While we appreciate the preliminary approval of our approach, I did want to address the issue you raised regarding contaminants. In short, based on the Mitigated DNS issued on May 22, 2022, and our compliance with the mitigation requirements of that report, we do not expect to encounter contaminated soils on this site. In further support of this position, we would like to highlight the following items: 1. The site in question consisted of four residences, which were demolished in order to begin this project. There was no dealership on this site at any point in the past. 2. Related, the current Brotherton Cadillac/Buick/GMC dealership was constructed in 1996; prior to that it was also residential property. Similarly, the lots adjacent to the east of the current construction site were residential until 1996. 3. As noted in the City of Renton Environmental Review Committee Report dated 5/16/2022, a. Item B - the subject property was tested for lead and arsenic (per Mitigation Measure #3); the results noted in the report generated 12/12/2022, by The Riley Group, indicate the “…soil samples analyzed indicated concentrations of arsenic and lead below the Method A CULs of 20 mg/kg and 250 mg/kg for arsenic and lead, respectively.” 4. The Geotechnical Engineering Report, prepared by Migizi Group, Inc., dated July 8, 2021 specifically notes the anticipated dewatering method under Item 4.1 – Site Preparation. As this report was part and parcel of the Environmental Review and no mitigation measures were specified aside from testing for lead and arsenic, we do not anticipate contamination on the site. 5. The site has already been over-excavated in accordance with the Geotechnical Engineering Report, with excess soils being exported and structural fill being imported. As you’re aware, our client is very sensitive to issues or parties which he may view as over-reaching. He has invested a considerable amount of money in order to fulfill the requirements dictated by the Mitigated DNS and ERC Reports. In this case, particularly in light of the facts presented above, and the very substantial costs he might incur should additional requirements now be placed on his job, we would respectfully request approval of the SWPPP amendments/update presented to you by our CESCL lead, without the additional requirement. One element to this plan that needs to be updated is including testing for contaminants, otherwise it is acceptable. The plan identified turbidity and PH but given the nature of the area we are concerned there may be other contaminants (such as oil) that is in the ground. Please update and send back over to me. When do you anticipate starting this work? Additionally, we recommend pursuing the discharge permit with KC in the event the groundwater is unable to be cleaned prior to discharge. Hi Nathan – following up on our meeting with Brad Stocco on Wednesday, I wanted to provide you with our plan/approach for the dewatering of a portion of the site where we need to install the stormcapture units and lift station. I’ve attached a narrative of our plan, along with a marked-up copy of our SWPPP. In summary, please note the following: 1. CSWGP for project is: WAR3111886 2. Site Info: approx. 1.2ac, previous use – (4) residential homes. 3. CESCL leads for the project: Eric Simonson and Scott Lindley 4. Relevant guidance from the CSWGP General Permit a. S1-C.3 Authorized Discharge: Non-Stormwater Discharges i. Item g - Uncontaminated excavation dewatering water 5. Relevant guidance from King County WTD “Discharge of Construction Wastewater to Sanitary Sewer System a. “It is WTD’s policy to prevent clean water from discharging to the sanitary sewer system.
