matter of
comparative densities with special reference to the northern
portion of the site. He noted that other City departments
had not yet had an opportunity to review the Environmental
Impact Assessment.
The Vice-chairman invited comment from the developer.
John Dininger , ' 4725 W. Mercer Way , Mercer Island , architect
representing C. H . G . International , stated that in view of
the additional information requested with regard to the
Environmental Impact Assessment , they would prefer to re-
spond formally in the form of an addendum to the EIA and
indicated that he would like to find out from the public
if there is anything further they want to offer with
regard to the proposal .
Vice-chairman Scholes called for comment from the audience .
Joe Mathews , 4125 N . E . 17th Stret, Renton , requested that
the neighbors have an opportunity to review a written state-
ment or report regarding the proposal prior to the Commis-
sion ' s making. its final decision .
In response to the Vice-chairman with regard to the avail -
ability of the Environmental Impact Assessment to the
neighbors , the Planning Director stated that because only
two. copies had been 'received , the staff would make one
available on a loan basis and indicated Mr. Mathews, would
be notified as soon as the document is complete . He
stated also that the staff would be happy to meet with
him and his neighbors to respond to any questions . Mr .
Mathews 'requested' that the developer reply more formally
to the ten items raised by the neighbors and stated that
they are willing to work with the developer to get the
problems resolved .
Vice-chairman Scholes invited further comment from the
audience . Noting none ,

of additional input from the applicant and time required
for further, review by the staff , neighbors , and -Commis-
sion .

The Vice-chairman requested that the request for Tempor-
ary Permit to allow a group home by Mrs . Evelyn M. Pipo
be considered at this point .

The application was introduced by Secretary Gibson and
the staff report was presented by the Planning Director
at the request of the Vice-chairman .
Mr. Eri'cksen advised that the Planning Commission had
previously approved a temporary permit for a period of.
two years and that permit is now expiring . He noted
the site, of the group home located on a 90 ' 'x 120 '
fenced lot off Benson Highway and S . 27th St . on the
vicinity map ., Slides of the single family home and
neighborhood were viewed . Mr. Ericksen noted that to
the use - adjacent neighbors have no objections .
The Vice-chairman invited comment and discussion from
the Commission , but none was offered . Similarly , no
one in the audience responded to a call for questions
from the audience by Commissioner Scholes .
The Vice-chairman reminded the Commission that issuance .
of a temporary permit was allowable for a two year
period and then was subject to the review process . It
was then -

The Planning Director referred the Commission to previous
action by the Commission and Council with regard to an
amendment to the Comprehensive Plan to a P-1 category ,
as it related to the 8. 28 acre site . Present zoning is
G-9600 , and existing use is single family residential .
Mr. Ericksen noted adjacent zoning, significiant develop-
ment in the vicinity and described the natural characteris-
tics of the site , which includes a ravine and creek on the
southerly third of the property . , Single family residential
districts lie to the north and east across Talbot Road. '
South . P- 1 use lies to the south .
Aerial photographs , slides of the property , and a topographi -
cal map were viewed . It was noted that approximately fifty
percent of the site is wooded and that principal access is
from Talbot Road . Mr. Ericksen pointed out that South 37th
is a half street--with thirty feet of right-of-way--and
that additional development might require upgrading of the
right-of-way and improvements .
The Vice-chairman invited questions from the Commission . .
In reply to Commissioner Gibson with regard to possible
encroachment of P-1 usage to the north , Mr . Ericksen noted
that this matter had been discussed rather extensively at
the time of the Comprehensive Plan amendment and stated
that any further changes in Comprehensive Plan designation
would require Planning Commission review.
Responding to Vice-chairman Scholes relative to allowable
uses in a- P- 1 District , the Planning Director quoted from
Section 4-710 , P- 1 Public District , and noted that pro-
posed development would require Planning Commission re-
view. P- 1 limitations include height limitations of four
stories or forty feet.
Vice-chairman Scholes invited comment from the applicant.
W. Stewart Pope ., applicant , stated that from an ecological
point of view, it was his opinion that P- 1 zoning is
preferable to residential zoning .
The Vice-chairman called for comment from the audience , but
none was received .
In response to an -inquiry from the Vice-chairman with ref-
erence to the possibility of an Environmental Impact Assess-
ment , Mr. Ericksen noted that Mr . Pope has submitted an En-
vironmental Impact Worksheet ; and it was the staff ' s posi -
tion that an Environmental Assessment or Environmental Impact
Statement were not necessary for the proposed rezone . - He
advised that the Commission will have development review
and that with design control , the impact on adjacent use
could be controlled .
Discussion ensued with regard to possible restrictive cove-
nants relating to development of the property . Among the
items considered were limitation of access to Talbot Road
South unless the right-of-way of South 37th is widened ; pres-
ervation of the natural vegetation ; structure height limita-
tions ; setback requirements ; and location, of the structures
on the property to reduce impact to adjacent single family
residential areas . Mr. Pope stated that height limitations
of two stories or 25 feet would be acceptable to 'him within
100 feet from the• northerly line with conformance to P-1
restrictions for the balance of the site .

