1. The Grantor(s)or his/her ctheir)successors in interest and assigns{'°Owners")shall at their own
cost, operate, maintain,and keep in good repair,the Property's drainage facilities construeted
as required in_the approved construetion plans and specifications �qQ3��,��(Prolecr
pfon#) on fi{e with the City of Renton and submitted to the City of Renton for the re�iew and
approval of permit(s) u16002232 �����(construction/euilding/utility Permit#).The
Property's drainage facilities are shown and/or listed on Exhibit A—Site Plan. The Property's
drainage facilities shall be maintained in eomplianee with the operation and maintenanee
schedule included and attached herein as Exhibit E�—Operations and Maintenance. Drainage
facilities include pipes, channels, flow contral facilities, water quality facilities, on-site best
management practices {BMPs) and other engineered structures designed to manage and/or

treat stormwater on the Property. On-site BMPs include dispersion and infiltration devices,
bioretention, permeable pavements, rainwater harvestin� systems, tree retention credit,
reduced impervious surface footprint, vegetated roofs and other measures designed to rnimic
pre-developed hydrology and minimize stormwater runoff on the Property.
2. City of Rentan shall have the right to ingress and egress over those portians of the Property
necessary to perform inspections of the stormvorater facilities and BMPs and conduct
maintenance activities specified in this D�claration of Covenant and in accordance with the
Renton Niunicipal Code. City of Renton shall provide at least thirty (30) days' written notiee ta
the Owners that entry on the Property is p9anned for the inspection of drafnage facilities.After
the thirty 430) days,the Owners shall allow the City of Renton ta enter for the sole purpose of
inspecting drainage faci(ities. In lieu of inspecteon by the City, the Owners may elect ta engage
a Eicensed civil engineer registered in the state of Washington who has expertise in drainage to
inspect the drainage facilities and provide a written report describing their condition. Bf the
engineer option is chosen,the Owners shall provide written notice to the City of Renton within
fifte2n (15)days of receiving the City's rrotice of inspection.Within thirty(30)days of giving this
notice,the Owners,or engineer on behalf of the Owners,shalB pravide the engineer's report to
the City of Renton. If the report is not provided in a timely manner as specified above,the City
of Renton may inspect the drainage facilities without further rsotice.
3. If City of Renton determines from its inspection, or from an engineer's report provided in
accordance wlth Paragraph 2,that maintenance, repair, restoratian, and/or mitigation work is
required to be done ta any of the drainage facilities, City of Renton shall notify�the Owners of
the specific maintenance, repair, restoration, and/or mitigation work ("Work") required
pursuant to the Renton Municipal Cade. The City shall also set a reasonable deadline far the
Owners to compiete the Work, or to provide an engineer's report that verifies completian of
the Work. After the deadline has passed, the Owners shall allow the City access to re-inspect
the drainage facifities unless an engineer's report has been provided verifying completion af
the Work. If the Work is not completed within the time frame set by the City, the City may
initiate an enforcement action andJor perforrn the Work and hereby is given access to the
Property for such purposes. Written natice will be sent to the Owners stating the Cit�s
intenti�n to perform such Work.This Work will not commence until at least seven(7)days after
such notice is mailed. If, within the sole discretion of the City, there exists an imminent or
present danger, the seven (7} day notice period will be waived and Work wilf begin
immediately.
4. The Owners shall assume all responsibility for the cost of any Wark, �r any measures taken by
the City to address conditions as described in Paragraph 3. Such responsibility shall include
reimbursement to the City within thirty(30)days of the receipt of the invoice for any such Work
performed. Overdue payments will require payment of interest at the maximum legal rate
allowed by RCW 19.52,020 (currently twelve percent (12!)). If the City initiates legal action to
enforce this agreement, the prevailing party in such action is entitled to recover reasonable
litigation costs and attorney's fees.
5. The Owners are required to obtain written approval from City of Renton prior to filling, piping,
cutting, or removing ve�etatian (except in routine landscape maintenance) in open vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performin� any
alterations or modifications ta the drainage facilities referenced in this Declaration of Covenant.

6. Any notice or ce�rasent required to be given or otherwise provided for by the provisions of this
Agreement shall be effective upon personal delivery,orthree(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parti�s, and supersed�s all prior discussions, negotiations, and aIB agreements
whatsoever whether oral or written.
8. This Declaration of Covenant is intended to protect the value and desirability and promote
efficient and effective management of sur�ace water drainage of the real property described
above, and shall inure to the benefit of all the citizens of the City of Renton and its successors
and assign5. This �eclaration of Covenant shalf run with the land and be binding upon
Grantor(s), and Grantor°s(s'J successors in interest, and assigns.
9. This Declaration of Covenant may be terminated by execution of a written agreement by the
Ovvners and the City that is recorded by King County in its real property records.

