please use this language: "Know all people by these presents that we, the undersigned
owner(s) of fee simple interest in the land hereby subdivided, declare this plat to be the
graphic representation of the subdivision made hereby and dedicate to the use of the
public forever all streets not shown as private. We dedicate the use thereof for all
public purposes not inconsistent with public highway purposes and also the right to
make all necessary slopes for cuts and fills upon the lots shown in the original
reasonable grading of said streets. We further dedicate to the use of the public all the
easements and tracts shown on this plat for all public purposes as indicated thereon,
which may include but not be limited to parks, open space, pedestrian access, utilities and
drainage unless such easements or tracts are specifically identified on the plat as being
dedicated or conveyed to a person or entity other than the public. We dedicate and
convey each street, easement and tract not dedicated to the public to the person or
entity identified and for the purpose stated.
Further, the undersigned owners of the land hereby subdivided, waive for ourselves,
our heirs and assigns, and any person or entity deriving title from the undersigned any
and all claims for damages against the City of Renton and its successors and assigns
which may be occasioned to the adjacent lands by the established construction,
drainage and maintenance of dedicated roads within this subdivision.
Further, know all people by these presents that we hereby certify that we have
established the Homeowners Association (HOA) of "Canopy” in accordance with
Washington State Law and have identified each lot of this plat as a member of said HOA.
Said HOA is subject to the Declaration of Covenants and Restrictions for the Plat of
“Canopy” as disclosed by instrument recorded under King County Recording Number

PUBLIC TRAIL EASEMENT
The ___ foot public trail easement shown on Tract "C” is
hereby granted to the City of Renton, a municipal
corporation, its successors and assigns, and for use by the
public for purposes of a perpetual, non-exclusive
non-motorized recreational trail over, across along, in,
upon, and under the easement. The plat’s homeowners
association shall be responsible for all costs related to
the repair and maintenance of the trail easement, and shall
have the right to enter the easement area at any time to
maintain the same.

PRIVATE WALL EASEMENT
Easements are hereby reserved for and/or
granted to all lots within this plat that
include or are within 4.00 feet of a retaining
wall or rockery that measure 8.00 feet in
width centered on said retaining wall or
rockery for purposes of maintaining and
repairing such retaining wall or rockery.
Repair and maintenance of such retaining wall

The following conditions of the Hearing Examiner
decision are required:
1. Buffer enhancement on the off-site benefit parcel
shall occur concurrently with construction of the
PUD/Preliminary Plat. Long-term ownership and
management of the off-site benefit parcel shall be the
responsibility of the Canopy Subdivision Homeowners
Association unless the City determines it is able to assume
ownership and provide those services.
2.The applicant shall submit a surety to ensure the
survival of the new trees in the Alderwood sandy loam
areas for a minimum of five (5) years. The surety shall
include a warranty for each new tree, irrigation system,
and maintenance for the five (5) year period. The surety
and maintenance specifications shall be executed prior to
final plat recording.
3.The applicant shall remove existing homes and
outbuildings on the subject property at 2020 NE 40th St
and 4130 Lincoln Ave NE prior to submitting final plat
and final planned urban development applications. The
applicant shall also remedy any encroachments on the
Canopy PUD subject property including but not limited to
potential encroachments along the boundary with 4006
Lincoln Ave NE prior to submitting final plat and final
planned urban development applications.
4. The applicant shall submit an overall plat building
coverage and impervious coverage analysis with graphic
representation with the civil construction permit
identifying the entire subject property complies with the
maximum building coverage of 50-percent and impervious
coverage limitation of 65-percent. The analysis and
graphic shall be reviewed and approved by the Current
Planning Project Manager prior to permit issuance and
recorded as an exhibit with the final plat.
5. The applicant shall submit an emergency and vault
access road detail exhibit with the civil construction
permit application. The exhibit shall provide details of the
road width and hammerhead turnaround meeting the
specifications of the Renton Regional Fire Authority with
paved materials that are complementary to pedestrian and
open space environments while meeting the needs of fire
apparatus such as scored and/or stamped concrete,
pavers, or other comparable materials as approved by the
Current Planning Project Manager. The access road
shall be pulled out of Tract H and placed in a separate
tract and easement that would limit use to emergency,
vault access, and open space and the tract/easement
shall be named for the purpose of addressing Lots 1-6.
The exhibit shall be reviewed and approved by the Current
Planning Project Manager prior to permit issuance. Tract
and easement language for the road shall be reviewed
and approved by the Current Planning Project Manager
prior to plat recording.
