Dear Mr. Pham and Ms. Tran:
Enclosed is a bill for civil penalties which you have incurred for violating the Code of the King County
Board of Health ("Health Code"). The violations include (i) allowing sewage at your above -referenced
property to discharge to the ground surface, and (ii) failing to connect your malfunctioning on -site sewage
system to the Renton Sewer District's public sewer system.
On or about July 16, 2004, the Public Health Department ("Public Health") issued you a Notice and Order
(Certified Mail Number 7002 2030 0006 9168 2389, copy enclosed) pursuant to Health Code Chapter
1.08 and Title 13. The Notice and Order directs you to have your property connected to the Renton
Sewer District's public sewer system. In addition, the Notice and Order warns that civil penalties ($25
per day) would be assessed against you if the corrective actions were not completed before August 12,
2004.
After the compliance deadline, Public Health staff observed that the Health Code violations on your
property remained uncorrected. However, in an effort to encourage you to act to get your property
connected to the public sewer system, Health & Environmental Investigator Dave Christensen agreed to
refrain, for a limited time, from causing civil penalties to be assessed against you, on condition that you
provide him with weekly updates on your progress toward securing funds to pay for the sewer connection.
As of the date of this letter, you have failed to connect to the public sewer system and to keep Mr.
Christensen informed of your progress, despite his attempts to contact you. Consequently, you have
incurred $1600.00 in civil penalties as of October 15, 2004.
Penalties will continue to accrue until the sewer connection has been lawfully completed and Public
Health staff have verified such completion. You must also cause the on -site sewage system on your
property to be lawfully decommissioned. This means the septic tank must be pumped by a licensed
pumper, the lid must be removed or destroyed, and the tank must be filled with soil.
One or more liens may be recorded against title to your property for the civil penalties accrued. In
addition, this matter may be referred to the King County Prosecuting Attorneys' Office for further legal
action. We therefore urge you to complete the lawful corrective measures without further delay.
If you have any questions concerning the King County On -site Sewage Regulations and corrective actions
required for the on -site sewage system on your property, please contact Environmental Health Specialist

On December 16, 2003 and April 23, 2004 inspections were made at the described property. At
those times it was found that Grey water was being discharged onto the lawn and there was a pump in
your septic tank rigged to pump septic effluent onto. the ground. There was evidence that sewage had
been discharged on the surface of the ground in different locations on your lawn and that your septic
system is failed.
In June of 2004 you may have received a second Notice of Violation stating you may repair
the septic system instead of hooking up to sewer. Further investigation has shown that a
satisfactory repair can not be made, so Renton Sewer district is again requiring hook up to
their sewer. Please disregard any correspondence from Public Health Seattle King
County that allows you the option of repairing your septic system.

MISDEMEANOR PROSECUTION:
Pursuant to Health Code Section 1.08.050, each willful or knowing violation of public health rules and
regulations is a .misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00) and/or
imprisonment in the county jail for a term not to exceed ninety (90) days. Each day such violation
continues shall be considered an additional offense.
DUTY TO NOTIFY:
You have the duty to notify the Health Department of any actions to correct the above -described code
violations you have taken since the receipt of this Notice and Order.
APPEAL:
Any person aggrieved by this order may appeal the Notice and Order to the King County Hearing
Examiner, provided the appeal is made in writing, states the decision being appealed and the reasons for
seeking an appeal hearing, and filed with the Seattle -King County Department of Public Health,
Environmental Health Administration, 999 Third Avenue, Suite 700, Seattle, WA, 98104, within ten (10)

Enclosed is the sanitary sewer extension agreement that you both must sign in the presence of a
notary public prior to connecting to the sewer main that the City of Renton will install in front of
your home. Please contact me to arrange for a City of Renton notary public to provide this
service at no cost.
The City will be using LaValley Backhoe LLC to perform the sewer main and stub installation. I
will call you when they plan to perform the work. You may want to contact them now and