discussed the items listed in Mr. Matthews' letter and
other items expressed in the letter to CHG International ,
Inc. from this Department dated May 28 , 1975 . We indicated
we could not recommend approval of the Planning Commission
items until the assessment was satisfactorily completed and
a determination of environmental significance made.

detailed discussion of the items expressed in the
letter in terms of their impacts and possible amend-

-- The representative of the applicant was asked
to address these concerns in the environmental
assessment and revised site plans . He indi -
cated he would do this .
-- The committee felt that most of the citizens
concerns were valid and should be studied
further when the assessment is completed .
They said that a status report would be pre-
sented at the May public hearing but it was
unlikely that the assessment could be pre-
pared in time for sufficient review to make a
decision at that time .

Gentlemen:
Your application to rezone an 11. 63 acre parcel on Sunset
Highway N. from G-7200 to R-2 has been continued by the
Renton Planning Commission until the May 28th public hear-
ing. Your request has been referred to the Environmental
Development Committee, and a meeting for the purpose of
more completely reviewing your applications has been set
for Wednesday, May 7th, at 7: 30 p.m. in the third floor
conference room.
Further action on your applications for Rezone and Special
Permit will be contingent upon the environmental assess-
ment. In this regard some major areas of concern that
must be addressed are as follows:
1. The tagging of mature evergreens to remain on
the site after clearing for roads, parking
spaces and buildings and the locating of these
trees on the landscape plan.
2. Site drainage and runoff.
3. The visual impact upon the surrounding pro-
perties specifically in reference to screen-
ing., landscape materials to he added to the
site and setbacks .

4. The impact upon the local schools and pedes-
trian access to local schools.
5 . The traffic impact upon Sunset Highway N.
6. The impact of the proposed project on ex-
isting utilities in the area.

and #SP-813-75
Bill Turner , Planning Technician , and I met with eight
property owners adjacent to C . H .G . International Development
located on Sunset Highway between Union Avenue N . E. and 138th,
Tuesday afternoon , April 22 , 1975 . We reviewed the application
and site plans in detail and noted development options under the
existing Comprehensive Plan designation . The structure , role ,
and responsibilities of the Planning Commission under the R-2
Zone , with Special Permit option was also explained.
After this review , the adjacent property owners had the
following comments :
1 . They would like consideration given to school access
for the children within the development , noting the
the danger of routing the children on Sunset Highway
and Union Avenue N . E . They felt that without a de-
fined access , trespassing through neighboring prop-
erties would occur.
2 . Consider switching the recreation vehicle site from
the northwest corner to the northeast corner.
3. Consider increasing the setback on the west property
line by moving the buildings closer to the east
property line .
4. One of the neighbors would like to see a minimum
50 foot setback from the west and north property
lines .

5. Fencing property lines was discussed , but a
decision or consensus was not reached .
The property owners were pleased that they had the
opportunity to review the plans before the Planning Com-
mission public hearing and that their opinions would be
part of the review process .

In response to a question from Commissioner Scholes with
regard to the kinds of equipment planned for outside stor-
age , Mr. Fiddes stated that it would be a pipe yard for
sewer pipe , manhole covers , and several pieces of heavy
equipment. Also replying to Scholes , Mr. Fiddes indicated
that an eight foot fence is planned , which should be ade-
quate screening from the East Valley Road but possibly not
from SR-167. It was noted that future review would be
appropriate at the time of site development.
The Chairman invited further questions from the Commission
or audience. Noting none , IT WAS MOVED BY TEEGARDEN , SEC-
ONDED BY MOLA, THAT THE PUBLIC HEARING BE. CLOSED . MOTION
CARRIED UNANIMOUSLY. '.

