Street and Logan Avenue South. Bid proposals delivered in person will be received only at the office of the City Clerk in the Renton Municipal Building. Bids received after the time fixed for opening will not be considered. The successful bidder will be required to adhere to the general requirements and covenants contained in the "Standard Specifications for Municipal Public Works Construction", 1969 Edition, as prepared by the Washington State Chapter of the American Public Works Association. The work to be performed will include furnishing of all necessary labor, materials, and equipment, and performing all- work required for the installation of a storm sewer trunk, and all appurtenances, including roadway restoration as required and such other work as may be necessary, all in accordance with the plans and specifications. The City reserves the right to reject any and/or all bids and to waive any and/or all formalities. Approved plans and specifications and form of contract documents may be obtained ,•,� at the office of the City Engineer at the Municipal Building, Renton, Washington, for a deposit of $10.00 per each set. The deposit willbe refunded upon return of the Plans and Specifications in g opening. ood condition within thirty days after bid All items in this contract are a part of the construction of a public road improve- ment as defined in Rule 171, issued by the Excise Tax Division of the Tax Commission of the State of Washington, and the Owner is exempt from the payment of sales tax on all items. The Contractor shall include in his unit bid prices any compensating tax that must be paid. See Section 7.09 of the Standard Specifications. A certified check or bid bond in the amount of five (5) percent of the total ?mount of each bid must accompany each bid. Sealed bids for Proposal will be received by the City of Renton at the City Clerk's office in City Hall until 2:00 o'clock p.m., May 18, 1972 At this time the bids will be publicly opened and read after which the bids will be considered and the award made as soon as practical. No proposal may be changed or withdrawn after the time set for receiving bids. Proposals shall be submitted on the forms attached hereto. 2. The work to be done is shown on the plans. Quantities are understood to be only approximate. Final payment will be based on field measurement of actual.quantities and at the unit price bid. The City reserves the right to add to or eliminate portions of the work as deemed necessary. 3. Plans may be examined and copies obtained at the City Engineer's office. Bidders shall satisfy themselves as to the local conditions by inspection of the site. Work along highways must be in conformance.with the applicable County or State regulations. 4. The bid price for any item must include the performance of all work and the furnishing of all material necessary for completion of that item as described in the specifications. Where alternate material is bid, the bidder shall fully describe the material proposed, either in the bid proposal or supplementary letter attached to the proposal. 5. The bid price shall be stated in terms of the units indicated and as a total amount. In the event of errors, the unit price bid will govern. Illegible figures will in- validate the bid. 6. The right is reserved to reject any or all bids and to waive informalities if it is deemed advantageous to the City to do so. 7. A certified check or satisfactory bid bond made payable without reservations to the TREASURER OF CITY OF RENTON in an amount not less than 5% of the total amount bid shall accompany each bid proposal. Checks will be returned to unsuccessful bidders immediately following decision as to award of contract. The check of the successful bidder will be returned provided he enters into a contract and furnishes a satisfactory performance bond covering the full amount of the work within ten days after receipt of notice of intention to award contract. Should he fail, or refuse to do so, the check shall be forfeited to the City of Renton as liquidated damage for such failure. 8. All bids must be self-explanatory. I.' 1 k n SPECIAL PROVISIONS SECTION I GENERAL Refer to APWA Specifications except for amendments as noted. 1-1 STANDARD SPECIFICATIONS The special provisions hereinafter contained shall supersede any provisions of the Standard Specifications in conflict therewith. The Standard Specifications for Municipal Public Works Construction prepared by the Washington State Chapter of the American Public Works Association, 1969 Edition, shall be hereinafter referred to as the "Standard Specifications" and.said specifications together with the laws of the State of Washington and the ordinances and charter of the City of Renton, so far as applicable, are hereby included in these specifications as though quoted in their entirety and shall apply except as amended or superseded by these Special Provisions. A copy of these Standard Specifications is on file in the office of the Director of Engineering, Municipal Building, Renton, Washington, where they may be examined and consulted by any interested party. Wherever reference is made in the Standard Specifications to the Owner, such reference shall be construed to mean the City of. Renton, and where reference is made to the Engineer, such reference shall be construed to mean the Director of Engineering, City of Renton, or his duly authorized assistant or assistants. 1-2 ORDER OF PRECEDENCE Where conflicting information as to specifications is found in the "Standard Specifications", Plans and Special Provisions, the Plans shall hold over the "Standard Specifications" and the Special Pro- visions shall hold over both the Plans and "Standard Specifications". 