ECF- 011-87 and SA-014-87 This is to inform you that the Environmental Review Committee met on October 28, 1987, and reconsidered its earlier Site Plan Review recommendations on this project. Specifically, the Committee deleted Item 2. which stated: "A revised site plan showing a joint access driveway with the property to the north and modified parking layout between Building A and B. " Because Building .A has loading doors on both sides of it, i.e. , on both its north and south facades, it would not be possible to resite the parking area along the north facade of the building with driveway access along the north property line. After discussions with Jerry Lind on September 15 in which I agreed with the advantage of a joint access , I attempted to contact the property owner to the north. My original contact was by letter on September 23rd and was followed by a meeting on September 29th. To-date, no agreement for joint access is forthcoming. . I will continue to pursue this joint access , however, I cannot continue to delay the construction of this project . Therefore , I request that this condition be qualified as discretionary and that the site plan remain unchanged. SUMMARY OF REQUEST: The applicant seeks site plan approval to allow the construction of an auto service center consisting of two buildings having 9, 720 sq. ft. COMMITTEE REVIEW: The review was conducted at 10 : 00 a.m. on April 27, 1987, in the third floor conference room of the Renton Municipal Building. The Committee review was conducted after receiving written comment from all divisions of the Public Works Department, both divisions of the Building and Zoning Department, and the Fire, Police, Parks and Policy Development Departments. The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No. 2 Site plan (received February 10, 1987) . Exhibit No. 3 Landscape plan (received February 10, 1987) . Exhibit No. 4 Building elevation plans. Exhibit No. 5 Preliminary site improvement ' s plan FINDINGS, CONCLUSIONS AND DECISION Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, Buchan Brothers Construction, has requested site plan approval to allow the constructinn of an ,.,�� Site Plan Review Com .tee 'City of Renton 111 Report and Decision Buchan Brothers Construction • Page 2 3 . Pursuant to the City of Renton' s Environmental Ordinance and SEPA (RCW 43 .21C 1971 as amended) , a Determination of Non- Significance - Mitigated has been issued for the subject proposal by the Environmental Review Committee, the responsible official. The determination was issued subject to the following conditions: a. That the applicant either provide plans prepared and stamped by a geotechnical engineer supporting the use of a rockery at the site or provide revised drawings detailing retaining walls where rockeries are shown on existing plans. b. That the applicant provide a landscape buffer composed of evergreen vegetation along that portion of the west half of the south property line near Building B. c. That mechanical equipment not exceed a noise level of 75 decibels measured at the rear property line. d. That all lighting shall be shielded at the source to ensure that it does not result in visible glare off site. e. That the businesses in the auto center not operate during evening and weekend hours. 4 . Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject proposal is consistent with the Comprehensive Plan designation of Commercial as well as the exiting zoning designation of B-1, Business Use. 6. The site plan as presented provides sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton. The project requires 24 parking stalls and the applicant has provided 34 parking stalls. . 7. The two one-story buildings together will provide 9,720 sq. ft. of space. Building A will consist of 6, 000 sq. ft. and Building B will consist of 3,720 sq. ft. 8. The site is part of the original townsite. The commercial zoning designation of B-1, Business Use has been on the site since 1953 when the City adopted a zoning map and zoning code. 9 . The applicant proposes landscaping along Rainier Ave. N. , the north property line and a terraced landscaping area along the steep bank of the west boundary line. 10. The site consists of an office building and garage serving a used car lot of approximately 1000 sq. ft. 11. The subject proposal provides for adequate air and light as well as preservation of property values in the immediate area. Conclusions: 1. The proposed development is consistent with the land use policies and codes of the city of Renton. The applicant still needs to meet the specifics of construction related codes (Building, Fire, and Public Works) . Redevelopment of -the site will increase the tax base of the City and will provide additional employment opportunities. 2 . The project as mitigated, will have a minimal impact on surrounding properties. Additionally, the noise and unsightliness of the work areas when the doors are open will Site Plan Review Com tee -City of Renton Report and Decision Buchan Brothers Construction • Page 3 be minimized due to the orientation of the buildings which face one another. The applicant should try to keep the roll- up doors of the first three doors on the northern side of Building A closed to reduce impacts to the north property owner. 