Inc. harmless from any claim, loss, lien or liability arising out of or in connection with this
project.

REQUEST FOR PERMISSION TO PERFORM SURVEY
SUBJECT PROPERTY ADDRESS 325 RAINIER AVENUE SOUTH
Dear Ms. Phelps:
The City of Renton is evaluating a sewer improvement on a portion of the Renton Center
Property, located at 325 Rainier Avenue South. Attached are two drawings, the first showing the
general layout of the subject parcel, and the second drawing showing the proposed area for
survey. The survey work will consist of a standard topographical survey. As such, we anticipate
negligible impact to the local businesses.
The City is pursuing this work as we currently spend a considerable amount of time maintaining
the downstream portion of the private system that serves the Torreros / Blockbuster site on your
property, as well as the southerly storefronts on Rainier Avenue South. We receive excess
amounts of grease into our system, and we have a difficult time determining who is at fault. The
scope of the work would potentially include the City replacing the existing private system with a
new City -owned sewer main that will allow us to install appropriate testing tees to monitor grease
releases from each of the businesses that feed into this system. This will allow the City to isolate
where the problems exist and work with that business to take appropriate corrective action.
The first step in this process is to seek permission from each of the property owners to perform
the topographical survey work. We will notify all affected property owners approximately two -
weeks in advance of performing any work. Page two of this letter is a Right of Entry form for
you to complete in order to permit the City access to your property to perform the survey work.
Attached is a self-addressed stamped envelope for you to return this form.
Once we receive this approval and perform the survey work, we will develop design options and

work associated with the Renton Center sewer extension project. Our proposed scope of work
and fee is outlined in the attached Exhibit "A". As discussed, this fee includes the additional
work on the lift station at Earlington Sewer Extension.
It is our understanding that this task will be incorporated into the Surveying Services Agreement
we currently in place have with the City of Renton on the Earlington Sewer Extension project,
dated June 7, 2005 (CAG-05-092). Your signature below will acknowledge acceptance of our
proposal, and serve as our authorization to proceed. I've enclosed an additional copy of this

Surveying Services Agreement dated June 7, 2005
between CITY OF RENTON and
TRIAD ENGINEERING & PLANNING ASSOCIATES, INC.
TASK 3 — TOPOGRAPHIC SURVEY — RENTON CENTER SEWER
This task includes:
• Obtain ground elevations along the centerline and 50 feet each side of the centerline of the proposed
sewer route on an approximate 50-foot station interval plus elevations along obvious topographic
breaks.
• Obtain location and finish floor elevation of existing structures within 100 feet of proposed sewer
route.
• Obtain location of the following improvements with elevations:
a) Edge of asphalt, curbing, sidewalks and other surface improvements on the property that are
within the proposed sewer right-of-way.
b) Catch basins, culverts, sewer manholes, fire hydrants, valve boxes and other utilities which are
observable from surface exploration on the property and within the proposed sewer right-of-way.
• Research to show location of parcel boundary lines along proposed sewer route.
• Research of available utility records for storm sewer, sanitary sewer, water, power, telephone, cable
TV and natural gas. Location information will be interpreted from these records for use in the drawing
but are typically not accurate. The purpose in showing these on the drawing is to indicate that they
are believed to exist in the vicinity of the project.
• Preparation of a drawing at a scale of 1" = 20' showing the location information noted above together
with the topographic relief shown via contours of equal elevation at a 1-foot contour interval. Drawing
will be a draft paper drawing for review by the City.
• Preparation of an AutoCAD file in Version 2004 showing all information identified in above items.
This task does not include:
• Resolution of physical encroachments/occupation that may be disclosed by field survey.
• Discovery of easements or other matters materially affecting the property which are not disclosed by
the title report.
Assumptions:
• Route survey per the sketch attached as Exhibit "B".
• Vertical Datum for this map will be NAVD '88.
• A published and acceptable bench mark exists within 1/2 mile of the project, and within 250 total
vertical feet.
• Client will notify owners of purpose of survey and will confirm permission is granted for access to
properties to conduct survey.
• The project is known as the Renton Center Sewer Extension.
FEE: Time & Expense
(Budget not -to -exceed $6,000 without further approval from Client)
GENERAL NOTES & ASSUMPTIONS FOR ALL TASKS
1. Fees billed at time and expense are calculated according to Consultant's standard hourly rate
schedule in effect at the time the work is performed. Standard hourly rates are subject to annual

