AN ORDINANCE OF. THE CITY OF RENTON, WASHINGTON CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE
CITY OF RENTON FROM P-1 (PUBLIC USE) ZONE TO IH [P] (HEAVY
INDUSTRIAL [PUBLIC] ) ZONE (CEDAR RIVER TRAIL PARK REZONE;
FILE NO. LUA-97-114, R) .
WHEREAS, under Chapter 7, Title IV (Building Regulations) , of
Ordinance No. 4260 known as the "Code of General Ordinances of the
City of Renton, " as amended, and maps and reports adopted in
conjunction therewith, the property hereinbelow described has
heretofore been zoned as P-1 (Public Use) ; and
WHEREAS, the City of Renton initiated a proceeding for change
of zone classification of said property. This matter was duly
referred to the Hearing Examiner for investigation, study, and
public hearing, and a public hearing having been held thereon on or
about October 28, 1997, and said matter having been duly considered
by the Hearing Examiner, and said zoning request having been
recommended, and said zoning request being in conformity with the
City' s Comprehensive Plan, as amended, and the City Council having
duly considered. all matters relevant thereto, and all parties having
been heard appearing in support thereof or in opposition thereto;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION I. The following described property in the City of
Renton is hereby rezoned to IH (Heavy Industrial) with a public "P"
suffix attached as hereinbelow specified, subject to the findings,

conclusionsl, and decision of the Hearing Examiner dated November 13,
1997; the Development Services Director is hereby authorized and
directed to change the maps of the Zoning Ordinance, as amended, to

if fully set forth herein.

Council: 1998 Legislative Renton's 1998 legislative priorities:
Issues
State and Local Transportation Funding. Support a comprehensive
revenue package that recognizes the need for a long-term sustainable
transportation revenue stream. Support an increase in the state gas tax
and seek approval of new transportation revenue sources. Support
existing formulas and increases in the dedicated distribution of gas tax
revenue to cities, counties, transit, and the Transportation
Improvement Board.

SUMMARY OF ACTION:
In June 1994, City Council directed Planning/Building/Public Works to proceed with assimilation of the
P-1 Zone into the other zones adopted in June 1993. The other zones do accommodate most, if not all of the
uses that were typically allowed in the P-1 zone.
The recommendation of the Hearing Examiner for approval of the City-sponsored rezone was published
November 13, 1997. No requests for reconsideration or appeals were received during the appeal period which
ended November 28, 1997. Neither the Environmental Review Committee(ERC) or Hearing Examiner
imposed conditions on this rezone.
The Examiner recommends that City Council approve reclassification of the subject property from P-1 to IH.
STAFF RECOMMENDATION:

SUMMARY OF ACTION: Development Services Recommendation: Approve with

DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the
Examiner on October 21, 1997.
PUBLIC HEARING: In accordance with Section 4-8-14(C)(2),the Hearing
Examiner shall determine if a change of zone classification is
advisable, in the public interest,tends to further the
preservation and enjoyment of any substantial property rights
of the petitioner, is not materially detrimental to the public
welfare or the properties of other persons located in the
vicinity thereof,and is in harmony with the purposes and
effect of the Comprehensive Plan: In such event,the Hearing
Examiner may recommend that the City Council approve the
change of the zone classification.

The following minutes are a summary of the October 28, 1997 hearing.
The legal record is recorded on tapes
The hearing opened on Tuesday,October 28, 1997,at 10:32 a.m. in the Council Chambers on the second floor
of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
City project manager,DONALD ERICKSON,P/B/PW Special Projects,City of Renton,200 Mill Avenue
South, Renton, Washington 98055,presented the staff report. He explained that when the City prepared its