The attached Operation and Maintenance checklist is intended to provide guidance to
the owner(s)for the operation and maintenance of th� drainage and the storrr�water
detentic�n system at the Sunset Terrace Development.
The owner is responsible for maintenance of storm drainage facilities within the
property. The owner is �rot responsible for maintenance within the public right-of-way.
This manual cannot anticipate every problem, but provide a checklist for the most
anticipated rnaintenance items.
The stormwater system should be regularly maintained an an annual basis during the
summer prior to the start of the "rainy season°' at the �nd of September.
When operating normally, the system should not have any surface ponding of
stormwater and the detention system should fully drain (except for the 4-foot sump)
within 24-hours after a storm event. If either of these are not true then the systerri should
be reviewed'using the maintenance checklist to determine the problem.

Below is a summary of each component af the storm drainage system:
Detention Vault
The vault in located in the south-west corner of the level 1 parking lot (see attach�d
plan) at the corner of Harrington Ave NE and Sunset Lane NE. The vault is ortly
accessible through a maintenance hole located outside the building in the sidewalk. The
purpose of the vault is ta use the flow control device (see beiow) to temporarily store
stormwater runoff firom the btailding roof to reduce the peak stormwater rtanoff flows. See
the attached "NO. 3— DETENTION TANKS AND VAULTS" checklist for items to be
reviewed during the inspection.
If any maintenance is required inside the vault, then th� owner shall used only personnel
with current confined space entry certification to enter the vault. Prior to personnel
entering the vault, the maintenance hole and three vents shall be opened and used for
forced air venting.

Flow control structure
The flow control structure is located in the vault and is visible from the maintenance
hole. The flow control structure consists af a 12-inch diameter vertical riser pipe with two
orifices sized to only let through a iimited flow of stormwater runoff. Yhe lowest orifice is
submerg�d in the sump iocat�d under the bottom of the riser, the second is lacated
under the elbow that is attached to the riser pipe near the top af the riser pipe. if the
orifices are blocked, the Stormwater Vault can be drained to allow cleaning by opening a
shear gate. This is done by pulling on the handle attached to the top rung undern�ath
the lid. The shear gate shall be closed after cleaning. See attached "NO. 4 —CONTROL
STRUCTURE/FLOW RESTRICTOR" checklist for items to be reviewed during the
inspection.
Connection to the City System
The detention system is connected via a storm water drain to the City's storm water
system in the intersection of Harrington Ave NE and Sunset Lane NE. The owner is not
responsible to maintain th� maintenance hale in the public right-of-way tha�the project's
storm drain cannects to. See attached "NO. 6— CONVEYANCE PIPES" checklist for
items to be reviewed during the inspection.
Right of Way Porous Pavement and Landscapong
The project encludas approximately 3,000 SF of perviaus concrete sidewalk �nd
adjacent landscape strip in the Ftight�f Way along Sunset Boulevard. See attached
"NO. 11 — GROUNDS (LANDSCAPING)" and "NO. 30— F'ERMEABLE PAVEMENT
BMP" checklist for items to be reviewed during the inspection.
Below is a stormwater enspection farm and checklists to be compieted �ach year at the
time of the inspection and wh�n any maintenance is perforrned on the storm drain
system. A copy of ail the compleked forms and checklists shall be kept on site in a log
book for review by the City.

defective and anay need to be replaced. lf this occurs, contact the pavetnent installer or the City
of Renton for further instructions.
+ A typicat perrneable pavement system has a life expectancy of approximately 25 years.Ta heip
extend the useful life of the system, the surface of the petxneable pavement should be kept
cyean, stable and free of leaves, debris, and sediment through regular sweeping or vacuum
sweeping. Aggregate fill in inodular grid pavement may need periodic surface replenishment.

