HomeMy WebLinkAboutRES 4504CITY OF RENTON, WASHINGTON RESOLUTION NO. 4504 A RESOLUTION OF THE CITY OF RENTON, WASHINGTON SETTING A PUBLIC HEARING DATE REGARDING VACATION OF A PORTION OF THE EAST -WEST RIGHT OF WAY THROUGH BLOCK 15, C.D. HILLMANS LAKE WASHINGTON GARDEN OF EDEN (PETERSON STREET VACATION PETITION VAC-23-001.) WHEREAS, a petition was filed with the City Clerk on or about June 26, 2023, pursuant to the requirements of chapter 35.79 RCW and Renton Municipal Code 9-14-2, petitioning for the vacation of a portion of the east -west right of way through block 15 of C.D. Hillmans Lake Washington Garden of Eden Division No. 1, as hereinafter more particularly described, and the petition was signed by the owners of more than two-thirds (2/3) of the property abutting upon that portion of the right of way sought to be vacated, and same being described in Exhibit A, and depicted in Exhibit B, attached hereto and made a part hereof as if fully set forth herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS: SECTION I. That the 11th day of September, 2023, at the hour of 7:00 P.M., is hereby fixed as the date and time for a public hearing to consider the above -mentioned petition for vacating the Street; which hearing date is not more than sixty (60) nor less than twenty (20) days from the date of passage of this resolution. SECTION II. The City Clerk is hereby authorized and directed to give notice of the time and date of the public hearing as provided in RMC 9-14-3.A, including instructions on accessing the hearing via Zoom, if applicable, and/or providing comment, and any and/or all persons interested therein or objecting to said vacation may then appear and be heard, or they may file 1 RESOLUTION NO. 4504 their written objections with the City Clerk at or prior to the time of public hearing on the vacation. SECTION III. After the close of the public hearing, the City Council shall determine whether the vacation of the Street should be granted. If the City Council determines that the Street should be vacated, the City reserves the right to retain an easement for public utility and related purposes. SECTION IV. If the City Council determines that the Street should be vacated, at a future date to be determined, the City Council shall determine the classification of the Street to be vacated and, in accordance with the discretion provided in RCW 35.79.030, the amount of compensation, if any, to be paid by the petitioner-owner(s) to the City for such vacation.