Comprehensive Plan in;1993 it deferred making changes to lithe Public Use(P-1)zone to allow more time to
study existing P-1 uses. Originally,the P-1 zone was intended to recognize public ownership and to provide a
process that would expedite development. The study found that the City's new zoning allows the same public
uses in virtually every zone. It was also found that a relatively high percentage of actual public uses are not
located in the P-1 zones. For example,City Hall and the Fire Station are in the commercial zone and schools
and parks are generally located in single family zones. Staff proposed to the City Council's Planning and
Development Committee that the City should either assimilate all public uses in P-1 zones or allow for public
uses in all other zones. The City Council chose the latter recommendation since there are adequate provisions
in other zones to accommodate public uses and it would be more consistent with the Growth Management Act.
Therefore,the current proposal is part of a series of 40 proposed rezones of publicly held properties. An
ordinance adopted in June 1995 and referred to as "P" suffix zoning,was incorporated to protect the public
interest by identifying publicly-held properties. It also requires public notification if there is to be a change in
tenancy,use,or ownership of any of these properties. All lof these P-1 rezones will be identified with a"P"
suffix.
The property which is the subject of this hearing is approximately 9.34 acres in size and is located generally at
North Riverside Drive and the Cedar River channel,beginning approximately 300 feet north of N.6th Street to
Lake Washington in Renton. The applicant has requested the site be rezoned from P-1 to IH which is the
Heavy Industrial zone. According to the Comprehensive Plan Land Use Map,the area adjacent to this property
is zoned IH. �I

In conclusion, Mr. Erickson recommended that Cedar River Trail Park be rezoned from P-1 to IH with a P
suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Land Use Map
designation for this parcel; it is consistent with City policy that encourages the development and maintenance
of a system of high quality parks and recreation facilities to serve Renton residents since existing
neighborhood,community,and regional parks are allowed in the IH Zone; and the rezone is consistent with
previous rezones of inearby properties with the Employment Area-Industrial land use designation to the Heavy
Industrial Zone in 1993.
The Examiner called for further testimony regarding this project. There was no one else wishing to speak,and

Having reviewed the record in this matter,the Examiner now makes and enters the following:
FINDINGS:

1. The applicant,City of Renton, filed a request to reclassify the subject site from P-1 (Public/Quasi-
public)to IH(Heavy Industrial).
2. The City of Renton filed requests for approval of a series of forty(40)separate rezones involving a
series of separate properties generally owned by public agencies including the City,King County and
the Renton School District. The City proposes phasing out its P-1 Zone,a zone that in the past was
designed to accommodate public and quasi-public uses. Each of the proposals requests that the new
zoning be changed to closely, if not exactly match, surrounding zoning districts and the goals of the
Comprehensive Plan.

3. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation
and other pertinent materials was entered into the record as Exhibit#1.
4. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of
Non-Significance(DNS)for the subject proposal.
5. The subject proposal was reviewed by all departments with an interest in the matter.
6. While the background information on the study and proposed abolition of the P-1 zone will be the same
for each report,each site will receive separate attention and a separate decision.

7. The P-1 (Public/QuasiPublic)Zone was established in the early 1950's to accommodate governmental
facilities as well as certain private uses such as private medical clinics and private hospitals,as well as
private schools,museums and the like that accommodated the public. The permitted uses were
expanded over the years to accommodate an even wider range of uses while other zoning districts also
broadened their range of respective uses, in effect,duplicating the permitted uses in the P-1 zone. The
current zoning categorization generally appears to accommodate most,although not all,of the uses the
current P-1 zone permits. The City Council directed staff to make a recommendation as to the
continued need for a distinct P-1 zone. A result of that study was presented to the Planning
Commission(May 4,.1994 Report). The Planning Commission recommended the assimilation of the
P-1 zone. The City Council then directed that individual parcels be assimilated into nearby,compatible
zones after appropriate public hearings. The current action is the result of those.decisions.
8. The subject site is part of the Cedar River Linear Park located on the east shore of the Cedar River and
bounded generally by North 6th Street on the south and Lake Washington on the north and Riverside
Drive and the Boeing plant on the east. The parcel is almost two-thirds of a mile long and consists of
approximately 9.34 acres. The site is owned by the City of Renton and is used for passive recreation.
9. The City proposes designating the site IH. The City has attached a special designation to any public
property which carries so-called "normal" zoning designations. This special designation is a"P" or P-
suffix,permitting those who view the Zoning Map to determine that the property is publicly owned.
This designation also carries with it a requirement for public notice of any further change of use or
zoning.
10. The map element of the Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of industrial uses that generate employment opportunities where
appropriate,but does not mandate such development without consideration of other policies of the
Plan.
11. The Boeing plant, the dominant land use in this area, is zoned IH. It just happens that the Cedar River
' and its associated trail runs between the industrial Boeing plant on its east and the airport to the west.
12. Park uses are permitted in the IH Zone. The City does not propose any redevelopment of the site and
will maintain the park use.

