bytheparties.IntheeventitisnecessaryfortheCountytoincurattomey’sfees,legalexpenses,orothercoststoenforcethepnrvittonsoftitiasection,allsuchfees,expenses,andtestsshallherecoverablefromthePermittee.intheeventitisdeterminedthatRCW4.24.115appliestothisagreement,thePermitteeagreestodefend,holdharmless,andindemnifyKingCountyInthemaximumextentpermittedthereunder,andspecificallyforitsnegligenceconcurrentwiththatofKingCountytothefullextentofPermittee’snegligence.Permitteeagreestodefend,indemnify,andholdharmlesstheCountyforclaimsbyPermittee’semployeesandagreestowaiverofitsimmunityunderTide51RCW.whichwaiverhasbeenmutuallynegotiatedbytheparties.11.ASSESSMENTS-PermitteeshallberequiredtopayanygeneralorspecialastessmentsincurredbyKingCountywhicharedirectlyattributabletoorarisingfromanyactions,occupancy,orusageauthorizedherein.12.ABATEMENTOFUNSAFECONDITIONS-TheCountyrepresentativemayatanytime,do,order,orhaveduneallworkconsiderednecessarytorestoretoasafeconditionanyaresdescribedinPermitleftbythePemdtteeinaconditiondangeroustolifeorproperty.ThePemnitteeshallpay,upondemand,totheCountyallcostsofsuchwork,materials,etc.NothingintinssectionshallrelievethePermitteeofdutiesunderTermsandConditionsNo.2above.AAF-RES-500aPrintedOs:/2/2O12Pageaeta 13.NOTICE.Permitteeagreestoobtaininformationfromotherutilityoperatorsregardingthelocationandcurrentatatusoftheieinstallationabeforestaffingwork.Propertyowneraadjoining,orinproximityto,theprojectaadearribedhereinshallbenotifiedbyPermitteewhensuchpropertyisexposedtothepossibilityofinjueyordamagethroughperformanceofworkontheprojectauthorizedbythisPermit.Pcrmittccshallmakealladvancearrangementsnecessarytoprotectsuchpropertyorutilityfrominjuryordamage.14.OTHERAPPLICABLELAWS-issuanceofthisPermitdoesnotinanywayrelievethePermitteefromcomplyingwithanyotherapplicablelawsinperformingtheworkaubjecttothisPermit.15SPECIALTERMSANDCONDITIONS:s.ThepermineewillreainctalluseofKingCountypmpertytothoaedescribedintheLetterdated11/29/06andshownontheattachedsiteplans,b.Ifatanytimetheauthodeeduseofthispermitcreatesaconditionwhichcouldposeadangertothepublic,thePennitteewillberesponsibleforpostingtemporarysignage.usingapprovedbarricades,ortakingotherapprovedmeasurestofacilitatecontinuedsafeuseoftheproperty.c.Theparmitteeshallrestorethepropertytoitsoriginalorbetterconditionuponcompletionofthework.d.Thepermitteeshallbereapnnsiblefortherepairand/orreplacementofanyimprovementsdatnagedasaresultoftheauthorizedactivitiesassociatedwiththispermit.e.Thepermitteeahaflberesponsibleforobtainingandprovidingproofofallnecessarypermitspriortobeginningwork.f.Thepermistceshallnotmakeanyadditionalimprovementsoralterationatothepropertythatisnotspecificallyaddressedinthispermit.g.KingCountyreservestherighttoactadditionaltermsasunforeseenconditionsatthistime,maywarrantinthefuture.AAF-RES-ttOoaPrintedOn:6126/2012Page3ot5
