On-site BMPs include dispersion and infiltration devices, bioretention, permeable pavements, rainwater harvestin� systems, tree retention credit, reduced impervious surface footprint, vegetated roofs and other measures designed to rnimic pre-developed hydrology and minimize stormwater runoff on the Property. 2. City of Rentan shall have the right to ingress and egress over those portians of the Property necessary to perform inspections of the stormvorater facilities and BMPs and conduct maintenance activities specified in this D�claration of Covenant and in accordance with the Renton Niunicipal Code. City of Renton shall provide at least thirty (30) days' written notiee ta the Owners that entry on the Property is p9anned for the inspection of drafnage facilities.After the thirty 430) days,the Owners shall allow the City of Renton ta enter for the sole purpose of inspecting drainage faci(ities. In lieu of inspecteon by the City, the Owners may elect ta engage a Eicensed civil engineer registered in the state of Washington who has expertise in drainage to inspect the drainage facilities and provide a written report describing their condition. Bf the engineer option is chosen,the Owners shall provide written notice to the City of Renton within fifte2n (15)days of receiving the City's rrotice of inspection.Within thirty(30)days of giving this notice,the Owners,or engineer on behalf of the Owners,shalB pravide the engineer's report to the City of Renton. If the report is not provided in a timely manner as specified above,the City of Renton may inspect the drainage facilities without further rsotice. 3. If City of Renton determines from its inspection, or from an engineer's report provided in accordance wlth Paragraph 2,that maintenance, repair, restoratian, and/or mitigation work is required to be done ta any of the drainage facilities, City of Renton shall notify�the Owners of the specific maintenance, repair, restoration, and/or mitigation work ("Work") required pursuant to the Renton Municipal Cade. The City shall also set a reasonable deadline far the Owners to compiete the Work, or to provide an engineer's report that verifies completian of the Work. After the deadline has passed, the Owners shall allow the City access to re-inspect the drainage facifities unless an engineer's report has been provided verifying completion af the Work. If the Work is not completed within the time frame set by the City, the City may initiate an enforcement action andJor perforrn the Work and hereby is given access to the Property for such purposes. Written natice will be sent to the Owners stating the Cit�s intenti�n to perform such Work.This Work will not commence until at least seven(7)days after such notice is mailed. If, within the sole discretion of the City, there exists an imminent or present danger, the seven (7} day notice period will be waived and Work wilf begin immediately. 4. The Owners shall assume all responsibility for the cost of any Wark, �r any measures taken by the City to address conditions as described in Paragraph 3. Such responsibility shall include reimbursement to the City within thirty(30)days of the receipt of the invoice for any such Work performed. Overdue payments will require payment of interest at the maximum legal rate allowed by RCW 19.52,020 (currently twelve percent (12!)). If the City initiates legal action to enforce this agreement, the prevailing party in such action is entitled to recover reasonable litigation costs and attorney's fees. 5. The Owners are required to obtain written approval from City of Renton prior to filling, piping, cutting, or removing ve�etatian (except in routine landscape maintenance) in open vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performin� any alterations or modifications ta the drainage facilities referenced in this Declaration of Covenant. Project: Sunset Terrace Development Building 9 — (AKA Colp6fts Site 9/�0) Prepared for. Colpitts Developmenf The attached Operation and Maintenance checklist is intended to provide guidance to the owner(s)for the operation and maintenance of th� drainage and the storrr�water detentic�n system at the Sunset Terrace Development. The owner is responsible for maintenance of storm drainage facilities within the property. The owner is �rot responsible for maintenance within the public right-of-way. This manual cannot anticipate every problem, but provide a checklist for the most anticipated rnaintenance items. The stormwater system should be regularly maintained an an annual basis during the summer prior to the start of the "rainy season°' at the �nd of September. When operating normally, the system should not have any surface ponding of stormwater and the detention system should fully drain (except for the 4-foot sump) within 24-hours after a storm event. If either of these are not true then the systerri should be reviewed'using the maintenance checklist to determine the problem. For additionai and updated maintenance in�ormation visit the King County Starm resources at: http://www.kingcounty.gov/environment/waterandland/stormwater.aspx or the Washington State Department of Ecology's web-sete at: http_//wwerv.ecy.wa.govlprograms/wq/wq home.htmi Below is a summary of each component af the storm drainage system: Detention Vault The vault in located in the south-west corner of the level 1 parking lot (see attach�d plan) at the corner of Harrington Ave NE and Sunset Lane NE. The vault is ortly accessible through a maintenance hole located outside the building in the sidewalk. The purpose of the vault is ta use the flow control device (see beiow) to temporarily store stormwater runoff firom the btailding roof to reduce the peak stormwater rtanoff flows. See the attached "NO. 3— DETENTION TANKS AND VAULTS" checklist for items to be reviewed during the inspection. If any maintenance is required inside the vault, then th� owner shall used only personnel with current confined space entry certification to enter the vault. Prior to personnel entering the vault, the maintenance hole and three vents shall be opened and used for forced air venting. The flow control structure consists af a 12-inch diameter vertical riser pipe with two orifices sized to only let through a iimited flow of stormwater runoff. Yhe lowest orifice is submerg�d in the sump iocat�d under the bottom of the riser, the second is lacated under the elbow that is attached to the riser pipe near the top af the riser