They recognize that you have proposed to reduce the intensity of the commercial activity by a limitation of height area and certain types of uses. However, the Committee cannot consider the reduction without actual documentation in the form of proposed restrictive covenants signed by the property owners which would reduce the intensity of the use. The information that you have provided relating to impacts upon residential use, traffic and storm water drainage do not truly address the issues as the Environmental Review Committee views them. The concern of the Committee was not focused upon the impact to the rezone area itself, but upon the adjacent areas particularly the Burnett Linear Park il. and the residential areas to the west of the subject site. The impact to those residential areas is not only from traffic, but from the general increased intensity of the commercial use in such areas as.pedestrians and noise. The Environmental Review Committee has, therefore, issued a declaration of significance for your project proposal. The environmental checklist does not present the worst case scenario of commercial development that would be allowed in a B-1, Business Use zone. State law specifically requires that in the environmental review process the worst case proposal be evaluated as to its impacts upon the community. In function the B-1, Business Use, zone could allow the construction of a 15 to 20 story office building, a commercial department store, or shopping center. Probably the best way to• limit the discussion of environmental impacts is to set an upper limit on the building capacity of the property as part of the rezone application. Basically, you have asked for an open-ended rezone which the Environmental Review Committee must look at in the worst case. If you were to propose structures with either a height limit or a square footage limit then the enivornmental consequences would be substantially reduced. The proposed rezone dramatically changes the potential use of the site;however, your statements reflect that there will be no change in employment, residential use, parking, or traffic. Therefore, the Environmental Review Committee is requesting that a formal expanded checklist addressing the areas of (1) residential impacts, (2) traffic impacts, and (3) storm drainage be prepared to analyzed as they impact the adjacent residential neighborhoods. The Environmental Review Committee believes that 90 days should be sufficient to provide the information. Please submit all information by no later than 5 p.m. on Friday, May 16, 1986. Williams; Associate Planner SUBJECT: GARRICK REZONE The Policy Development Department is opposed to the Garrick rezone proposed for a block in South Renton. There are several reasons to recommend denial, but the principal one is that the proposal is contrary to the Comprehensive Plan. The Land Use Element of the Comprehensive Plan designates the block between South 6th and South 7th Streets, Smithers to Burnett as appropriate for High Density Multiple Family Residential development. The Central Renton Sub-area Plan (adopted March 9, 1983) specifically looked at other designations for this area. The ultimate decision was to leave the plan designation as High Density Multi-family consistent. with the R-4 zoning. Factors that were considered in the Central Area Plan were neighborhood integrity, I existing uses, the location of arterial streets and development of the Burnett Linear Park. B-1 zoning is not consistent with the land use designation of the Comprehensive i Plan. The policies of the Comprehensive Plan also argue against a rezone in this location. "NEIGHBORHOOD OBJECTIVE: Sound, viable neighborhoods should be created and/or maintained; and declining neighborhoods should be revitalized." (p. 14 Comprehensive Plan Compendium) "RESIDENTIAL OBJECTIVE: The Central Renton Planning Area should provide a variety of housing opportunities, including single family and multiple family housing. Adequate locations for "close-in" living should be available." (p. 61) "Multiple family growth should be concentrated in transitional areas near the slopes west of Rainier Avenue, in South Renton and, to a lesser extent, in North Renton." (p. 62) "South Renton should be redeveloped in a timely and logical manner as a quality multi-family residential area." (p. 66) 4 Fred J. Kaufman and Roger J. Blaylock January 31, 1986 Page 2 These policies strongly suggest that the intent in the South Renton area is for a continuing residential area with gradual transition from single family to higher density residential. This process, in fact, has been occurring steadily in South Renton for a number of years. Retail commercial uses are not mentioned as appropriate for South Renton. — Other--policies---of--the- Comprehensive- Plan do indicate -where commercial uses are appropriate. "New retail commercial services should be encouraged to locate within established shopping districts and centers." (p. 62) i The proposed rezone to B-1 is clearly in conflict with this Central Area policy. There is no B-1 zoning or commercial use adjacent to the site. B-1 zoning at this location will represent a new spot of commercial "zoning in a residential area. "To minimize traffic congestion, commercial areas should not be located near facilities that require a high degree of safety and traffic control." (p. 17) ,Burnett Linear Park is classified as a neighborhood park. We believe that the proposed ;location would be in conflict with the above policy which calls for sensitivity toward facilities such as neighborhood parks. There are other reasons besides Comprehensive Plan policies for not approving this rezone. The integrity of neighborhoods is a fundamental consideration in planning decisions. "Districts should be identified and their integrity preserved." (p. 12) The South Renton neighborhood has clearly defined boundaries. Burnett Linear Park is the focal center point of the neighborhood. The residential blocks west of Burnett are bounded by the railroad on the north, Shattuck Avenue on the west and South 7th Street to the south. These are discrete barriers between the residential areas which are zoned R-4 and R-3 and the surrounding uses. There is industrial activity south of South 7th Street ' zoned L-1, but the street creates an effective buffer. To the east, Burnett Park separates the subject block from the one industrial use (a printing company) that intrudes north of 7th Street. Therefore, the boundaries of this residential district are very well defined. Heretofore, no pocket of commercial zoning has existed in the area.