pre-developed hydrology and minimize stormwater runaff an the Property.
2. City of Renton shall have the right to ingress and egress over those portfons of the Property
necess�ry to perform inspections of the stormwater facilities and BMPs and conduct
maintenance activities specified in this Declaration of Covenant and in accardance with the
Renton Munieipal Code. City of Renton shall provide at leas�thirty (30) days' written notice to
the Owners that entry on the Property is planned for the inspection of drainage facilities.After
the thirty(30) days, the Owners shall alB�w the City of Renton to enter for the sole purpose of
inspecting drainage facilities. !n lieu of inspect6on by the City,the Owners may elect to engage
a licensed civi! engineer registered in the state of Washington who has expertise in drainage to
inspect the drainage faci6ities and provide a writt�n report describing their condition. If the
engineer option is chosen,th�Owners shal! provide written notice to the City of Renton within
fifteen (15j days�f receiving the City's notice of inspection. Within thirty(30)days of giving this
notice,the Owners,or engineer on behalf of the Owners,sha11 provide the engin2er's repart to
the City of Renton. If the report is not provided in �timely manner as specified above,the City
of Renton may inspect the drainage facilities without further notice.
3. If City af Rentan determines from its inspection, or from an engineer's report provided in
accordance with Paragraph 2, that maintenance, repair, restoration, and/or mitigation work is
required to be done to any of the drainage facillties, City of Renton shafl notify the Owners of
the specific maintenance, repair, restoratian, and/or mitigation work ("Work°') required
pursuant to the Renton Municipal Code. The City shaB! also set a reasonable deadline for the
Owners to complete the Work, or to provide an engineer's report that verifies completian of
the Work. After the deadline has passed, the Owners shall allow the.City access to re-inspect
the drainage facilities unless an engineer's report has been provided verifying completion af
the Work. If the Work is not completed within the time frame set by the City, the City may
initiate an enforcement action and/ar perform the Work and hereby is given access to the
Property for such purposes. Written notice will be sent to the Owners stating the City's
intention to perform such Work.This Wark will not commence until at least seven (7)days after
such notice is mailed. If, within the sole discretion of the City, there exists an irnminent or
present danger, the seven (7) day notice period will be waived and Work will begin
immediately.
4. The Owners shall assume all responsibility for the cost of any Work, or any rreeasures taken by
the City to address conditions as described in Paragraph 3. Such responsibiBity shal6 include
reimbursement to the City within thirty(30)days of the receipt of the invoice for any such Work
performed. Overdue payments will require payment �f interest at the maximum legal rate
allowed by RCW 19.52.020(currently twelve percent(12%)). If the City initiates legal action to
enforce this agreement, the prevailing party in such action is entitled to recover reasonable
litigation costs and attorney's fees.
5. The Owners are required to obtain written approval from City of Rentan prior to filling, piping,
cutting, or remaving ve�etation (except in routine landscape maintenance) in op�n vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performang any
alterations or modifications to the drainage facilities referenced in this Deciaration of Covenant.

6. Any notice or consent required ta be given or otherwise pravided for by the provisions of this
Agreement shall be effective upon personal deiivery,or three(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parties, and supersedes aBl prior discussions, negotiations, and all agreements
vorhatsoever whether oral or written.
8. This Declaration of Covenant is intended to protect the value and desirability and promote
efficient and ei�fective management of surface water drainage of the real property described
above, and shall inure to the benefit of all the citizens of the City of Renton and its successors
and assigns. This Declaration of Covenant shall run with the land and be binding upon

The attached Operation and Maintenance checklist is intended to provide guidar�ce to
the owner(s)for the operation and maintenance of the drainage and the stormwater
detention system at the Sunset Terrace Development.
The owner is responsible for marntenance of storrn drainage facilities within the
property. The owner is not responsible for maintenance within the public right-of-way.
This manual cannot anticipate every problem, but provide a checklist for the most
anticipated maintenance items.
The stormwater system should be regular0y maintained on an annual basis during the
summer prior to the start of the "rainy season'° at the end of September.
When operating normally, the system should not have any surfiace ponding of
stormwater and the detention system should fully drain (except for the 4-foot sump)
within 24-hours after a storm event. If either of these are not true then the system should
be reviewed using the maintenance checklist to determine the problem.

Below is a summary of each camponent of the storrn drainage system:
Detention Vault
The vaul# in located in the sauth-west corner of'the {evel 1 parking lot (see attached
plan) at the carn�r of Harrington Ave NE and Sunset Lane NE. The vault is only
accessible through a maintenance hole located outside the building in the sidewalk. The
purpose of the vault is to use the flow control device (see below) to temporarily store
stormwater runoff from the buiiding roof to reduce the peak stormwater runoff flows. See
the attached "NO. 3 — QETENTION TANKS AND VAULTS" checklist for items to be
reviewed during the inspection.
If any maintenance is required inside the vault, then the owner shall used only personnel
with current confined space entry certification to enter the vault. Prior to personnel
entering the vault, the maintenance hole and three vents shall be opened and used for
forced air venting.

