Sections 1 -04.4 and 1-04.5 of the 2010 Standard Specifications shall govern the issuance of this Change Order. The work of
this contract is herein modified to include the change detailed below. Additional quantities for existing and new items shall
constitute the complete and final settlement for all costs of labor, material, equipment, overhead, profit, permit fees, damages
(whether direct or indirect), and all other claims by the contractor as a result of this change.
The time for completion is not changed by this Change Order;
zero worldng days are hereby added to the contract.

Reason for Change:
At BNSF's request, the specification for Subballast is revised to meet a 1 -1/2" CSBC as provided by
CADMAN High Rock Quarry. Atkinson requested an additional $3.18 per ton in addition to costs for
Bid Item No. 12 Subballast to provide this material. This added compensation is the result of a longer
haul from KLB's original source to the source that could provide a material acceptable to BNSE
New Bid Item No. 139 Subballast —Added Cost for Revised Specification, will be added to the con-
tract and will be paid per Ton. The estimated quantity for this material is 2,160 Ton. New Bid Item
No. 139 Subballast — Added Cost for Revised Specification, will be paid in addition to existing Bid
Item No. 12 - Subballast.
The Tukwila yard stockpile material was tested for contaminates on February 22, 2012 and
the results indicated detectable levels of Lead and Arsenic. The detect levels for Arsenic and
Lead are less than Statewide and Puget Sound background concentrations as reported in
Ecology Publication 94 -115, Natural Background Soil Metals Concentrations in Washington
State. The material is not considered a regulated waste however the detectable levels signifi-
cantly reduced the receiving sites that will accept it. The Contractor's designated waste site of
Cadman has confirmed they will not accept it after reviewing the test results.
The removal of the stockpile is included in the quantity for Roadway Excavation Including
Haul. However the permitted receiving site is a longer haul from the original waste site and
the disposal fees are more. It was deemed prudent to time the removal of this material with
the import of the subballast since the receiving site and pit site are in the same general area.
To compensate the Contractor for additional haul and disposal of the material new Bid Item
No. 140 — Dispose of Existing Stockpile Material, will be added to the contract and will be paid per
Ton. The estimated quantity for this material is 1,150 Ton at a price of $18.51 per ton.
Add the Following New Items to Contract CAG 11 -133:
Description:
Provide subballast material matching the composition and gradation of CADMAN High
Rock Quarry 1 -1/2" CSBC. Unit price is to include all additional costs for material and haul-
ing.
Dispose of Existing Stockpile material while back hauling for delivery of Subbalast material
for the west shoofly. Unit price is to include all costs for hauling and disposal.
New Bid Items 139 and 140 represent full payment for all labor, equipment, and material nec-
essary to construct the revised access road as described in this change order.
