and abligatians set forth and described in Paragraphs 1 thraugh 9 below with regard to the

1. The Grantor(s)or his/her(their)successors in interest and assigns("Owners")shali at their own
cast,aperate,rnsintain,and keep in gaod repair,the Property's drainage facilities eonstructed
as required in the approved construction plans and specifications N�A (Pro�ect
Plan�)on file with the City of Renton ancl submitted to the City of Renton for the review and
approval of permit(s} �23002�41 (Canstructian/Suilding/UtilityParmii#).The
` Property's drainage facilities are showr� and/or listed on Exhibit A—Site Plan.The Property's
drainage facifities shalt be maintained in compliance with the operation and rriaintenanee
schedule included and attached herein as Exhibit B—CAperations and Maintena�nce. Drainage
facilities include pipes, channels, flow control facilities, water quality facilities, on-site best
management practices (BMPs) and other engineered structures designed to manage and/or

treat stormwater on the Property. On-site BMPs include dispersion and infiltration devices,
� biaretentian, permeable pavements, rainwater harvesting systems, tree retention credit,
reduced impervious surfae�footprint,vegetated roofs and other measures designed to mimic
pre-develaped hydrology and minimize stormwater runoff an the Property.
2. City af Renton ShaU h8ve the right to ingress and egr�ss over thase portians of the E�roperty
necessary ta perform inspections of the stormwater facilities and BMPs and conduct
maintenance activities specified in this Declaration of Covenant and in accordance with the
Renton Municipal Code.City of Rentan shall provide at least thirty(30)days'written natice to
�he Owners that entry on the Property is planned for the inspection of drainage faeilitfes.After
the thirty(30)days,the Owners shall allow the City o�Renton to enter for the sole purpose of
inspecting draine,ge faciliti�s. In li'eu of inspection by the City,the�wners may elect to engage
a licensed civil engineer registered in the st�te of Washington who has expertise in drainage to
inspect the drainage facilities and prouide a written report descrikaing their conditian. If the
engineer aption is chosen,the Owners shail provide written notice#o the City af Renton within
fifteen(15)days of receivin�the City's netice of inspection.Within thirty(30)days af giving this
notice,the Owners,or engin�er on behalf of fhe Owners,shall pravid�the engineer"s report to
the City af Renton. If the report is not provided in a timely manner as speeified above,the City
of Renton may inspect the drainag�facili�ies without further notice.
3. If City of Renton determines from its inspection, or from �n engineer's report provided in
accardance with Paragraph 2,that maintenance,repair, restoratdon,and/or miti�atian work is
required to be done ta any of#he drainage facilities,City of Ren�Con shall notify the Owners of
the specific maintenance, repair, restoration, and/c�r mitiga�iarr work ("Work") required
pursuant to the Renton Municipal Code.The City shalB also set a r�asonable deadline for the
Qwners ta complete the Work,or to pravide an engineer's report that verifies completion of
the Work.After the deedline has passed,the Owners shall allow the City access to re-inspect
the dra�na�e facilities unEess an engineer°s report has been provided verifying completion af
the Work. if the Work is not campleted within the time fra�me set by the Ci#y, the City may
initiate an enforcement action ar�d/or perForm the Vti/ork and hereby is given access to the
Property far suCh purpases, Written notice will be sent to the Own�rs stating the City's
intentian to perform such Wark.This Wark will nat commence until at least seven(7)days after
such notice ls mailed. if, within the sole discretion of the City, fhere exists an imminent ar
present danger, the seven (7) day notice period will be waived and Wark will be�in
immediately.
4. The Uwners shall assume all responsibility for the cosfi of any Work,or any measures taken lay
the City to address canditians as described in Paragreph 3. Such resp+�nsibility shall inciude
reimbursemerat to the City withln thirty(30)days of th2 r�ceipt of the invaice for any such iNork
performed. Qverdue payments will require payment of interest at the maxirnurn I�gal rate
allowed by RCW 19.52.0�0(currentiy twelve percent(1290)}. If the City inifiiates legal action to
enforce this agreement,the prevailing party in such action is entitled to recaver reasonable
" litigatian casts and attarney's fees.
S. The Owners are required to obtain written approval frorrt City of Rent�n priar ta filling,piping,
cutttng,or removing vegetation(except in routine landscape rnainfenancej in open vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), ar perForming any
a9teratiorrs or modifications to th�drainag�facilities referenced in this Aeclaration of Covenant.

6. Any notice or consent required to be given or otherwise provided for by the provisians of this
Agreement shall be efFective upcan personal delivery,or three(S)days after mailtng by Certified
Nlail,return receipt requested.
7. With r�gard to the matters addressed herein,this agreement constitutes khe entire agreement
between the parties, and supersedes a!1 prior discussions, ne$otiations, and all agreements
whatsaever whether aral or written.
�. 'This Declaration of Covenant is int�rsded to protect the value and desirability and promote
efFicient and effective management af surFace water drainage of the real property described
ahove,and shall inure�a the benefit of all the citizens of the City of Rentan and its successors
and assigns. This Declaration o# Covenant shall run with the land and be binding upon
Grantor(s),and Grantor"s(s")successQrs ir� interest,and assigns.
9. This Declaration of Covenant may be terrninated by execution of a writt�n agreement by the
Owners end the City that is recorded by King Caunty in its real properky records.

Your praperty contains an on-site BMP(best management practice)cailed"limited ir�filtration,"which
was installed to mitigate the stormwater quantity and quality impacts of same or all of the impervious
surfaces an your property.
1Limited infillration is a methad of soaking runoff from impervious area(such as paved areas and roofs)
into the ground.lnfiltration devices,such as gravel flled trenches,daywells,and graund surface
deprassions,facilitate this process by putting runoff in direct�ontact wit}t the sail and holding the
runoff long enough to soak most of it►nto the ground.To be successful,the soil conditi�an around the
infiltration device must be able to soak r�vater into the ground for a reasonable nurnber af years.This
an-site BMP shall be maintained per Appendix A of the City of Renton's Surfac�Water 17esi�n
Manual.

Ta be successful,the soil oo»ditic�n araund the infiltration device must be able to soak water into the
ground for a reasonable nurnber of years.
� Infiltration devices rnust be inspected annually and after rnajar starm events to identify and
repair any physicai defects.
� Maintenance and aperation of the systern should fbcus on ensuring the system's viability by
preventing sediment-laden flows from entering the device. Excessive sedimentatian witl result
in a plugged or non-functioning facility.
• If the infiltration device has a catch basin,sedimeiit accumulation must be removed on a yearly
basis or rnore frequently ifnecessary.
* Pralonged ponding aroixnd or atop a device may indicate a plugged facility.If the device
becornes plugged,it must be repla�ed.
+ ICeeping the areas that drain ta infiltration devices well swept and clean will enhance the
, longevity of these devfces.
* For roofs,frequent cteaning of gutters will reduce sediment loads ta these devices.

These limited infilYration on-site SMA maintenance and aperafion instructinns must be recorded as an
attachrnent to the required declar�tflon of covenant and grant of easement per Requirement 3 of
Section C.1.3.4 of the City of Renton Sur^face Water Design Manual,The intent of these instructions is
to explain to future property owners,the purpose of the BMP and how it mnst be maintained and
operated.These instructions are intended to be a rniniamurn;the�ity of Renton may require additional
instructions based on site-specific conditions.See the City of Renton's Surfaee Water Design Manual
website�far additional information and updates.