1-3 TIME OF COMPLETION The project shall be completed within seventy-five (75) calendar days excluding the day of starting. Provided, however, that the City Council shall have the right upon request of the Engineering Department, City of Renton, Washington, to extend the time of com- pletion of said work. No extension shall be valid unless the same be in writing and accompanied by the written consent to such exten- sion by the surety on the bond of the Contractor. 1-4 FAILURE TO MEET SPECIFICATIONS _. In the event that any material or workmanship does not meet the SPECIAL PROVISIONS (CONT.) 1-4 FAILURE TO MEET SPECIFICATIONS (Cont.) requirements or specifications, the City may have the option to accept such material or workmanship if the Engineer deems such acceptance to be in the best interest of the City, provided, the City may negotiate payment of a lower unit price for said material or workmanship. 1-5 FIELD CHANGES Any alterations or variances from the plans, except minor adjustments in the field to meet existing conditions shall be requested in writing and may not be instituted until approved by the Enqineer or his repre- sentatives acting specifically upon his instructions. In the went of disagreement of the necessity of such changes, the Engineer's decision shall be final. 1-6 PUBLIC CONVENIENCE AND SAFETY Section 7 shall include: 1. The contractor shall be responsible to notify affected utility companies (gas, water, telephone, power, T.V. cable, etc.), prior to construction. 2. The Contractor shall notify the Police and Fire Departments in writing prior to construction and thereafter they shall -be ver- bally kept aware of changes to initial notification. Any cost incurred shall be considered as incidental and no compensa- tion will be made. 1-7 CONSTRUCTION EQUIPMENT Operators of motor vehicles used in construction or repair work shall obey traffic rules posted for such location in the same manner and under the same restrictions as provided for the drivers of private vehicles. 1-8 PROJECT CONSTRUCTION AND IDENTIFICATION SIGNS The Contractor shall furnish and install project identification signs on each end of the project one (1) week in advance of construction. The signs shall conform to the specifications as per attached sheets. One sign of each type shall be installed at each end of the project. Construction Signs The Contractor shall furnish and install construction signs which 'SPECIAL PROVISIONS (CONT.) 1-8 PROJECT CONSTRUCTION AND IDENTIFICATION SIGNS Cont. Construction Signs (cont.) conform to Part 6 of the 1971 Edition of Manual of Uniform Traffic Control. Devices for Streets and Highways, United States Department of Trans- portation --Federal Highway Administration. The cost of furnishing and placing all construction and identifica- tion signs shall be incidental to the project and no further compensa- tion will be made. 1-9 SCHEDULING OF WORK Section 8.01 of the Standard Specifications shall be deleted and the following inserted: Promptly after the award of the contract, the Contractor shall submit for approval to the Engineer, a progress schedule on a form furnished by the City. From this information a progress schedule diagram will be computed, plotted and a copy returned to the Contractor. Payment to the Contractor on any estimate may be withheld until. such a sche- dule has been submitted and approved. Payments shall be made in Cash Warrants. Partial payments on estimates may be withheld until work progress schedules as described in these Special Provisions have been received and approved. Test holes at S. 2nd Street and Logan Avenue South and South Tobin Street and Logan Avenue South will be the first order of work to determine exact elevations and locations of existing utilities. Should it become evident at any time during construction that opera- tions will or may fall behind the schedule of this first program, the Contractor shall, upon request, promptly submit revised schedules in the same form as specified herein; setting out operations, methods, and equipment, added labor forces or working shift's, night work, etc., by which time lost will be made up, and confer with the Engineer until an approved modification of the original schedule has been secured. Further, if at any time any portion of the accepted schedule is found to conflict with the contract provisions, it shall, upon request, be revised by the Contractor and the work shall be performed in compli- ance with the contract provisions. Payments of any further estimates to the Contractor after such request is made and until an approved modified schedule has been provided by the Contractor may be withheld. Execution of the work according to the accepted schedule of construc- tion, or approved modifications thereof, is hereby made an obligation J of the contract. SPECIAL PROVISIONS (CONT.) 1-10 TRAFFIC The following special provisions shall apply as directed by the Engineer: 1. There shall be, at all times, reasonable pedestrian access to and egress from the properties adjacent to the project. 2. Prior to 8:30 a.m. and after 3:30 p.m., the Contractor shall keep the existing traffic lanes clear for traffic without interference from his operations, as directed by the•Engineer. 3. Where hazardous conditions exist, proper signing and barrica- ding shall be provided as directed by the Engineer. Where designated by the Engineer, the signs and barricades shall be supplemented by lanterns or flasher units during the hours of darkness. - The handling of traffic during construction will be critical, there fore a detailed construction sequencing plan shall be submitted by the Contractor as mentioned in Section 1-9 of these provisions. 