ture to appoint a Tax Reform Commission and that there should be full
citizen participation in implementing such Tax Reform Package. After

(Boeing) and recommended referral to the Legislation Committee for annexation
ordinance. MOVED BY CLYMER, SECONDED BY GRANT, THAT MATTER OF
ANNEXATION OF THE INNER HARBOR LINE AREA BE REFERRED TO THE LEGISLATION
COMMITTEE. MOTION CARRIED.
10% Letter of Letter from City Clerk Mead reported that 10% Letter of Intent to annex
Intent to Annex property to the City of Renton had been filed with her office and had
Water Reservoir been certified valid by the Planning Department, 76.5% of assessed
Talbot Hill Area valuation represented by signatures; also recommended that December 22,
1975 be set as a Public Meeting with initiating property owners to
Public Meeting determine whether to accept the letter of intent, require adoption of
Set - 12/22/75 the Comprehensive Plan, Zoning Ordinance, Pre-Existing Indebtedness ,
and to authorize circulation of 75% Petition. MOVED BY STREDICKE,

AN ORDINANCE OF THE CITY OF' RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
GENERAL CLASSIFIGTION DISTRICT (G) TO RESIDENCE
DISTRICT (R-3)
WHEREAS under Chapter VII , Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton" , ' as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has
heretofore been zoned as General Classification District (G) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the City Clerk on or about
June 3 , 1975 , which petition was duly referred to the Planning
Commission for investigation, study and public hearing, and a public
hearing having been held thereon on or about June 25 , 1975 and
continued to September 24 , 1975 , and said matter having been duly •

Towaway Signs on Councilman Stredicke commented that he was concerned about signs
Private Property on private property being visible enough, especially at night,
that citizens were able to see them, their cars being liable for
ticketing and towaway. MOVED BY STREDICKE, SECONDED BY PERRY,
THAT THE SIGNING BE REFERRED TO THE TRANSPORTATION COMMITTEE.

Service Station Councilman Stredicke reported that nothing had been done about
12th & Sunset the abandoned service station at 12th and Sunset, it has been
vacant for some time and the service pumps had been removed.
Mayor Garrett requested the Public Works Director to investigate
for proper safeguards.
Councilman Stredicke corrnnented regarding the negotiating team of
Boeing Company the Aviation Committee's acceptance of the Boeing Co. offer on
Leases the leases and subsequently making counter offer. Next meeting
to finalize the matter prior to budgetary funding. Councilman
Schellert said the Finance Committee was waiting for the Aviation
Committee report for appropriate action on the budget. Mr. Stredicke
asked for written request.
Bid Award Public Safety Committee Chairman Grant presented report recommend-

SECONDED BY CLYMER, TO CONCUR IN THE RECOMMENDATION OF THE PUBLIC

NEW BUSINESS Councilman Stredicke questioned if the Systems Development charge

Green River Valley Councilman Grant asked Mayor Garrett for a report on his meeting
Hearing with the congressmen. Mayor Garrett reported there were three
congressmen present at the hearing, Don Bonker, 3rd District;
Floyd Hicks . 6th District and Brock Adams, 7th District; the main
subject of the hearing was the proposed drainage system. He reported
that some of the participants toured around the area to observe what
they were talking about and pointed out the area that was discussed
in Washington, D.C.

VOUCHER APPROVAL Finance Committee Chairman Schellert presented Vouchers No. 7007
through 7187 in the amount of $250,639.79 for approval , having
received departmental certification that merchandise and/or services
had been received or rendered. MOVED BY SCHELLERT, SECONDED BY
CLYMER, THAT THE COUNCIL AUTHORIZE PAYMENT OF VOUCHERS NO. 7007
THROUGH 7187. MOTION CARRIED. Vouchers No. 7000 through 7006 were
machine voided.

The Community Services Committee recommends. concurrence
in the Planning Commission recommendation for approval
of the rezone as it agrees with the Comprehensive Plan.
The Comprehensive Plan indicates a medium density
multiple-family future use designation for the site
and area immediately south of it in King County. The
applicant has contacted the adjacent property owners ,
they had no objections to the proposed rezone , and
no objections were filed at the several public hearings
that were held on the rezone .

