Exhibit No. 4: Drawing No. 3, Floor Plan, Building Elevations (Received August 6, 1997). PROJECT DESCRIPTION: The applicant requests Site Plan Approval (SA) to establish a dental lab. There is an existing 1,048 square foot building and a 480 square foot storage building located behind the principal building. No expansion or exterior modification of the buildings on the site is proposed. The applicant plans to continue use of the storage building for storage of materials. Site Plan Review is required in order to establish the use, a dental lab, in the Commercial Arterial (CA) zone. The property has been in commercial use, rented most recently to an automobile broker and previously used for a beauty salon. According to information submitted by the applicant, dental lab procedures require mostly hand- technique to fabricate gold or porcelain crowns. Necessary equipment is portable with the exception of a casting unit, which requires permanent installation with a hood and proper ventilation. There are 6 employees on the staff and the normal hours of operation are 8:00 a.m. to 5:00 p.m. Monday through Friday. There would be little customer traffic associated with the dental lab. An employee driver makes pick-ups and deliveries twice a day. The applicant proposes no site improvements. According to the applicant,there are six off-street parking spaces existing on the site for employees. There is no existing landscape strip along Shattuck Avenue S. and the applicant requests a waiver from requirements for a 10 foot wide street frontage landscape strip. CONSISTENCY WITH SITE PLAN APPROVAL CRITERIA Section 4-31-33(D) lists ten criteria that is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: 1. CONFORMANCE WITH THE COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES; The site is designated Employment Area - Commercial (EAC) in the Comprehensive Plan. Land uses intended for the EAC designation are those that require large amounts of land and high visibility and access to large volumes of automobile traffic. (Objective LU-AA) The proposed dental lab use requires neither high visibility nor large amounts of land. However, the site is not highly visible from an arterial and is only 6,000 square feet in size. Since the site is already developed, the proposal does not appear to pose any additional obstacle to future aggregation of the existing small lots for eventual redevelopment. Dental labs are considered light industrial uses which are considered appropriate to all Employment Area designations if they do not pose compatibility issues. The proposal is consistent with the following general Employment Area policies. Policy LU-148. In each employment designation, an appropriate mix of commercial, office, light industrial and industrial uses should be encouraged. The mix will vary depending on the employment area emphasis. Policy LU-149. Employment Area designations should each have a primary emphasis but allow a range of allowable secondary uses. Policy LU-166. Light industry should be an allowed secondary use in Employment Area designations. Policy LU-164. Light industrial uses which are allowed should be less intensive in order to maintain compatibility with adjacent uses. Policy LU-165. Light industrial uses should not create noxious conditions such as noise, odors, or traffic which could detract from the office uses allowed in this category. Policy LU-181. Development should be designed to be compatible with adjacent, less intensive uses, e.g. lighting, fences, landscaping, setbacks should all be considered during site design. 2. CONFORMANCE WITH EXISTING LAND USE REGULATIONS; The subject site is zoned Commercial Arterial (CA). Dental labs are permitted as a secondary use in the CA zone,with a single condition requiring site plan review. Therefore, the subject proposal is required to obtain site plan approval in order to establish the dental lab use. The subject site is developed with an existing 1,048 square foot building and a 480 square foot storage building. The applicant does not propose any expansion or exterior modifications to the buildings. Therefore, most development standards applicable to construction of buildings are not relevant to the subject proposal. The existing buildings meet the setback, height, and lot coverage requirements of the CA zone. The CA zone requires a 10 foot wide landscape strip abutting public streets. The applicant has requested a waiver from this requirement. The code allows this landscape standard to be reduced through the site plan review process. The applicant asserts that the cost of the landscape improvements would not be commensurate with scope of the proposal, which does not include building expansion or exterior modifications. The applicant has also justified the requested waiver stating that adjoining properties do not provide