To Whom It May Concern:
The City of Renton is evaluating a sewer improvement on properties generally located in the
Renton Center Complex, along Rainier Avenue South. Attached are two drawings, the first
showing the general layout of the subject parcel, and the second drawing showing the proposed
area for survey. The survey work will consist of a standard topographical survey. As such, we
anticipate negligible impact to the local businesses.
The City is pursuing this as we currently spend a considerable amount of time maintaining the
downstream portion of the private system that serves the Motorcycle Works site on your property,
as well as the adjacent storefronts on Rainier. We receive excess amounts of grease into our
system, and we have a difficult time determining who is at fault. The scope of the work would
potentially include the City replacing the existing private system with a new City -owned sewer
main that will allow us to install appropriate testing tees to monitor grease releases from each of
the businesses that feed into this system. This will allow the City to isolate where the problems
exist and work with that business to take appropriate corrective action.
The first step in this process is to seek permission from each of the property owners to perform
the topographical survey work. We will notify all affected property owners approximately two -
weeks in advance of performing any work. Page two of this letter is a Right of Entry form for
you to complete in order to permit the City to access your property to perform the survey work.
Attached is a self-addressed stamped envelope for you to return this form.
Once we receive this approval and perform the survey work, we will develop design options and
share them with you yo have any questions regarding this request, please contact me at 425-
430-7212.

Dear Mr. Christensen:
With respect to the above -referenced site, we understand that the City of Renton
("City") is requesting approval from Jack in the Box Inc. ("JIB") to perform a
topographical survey in order to scope a potential sanitary sewer main installation
project ("Work") at the above -referenced JIB restaurant site ("JIB Property").
This letter agreement is intended to set forth the parties' agreement with respect
to the Work, and by its execution hereof JIB hereby grants the City access to the
Property and approves the Work subject to the provisions and conditions set forth
below. The parties agree as follows:
The Work shall be completed in accordance with the plans and
specifications attached hereto as Exhibit "A".
2. The Work shall be performed by the City at its sole cost and expense.
The City assumes all risk associated with the performance of the Work,
and shall indemnify, defend and hold JIB and its agents, representatives,
assigns, employees, officers and directors, harmless from and against any
and all claims, demands, actions, judgments, losses, liabilities, costs or
expenses of any kind, including without limitation, attorneys fees and
costs, incurred or arising directly or indirectly out of or in connection with
the performance of the Work or the entry onto the JIB Property. In no
event shall JIB or JIB's insurance carrier be liable for any loss, cost,
damage or expense arising out of death of or injury to persons, or loss of
or damage to property caused by or resulting from the negligence of the
City or its servants, employees and/or agents.
3. The Work shall be performed in such a manner that will not interfere with
access to the JIB Property or otherwise interfere with the ongoing
operations of JIB.

4. The Work shall be completed in a prompt and timely manner. This
agreement shall expire three months following the date of this Agreement
as indicated on the first page.
5. The City shall repair or replace, in whole or in part, any and all
landscaping or other improvements which are damaged or disturbed, in
any manner, by the Work. Said landscaping and improvements shall be
restored to their prior condition, including the replacement of equivalent
products (plants, etc.).
6. The terms of the agreement contained herein shall remain in full force and
effect until the completion of the Work. The covenants contained in this
agreement shall be binding upon and inure to the benefit of JIB and its
respective grantees, successors and assigns.
7. If either party to this letter agreement institutes any action or proceeding in
court to enforce any provision hereof, for damage by reason of an alleged
breach of any provision of this letter agreement, for a declaration of such
party's rights or obligations hereunder, or for any other judicial remedy, the
prevailing party shall be entitled to receive from the losing party such
amount as the court may adjudge to be reasonable attorney's fees for the
services rendered the party finally prevailing in any such action or
proceeding.
If the foregoing terms are acceptable, please execute a copy of this letter
agreement in the space provided below and return it to me at your earliest convenience.
In addition, please coordinate with Vanessa Fox at 858-571-2649 when the City is in a
position to commence the Work.