PUBLIC HEARING This being the date set and proper notices having been posted and

N.W. 5th to consider vacation of a portion of N.W. 5th St. located between
(Gary Vigoren) Lind Ave. N.W. and Steven Ave. N.W. (formerly known as Renton St. ) as
requested in petition filed by Gary L. Vigoren. Public Works Director
Gonnason noted the Board of Public Works had recommended proceeding
with the vacation contingent upon securing a minimum 20-ft. utility
easement and that the Public Works Department verified signatures on
the petition represent 75% of the property abutting that portion of
right-of-way proposed for vacation, noting recommendation that public
interest would be served by vacating portion of N.W. 5th St. and return-
ing same to tax rolls. Following discussion, it was MOVED BY STREDICKE,
SECONDED BY PERRY, COUNCIL CLOSE HEARING. CARRIED. MOVED BY STREDICKE,
SECONDED BY PERRY, COUNCIL APPROVE STREET VACATION AND REFER TO THE

PUBLIC HEARING This being the date set and proper notices having been posted and

R-821-75 of rezone request as it would be incompatible with the existing Compre
hensive Plan which indicates medium density multiple-family residential
j for the area in question and the area immediately to the north is
zoned R-3 with areas on east and south zoned G, also noting review by
the Commission indicated no additional commercial zoning was justified.
The letter also noted the Comprehensive Plan for the Highlands area
is presently under review by the Commission. Letter from Planning
Director Ericksen to Community Services Committee Chairman Clymer and
Committee Members was read noted the Planning Commission recommendation
regarding request for rezone from G to R-3 of the Dennis R. Oster
property which is adjacent to the Moritz property, was referred to the
Community Services Committee on 10/6/75 for study and recommendation.
The letter requested simultaneous review of both the Oster and Moritz
items in order that decision be consistent with Council policy.
Attorney Mel Kleweno, 213 S.4th, Kent, representing Gary Moritz, used
map to point out the only single family resident in the area of Moritz
property was one home zoned 8-1 to the west, home on Oster property
and some County homes , that across the street is City property used
for equipment and gravel storage, that the intersection to east is zoned
business on all four quadrants. Mr. Kleweno submitted letter from Mr.
Steve Skeel , adjacent land owner to the north (zoned multi-family), sup-
ported Moritz' s efforts to have property zoned for business as being
compatible with economic situation and with his own future plans.
Mr. Dennis R. Oster, 316 Union Ave. N.E. , noted light industry in area.
Following discussion, it was MOVED BY STREDICKE, SECONDED BY GRANT,
Public Hearing R COUNCIL CONTINUE PUBLIC HEARING TO NOVEMBER 24, 1975 AND THE APPEAL BE