Chairman Ross informed Mr. Fiddes that the Planning staff
would advise him, when the request would appear on the City
Council agenda.
REZONE - SPECIAL PERMIT:
C. C . H. G. INTERNATIONAL , INC . ; Appl . No . R-811-75 ; rezone
from G-7200 to R-2 ; property located on Sunset. Highway
P . S. H . 2 between Union and 138th . .
The application was introduced by Secretary Gibson , and a
staff presentation was requested by the Chairman .
Mr. Ericksen noted that the 11 . 5 acre site is adjacent to
the Robert Jackson site on the north, side of Sunset Highway
near Glencoe Subdivision . He pointed out that the appli-
cant was making, two requests , one for rezone of the
property from G-7200 to R-2 , and a request for approval of
a special permit to construct a 148 unit apartment complex .
He described Comprehensive Plan designations , which include
medium density multiple family residential on the north and
commercial on the south of the site , as well as other devel -
opment 'in the vicinity. Adjoining zoning was cited. He
noted there is a residence on the property and described
existing natural conditions of the land. He briefly des-
cribed proposed development plans , including structural
design plans , recreational and parking areas , access and
circulation .
Slides of the area were viewed . Natural characteristics ,
including ' a large stand of Douglas firs were noted . The'
Planning Director stated that it. is the developer ' s intent
to retain as much of the wooded area as possible . He
advised that an environmental impact assessment has been
requested; and , therefore , it was recommended by the staff
that the Special Permit application be continued for thirty
days to allow for its submittal and review.
Discussion followed among the Commissioners with the Chair-
man noting that rezoning of the property would not commit
the developer to the proposed plan . , Commissioner Teegarden

Discussion followed , with Commissioner Scholes inquiring
as to the effects of the Shell ruling in this case . The
Planning Director advised that the standards to be estab-
lished affect Section 417 . 4E only of the Zoning Ordinance
and would not affect this property . Mr. Scholes also
asked about a possible dedicated greenbelt area on the
easterly boundary and was advised by Mr. Ericksen that
there is a 20 foot setback requirement along the Valley
Freeway, as it is a primary state highway. Mr. Erick-
sen also noted Soil Conservation Service requirements
for preservation of two percent of natural area for
wildlife habitat and interior landscaping of five per-
cent per the Parking and Loading Ordinance . He stated
that the staff recommended L- 1 zoning based on existing
conditions , noting that the surrounding area is L- 1 .
Noting that the request appeared logical , IT WAS

COMMISSION RECOMMEND APPROVAL OF THE DR. H. M. ALLEN-
BACH REQUEST FOR REZONE FROM G-9600 TO L-1 , AS IT AGREES
WITH THE COMPREHENSIVE PLAN. MOTION CARRIED UNANIMOUSLY.
REZONE:
B, JOE AGOSTINO ; Appl . No . R-810-75 ; rezone from G to
M-P ; property located on E . Valley Highway between
S . W. 21st St. and S . W. 23rd St.
The application was introduced by Secretary Gibson , and
the Chairman requested a staff presentation .
Mr. Ericksen pointed out the two acre site located directly
on the East Valley Highway on the vicinity map and noted
access to the site and surrounding zoning in the area .
Present use of the property is undeveloped ; proposed use
is for a contractor' s storage office . Mr. Ericksen
stated that Planning Commission review of site plans
would be required by the M-P Ordinance , as well as pro-
visions specified in the Parking and Loading Ordinance .
The Chairman opened the request to the Commission for
comment and discussion .
In response to Commissioner Rivily ' s query if fill would
be required for the site , the Planning Director advised
that it would , inasmuch as it is a low marshy parcel ,
below the level of the East Valley Highway.
Chairman Ross invited comment from the applicant .
Andy Fiddes , 4913 Evanston , Seattle , representing the
applicant , stated that it was their intention to develop
the property for the use of a contractor ' s equipment
storage structure plus warehouse , shop and eventually
to move their offices from Bellevue to the Renton area .
He stated that they will seek a Special Permit to fill
in the near future and that they plan on 20 foot setbacks
to give better contour to the land after filling. He
said it is their intention to provide an opaque fence
to screen their operations and that they would abide with
Code requirements .

