PERMISSION FOR RIGHT-OF-ENTRY TO GENE COULON MEMORIAL BEACH PARK
Ms. Darling:
The City of Renton Parks and Recreation Department hereby licenses Greystar Property Management
(Permittee) and its contractor to enter Gene Coulon Memorial Beach Park (the “Park”) to place HVAC
equipment on the roof of the Bristol Apartment building(s) (the “Apartments”). The area of the Park
subject to this license is shown in Attachment “A.”
Permittee’s equipment will include:
x National NBT60 128-foot crane.
x Support vehicles.
x HVAC equipment.
Permittee’s setup will be performed as follows:
x Crane will be staged in the area indicated in Attachment “A”;
x Work areas must be identified by the use of cones, barricades and/or cautionary ribbon to
clearly make park patrons aware of construction activities;
x Cautionary signage will be placed around equipment;
x Cones will be placed in parking spaces used for this work.
x While lifting operation is in progress permittee will ensure that park patrons do not enter into or
underneath the work zone. This can be accomplished by the use of support staff wearing easily
identifiable clothing such as safety vests.
Permittee’s work is subject to the following:
x No off-pavement access is allowed. Lift equipment and support vehicles must remain within the
boundaries of the parking area at all times.
x Lifts and other heavy equipment must not travel on sidewalks or cross curbs.
Conditions of right-of-entry are as follows:
1. Permittee’s compliance with the requirements listed above.
2. A copy of this document must be in Permittee’s possession when on-site in the Park.

It is understood and agreed by the Permittee that the performance of any work under this license
shall constitute an acceptance of all provisions.
The term of this license shall begin Thursday, August 3, 2023 and shall terminate Friday,
August 4, 2023. The City retains the right to terminate this license at any time it sees fit, including
before August 3, 2023, and for any reasons it desires.
Prior to entering the Park (approximately two days prior), the Permittee shall communicate with
Parks Supervisor, Dana Appel, at (425) 766-6202 to confirm when work will be performed.
At no time shall Permittee in any way represent themselves as an employee, officer, or agent of
the City.
Vehicles shall be kept on maintained roads and in parking lots.
Overnight use of the Park is not allowed unless approved in writing by the City.
Permittee shall notify City Park staff of any unusual or unauthorized activities noted while in the
Park.
Permittee must restore and/or correct any negative physical impact to the Park to the satisfaction
of the Administrator of the Parks and Recreation Department.
Permittee shall in no way obstruct or impede access tKURXJK SDUNJDWHV. In addition,
Permittee shall take action to ensure that all work in relation to this license is conducted in a safe
and prudent manner.
Permittee must be insured for damage resulting from liability of Permittee or any of Permittee’s
agents or employees with General Liability insurance with minimum policy limits of $1,000,000 for
each occurrence/$2,000,000 aggregate for the Term of this Agreement. Permittee may be
requested to furnish to City proof of insurance in the forms and amounts satisfactory to City.
Permittee shall defend, indemnify, and save harmless the City, its officers, agents, and employees
from and against any and all claims (whether valid or alleged), demands, actions, suits, damages,
losses, judgments, liabilities, expenses and costs, including but not limited to, court costs and
reasonable attorney’s fees incurred by City on account of any such claims, demands, or liabilities,
and from loss of any kind or nature or nature arising out of, resulting from, or in connection with
this license. Permittee’s obligation shall apply whether or not there is concurrent, active, or
passive negligence on the part of the City, its agents, officers, or employees, except where the
City is solely negligent. It is further specifically and expressly understood that the
indemnification provided constitutes Permittee’s waiver of immunity under the Industrial
Insurance Act, RCW Title 51, solely for the purposes of this indemnification. The parties
have mutually negotiated and agreed to this waiver. The provisions of this section shall survive
the expiration or termination of this license.
Nothing in this Permit shall be construed to grant Permittee an easement by implication,
prescription, or any other operation of law, or to extend the term of the license past its expiration
date as stated herein.
Permittee must make all necessary precautions and coordinate all efforts with Parks and
Recreation Department staff to insure the safety and security of the Park at all times.