Impact Statement Draft Environmental Impact Statement for Local Improvement District
for LID 296 No. 296, Kennydale Interceptor. Public Works Director Gonnason intro-
Kennydale Sewer duced Project Consultant Bill Moore and Project Engineer Larry Osborn
Project of Moore, Wallace & Kennedy, Inc. , Seattle, Project Consulting Firm,
authors and principal E. I .S. contributors. Mr. Moore summarized the
Impact Statement, describing the L. I .D. project which will provide
collection sewer lines for residential areas in the northern portion
of Renton (Kennydale area)with 28 linear feet of 8-inch or larger line
plus side sewers stubbed to the 500 homes in the area, each homeowner
required to make connection from home. The Draft Statement listed
direct environmental impacts: Removal of ground cover on easements
( two acres), would be replaced; construction noise & dust, and con-
struction disruption of traffic; and elimination of health hazard.
Secondary environmental impacts: full utilization of existing zoning
and possible increase in storm water runoff. Alternatives listed:
no action and reduce occupancy in areas with septic problems through
abatement procedures. The Statement listed mitigation of adverse
impact by hydroseeding of unimproved easements; sprinking with water
to relieve dust and traffic detours during construction. Mr. Moore
requested that all responses to the E. I.S. be written and submitted
to the responsible official , Public Works Director Gonnason, by 11/15/75.
Councilman Perry inquired re storm water and was advised existing run-
off has been taken into consideration and that new plats should be con-
sidered as developed. Following further discussion, Mr. Mark Iozzio
255 First Ave. N.W. , Issaquah, made inquiries on behalf of Washington
Environmental Impact Council; commented on alternatives for "where
sewerage goes" after collected in Kennydale and also that acceptance
of this plan would develop northern side of May Creek. Mr. Moore
requested the comments be submitted to the Public Works Director in
writing prior to the deadline of 11/15/75. Upon inquiry by Councilman
Stredicke, City Attorney Shellan noted closing of hearing does not
constitute acceptance of the Impact Statement and Council will have
further opportunity to review final statement. Project Engineer Osborn
used display map to further explain the district and project. Council-
man Grant inquired regarding inclusion of property on Edmonds N. E. where
the L. I.D. had been rejected, being advised of inclusion. Plans for
installation of the line in or adjacent to Edmonds Ave. N.E. were dis-
cussed. Upon inquiry of Councilman Bruce, Mr. Osborn noted no lift sta-
tion was planned. Meetings with property owners noted (see schedule) .

Lighted Reader Letters from the Renton Municipal Arts Commission and the Renton
Board for CARCO Creative Arts - Bicentennial Committee both requested funding for
Theatre a lighted readerboard for the CARCO Theatre at the Maple Valley
entrance to Cedar River Park. Both letters emphasized the value of
such a sign to increase awareness and attendance at functions given
at the theatre and requested that money be appropriated in the 1976
budget for this purpose; the Renton Municipal Arts Commission request-
ing an appropriation of $8,000. It was Moved by Perry, Seconded by
Grant, to refer both of these communications to the Finance and Personnel
Committee, Councilman Stredicke remarked that the appropriation should
be included in, the preliminary budget. SUBSTITUTE MOTION BY STREDICKE,
SECONDED BY DELAURENTI , THAT THIS REQUEST BE REFERRED TO THE MAYOR'S

Temporary Street Board of Public Works Chairman Del Bennett's letter noted that they

in the Saturday market program. Possible sites recommended for use

Public Hearing The Clerk read announcement from the Puget Sound Air Pollution Control
Puget Sound Air Agency that there will be a Public Hearing held Thursday, November 20,
Pollution Control 1975 to consider a proposal to replace Section 9.02 governing outdoor
Agency fires with Article 8 having the same outdoor fire requirements. The
Public Hearing will be held at 9:30 A.M. in the Commissioners Audito-
rium, Port of Seattle, Pier 66, Seattle.
State Audits of Letter from Public Works Director Gonnason was read for informational
City Construction purposes on the State Audits of City Construction Projects and stated
Projects that during June and July of this year, the State performed audits of
nine completed UAB projects, including S. 2nd, S. 3rd and Main Ave, =
which were in the CBD program. These audits involved $3,725,035.48
in Urban Arterial Trust Funds, and another $1 ,255,130.06 of matching
funds and the net results of the audits is that the City will receive
an additional payment of $6,797.41 for eligible project costs.
APPOINTMENTS Letter from Mayor Garrett requested concurrence in the appointment of
Police Dept. Ms. Mary Widmer, 18104 S.E. 136th St. , Renton, to the position of Clerk
in the Renton Police Department to fill a vacancy within the Communica-

Clerk having been certified by the Police Civil Service Commission, and sub-

Clearview Cable Works was submitted by Councilman Clymer regarding Clearview Cable TV
TV Rate Increase rate increase and franchise, Clearview being advised to continue opera-

pared to cover both TelePrompter, Inc. and Clearview Cable TV. Sample
Public Hearing ordinances are being secured from other agencies. The joint report