1. The proponent of a rezone must demonstrate that the request is in the public interest,that it will not
impair the public health,safety and welfare,and in addition complies with at least one of the criteria �I
found in Section 4-8-14,which provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or land use analysis;or
b. The subject site is potentially designated for the new classification per the Comprehensive
Plan;or �I
c. There has been a material and substantial change in the area in which the subject site is located II
since the last rezoning of the property or area.
The requested classification is justified and should be approved.
2. The P-1 district and its associated properties were removed from the city-wide reclassification effort to
study the basis for the zone itself. This site as well as the other P-1 properties were segregated for
special review. The public hearing that preceded'this recommendation is the first analysis since that
study demonstrated that there is no reason to maintain the P-1 zones.
3. The Comprehensive Plan designates the area as suitable for industrial uses ignoring the river
environment and considering the placement of the adjacent Boeing complex. The Heavy Industrial
zone comes closest to providing zoning which matches the Comprehensive Plan's designation while
still permitting the use of the site for park purposes. The proposed zoning matches the zoning of
surrounding property.
4. While changes to the area have not been substantial,the Comprehensive Plan and Zoning code have
themselves undergone a profound change. The need for a separate holding zone for public and quasi-
public uses has been questioned for a long time and the adoption of these new land use provisions just
provided the impetus to review the P-1 zone. The proposed zoning is an appropriate alternative for the
current P-1 zone.
RECOMMENDATION:
The City Council should approve the reclassification of the subject site from P-1 to IH with the P-suffix I�

The hearing opened on Tuesday,October 28, 1997,at 10:32 a.m. in the Council Chambers on the second floor
of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
City project manager,DONALD ERICKSON,PB/PW Special Projects,City of Renton,200 Mill Avenue

Comprehensive Plan in 1993 it deferred making changes to the Public Use(P-1)zone to allow more time to
study existing P-1 uses. Originally,the P-1 zone was intended to recognize public ownership and to provide a
process that would expedite development. The study found that the City's new zoning allows the same public
uses in virtually every zone. It was also found that a relatively high percentage of actual public uses are not
located in the P-1 zones. For example,City Hall and the Fire Station are in the commercial zone and schools
and parks are generally located in single family zones. Staff proposed to the City Council's Planning and
Development Committee that the City should either assimilate all public uses in P-1 zones or allow for public
uses in all other zones. The City Council chose the latter recommendation since there are adequate provisions
in other zones to accommodate public uses and it would be more consistent with the Growth Management Act.
Therefore,the current proposal is part of a series of 40 proposed rezones of publicly held properties. An
ordinance adopted in June 1995 and referred to as "P"suffix zoning,was incorporated to protect the public
in▪ terest by identifying publicly-held properties. It also requires public notification if there is to be a change in
tenancy,use, or ownership of any of these properties. All of these P-1 rezones will be identified with a"P"
suffix.
The property which is the subject of this hearing is approximately 9.34 acres in size and is located generally at
North Riverside Drive and the Cedar River channel,beginning approximately 300 feet north of N. 6th Street to
Lake Washington in Renton. The applicant has requested the site be rezoned from P-1 to IH which is the
Heavy Industrial zone. According to the Comprehensive Plan Land Use Map,the area adjacent to this property
i▪s zoned IH.
In conclusion,Mr. Erickson recommended that Cedar River Trail Park be rezoned from P-1 to IH with a"P"
suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Land Use Map
designation for this parcel; it is consistent with City policy that encourages the development and maintenance
of a system of high quality parks and recreation facilities to serve Renton residents since existing
neighborhood,l community, and regional parks are allowed in the IH Zone; and the rezone is consistent with
previous rezones of nearby properties with the Employment Area-Industrial land use designation to the Heavy
Industrial Zone in 1993.