pipe. if the orifices are blocked, the Stormwater Vault can be drained to allow cleaning by opening a shear gate. This is done by pulling on the handle attached to the top rung undern�ath the lid. The shear gate shall be closed after cleaning. See attached "NO. 4 —CONTROL STRUCTURE/FLOW RESTRICTOR" checklist for items to be reviewed during the inspection. Connection to the City System The detention system is connected via a storm water drain to the City's storm water system in the intersection of Harrington Ave NE and Sunset Lane NE. The owner is not responsible to maintain th� maintenance hale in the public right-of-way tha�the project's storm drain cannects to. See attached "NO. 6— CONVEYANCE PIPES" checklist for items to be reviewed during the inspection. Right of Way Porous Pavement and Landscapong The project encludas approximately 3,000 SF of perviaus concrete sidewalk �nd adjacent landscape strip in the Ftight�f Way along Sunset Boulevard. See attached "NO. 11 — GROUNDS (LANDSCAPING)" and "NO. 30— F'ERMEABLE PAVEMENT BMP" checklist for items to be reviewed during the inspection. Below is a stormwater enspection farm and checklists to be compieted �ach year at the time of the inspection and wh�n any maintenance is perforrned on the storm drain system. The owner is responsible for marntenance of storrn drainage facilities within the property. The owner is not responsible for maintenance within the public right-of-way. This manual cannot anticipate every problem, but provide a checklist for the most anticipated maintenance items. The stormwater system should be regular0y maintained on an annual basis during the summer prior to the start of the "rainy season'° at the end of September. When operating normally, the system should not have any surfiace ponding of stormwater and the detention system should fully drain (except for the 4-foot sump) within 24-hours after a storm event. If either of these are not true then the system should be reviewed using the maintenance checklist to determine the problem. The vault is only accessible through a maintenance hole located outside the building in the sidewalk. The purpose of the vault is to use the flow control device (see below) to temporarily store stormwater runoff from the buiiding roof to reduce the peak stormwater runoff flows. See the attached "NO. 3 — QETENTION TANKS AND VAULTS" checklist for items to be reviewed during the inspection. If any maintenance is required inside the vault, then the owner shall used only personnel with current confined space entry certification to enter the vault. Prior to personnel entering the vault, the maintenance hole and three vents shall be opened and used for forced air venting. The flow control structure consists of a 12-inch diameter vertical riser pipe with two orifices sized to only let through a limited flow of stormwater runoff. The lowest orifice is submerged in the sump located under the bottom of the riser, the second is located under the eibow that is attached to the riser pipe near the top of the riser pipe. If the orifices are blocked, the Stormwater Vault can be drained to allow cfeaning by opening a shear gate. This is done by pulling on the handle attached to the top rung underneath the lid. The shear gate shall be closed after cleaning. See attached "fVO. 4—CONTROL STRUCTURE/FLOW RESTRICTOR" checklist for items to be reviewed during the inspection. Connection to the City System The detention system is connected via a storm water drain to the City's storm water system in the int�rsection of Harrington Ave NE and Sunset Lane NE. The owner is not responsible to maintain the maintenance hole in the public right-of-way that the project's storm drain connects to. See attached `°NO. 6— CONVEYANCE PIPES" checklist for items to be reviewed during the inspectiane Right of Way Porous Pavem�nt and Landscaping The projsct includes approximately 3,000 SF of pervious concrete sidewalk and adjacent landscape strip in the Right of Way along Sunset Boulevard. The stormwater system should be regularly maintained on an annual basis during the summer priar to the start of the "rairay season" at the end af September. When operating normally, the system should not have any surfiace ponding of stormwater and the detention syskem should fully drain (except for the 4-foot sump) within 24-hours after a storm event. If either of the�e are nat true then the system should be reviewed using the maintenance checklist to determine the problem. The vault is only accessible through a rnaintenanc� hole located outside the bui6ding in the sidewalk. The purpose of the vault is to use the flow control device (see below} to tempc�rarily store stormwater runoff from the building roof to reduce the peak stormwater runoff flows. See the attached "NO. 3 — DETENTION TANKS AND VAULTS" checklist for items to be reviewed during the inspection. If any maintenance is required inside the vault, then the owner shall used only personnel with current confined space �ntry certification t� enter the vau6t. Prior to personnel entering the vault, the maintenance hole and three vents shail be opened and used for forced air venting. The flo,nr control structure consists of a 12-inch diameter vertical riser pipe with two orifices sized to only let through a limited flaw of stormwater runoff. The lowest orifice is subrrierged in the sump lo�ated under the bottorri c�f the riser, the second is iocated under the elbow that is attached to the riser pipe near th+� top of the riser pipe. If the orifices are blocked, the Stormwater Vauit can be drained to allow cleaning by apening a shear gate. This is done by pulling on the handle attached to the top rung underneath the lid. The shear gate shall be closed after cleaning. See attached °`NO. 4— CONTROL STRUCTURE/FLOW RESTRIGTOR" checklist for items to be reviewed during the inspection. Connection tr�the �ity System The detention system is corenected via a storm water drain t� the City's storm water system in the intersection of Harrington Ave NE and Sunset Lane NE. The awner is not responsible to maintain the maintenance hole in the public right-of-way that the project's storm drain connects to. See attached "IVO. 6— CONVEYANCE PIPES" checklist for items to be reviewed during the inspection. Right of Way Porous Pavement anc! Landscaping The project irecludes approximately 3,000 SF of pervious concrete sidewalk and adjacent landscape strip in the Right of Way along Sunset Boulevard.
