The Development Charges are collected either as part of the construction permit (if there is one) or prior to the recording of the short plat. STREET IMPROVEMENTS: • The Board of Public Works granted a deferral to the offsite road improvements. • Street lighting is not required for a two lot short plat. TRANSPORTATION: • Transportation Mitigation Fees of $716.5 shall be paid prior to the recording of the short plat. GENERAL: • All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a registered Civil Engineer. • Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvement is 5% of the first $100,000 of the estimated construction costs; 4% of anything over $100,000 but less than $200,000, and 3% of anything over $200,000. Half of the fee must be paid upon application for building and construction permits, and the remainder when the permits are issued. There may be additional fees for water service related expenses. I am against this project being approved. I live on the corner of NE 50th street and 114th Avenue SE, and the location of the above referenced property is just down the street from my home. As such it is not only in my immediate neighborhood, it also is part of the entrance to my neighborhood. This neighborhood is made up of large lots and large houses surrounded by trees and greenery. Approving this project would be a blight on what is a unique and beautiful semi-rural setting in the midst of the urban development which surrounds it. No doubt the owner of this property has requested approval so the property can be developed with a "skinny" house typical of some of the densely packed neighborhoods in Seattle. To allow such a house would lower the property values of the remaining houses in the neighborhood, since it would unalterably change the unique character or our neighborhood. It would also be the "thin end of the wedge," setting a dangerous precedent for others who might want to pursue similar types of development in our neighborhood. In the interests of preserving a unique and beautiful neighborhood on the border of Renton and Newcastle, and to preserve the property values of those of us who live here, I ask that approval of this project be declined. Short plat of this property is not in the best interest of the surrounding property owners even though this property is zoned R-8. The subject property is in a small section zoned R-8 while the majority of the surrounding area is in the city of Newcastle and is zoned R-4. I recently purchased a piece of land approximately 0.5 acres in size(short plat#LUA-95-0390 SHPL)which is about 100 feet from the subject property. The previous owner was granted the short plat by the city of Renton in 1995, even with a property of this size in a R-8 zone, because it was in keeping with the size and intent of the surrounding properties. This was a significant reason why I purchased the property and I have no intent to further subdivide the property. Allowing the subject short plat to be approved would jeopardized the value, intent and the desires of the surrounding property owners. The fact that the area is currently zoned R-8 is an oversight which will be corrected within the coming months by the propose annexation of the area,which includes the subject short plat,to the city of Newcastle. This annexation has been in planning several months before the current owner applied for the short plat. Numerous property owners are involved in the annexation together with the help and endorsement of Jesse Tanner, Mayor of Renton, and Gary Adams, Deputy Mayor of Newcastle. If for any reason the area subject to annexation to the city of Newcastle is not approved,we will still pursue obtaining R-4 zoning for the Renton portion of the involved area. To allow this short plat to be approved before this issue is settled would jeopardize the efforts of many people and could result in costly, lengthy legal battles Even though I believe the above reasons are strong and compelling reasons not to grant the short plat there is one other issue to discuss. I have visited the subject short plat and believe it would be very difficult to place two homes in the short plat within the required setbacks. One side of the short plat is bordered by a designated sensitive area,because of the stream and the rear setback requires a variance as indicated in the application. If the property cannot meet the minimum R-8 zoning requirements without variance it should not even be considered for short plating. Please feel free to contact me to discuss any of these issues further and if a hearing is being arranged. The proposed Reed short plat is situated in the northeast end of the City. Bounded on the south by NE 51st Street and on the west it is bounded by Aberdeen Avenue NE. On the north and east it is bounded by a large tracts that are not densely populated. Access to the property will be from Aberdeen Avenue NE. Adjacent street improvements consist of 18 to 20 feet wide of asphaltic pavement with a 3-foot asphaltic sidewalk along the north side of NE 51st Street and gravel shoulders and ditches along the east side of Aberdeen Avenue NE. There is a gravity sewer, water and gas facilities adjacent to the site. The project area is rolling at an average slope ranges from 15% to 25%. Slopes oriented from east to west. The City of Renton designates the site with the R-8 zone. The R-8 zone allows for a minimum lot size of 4500 square feet and a maximum density of 8 units per acre. The setbacks allowed in the R-8 zone