The Appearance of Fairness Doctrine provides that no ex parte(private one-on-one)communications may
occur concerning pending land use decisions. This means that parties to a land use decision may not
communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use
process include both the Hearing Examiner and members of the City Council.
All communications concerning the proposal must be made in public. This public communication permits all
interested parties to know the contents of the communication and would allow them to openly rebut the
evidence. Any violation of this doctrine would result in the invalidation of the request by the Court.

G. DEPARTMENT ANALYSIS:
1. PROJECT DESCRIPTION/BACKGROUND
The current proposal is part of a series of six(6)proposed rezones of publicly held properties begun by the
City of Renton in 1995. These rezones would change the Public Use (P-1) zoning designation on the
subject properties to zoning usually already in the area. Such zoning typically allows the type of uses
found on these existing P-1 zoned properties. Occasionally existing zoning may have to be amended to
allow some uses that may not have been anticipated, but this has been the rare exception. The current P-1
rezone is part of a series of approximately fifty (50) rezones, more than forty (40) of which have already
occurred,that will be necessary to assimilate out all P-1 zoned properties in the City. This consolidation of
the City's zoning is based in part upon an extensive staff report that was prepared in November, 1993 the
findings of which are summarized in staff May 4, 1994, Staff Report to the Planning and Development
Committee on the issue of the relevance of the Public Use Zone. Given the number of uses provided for
within Renton's new zoning codes adopted in June, 1993, and the fact that the P-1 Zone had not been
consistently applied to all public uses over the years,the Council in 1994 directed that the P-1 Zone's uses
should be assimilated into the City's other zones (see Exhibit`B').
2. ENVIRONMENTAL REVIEW
Pursuant to the city of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended),
on September 23, 1997 the Environmental Review Committee issued a Determination of Non-significance
for this proposed rezone.
3. COMPLIANCE WITH ERC CONDITIONS
Because no mitigation measures were imposed on this non-project action, there were no ERC conditions
that the applicant was required to comply with.

4. STAFF REVIEW COMMENTS
Because this rezone is a non-project action under SEPA as well as a part of a package of City sponsored
P-1 rezones,no negative impacts were received from other reviewers.
5. CONSISTENCY WITH REZONE APPROVAL CRITERIA
Section 4-8-14.0 "In the case where a change of the zone classification of property is
recommended, at least one of the following circumstances shall be found to
apply:"
GENERAL CRITERIA:
a) Previously Not Considered Zoning Reclassification
That substantial evidence was presented demonstrating the subject reclassification appears
not to have been specifically considered at the time of the last area land use analysis and area
zoning; or
The subject site was not specifically considered at the time of the last area land use analysis and area
rezoning in June, 1993 since it was understood that Staff were studying the P-1 Zone and were preparing
recommendations to the Planning Commission and City Council on whether this special purpose zone
should be retained, or, assimilated into the City's other new zoning classifications. Industrial areas to the
north, south and east were rezoned in June, 1993 to the IH(Heavy Industrial) Zone and, properties to the
west across the Cedar River were left with P-1 zoning as was this site. The subject site was not included in
these rezones because the City was waiting for the Council's resolution as to how the Public (P-1) Zone
would be handled. In June of 1994, the Council directed staff to proceed with the assimilation of the P-1
Zone into the city's other new zones.
b) Consistency with the Comprehensive Plan, Its Elements and Policies
That the property is potentially classified for the proposed zone being requested pursuant to
the policies set forth in the Comprehensive Plan and conditions have been met which would
indicate the change is appropriate; or
The subject site has been determined to be potentially classified for the proposed Heavy Industrial Zone
based upon the fact that it is designated on the City's Comprehensive Land Use Map as Employment Area
-Industrial. In fact most of this land use designation was zoned Heavy Industrial(IH)in 1993.
Objective LU-ZZ states that developing and maintaining a system of high quality parks and recreation
facilities to serve Renton residents is a City objective.
The proposed rezone will not change any of the uses in the existing park/trail since existing neighborhood,
community and regional parks and trails are a primary permitted use in this zone. It has been assumed by
some that P-1 zoning would guarantee continued park/trail uses but staff note that there are a whole array
of different uses allowed under the P-1 Zone, only one of which is parks/trails. These uses range from
wastewater(sewage)treatment plants and airports to schools and hospitals.