CLYMER, SECONDED BY SCHELLERT, THAT THE COUNCIL CONCUR IN THE RECOMMENDA-

concerning the rates and regulatory powers of the Council granted by the
F.C.C. , citizen complaints , and the past events and studies undertaken
by Council committees and City personnel as concerns the franchises of
the two companies now operating in Renton. Moved by Grant, Seconded
by Stredicke, that the Board of Public Works negotiate with Clearview
Cable TV and have a section in the franchise regarding the increasing
of fees and that this be subject to Mayor and Council review, and that
the Council have a report back in thirty days. More discussion ensued
and Councilman Grant withdrew his motion. SUBSTITUTE MOTION BY GRANT,
SECONDED BY BRUCE, TO REFER THE RECOMMENDATION, ALONG WITH THE FRANCHISES,
TO THE BOARD OF PUBLIC WORKS FOR REVIEW AND REPORT BACK IN THIRTY DAYS.
It was noted that the F.C.C. requires some local programming, educational
films, etc. and that it was up to the companies to show the Council
why they need the increase and what they are doing for public programming.

The July 1975 public hearing meeting of the Renton Planning
Commission was called to order at 8 : 05 p . m. by Chairman
Ross , who led the Pledge of Allegiance . Approximately fifty
people were noted as being present in the audience .
1 . INTRODUCTION OF OFFICERS :
The Chairman requested that Commissioner Scholes assume
his newly elected post as Chairman for the year 1975-76
at this time . He described the duties of the Chairman-
ship , offered his congratulations , and thanked Commis-
sion members for their cooperation during the past year .
The new Chairman introduced the new officers : Vice-
chairman Wik and Secretary Rivily . He also introduced
a newly appointed Planning Commissioner , Joan Walker.
Mrs . Walker expressed her appreciation to the Commis-
sion and staff for their helpfulness and interest .
Chairman Scholes announced the formation of three
new committees and their officers : Land Use Commit-
tee - Teegarden , Chairman ; Rivily and Scholes , members ;
Zoning Committee - Mola , Chairman ; Walker and Ross ,
members ; and Special Studies Committee - Gibson ,
Chairman ; Garrison and , Wik members . He stated that a
list of outstanding activities that are before the
Commission would be announced prior to July 30th and •
committee assignments designated .
2 . ROLL CALL was taken by Commissioner Mola in the absence
of Secretary Rivily. All members responded present with
the exception of Gibson ( vacation ) and Rivily ( illness ) .

3 - APPROVAL OF MINUTES :
The Chairman invited corrections or additions to the min-
utes of the June 25 , 1975 , meeting . Commissioner Teegar-
den requested that the word " rezone" in the first para-
graph of item 3 , referring to an addition to the minutes
of June 11 , 1975 , by Commissioner Mola , be corrected to
read " reason . " He also noted with regard to the discus-
sion concerning the John C . Edwards ' application on page
ten an apparent misinterpretation in the first paragraph
in the statement by Mrs . Bala and requested that the
word "moss " be changed to "marsh . " In the same para-
graph in one instance Mrs . Bala was referred to as "Mr . "

Other committee members questioned the need
for more business zoning in the area at this
time .
Mr . Moritz made his presentation in favor of his
request noting existing business zoning in the
area . He indicated that the property cannot
be properly developed under its existing
classification . When asked if he had a specific
development proposed that the committee could
review , he said he did not.
ACTION The committee voted to continue the application
for further information and justification from
the applicant.
iITEM 2 DENNIS OSTER Rezone #R-827-75
Mr . Smith gave a brief overview of the proposal and
the area in which it is located .
Mr . Mola stated that R-2 zoning may be more appro-
priate at this time because it would be more com-
patibile to the single family uses directly adjacent
to the subject site and act as a buffer between
the single family area and anticipated multi family
area to the north .
Mr . Oster made his presentation stating that R-3
was appropriate and that the property could not be
reasonably developed in a lesser intensity zoning .
The matter of public use of the undeveloped eastern
portion of the property led Mr. Lynn Spech , the
ministers -to indicate the chruch ' s willingness to
allow public type uses of the property if it does
not hinder their exemption status .
The related traffic problems in the area were dis-
cussed with complaints issued by Mrs . Gist and Mr.
Noble , who reside in the area . They complainabout
general traffic as well as church traffic problems .
Mrs . Gist also felt that single family residence
usage of the property would be less detrimental than
the proposed use in terms of visual quality and traffic •
impacts .