are as follows: 20 feet front yard setback, 15 feet side year along a street setback, 5 feet interior setback and 20 feet for rear yard setback. The City of Renton Comprehensive Plan designates the site as Single-Family (SF) Residence which is consistent with present zoning. The proposed development would create 2 single family lots with a minimum lot area of 6700 square feet. There exist a house on the property, therefore one additional dwelling unit will be built. The dwelling unit density calculates at 6.2 units per net developed area. No new road is proposed to serve the new lot. Existing street will provide access to the new dwelling. Minimal grading will be required in order to prepare the final residential lots. Public water and sewer are available along the south and west of the site. The area cover consists of overgrown and brushy covers for most of the site, except for lawn around existing house and a few mature evergreen trees. The surface water is directed south toward open ditches along NE 51st Street; thence westerly to Lake Washington Blvd, and southerly to existing crossing which crosses Intestate 405, situated approximately a 1/2 mile from the site. Traffic circulation and access to the property is proposed to provide vehicular access from Aberdeen Avenue NE. In accordance with City Zoning Ordinance 4405, Section 4-31-5 .D. 6, the minimum rear yard setback for R-8 zone is 20 feet . The existing rear yard setback for the existing house is measured at 11 . 79 feet . The following justification for the above-referenced variance are written in a format acceptable to the Hearing Examiner. a. " That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, and location of surroundings of the subject property; , and the strict application of the Building & Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical classifications " Discussion: The variance request is to allow the use of a shorter rear yard for the proposed Lot 1 . This request is the result of the site is being located within the R-8 zone which requires a minimum lot rear yard setback of 20 feet . The presence of an existing house and the property configuration is difficult to provide necessary rear year setback. A shorter rear yard setback is being considered in this short plat to provide reasonable flexibility to achieve the necessary density in the R-8 zone . The proposed lot will contain the required area for the zoning classification. b. " That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated. " Discussion: Granting the variance for a shorter rear yard setback would allow the applicant to efficiently use the property and achieve a density as close to eight units per acre as possible. Due to the existing house on the property and the physical constraints which would limit the overall density of the site, a shorter rear yard setback would provide an answer to the density issue. Therefore, the applicant feels the variance is necessary in order to develop the site in such a manner to ensure the rights of the property owner that which would be enjoyed by other properties in under the similar circumstances . " That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated. " Discussion - The proposed request for shorter rear yard setback for Lot 1 will not be detrimental to the public welfare or injurious to the property in the vicinity. d. " That the approval as determined by the Hearing Examiner or Board of Adjustment, is a minimum variance that will accomplish the desired purpose. " Discussion - The approval of this variance is minimal, and it would not have an impact upon the desired purpose of developing the site into single family lots within the designated R-8 zone . This variance will have no appreciable impact upon either the vehicular or pedestrian traffic within and adjacent to the proposed development . The property is situated north of the City of Renton in the SE Quarter of Section 29, Township 24 North, Range 5 East, W.M. It is bounded on the south by NE 51st Street, on the west by Aberdeen Avenue NE and the along the north and east there exist large single family parcels . The soil type as classified by King County Soil Conservation Service is Alderwood Soil (Agc) . REVIEW OF RESOURCES 1 . City of Renton Aquifer Protection Area Map 2 . City of Renton Zoning and Subdivision Ordinances FIELD INSPECTION Field inspection of the site area was performed on March 15, 1997 . The property is presently occupied with one single family home, situated on the northerly half of the property. Adjacent street improvements consist of 18 to 20 feet of asphaltic pavement with a 3-foot asphaltic walk along the north side of NE 51st Street and gravel shoulder along the south side of NE 51st Street . The improvements along Aberdeen Avenue NE consist of 18 foot pavement with shoulders on both sides and open ditches directing surface water toward existing underground storm system at the intersection of both streets . Sewer and water are available to the site and will be served by Coal Creek District . The topography of the site is oriented from north to south and southwesterly with average slopes 15 percent . The land cover mostly overgrown and brushy covers for most of the site, except of scattered mature evergreen trees . Page 1 of 2 NARRATIVE UPSTREAM ANALYSIS In reviewing the upstream drainage flows it was ascertained that very little if any of the off-site drainage flows into the subject property. This is confirmed in reviewing the topographic