the landscape strip improvement. The property directly to the north of the site (the back of a mini-mall fronting on Rainier Avenue) has improved their frontage with a curb, sidewalk, and planting strip (though unplanted at this time). However, all the other properties on the west side of Shattuck do not have right-of-way improvements. On the east side of Shattuck Avenue are residential uses, and the right-of-way is fully improved along the entire frontage. The site presently utilizes the front yard for head-in parking and this parking would be eliminated if the applicant is required to install the landscape strip. Staff recommends Zoning Administrator approval of the requested waiver. The parking code requires a minimum of 3 and a maximum of 4 parking spaces per 1,000 square feet of floor area for professional office and businesses,which is the type of use listed in the parking code which is most similar to a dental lab use. The subject site has 4 parking spaces located in back of the building. This parking would be comply with the code requirements for the 1,048 square foot building. MITIGATION OF IMPACTS TO SURROUNDING PROPERTIES AND USES; The proposed dental lab would not generate noise or traffic impacts that would adversely impact surrounding properties or uses. The equipment used for the dental lab would not generate noise impacts and traffic would be limited to the 6 employees and 2 deliveries per day. Across the street from the subject site is an established residential area, the zoning changes from Commercial Arterial (CA) on the subject property to Residential Multi-family Urban (RM-U) on the east side of Shattuck Avenue S. There is the potential for land use conflicts between commercial and/or light industrial uses that are permitted in the CA zone and the adjacent residential uses. However, the operations of the proposed dental lab use would not conflict with the adjacent residential uses and may actually provide a buffer from the more intensive commercial uses which line Rainier Avenue and back to Shattuck Avenue. The existing building on the site is a residential structure that has been converted to commercial use. The appearance and scale of the building is compatible with the residential area across the street. Abutting the subject site to the east and north are existing commercial uses. The subject site is fenced from these adjacent properties and the proposed dental lab would not impact the surrounding commercial uses. Directly behind the site to the east is a small shopping center which faces toward Rainier Avenue. The parking lot for the shopping center backs to the site, and there is an existing fence covered with plants that screens the subject site from the parking lot. Just north of the subject site is a commercial building and a driveway that provides an exit for the shopping center onto Shattuck Avenue. 4. MITIGATION OF IMPACTS OF THE PROPOSED SITE PLAN TO THE SITE; The subject site is presently developed and the proposal would not expand or modify the exterior of the existing buildings. Therefore, the proposal to establish a dental lab use on the site would not negatively impact the site. 5. CONSERVATION OF AREA-WIDE PROPERTY VALUES; The proposal would conserve area-wide property values. The proposal would establish a light industrial/ commercial use in a residential structure; This would conserve commercial property values yet be compatible with the residential uses across the street. 6. SAFETY AND EFFICIENCY OF VEHICLE AND PEDESTRIAN CIRCULATION; The site is accessed off Shattuck Avenue S. and the entire frontage along the street is presently a driveway cut. The front yard is used for head-in parking. There are 4 existing parking spaces in the rear of the building. The applicant should stripe the parking stalls as shown on the submitted site plan, so the front of the parking stalls faces the south property boundary. 7. PROVISION OF ADEQUATE LIGHT AND AIR; NA 8. MITIGATION OF NOISE, ODORS, AND OTHER HARMFUL OR UNHEALTHY CONDITIONS; The proposal would not create noise, odors or other harmful or unhealthy conditions. AVAILABILITY OF PUBLIC SERVICES AND FACILITIES TO ACCOMMODATE THE PROPOSED USE; AND, The site is presently developed and served with public utilities. The proposed dental lab use would not create a need for additional public services. 10. PREVENTION OF NEIGHBORHOOD DETERIORATION AND BLIGHT. The proposal would assist in preventing neighborhood deterioration and blight by adding a new business to a commercially-zoned area that is also compatible with residential uses in the vicinity. FINDINGS, CONCLUSIONS, AND DECISION Having reviewed the written record in the matter,the City now makes and enters the following: FINDINGS 1. The Applicant, Emerald Dental Arts, inc., has requested Site Plan Approval for establishment of a dental lab. 2.