It was mentioned that alternative single family
development may cause more visual and traffic
impacts than the proposed development. However ,
the committee and staff indicated they would
ask that the traffic engineer comment on these
questions and the six year street program for
the area .
He was then informed of the possible allowable
uses in each zone . It was pointed out that some
of the possibilities he anticipated may be allowed
in an R-2 zone .
ACTION The committee voted to recommend R-2 zoning for
this site , feeling that the R-3 zoning was not
appropriate for the area at this time .
ITEM 3 HIGHLANDS CHURCH OF CHRIST Site Approval #SA-830-75
Mr. Ericksen gave a brief overview of the proposal ,
and commented an the field trip conducted to
the church in Montlake Terrace developed by the
applicant.
Mr. Teegarden made a brief statement concerning
his impressions as a result of the field trip. He
indicated that with some controls established he
would not be opposed to the development .
Mr. Pribble then presented the revised plans
requested by staff and the committee . These included:
1 . revised site plan
2 . landscape plan
3 . grading plan
4 . floor plan
Mr. Ericksen also stated that there were alternatives
to the development plan that would reduce certain
impacts which include additional setbacks and screening,
control of access , and choice of colors for the pro-
posed structures .
Mrs . Gist felt that there were enough churches in
the area .
Mr. Noble stated that he didn ' t necessarily object
to the proposed project, but did complain about
traffic problems in the area . . Wanted to make sure
the neighbors were considered in the site planning
of the project.

rezone proposal . We initially discussed the
similarities and differences between the R-3
and R-2 zones . I indicated the type of
development that might occur in an R-2 by
Special Permit if done properly. I pointed
out some examples . He questioned me regarding
procedures of continuation , goals and policies
of the Commission and the staff report. I
indicated that the staff would forward his
request for continuation until the September
public hearing , and that we would have no
objection to such a continuation .

The Chairman invited comments and questions from the Commis-
sion . Discussion centered around provisions for a street
on the southern boundary. The Planning Director noted
street "right-of-way and waterline easements between the
property line and the paved area , the access road to
Olympic , and that Olympic Pipe Line Company also has two
lines located there . Further discussion ensued with regard
to the location of the- proposed P-9 Channel , its proposed
width , and its relation to the private road .
WAIVER OF OFF-SITE IMPROVEMENTS :

5- ADMINISTRATIVE :
A. FIELD TRIP
It was decided not to have a field trip in view of the
Commission ' s familiarity with the sites in connection
with recent rezone requests . The Planning Director
noted that should Commissioner Garrison be interested
in visiting the sites , in view of his recent_ appoint-
ment, the staff would be available at his request .
A recess was declared at 9 : 40 p . m. The meeting was resumed at
9 : 50 p . m. with all members noted above in attendance .
B. PROPOSED BULK REGULATIONS WITH DEFINITIONS
' The Planning Director presented for. Planning Commission
consideration the revised draft " B" of the proposed
bulk regulations with definitions . It was noted that
the proposed revision incorporated both the input from
the Planning Commission and the City Attorney that
evolved during the previous work meetings on this sub-
ject.
Noting the Court ' s deadline requiring the City to
• establish definitive , written standards and guidelines
regulating the issuance of a special permit pursuant
to Subsection 4-713( b) of the Zoning Ordinance , the
Planning Director requested Commission concurrence
in the revised draft in order that it might be pre-
sented
to the City Council at their meeting of
July 14.-
Gary Kruger , Associate Planner, noted that "Revision
A" of the proposed document had been reviewed with
the City Attorney and that his suggestions had been