1-11 DUST AND MUD CONTROL " The Contractor shall be responsible for controlling dust and mud within the project limits and on any street which is utilized by his equipment for the duration of the project. The Contractor shall be prepared to use water trucks, power sweepers and other pieces of equipment as deemed necessary by the Engineer, to avoid creating a nuisance. All streets used by his operation shall be thoroughly cleaned at the end of each work day. Any damage caused by dust and/or mud shall be the sole responsibility of the Contractor. Complaints on dust, mud or unsafe practices and/or property damage to private ownership will be transmitted to the Contractor. and prompt action in correcting will be required. Written notice of correction of complaint items will be called for should repetitive complaints be received by the City. 1-12 STATE SALES TAX The items in this contract which are a part of the construction of a storm sewer improvement project as defined in Rule 171, issued by the Excise Tax Division of the State of Washington, are exempt from the payment of sales tax. The contractor shall include in his unit bid prices any compensating SPECIAL PROVISIONS (CONT.) 1-12 STATE SALES TAX (,,Ont.) tax.that must be paid. See Section 7.09 of the Standard Specifica- tions. 1-13 DISPUTES AND LITIGATION Any questions arising between the Inspector and the Contractor or his Superintendent or Foreman as*to the meaning and intent of any part of the plans and specifications shall be immediately brought to the attention of the Engineer and will be adjusted by him. To prevent disputes and litigation, it is further agreed by the par- ties hereto that the Engineer shall determine the quantity and quality of the several kinds of work embraced in these _mProvements. He shall decide all questions relative to the execution of the work and the interpretation of the Plans and Specifications. In the event the Contractor is of the opinion he will be damaged by such interpretation, he shall, within three (3) days, notifTi the Engineer and the City Clerk in writing of the anticipated nature and amount of the damage or damages. In the event an agreement cannot then be reached within three (3) days the City and the Contractor will each appoint an arbitrator and the two shall select a third. The decision of the majority of the arbitration board shall be binding upon both parties and shall be delivered before any work is performed upon the feature in question. The arbitration shall be conducted in accordance with the statutes of the State of Washington and court decisions governing such procedure. The costs of such arbitration shall be borne equally by the City and the Contractor unless it is the majority opinion that the Contractor's filing of the protest is capricious and without reasonable foundation. In the latter case, all costs shall be borne by the Contractor. The venue of any suit shall be in King County, Washington, and if the Contractor is a non-resident of the State of Washington, he shall designate an agent, upon whom process may be served, before commencing work under this contract. 1-14 OVERTIME FIELD ENGINEERING When the Contractor performs construction work over the accepted 8 hours per day or 40 hours per week, or on any City holiday, and the work requires inspection, then the Contractor shall reimburse the City at the rate of $12.00 per hour. The City shall have the sole authority in determining the necessity of having the overtime inspection, and _ shall notify the contractor of intent and said costs will be deducted ,qPECIAL PROVISIONS-(CONT.) 1-14 OVERTIME FIELD ENGINEERING (font ) from monies due the contractor on each monthly estimate. 1-15 DELIVERY TICKETS All delivery tickets that are required for the purpose of calculating quantities for payment must be received by the Engineer at the time of delivery. No payment will be made on tickets turned in after date of delivery of material. Payment will not be made for delivery tickets which do not show type of material, gross weight, tare weight, truck number, date and inspec- tor's initials. 1-16 SALVAGE All salvage material shall be delivered to the City yard. Any cost incurred in salvaging and delivering such items shall be con- sidered incidental to the project and no compensation will be made. 1-17 CONSTRUCTION CONFERENCE Prior to the start of construction the Engineer will call for a pre- _ - construction conference. The Contractor and his subcontractors shall attend the pre -construction conference, the time, place and date to be determined after awardance of the contract. Subsequently, a represen- tative of the Contractor will attend a weekly conference with the Owner's representative to review progress and discuss any problems that may be incurred. 1-18 FIELD OFFICE The Contractor shall provide a field office with heat, lights, and telephone in a central location on the job site for the use of the Engineer. The field office should be of sufficient size to accommodate the inspector and one or two additional personnel; so as to discuss the plans or problems that might arise during construction. 1-19 PAYMENT TO THE CONTRACTOR The Contractor is advised that Section 9.05 of the APWA Standard Spec- ifications has been revised by Senate Bill No. 164, Chapter 3, 41st Legislature, 2nd Extraordinary Session, signed 21st February 1970, which outlines the handling of the Contractor's retained monies. 