Flaw control structure
The flow control structure is located in the vault and is visible fram the maintenance
hole. The flow control structure consists of a 12-inch diameter vertical riser pipe with two
orifices sized to only let through a limited flow of stormwater runoff. The lowest orifice is
submerged in the sump located under the bottom of the riser, the second is located
under the eibow that is attached to the riser pipe near the top of the riser pipe. If the
orifices are blocked, the Stormwater Vault can be drained to allow cfeaning by opening a
shear gate. This is done by pulling on the handle attached to the top rung underneath
the lid. The shear gate shall be closed after cleaning. See attached "fVO. 4—CONTROL
STRUCTURE/FLOW RESTRICTOR" checklist for items to be reviewed during the
inspection.
Connection to the City System
The detention system is connected via a storm water drain to the City's storm water
system in the int�rsection of Harrington Ave NE and Sunset Lane NE. The owner is not
responsible to maintain the maintenance hole in the public right-of-way that the project's
storm drain connects to. See attached `°NO. 6— CONVEYANCE PIPES" checklist for
items to be reviewed during the inspectiane
Right of Way Porous Pavem�nt and Landscaping
The projsct includes approximately 3,000 SF of pervious concrete sidewalk and
adjacent landscape strip in the Right of Way along Sunset Boulevard. See attached
"NU. 11 — GROUNDS (LANDSCAPING)" and "NO. 30 — PERMEABLE PAVEMENT
BMP" checklist for it�ms to be reviewed during the inspectian.
Below is a stormwater inspection form and checklists to be connpleted each year at the
time of the inspection and when any rriaintenance is performed on the storm drain
system. A copy of all the completed forms and checklists shall be kept on site in a log
book for review by the City.

2. City of Renton shall have the right to ingress and egress over those partions of the Property
nec�ssary to perforrr9 inspections of the stormwater facilities and BMPs and conduct
maintenance activities specified in this Declaration af Govenant and in accordance with the
Renton Munieipal Code. City of Renton shall provide at least thirty (30} days' written notice to
the Owners that entry on the Property is planned for the inspection of drarnage facilities.After
the thirty(30) days,the Owners shall aBlow the City of Renton to enter for the sale purpose of
inspecting drainage facilities. In lieu of inspection by the City, the Owners may eBect to engage
a licensed eivil engineer registered in the state of Washington who has expertise in drainage to
inspect the drainage facilities and provide a written report describing their condition. If the
engineer optian is chosen,the Owners shall provide written notice to the City of R�nton within
fifteen (15)days of receiving the City's notice af inspection.Within thirty(30)days of giving this
notice,the Owners,or engineer on behalf of the Owners,shall provide the en�ineer's report to
the City of Renton. If the report is not provided in a timely manner as sp�cified above,the City
of Renton may inspect the drainage faeilities without further notice.
3. If City of Renton determines from its inspection, or from an engineer's report provided in
acccrrdance with Paragraph 2,that rnaintenance, repair, restoration, and/or mitigation work is
required t� be dane to any of the draina�e facilities, City of Renton shall notify the Owners of
the specific maintenance, repair, restoration, and/or mitigation work ("Work'°) required
pur�uant to the Renton Municipal Code. The City shall also set a reasonable deadline for the
Owners ta complete the Work, or to provide an engin2er's repart that verifies completion of
the Work. After the deadline has passed, the Owners shall alfovv the City access to re-inspect
the drainage facilities unless an engineer's report has been pr�vided verifying completion of
the Work. If the Work is not completed within the time frame set by the City, the City may
initiate an enforcement action and/or perfor►n the Work and hereby is given aceess to the
Praperty far such purposes. Written notice will be sent ta the Owners stating the City's
intentian to perform such Wark.This Work vrrill not commence until at least s�ven {7)days after
such notice is mailed. If, within the sole d'escretion of the City, there exists an imminent or
present danger, the seven (7) day notice periad will be waived and 1/Vork will begin
immediately.
4. The Owners shall assume all responsibility for the cast of any Wprk, c�r any measures taken by
the City to address conditions as described in Para�raph 3. Such responsibility shall 6nclude
reimbursement to the City within thirty(30)days of the receipt of the invoice for any such Work
performed. Overdue payments wili require payment of interest at the maximum legal rate
allowed by RCW 19.52.020(currently twelve percent (12%)). If the City initiates legal actian to
enforce this agreement, the prevailing party in such action is entitled to recover reasonable
litigation costs and attorney's fees.
5. The Owners are required to obtain written approval frcam City of Renton prior to filling, piping,
cutting, or removing vegetation (except in routine iandscape maintenance) in open vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performing any
alterations or modifications to the drainage facilities referenced in this DecBaration of Covenant.