Discussion ensued with Commissioner Gibson inquiring with
regard to the Comprehensive Plan designations being unequal
in depth on Union Avenue N . E . south of N . E . 4th Street .
The Planning Director described the reasoning of the Plan-
ning Commission at the time of the Comprehensive Plan rec-
ommendations .
The Chairman asked for' comment from the applicant .
Gary Moritz , 2525 N . E . 24th , Renton , stated that it was his
opinion that since the property across the street to the
west was zoned for business usage , his request seemed appro-
priate . He noted that the Dennis Oster site to the south pre-
sently zoned G is the last piece of property within the City
limits and inquired if the property to the south , located
in the County , was not zoned as R-3 . He also inquired re-
garding the King County Comprehensive Plan designation for
the area . Mr. Magstad replied that the King County Planning
Department had been contacted on June 24th and had advised
that the property to the south is presently zoned SR, which
is single family residential . The Assistant Planning Direc-
tor stated that he could not comment regarding the County ' s
Comprehensive Plan designation .
The Chairman invited comment from the audience but received
no response . Discussion was then opened to the Commission .
Discussion ensued with regard to the appropriateness of
the City ' s Comprehensive Plan designation , reasons for just-
ifying a rezone request, availability of sewers , and the
flexibility of the use lines on the Comprehensive Plan .
Commissioner Teegarden stated that Commission recommendations
are not always concurred in by the Council . He also stated
that the property to the north of the subject site was zoned
R-3 as a part of a larger site to provide a transition be-
tween business and single family use to the south . In
response to Commissioner Garrison ' s inquiry regarding the
availability of plans for the site , the Planning Director
advised that none had been submitted , and he understood
that there were no immediate plans for its use . It was
noted that the Comprehensive Plan in the Highlands area
will be reviewed next by the Community Development Commit-
tee and that the County ' s Comprehensive Plan for adjacent
areas should be considered in the decision .
ACTION:

COMMISSION MOVE TO CONTINUE THE MATTER AND REFER THE SUBJECT

Mr. Magstadt pointed out the location of the 3 . 79 acre
G-7200 zoned site overlooking Lake Washington in the
Kennydale area on the vicinity map .. He reported that an
existing single-family residence is to be removed and
the property subdivided into sixteen single family
'residential lots ranging in size from 7600 square feet
to 25 ,000 square feet . Primary access to the site is
from North 38th Street ; access from Park Avenue North
is limited to two lots . The rear lots would have
access from separate roads that front North 38th Street .
City sewers are available .
In reply to Commissioner Teegarden ' s inquiry regarding
the width of the stem of the pipe to the pipestem lots ,
the Assistant Planning Director indicated that they
are twenty feet wide private driveways which run with
the property . He also indicated , in response to Com-
missioner Gibson , that the owner could combine the
two rights-of-way for a total of forty feet .
Discussion followed with respect to possible preserva-
tion of natural vegetation . It was noted that some
of the sites have a view of Lake Washington .
Comment was invited from the applicant by the Chairman .
Lyle L . Pickle , 1150 Union Avenue , Renton , stated that
it was his intention to subdivide the property for a
custom home development . He noted that while some of
the trees would be desirable for preservation , he felt
potential buyers may wish to choose between them or
the Lake Washington view. He stated that he would be
glad to work with the Planning Commission on the prob-
lem.
Chairman Ross invited comment from the audience but

The Planning Director noted that this is an initial pub-
lic hearing under the Mining , Excavation and Grading
Ordinance and that an Environmental Impact Assessment
had been requested on the property . Mr. Ericksen indi -
cated that the assessment had not yet been prepared and
was unavailable which would preclude any final action.