1-20 OTHER CONTRACTS OR OTHER WORK It is anticipated that the following work adjacent to or within the SPECIAL PROVISIONS (CONT.) 1-20 OTHER CONTRACTS OR OTHER WORK (Cont.) limits of this project will be performed by others during the period of this Contract: 1. Construction of a bridge over the Cedar River at Logan Avenue South. 2. Roadway widening of Airport Way, including the construction of the Storm Sewer Connection for this project. 3. Railroad track removal. That portion of the construction on Burnett Avenue South between S. 2nd Street and S. 3rd Street may be deleted or the contract time extended if the railroad tracks are not removed prior to construction in paid area. The Contractor shall familiarize himself with the construction sche- dule of the other contractors working on this site. A copy of this schedule may be inspected in the office of the City of Renton, Director of Engineering. The Contractor shall coordinate all activities and schedule all work with others working on the site to avoid any delay in the work. This Contractor shall accomplish his work to avoid disruption of work being accomplished by others in the site area. In case of conflict between various contractors working on the site and this Contractor regarding scheduling, coordinating, or any other item relative to the work on this project, the Engineer will deter— mine priorities and his decision will be final. The Contractor shall, at all times, throughout the project, conduct the work in such a manner as will obstruct and inconvenience traffic or work of other contractors as little as possible. Streets shall be kept open by the Contractor except for possible brief periods, as approved by the Engineer. The Contractor shall so conduct his opera- tions so as to have under construction no greater amount of work than he can prosecute vigorously; and he shall not begin sections of the work and leave them unfinished, but shall finish the work as it pro- gresses. The Contractor shall have his Job Superintendent attend regular:weekly meetings with the Engineer, other contractors working in the area, and other interested persons. Adequate time shall be allowed in schedule for approval of any work that might interfer with other construction in the area. No additional compensation will be made by reason of any delay or other expense to the Contractor caused by other contractors working on the ,44 'SPECIAL PROVISIONS (CONY,) 1-20 OTHER CONTRACTS OR OTHER WORK Cont. site. However, any unavoidable delays to the Contractor, resulting therefrom will be adjusted in accordance with Section 5.04 of the Standard Specifications. SPECIAL PROVISIONS SECTION II TECHNICAL 2-1 REMOVAL OF EXISTING PAVING Removal of existing pavement shall cover all types and thicknesses of pavement. Payment will be by the lineal foot measured along the centerline of the pipe. The unit contract price per lineal foot for "Pavement Removal" shall be full compensation for cutting or line drilling, breaking and removing all types and thicknesses of pavement encountered in this project. 2-2 PIPE BEDDING CLASS "B" Section 61-3.03 B2 Class "B" Bedding. In last line of third paragraph of this section, "per lineal foot for each size of pipe" is changed to "per cubic yard". No back - filling of the trench until directed by the Engineer. 2-3 CONCRETE PIPE Concrete pipe shall be non -reinforced and shall conform to A.S.T.M. designation C-14-2 and shall be manufactured for use of Brant rubber gaskets or approved equal. All fittings shall be of the same material and class as the pipe. Section 61-3.05 shall include the following: The hand -placed backfill from the pipe springline to a point six inches above the crown shall be foot tamped until it is unyielding. The remainder of the trench shall be backfilled in uniform layers not to exceed 8 inches in depth and it shall be compacted to 90% optimum density using vibratory compactor of a type approved by the Engineer. 2-4 CATCH BASIN CONNECTIONS TO MAIN LINES Where catch basin connections are not made at manholes, the connections will be made as per'City of Renton Standard Plan No. 72-6. 2-5 48" EXTRA SHALLOW MANHOLE TYPE "A" As per City of Renton Standard Plan No. 72-1. 2-6 48" EXTRA SHALLOW MANHOLE TYPE "B" As per City of Renton Standard Plan No. 72-2. 2-7 EXTRA DEPTH FOR 48" EXTRA SHALLOW MANHOLE TYPE "B" As per City of Renton Standard Plan No. 72-2. All catch basins shall have traps unless otherwise specified in writing by the Engineer. 2-12 SAWING PAVEMENT This item refers only to the sidewalk and curb removal on S. 2nd Street between Shattuck Avenue South and Morris Avenue South and catch basin installation under sidewalks. Saw cut to 1" minimum. 2-13 REMOVE CEMENT CONCRETE SIDEWALK Removal of cement concrete sidewalk shall be per Section 52-2.06 of the Standard Specifications. Any curb removal necessary shall be considered incidental to the sidewalk removal and no further compensation will be allowed. 2-14 CEMENT CONCRETE PAVEMENT PATCH Section 54-4 is hereby modified in that payment shall be by the lineal foot as measured along the centerline of the pipe. This includes restoration around manholes, catch basins and other appurtenances. 2-15 COLD MIX ASPHALT Cold mix asphalt shall be placed and compacted 0s directed by the �I Engineer. The unit price per ton for cold mix asphalt shall be full compensation for furnishing all labor, materials, equipment and all incidental costs necessary to furnish and place cold mix asphalt. 2-16 TRUCK MEASURES AND WEIGHTS All trucks which are to be used on this project shall be measured by the Engineer prior to any construction. The contractor to furnish an airgauge calibrated in ounces. 2-19 FINISHING AND CLEAN-UP Section 68-1. This section shall include all existing appurtenances connected to the new construction.