3 . The applicant is proposing two driveways for the site. The northern most driveway is close to the driveway of the adjacent property owner. In order to limit the number of curb cuts along Rainier Ave. N. , a busy arterial street, the applicant should work with the adjacent property owner on a joint access agreement and thus eliminate the need for the north driveway. Finally, the existing driveway must be 30 feet in width. This will enable a safe pedestrian environment along Rainier Ave. N. 4 . On-site vehicular circulation needs to be enhanced. Between Buildings A and B, the applicant shows 10 ft aisle widths. This is not enough to provide adequate maneuvering on site. A minimum of 24 feet should be provided. Further, this parking area should be broken up with landscaping. This can be accommodated since the applicant is providing more than the necessary required parking stalls. 5. This business is located on the Renton "loop" . The Police Department, in order to discourage loitering on the business property, requests the applicant provide posts at the driveway entrances so the parking lot can be chained off if need and that "No Trespassing" signs be placed in the parking lot. 6. The proposed landscaping plans will need to be enhanced. The applicant shall work with the City's landscape architect on an acceptable plan. Decision: The subject application for Buchan Brothers Construction, file SA- 014-87, is approved subject to the following conditions: 1. Compliance with the condition of the Determination of Non- Significance issued by the Environmental Review Committee for the project. 2 . A revised site plan showing a joint access driveway with the property to the north and modified parking layout between . Building A and B. 3 . A revised landscaping plan per the recommendation of City's landscape architect. 4 . Meeting Fire and Building Code Requirements as well as providing the necessary off-site improvements identified by the Public Works Department. 5. Providing posts and "No Trespassing" signs at entrances to the property form Rainier Ave. N. Any aggrieved person feeling that the decision of the Site Plan Review Committee is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior meeting may make a written request to the Zoning Administrator for review by the Site Plan Committee within fourteen (14) days of the decision. This request shall set forth the specific errors relied upon by such appellant, and the Committee may, after review of the record, take further action as it deems proper. If an appeal is made to the Hearing Examiner, requests for reconsideration will be forwarded to that office for consideration at the same time as the appeal. AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B) (1) , which requires that such appeals be filed directly with the Hearing Examiner. Appeals must be made in writing before 5 p.m. on September 14 , 1987 , accompanied by a $75. 00 fee and other specific requirements. THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. All communications after the decision date must be made in writing through the Zoning Administrator. All communications are public record and this permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence in writing. ISSUES: 1. Whether the applicant has provided sufficient measures to reduce or control erosion. Discussion: The applicant's checklist notes that the bank along the west property line has a 70% slope. The applicant has shown a rockery at the toe of the bank together with landscaping the bank with photina, privet, and ivy. A rockery is not an acceptable erosion control measure unless a geotechnical engineer provides a report and stamps plans to assure the rockery will hold. Otherwise, the applicant needs to design a retaining wall for the purpose of holding the bank and reducing or minimizing erosion. 2. The B-1 zone only requires a landscaping buffer when commercial projects abut residential uses so 'designated on the Comprehensive Plan and Zoning Map. In this case, however, the buffer is not required since the property to the south, the residence, is zoned B-1, Business Use. Therefore, in order to reduce the visual impact of the concrete block wall on the residential use, dense evergreen landscaping should be provided along that portion of Building B showing a rockery along the south property line (southwest corner of the project). The applicant on the landscaping plan proposed to plant the bank with ivy, photinia, and privet. The ivy in particular is a good plant for holding soils. The City's landscape architect will work with the applicant when building plans are submitted (provided the application is approved) to ensure the plants are planted closely to ensure the soil will be held and the potential for erosion is minimized. 4. Whether sufficient information has been provided on the types of products used by the auto center with respect to toxicity, risk of fire and explosion, etc. Discussion: The applicant notes in the checklist that oils and cleaners normally associated with auto maintenance activities will be used. While the applicant has not provided a specific list of uses, the building and fire codes appear to have requirements that provide sufficient protection to avert the potential for adverse impacts due to the storage of oils and cleaners and any other types of chemicals used in automobile maintenance. 5. Whether sufficient information has been provided on the type of fill to be used for improvements to Hardie Avenue S.W. Discussion: The applicant's checklist notes that fill will be needed for Hardie Avenue Road improvements required by the City but has not indicated the source of the fill nor type of fill to be used. Fill used for the project will need to meet City standards which are provided in the moving, excavation, and grading ordinace together with specific standars established by the Public Works Department.
