AGREEMENT
By and Between
THE CITY OF RENTON
And
KING COUNTY FIRE PROTE=CTION DISTRICT#40

This Agreement amending CAG-08-015 is entered into this day of , 2013 (the
"Effective Date"), by and between the City of Renton, Washington, a noncharter code city
under RCW 35A, and a municipal corporation under the laws of the State of Washington
(hereinafter"Renton"), and King County Fire Protection District #40 (hereinafter "District 40"),
a State of Washington municipal corporation, jointly referred to as the "Parties", to mutually
address the project management of the demolition of Fire Station 42, located at 10810
Petrovitsky Road, Renton;WA 98055.
WHEREAS, on March 1, 2008, King County Fire District 40 entered into a long-term
contractual relationship with Renton, described in CAG-08-015, to provide fire and life safety
services to the citizens of District 40, and
WHEREAS, the Contract provides that District 40 shall be responsible to fund all major
capital repair and replacements (above$5,000.00), and
WHEREAS, Renton's Facilities Division has the requisite experience and expertise to
provide project management services on behalf of District 40 for the singular demolition of Fire
Station 42 and attached storage containers and previously decommissioned fuel tank which
property was not included in CAG-08-015,and
WHEREAS, the agreement for work at this property should not extend past the
completion of the demolition,and
WHEREAS, the Parties, pursuant to RCW 39.34 (Interlocal Cooperation Act), enter into
this Agreement to set forth the duties and responsibilities of the Parties with regard to the
project management of the demolition of Fire Station 42.
NOW THEREFORE,the Parties agree as follows:
1. . Renton agrees to provide a Project Manager, in this case the Facilities Director
and designee(s) as necessary; to fulfill the responsibilities of project management. The Project
Manager duties will be to represent the best interests of District 40 during the environmental
assessment and subsequent mitigation, creating create a scope of work, coordinate the bidding
process according to the provisions set forth in State law, supervise the activities of the various
contractors and consultants, provide for the erection of temporary construction fencing and the
modification and expansion of existing perimeter fencing, and review the billing to assure its
accuracy and appropriateness.
2. District 40 agrees to reimburse Renton five percent (5%) of the project's total
cost for all contracted activities indicated above those costs entirely subject to Commissioners'
approval. -
3. The Parties agree that this Agreement is made in the spirit of cooperation in
order to facilitate the orderly demolition of Fire Station 42.
4. The Parties agree that the City of Renton shall retain and manage a third-party
who shall be responsible for the -actual demolition of Fire Station 42, and King County Fire
District 40 shall pay the City of Renton the aforementioned five percent (5%) of the project's
total cost, and one hundred percent(100%)of the actual demolition costs to the contractors for
Fire Station 42.
IN WITNESS WHEREOF, the undersigned have executed this ILA as of the Effective Date.