stated that he was impressed by the exceptional stand
of trees on the property and suggested that develop-
ment as a park would be more appropriate . It was indi -
cated by Mr. Ericksen and Mr. Smith that the subject
had been previously considered by the Parks Director ,
but the Commission ' s position would be presented to
the Parks Department .
The Chairman invited comment from the applicant .
John Dininger, 4725 W. Mercer Way, Mercer Island ,
representing the applicant , noted that the Planning
staff had presented their proposal adequately and
invited questions from the Commission .
In answer to an inquiry from Commissioner Wik relative
to the extent of filling and grading necessary for
development , Mr. Dininger stated that grading would
be held to a minimum and that the low profile design
would tend to alleviate any major excavation . Dis-
cussion followed with regard to the requirement for
Planning Commission review of development in an R-2
zone , the matter of preservation of the trees , and
the possibility of restrictive covenants .
Mr. Dininger noted that their proposal meets the
requirements of R-2 zoning and includes buffers to
protect neighboring single family residences . He
stated that they consider it a logical use as a
transition from single family to commercial zoning and
that the need for construction of apartments was indi -
cated in Renton by the low vacancy rate .
The Chairman invited comment from the audience .
Joe Matthews , 4125 N. E . 17th St. , Renton , noted he
was speaking for the adjacent neighbors and that they
had reviewed the plans earlier. He stated that while
none of them were very happy to see high density struc-
tures in their back yards , they recognized the prop-
erty owner ' s right to develop his site and that they
could not expect retention of those big trees at some-
one else ' s expense . He stated that they did not
object toiR-2 zoning as proposed with .a special per-
mit to construct. Mr. Matthews indicated that they
would prefer to see some restrictive covenants included
with the rezone application. He stated it is their
feeling that a 35 foot greenbelt area would not be
unreasonable and a fifty foot setback to include the
thirty-five feet of greenbelt. He stated it is their
belief that the matter of access to school had not been
addressed . They also recommend that upon completion ,
a cyclone fence as high as permissible between the
two zones would be desirable . Speaking for the
neighborhood , Mr. Matthews requested that any action
be postponed until the environmental assessment that
has been requested is available for their review.
He noted that it is their desire that the rezone and
special permit requests be considered as a package in
order to assure them of what can be expected .
The Chairman called for additional comments from the
audience , but none were offered . Chairman Ross then
opened the subject to discussion by the Commission .

Discussion ensued with regard to the possibility of consider-
ing both applications simultaneously , preservation of the
evergreen trees on the site , appropriateness of restrictive
covenants attached to the rezone application , location of
buffering zones , and possible revisions to the proposed con-
struction plan with consideration for the neighboring home
owners ' recommendations . Noting the need for further study ,

NATIONAL, INC. REQUEST FOR REZONE FROM G-7200 TO R-2 BE

Mr. Dininger spoke in opposition to continuation of the
rezone request and indicated preference for restrictions
on the special permit.
There was further discussion with reference to the require-
ment for an environmental impact assessment, its relation-
ship to the rezone and special permit applications , and
the time-frame for its review.

Commissioner Mola , Chairman of the Environmental Develop-
ment Committee , called for a meeting to be held May 7 , at
7 : 30 p . m.
It was decided that the C . H . G . International , Inc . special
permit should also be reviewed at the May 7th Committee
meeting .

reconvened at 10 : 37 p . m. with all members noted above as being
in attendance .

The application for special permit was. introduced by Secre-
tary Gibson at the request of the Chairman . A presentation
was requested from the staff.
The Planning Director noted the location of . 7 acre R-4
zoned site on Puget Drive in the vicinity of Benson Road
northerly of the Maxwell Clinic . Mr. Ericksen described
the general configuration of the property and discussed
proposals for access off Puget Drive and Benson Road . He
stated that the proposal has been reviewed by the Traffic
Engineer, who indicated that the revised access plans did
not appear to present a problem. Mr. Ericksen stated that
the staff feels the plan is inadequate with respect to
landscaping , particularly on the southeast and north prop-
erty lines . Sketches of elevations on the proposed struc-
tures were displayed and discussed .

The following issues were discussed :
1 . Enlargement of the existing 8 inch sewer line to 18
inches . Tom Touma stated that the improvement costs
must be borne by the developer. C . H . G . agreed that
they will pay their fair share of the costs . Details
will be worked out later once a cost estimate is
determined by the Public Works Department.
2 . Dave Hamlin stated that there is no significant traffic
problem. Sunset Highway is an adequate Road to handle
the added traffic flow. It has a left turn lane and
no improvements of the highway itself will be needed .
3 . Mike Smith stated that an environmental assessment will
be required . The issues to be addressed are site
drainage , tagging of existing Douglas Firs to remain ,
traffic flow, impact on local utilites , impact on local
schools , landscaping , screening and building setbacks ,
and etc. C . H.G . agreed to write an assessment follow-
ing the environmental impact statement outline.