Although Policy LU-351 suggests that existing parks should be more intensely developed to provide needed
recreation facilities where feasible,no intensification is proposed for the Cedar River Trail Park as a
consequence of this proposed rezone action. It is conceivable,however,that recreational facilities could be
improved or expanded in the future under the proposed 111 zoning which allows existing parks,trails and
open spaces as a primary use.
c) Timeliness of Proposed Rezone
That since the last previous land use analysis of the area zoning of the subject property,
authorized public improvements, permitted private development or other circumstances
affecting the subject property have undergone significant and material change.
The proposed rezone is timely because in June, 1995,the City adopted new zoning provisions to protect the
public trust that implemented Public Facilities Policies LU-229, LU-230, and LU-231. These provisions,
which ensure early notification for nearby residents and property owners whenever there is a change of use,
ownership, or major tenancy of any publicly owned property, allowed the City to move ahead with its P-1
rezones and their assimilation to other zones.
H. RECOMMENDATION:
Staff recommend approval of the Cedar River Trail Park P-1 Rezone, File No. LUA-97-114, ECF, R, (with a
public use"P"suffix attached because this is a publicly owned parcel),for the following reasons:
1. The rezone is consistent with the Comprehensive Plan Land Use Map designation for this parcel,
2. The rezone is consistent with City policy that encourages the development and maintenance of a system of high
quality parks and recreation facilities to serve Renton residents since existing neighborhood, community, and
regional parks are allowed in the IH(Heavy Industrial)Zone.
3. The rezone is consistent with previous rezones of nearby properties with the Employment Area-Industrial land
use designation to the Heavy Industrial Zone in 1993.
4. The subject rezone is a non-project action under SEPA and is a legislative act which of and by itself will not
result in new development.
Note: The applicant was not required to comply with any mitigation measures since the Environmental
Review Committee issued a straight Determination of Non-significance for these proposed rezones
when it considered them on November 12, 1996.

Dear Mr. Kaufman:
We have been working closing with the City's Planning Staff in their-effort to
simplify and make more consistent the zoning applications as they pertain to
publicly owned property within the City of Renton, and more specifically, parks,
open space and trails.
As a result of this work, the City is proposing to reclassify park and open space
parcels from their current P-1 (Public Use) Zones to new zoning designations
consistent with the zoning that exists with the abutting or surrounding properties.
We support this change, as we believe the interests of the surrounding
community will be better protected while still allowing the City to reasonably use
and develop these properties for their intended purposes.
To clarify any potential misunderstanding with this process, the City of Renton
has no plans to sell or change the use of any of its park or open space properties
as a result of this action, as we consider this action to be simply a technical
zoning change. Any future plans or construction activities will continue to be
subject to full public review and participation.

LEGAL DESCRIPTION:
That portion of the former Commercial Waterway District No. 2, located on the easterly bank of the
Cedar River in the East half of Section 7, Township 23 North, Range 5 East, W.M., King County,
Washington, more particularly described as Track 1 thru Track 6, inclusive, as shown on City of
Renton Engineering Map B-9.2-50,Dated 5/23/57.