• Any change to B-1 zoning would represent a significant intrusion in this integrity. The question of neighborhood integrity was the paramount concern in a recent rezone to B-1 in South Renton on the east side of Burnett Avenue South. The property was directly adjacent to existing B-1 uses, but there 'was considerable hesitancy expressed about moving the transition zone even one lot further into the residential area. In that case the adjacent zoning was B-1 and the Comprehensive Plan partially supported the rezone. The ultimate result, however, was a rezone to B-1 with only very restrictive uses allowed: retail uses were expressly prohibited. The Garrick rezone is west of Burnett Avenue, has no Comprehensive Plan support and no adjacent B-1 zoning. The City should be consistent and protect the neighborhood integrity in the area of the Garrick rezone. Fred J. Kaufman and Roger J. Blaylock January 31, 1986 Page 3 Another concern we have about a rezone to B-1 is that there are many alternative locations which could serve similar roles to that proposed for the block. There are a number of blocks between South 3rd and South 4th Streets west of Burnett Avenue and between South 2nd Street and the Cedar River east of Burnett Avenue which are already zoned B-1 and are supported by the Comprehensive Plan. These blocks contain older -homes-which- are-slowly being converted-or replaced with small business or office uses. This is exactly the• type of area that the proponent argues for in the Garrick rezone. These areas could accommodate small, start-up businesses in the manner desired. There appears to be little justification for rezoning additional areas to B-1. "Commercial zoning should only be allowed to the extent of short term 1 needs." (p. 16) One means of justifying a rezone that is not consistent with the Comprehensive Plan is to show changed conditions in the area. This case cannot be made for the Garrick rezone. There have been no new commercial uses in South Renton since revision of the Comprehensive Plan. The industrial uses across South 7th Street have been in place for a number of years without change. The streets in the area have not been upgraded to handle arterial traffic. The only change in the area has been construction of Burnett Linear Park in the early 1980's. As noted before, the completion of this neighborhood park suggests that there is even more reason to protect the residential character, not less reason. It appears that the only justification offered for the rezone is the presence of an illegal retail use and one non-conforming use. The City has been aware of the illegal retail shop ;for a number of months, but has yet to require its closure. The presence of an illegal ;activity should not be an argument for a rezone. The non-conforming commercial ,building on the northwest corner also raises some concerns. First of all, it is not clear 'that the current use would be allowed in the B-1 zone. It may be more appropriate in an 1L-1 zone. Secondly, we do not believe that the current use has been at the site continuously over the years. Renton code prohibits changing a non-conforming use to ;another non-conforming use, and requires that the site cannot be unused for more than one year. Therefore, it is uncertain whether the activity at this site is a legal non-conforming use. The presence of a clearly illegal use and a use that may be illegal is poor justification for a rezone. Finally, the proposed rezone is not timely. The Comprehensive Plan is up-to-date, and no changes have occurred in the area to warrant a rezone. If the City should develop arterial streets in the area, such as along Smithers Avenue, then a re-examination of the Comprehensive Plan in the area might be warranted. No such improvements are planned ; in the near future. Therefore, until and unless such circumstances come to pass, the rezone is untimely. L PT. lY January 15, 1986 City of Renton Building and zoning Department Rezoning of property We the owners of property situated at 601 Burnett Avenue South, a single family residence currently being used as a speciality apparel shop for tall women do petition the City of Renton to rezone this site and the included block, Burnett Avenue South, South 7th Street, Smithers Avenu: South and South 6th Street, to B-1 from current R-4 zoning. We have compiled the following list of observations, reviews and petitions that we feel should qualify this change. The following list of existing conditions require consideration in our rezone request. The block has not been subject to reclassification in the latest com- prehensive plan. The area south of 7th street now has commercial development to the base of the Talbot Hill residential area, and includes a high rise multi- purpose office building. The normal commercial flow should now be to the north resIlting in eventual fusing with the inner city business area. Burnett Avenue South has now become a major traffic artery which makes this area more conducive to business than to residential. An improved transition to Grady Way will increase its use. This block is tangent to commercial areas on South 7th street and also the SE portion of Burnett Avenue (Milmanco ) . A rezone to B-1 should not be looked upon as isolated rezoning but as an extension of existing zoning. The NW portion of this block is currently non-conforming commercial, a rezone would help the city dispose of a non-conforming condition. There is 100% representation by the vested property owners in requesting this re-classification. Environmentally the current R-4 zoning has the potential to impact the existing public utilities to a far greater extent than would a B-1 classification. This block could become the site of a 140 unit high rise apartment. Think of the impact that would make on city services . Small businesses such as ours do not increase the demands for such services. There is a trend to retain the residential atmosphere in areas of small businesses . The building department can control adverse structuring that would blight the area. Starting businesses initially cannot afford the high cost of shopping center leases that include compulsorily participation in various pro- grams and payment of a percentage of gross sales . The humble "Mom & Pop" beginning of large business and industry in the Northwest is legend. Providing a starter area for initial businesses will ulti- mately enhance the Renton Business Community. We met with the commercial division of the King County Assessors office to determine what effect a re-classification would have on those who prefer to continue using their property as residences . We were informed that the tax base would not change. Their policy is to decrease the building value and increase the land value by the same amounts , thus the tax base remains the same. When an area eventually becomes predominately business , the few remaining residential sites will be taxed accordingly. The subject block contains many of the oldest and some of the smaller residences in the city. Current classification did not stimulate much upgrading of existing structures , rezoning to multiple use could be the impetus needed for a general upgrading of these properties. Ih reviewing the August 1985 edition of the comprehensive plan I would like to list a few quotations from page 3 - entitled Purpose - "The plan is of necessity, general in purpose. It must be flexible . It does not represent engineering accuracy, nor does it claim to pre- dict exactly the, future use of every parcel of property or insure that the growth is consistant with the comprehensive plan. " We realize these excerps are not in themselves representative of total plan policy, there are also checks and balances to qualify them. They do, however, indicate that a fair common sense evaluation of re-classification re- quests will be rendered., We are not critical of the comprehensive plan. I don't expect any planning commission to dictatorally change a zoning status .