6. Any notice or consent required to be given or otherwise provided for by the provisions of this
Agreement shall be effeetive upon personal delivery,orthre2(3) days after mailing by Certified
Mail, return receipt requested.
7. With regard to the rnatters addressed herein,this agreement canstitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and al! agreements
whatsoever wh�ther oral or written.
8. This Declaration of Covenant is intended to protect the v�Bue and desirability and promote
efficient and effective management of surface v�eater drainage of the real property described

The aitached Operation and Maintenance checklist is intended to pravide guidance to
the owner(s)for the operation and maintenance �f the drainage and the stormwater
detention system at the Sunset Terrace Development.
The owner is responsible for maintenance of storm drainage facilities within the
properEy. The owner is not responsible for maintenance within the public right-of-way.
This manuai cannot anticipate every problem, but provide a checklist for the most
anticipated t�taintenance items.
The stormwater system should be regularly maintained on an annual basis during the
summer priar to the start of the "rairay season" at the end af September.
When operating normally, the system should not have any surfiace ponding of
stormwater and the detention syskem should fully drain (except for the 4-foot sump)
within 24-hours after a storm event. If either of the�e are nat true then the system should
be reviewed using the maintenance checklist to determine the problem.

Below is a sumrnary of each compon�nt of the storm drainage system:
Detention Vault
The vault in loc�#ed in the south-west corner of the level 1 parking !ot (see attached
plan) at the corner of Harrington Ave NE and Sunset Lane NE. The vault is only
accessible through a rnaintenanc� hole located outside the bui6ding in the sidewalk. The
purpose of the vault is to use the flow control device (see below} to tempc�rarily store
stormwater runoff from the building roof to reduce the peak stormwater runoff flows. See
the attached "NO. 3 — DETENTION TANKS AND VAULTS" checklist for items to be
reviewed during the inspection.
If any maintenance is required inside the vault, then the owner shall used only personnel
with current confined space �ntry certification t� enter the vau6t. Prior to personnel
entering the vault, the maintenance hole and three vents shail be opened and used for
forced air venting.

Flow control structure
The flow cantrol structure is located in the vault and is visible from the mairatenance
hole. The flo,nr control structure consists of a 12-inch diameter vertical riser pipe with two
orifices sized to only let through a limited flaw of stormwater runoff. The lowest orifice is
subrrierged in the sump lo�ated under the bottorri c�f the riser, the second is iocated
under the elbow that is attached to the riser pipe near th+� top of the riser pipe. If the
orifices are blocked, the Stormwater Vauit can be drained to allow cleaning by apening a
shear gate. This is done by pulling on the handle attached to the top rung underneath
the lid. The shear gate shall be closed after cleaning. See attached °`NO. 4— CONTROL
STRUCTURE/FLOW RESTRIGTOR" checklist for items to be reviewed during the
inspection.
Connection tr�the �ity System
The detention system is corenected via a storm water drain t� the City's storm water
system in the intersection of Harrington Ave NE and Sunset Lane NE. The awner is not
responsible to maintain the maintenance hole in the public right-of-way that the project's
storm drain connects to. See attached "IVO. 6— CONVEYANCE PIPES" checklist for
items to be reviewed during the inspection.
Right of Way Porous Pavement anc! Landscaping
The project irecludes approximately 3,000 SF of pervious concrete sidewalk and
adjacent landscape strip in the Right of Way along Sunset Boulevard. See attached
"NQ. 11 — GROUNDS (LANDSGAPING)°' and "R10. 30 — PERMEABLE PAVEMENT
�MP" checklist for items to be reviewed during the inspection.

• Perrneable pavements must be inspected af�er one major storm each year to make sure it is
working properly. More frequenl inspection is recotnmendeci.
• Prolonged ponding ar standing water on the pavement surface is a sign that the system is
defective and inay need to be replaced. If this occurs, contact the pavement installer or the City
of Rentan for further instructions.
• A typical permeable pavernent system has a life expectancy of approximately 25 years.To help
extend the useful life of the system, the surface of the permeable pavement should be kept
clean, stable and free of leaves, debris, and sediment through regular sweeping or vacuum
sweeping.Aggregat�fill in inodular grid pavement may need periodic surface replenishment.

pavers.