mapping for the area, and actual topography performed for the site . However, we observed a definite swale along the southerly side of the property adjacent to NE 51st Street which picks up fairly large basin area upstream of the site . The runoff will by- pass majority of the property. Another small swale was observed along the northwest corner of the properly picking up flows from the north and northeast and directing the flows into an existing underground storm facilities . DOWNSTREAM ANALYSIS Runoff from the proposed site sheet flows south and southwesterly and the flow is directed southwesterly to roadside ditches along NE 51st Street . Thence flow is directed to west toward Lake Washington Blvd. and south along Lake Washington Blvd. for approximately 200 to 250 feet, and then west to low areas directly east of I-405 . The flow is directed under I-405 to the west into Lake Washington. SUMMARY During our field inspection of the site we did not observe any flooding problems . it appears that the downstream system consisting of open ditches and shallow swales is adequate to handle normal storms . Recent work performed on the storm system under I-405 by WSDOT have improved the flooding situations in the lower areas east of the highway. District shall collect the pro rata share of the cost of construction and contract administration costs of the Extension Facilities as a charge from the owners of benefited properties set forth on Exhibit "C" desiring to connect to or use the Extension Facilities. The amount of such connection charges to be collected prior to such connection is set forth on Exhibit C . Such charges may include, but are not limited to, pro rata share of District legal, engineering, administrative, set-up, handling and actual costs of the ,r.4 Extension Facility. Such reimbursement charges shall be in addition to all other District charges Cl in effect at the time of seeking connection to such Extension Facilities. Upon application by • {` affected property owners, the District may further segregate reimbursement charges attributed r-1c. to property benefited by the Extension Facilities. OharEe; Satisfaction and Discharge. Tne amounts payable by benefiting ' property owners desiring to connect to the Extension Facilities shall be recorded as a charge upon such property until paid. When paid, the charge shall be satisfied and discharged of record. Owner hereby appoints the Secretary of the Board of Commissioners, or his successor, as its attorney-al-fact, to prepare, execute and file for record with King Coun:y a document appropriate to cancel the charge and obligation of the benefited property owners paying the rcimburserr.cnt amount to District, and which will describe the property so connecting and paying the rei,nbursemcnt amount, and thereupon this Agreement shall no longe apply to such property. The District shall forward reimbursement funds referenced .herein to Owner at Owner's address provided herein or to Owner's agent as authorized by Owner to the District in writing. As a condition of receiving such reimbursement funds, the District may require Owner or Owner's agent to execute a receipt to the District for such reimbursement amounts so paid upon a receipt form provided by District. In the event of a dispute as to the rightful party to receive such funds, District I may pay the same to the Owner referenced herein or interplead such funds to the court; in either event, District shall thereupon be relieved of any further obligation or of any liability hereunder as to such reimbursement funds so paid. 4. District Autho irj: Effective Date. District is authorized to enter into this • agreement by virtue of the provisions of Chapters 56.22 and 57.22 RCW. This Agreement shall remain in full force and effect for a period of ten (10) years from the date of acceptance of title I to the Extension Facilities referenced t,arein by District from Owner, which date shall be the 1 effective date of this contract. 5. Recording. This contract shall be recorded in the office of the King County Auditor, King County,Washington, immediately upon execution by the District and the Owner. Such contract shall constitute a charge and obligation upon the properties described on Exhibit NC. not contributing to the original cost of the Extension Facilities under the provisions r-4 hereof, and shall be binding upon the present owner thereof, and all successors and Interest to r= those respective parties. 1 t% 1 T-4 LI 6. Indemnification. The District will use its best efforts to collect and distribute the .-1 funds pursuant to the process set forth in this Agreement. However, the District, its officials, 1 :4 J employee or agents shall not be held liable or responsible for failure to implement any of the provisions of this Agreement unless such failure was willful or intentional. Owner agrees to indemnify and hold the District harmless from any liability or damages of any nature or kind whatsoever arising out of claims and/or suits filed against the City as a result of any action taken pursuant to this Agreement, and shall defend the District whenever the District is named in a suit in which this Agreement is at issue and pay all costs of such defense, including but not limited to attorney and expert witness fees and costs. 7. GencIIl. This Agreement constitutes the entire agrer.:.ent between the parties. All exhibits ^:ferred to herein are by this reference made a part of this Agreement as though set forth in full.