Project Proposal
(GR 40)
Rezone Cedar River Park from its current Public Use (P-1) zoning to Industrial -Heavy OH) zoning
with a "P" suffix attached designating as a public owner property subject to certain early public
notification procedures whenever a change of ownership,major tenancy, or use occurs on the site. This
rezone is one of approximately 50 P-1 Zone rezones that are being made to make Renton's Zoning Map
consistent with its Comprehensive Land Use Map. Attached is a copy of the Council Committee Report
recommending that staff proceed with the assimilation of the P-1 Zone into existing zones (see Exhibit
"B",attached).
Project Summary
The subject rezone proposal is one of approximately 50 City sponsored rezones of publicly held
in the Cityof Renton that are currentlyzoned Public Use properties (P-1)a zoning classification that
the City has decided to get rid of. Reasons for not keeping this zoning classification include:
1. it allows too large an array of uses(every thing from public hospitals and schools to
museums, offices,and libraries to fire stations,municipal airports and park and ride lots for
transit patrons). In addition,uses such as heliports,major medical office buildings,and
buildings over 50 feet in height are allowed as conditional uses;
2. such zones are often"spot"zones where there is only one lot or one owner for the area
designated;and,
3. such zones are often subject to legal challenge because they are"spot"zones and do not
represent a class or group of lots or multiple owners within a given area.
4. not all publicly held sites are zoned P-1 and,in fact,nearly half of the public schools in the
area have zoning designations different that P-1 and many municipal buildings including
City Hall do not have P-_1 zoning at the current time;and,
5. these zones are not consistent with the City's Comprehensive Plan Land Use Map.
The intent of these rezones is too make the remaining P-1 zoned sites consistent with the City's
Comprehensive Plan Land Use Map. To date approximately 41 formerly zoned P-1 sites have been
rezoned to one of the City's new zoning classifications adopted in 1995. These rezones have been
conducted over the last couple years and should be completed in late 1997 or early 1998. All former P-
j 1 zoned sites that were publicly owned will carry a so-called"P"suffix designating that they are
publicly owned. Sites with this designation are required to give early public notification of any change
of use,change in major tenancy,or change of ownership.

The Committee also recommends that staff continue to work with all interested parties to address
concerns of the Planning Commission and the Planning and Development Committee related to
preserving the public trust and revising the development standards related to these uses.

This action will allow staff to proceed in a timely manner with amendments to the Comprehensive Plan
related to these public uses. The Committee will continue to work with staff on the remaining issues and .
report back to City Council prior to adoption of the Comprehensive Plan and Zoning Code amendments. •

Purpose of Checklist:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
Environmental Impact Statement (EIS) must be prepared for all proposals with probably significant
adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid
impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is
required.
Instructions for Applicants:
This environmental checklist ask you to describe some basic information about your proposal.
Governmental agencies use this checklist-to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the
most precise information known, or give the best description you can.

cases, you should be able to answer the questions from your own observations or project plans

designations that typically are found in the vicinity of the subject sites or found to be appropriate for
a given site, particular if it is a special use. New zoning classifications will allow the same or similar

D. SUPPLEMENTAL SHEET FOR NONPROJECT ACTIONS

of a series of approximately fifty (50) similar rezones that are necessary in order to phase out the
Pubic Zone, a zone which is considered to be a "spot" zone that allows a wide array of different
uses, many of which would have questionable land use compatibility with surrounding uses. New
zoning is consistent with the City's Comprehensive Plan and will afford a greater level of
compatibility.
Proposed measures to protect or conserve energy and natural resources are:
None are proposed since no actions will be taken to deplete energy or natural resources.

4. How would the proposal be likely to use or affect environmentally sensitive areas or areas
designated (or eligible or under study) for governmental protection; such as parks, wilderness,
wild and scenic rivers, threatened or endangered species habitat, historic or cultural sites,
wetlands, floodplains, or prime farmlands?
The proposed rezones should not adversely affect any of the six rezone sites under consideration.
Because of the "P" suffix provisions additional protection of the six sites will exist. This is because
before there can be a change of ownership, a change of major tenancy, or a change in use on any of
these six sites the owners will be required to notify all residents and property owners within 300 feet
= of the proposed changes at least 60 days in advance of any such proposed changes. In addition, the
two sites at the .P-1 Forebay will receive Resource Conservation zoning which would allow
considerable less development on these two sites than is allowed under the current P-1 zoning
designation. Gene Coulon Park is proposed to receive R-8 zoning which allows for less intense uses ,
than commonly allowed under the current P-1 zoning on this site. Whereas Liberty Park and the
Cedar River Park would be rezoned to more intense zones, there is no intention of changing these
uses, and were they to change there would be ample opportunity for public input because of the 60
day notification provisions under the "P" suffix provisions that would be attached at the time the six
sites are rezoned under this proposal.

would be allowed and in most cases will allow for less intense uses than currently allowed under the
P-1 Zone J As noted above, the two sites in the environmentally sensitive P-1 Channel Forebay will
receive Resource Conservation zoning which is very restrictive as to permitted uses, basically limiting
uses to passive agricultural type uses, uses like golf courses, and low density residential at one
dwelling unit per each 10 acres. ,