The Assistant Planning Director described the existing •
gravel pit operation , which includes an area north of
a single family area and incorporates all of one hill -
side , and noted the boundaries of the 90 acres , which are
located within the City limits . He pointed out single
family residential areas in the vicinity , primarily
the Maplewood area . Mr. Magstadt indicated that the
Comprehensive Plan indicates the eventual use of single
family , low and medium density development and a poten-
tial for high-rise , recreational and greenbelt areas .
He reviewed the present topography of the area and plans
for grading and excavation and eventual regrading .
Aerial photographs , slides , and maps of the area were
viewed.
The Chairman invited comment from the applicant or his
representative .
David Kennedy of Moore , Wallace , and Kennedy , 1915 - 1st
Avenue , Seattle , consulting planning and engineering firm,
noted that he represented John C. Edwards , also known as
Rainier Sand and Gravel Company , and that Mr. Edwards
was in. the audience . Mr . Kennedy cited the provision
of the Mining , Excavation and Grading Ordinance which
directs itself primarily to the compatibility of the
proposed use and adjacent uses and stated that he would
primarily direct his remarks to that matter.
Mr. Kennedy then described the history of the Edwards '
operation , noting that it was first leased by Mr. Edwards

from the State of Washington in 1939 while a coal mining facility
the land partially acquired by auction in 1940 and balance of
the site purchased in 1946, at which time it was converted to
Rainier Sand and Gravel Company. He stated that the volume
of material removed annually since that time had reached a
maximum of 400, 000 cubic yards . The area was annexed into
the City in 1947 . A crushing plant was erected in 1963,
and settling ponds were added.
Mr . Kennedy reviewed the permit procedures of th.e City of ,
Renton and the State that had been met by Mr. Edwards . A ,
permit for his grading plans was issued by the City in 1967 ,
and in 1971 another permit was granted for an excavating
plan . He stated that the State Department of Natural Re-
sources had also issued the applicant a permit under their
Surface Mining Operation Act in 1971 and that this permit
had been renewed annually since. Upon notification by the
City of Renton of the passage of their Mining , Excavation
and Grading Ordinance in 1974, an application was submitted
along with an Environmental Impact Worksheet .
Mr. Kennedy stated that it was their view that the Renton
Ordinance referred to compatibility of a proposed use and
that this had been an existing use for approximately thirty
years . He also noted an additional eighty acres under the
same ownership outside of the City limits .
Slides depicting the operation were presented by the appli -
cant and described by Mr. Kennedy, who described the general
area as covered with gravel pits and primarily used for
cemeteries , municipal uses and gravel pits . The primary
traffic flow is to Third Avenue North and some traffic to
the east on N . E . 4th Street . During the summer: months
there are twenty to forty trips on an eight hour per day
basis on Third Avenue North .
He stated that the property is fronted on the south by the
Maple Valley Highway ( SR169) . noting that the property is
bordered by major east/west arterials on both the north and
south . Mr. Kennedy stated that with regard to screening ,
landscaping and setbacks , most of the property is fenced ;
and there is a ten foot screening easement as required through
the Department of Natural Resources . There is an additional
forty foot setback from areas adjacent to residential uses
but not much landscaping . He described proposals for the
slope treatment, when the operation is •completed , stating
that these plans would go forward within one year. With
regard to unsightliness , he stated: that most of' the excava-
tion is not visible except from the air , with the exception
of the bluff to the south . He said that bluff would continue
to slide at a slow rate and could not be screened . Ulti -
mately the problem will be resolved when it is regraded .
With reference to noise and dust , he described the general
operation as consisting of a crushing procedure , which is
worked primarily in the winter with the materials held for
use during the summer . In regard to surface drainage , Mr .
Kennedy indicated that they have had settling ponds for
years and revised, plans have recently been submitted to the
Public Works Department relative to them.
Noting the requirement for Planning Commission determination
that the activity would *not be unreasonably detrimental to
the surrounding area , he stated that there were some' things
.that could be detrimental but they feel they are no more
detrimental than in the thirty years the operation has been
in business . He stated that with regard to reuse , they did

and the Commission advised that the applicant is aware of the
disagreement . Commissioner Gibson requested that the topography
of the eastern end of the site be field checked by the staff.

DENNIS R. OSTER; Appl . No . R-827-75 ; Rezone from G to R-3 ;
property located on the east side of Union Ave . N . E . approxi -
mately 500 feet south of N. E . 4th St .
The . 66 acre site directly south of the Moritz property was
described by Mr . Smith . It was noted that there are no plans
for the property at this time . The Comprehensive Plan desig-
nates the area as medium density , multi -family residential
district. In response to an inquiry from Commissioner Gibson ,
Mr . Smith indicated that sewers would be necessary for develop-
ment of the site .
SPECIAL PERMIT:
De JOHN C. EDWARDS ; Appl . No . SP-752-74 ; special permit for
existing gravel and sand excavating operation in S- 1 zone ;
property located at 2930 S. E . 5th St .
It was noted that 90 acres of the existing gravel pit are loca-
ted within the City of Renton . Its locale off the Maple Valley
Highway and north and west of the Maplewood area was pointed
out by Mr. Smith . The request for review is pursuant to the
Mining , Excavation and Grading Ordinance . Existing zoning is
S- 1 . While the present use is a gravel pit , it is proposed
to ultimately develop the area for various residential uses ,
combined with greenbelt and recreational areas . The Compre-
hensive Plan for the property indicates a combination of
single family residential ; low, medium and high density multi -
family , recreational and greenbelt uses . It was noted that
the property is about 1350 feet in depth within the City ;
topographical and natural characteristics of the site were
described. The proposed excavation plan and provisions for
drainage were noted . There is no operation at this time .
The Planning Director noted items to be considered will
involve processing of the plan , the long-range process and
rehabilitation of the site , Mr. Smith noted that the reuse
plan submitted indicates plans for a commercial shopping cen-
ter facility which is not in agreement with the Comprehensive
Plan .

Robert Boyd , Property Manager of the Burlington Northern ,
Glacier Park Company , stated that the new plan involving
"deferred development" did not change their position .
They continue to ask for some heavy industrial zoning ,
and their offer to donate 20 acres for greenbelt remains .
Responding to Commissioner Teegarden ' s inquiry , Mr . Boyd
stated that after study of the Zoning Ordinance with re-
• gard to M-P zoning , it was still their position that the
designation did not satisfy the things they wanted to do .
Vice-chairman Scholes reminded representatives of Burling-
ton Northern and Milwaukee Railroad that a great deal of
their land is zoned G, and there is no intent of the
Commission to affect the rezone of the property either
up or down , noting that it may be developed to the fullest
extent allowable in the G zone .
Further discussion continued with respect to the issue
of the method of acquisition of land for greenbelt areas ,
and it was noted by Commissioner Gibson that land devel -
opment should be made on a cooperative basis . A sug-
gestion that the issue be placed on the ballot was made
by Commissioner Rivily . Leonard Steiner spoke in support
of citizen ' s rights regarding the use of property and
noted avenues for preserving land as "open space , " if
the property owner wants to take advantage of it .
Kay Johnson , Secretary of the Renton Chamber of Commerce ,
noting the intent to continue the public hearing for two
weeks , stated that he preferred to provide his input in
writing .
Following further discussion regarding the need for fur-
ther study of recent input , possible revision of the
Environmental Impact Statement and desire for a decision
as soon as possible , IT WAS
ACTION:
MOVED BY TEEGARDEN, SECONDED BY GIBSON, THAT THE PUBLIC
HEARING BE CONTINUED UNTIL JUNE 25, 1975, AND THAT A
COMMITTEE-OF-THE-WHOLE MEETING BE HELD ON JUNE 18, 1975,
TO DISCUSS THE MATTER. MOTION CARRIED, WIK DISSENTING .
It was noted by the Planning Director that any input
received by the Department would be forwarded to the
Planning Commission . Vice-chairman Scholes announced
that the June 18th committee meeting would be an open
meeting .
The Vice-chairman declared a recess at 11 :45 p . m. The meet-
ing was resumed at 11 : 55 p . m. with all members noted above
as being present in attendance .
5 • NEW BUSINESS :
The Planning Director requested that the new items to
be considered at the June 25th public hearing be des-
scribed by the Assistant Planner. Mr. Smith pointed out
the locations of the sites involved on the vicinity map ,
noted existing and surrounding zoning , Comprehensive Plan
designations , and significant development in the vicinity ,
and described the requests for the Commission .
