EE32148 CASE# 23-14516 DATEAND aE dF coyL� 12/18/23 16:51 LISIO isi©�u NARRATIVE ASSIGNMENT/ARRIVAL On 12/18/2023 at approximately 1651 hours, I assisted Officer B. Grozav who was involved in a two- vehicle collision at the intersection of Sunset Boulevard N and N 3rd Street in the city of Renton, King County, Washington. Officer Grozav was an on-duty police officer, driving a marked City of Renton police vehicle, to an emergency call for service: a vehicle collision with injuries at 3904 NE 4th Street in the city of Renton. I arrived at approximately 1652 hours. SCENE The collision occurred in the intersection of Sunset Boulevard N and N 3rd Street, a major intersection in the city of Renton. The intersection is controlled by traffic signals. Traffic was medium- to-heavy, there was a light rain, and the roadway surface was wet from rain. The area was illuminated by streetlights and ambient lighting from nearby businesses and vehicle headlights. The outside temperature was approximately 45 degrees Fahrenheit. UNIT 1: TOYOTA RAV4 Upon arrival I located Unit 1, a gray 2021 Toyota Rav4 (WA/ DP59920, Unit 1), in the parking lot of Burger King at 311 Sunset Boulevard N. Unit 1 had moderate damage to the rear passenger wheel, fender, and trailing edge of the rear, passenger door. Unit 1 was moved from its point of rest prior to my arrival. No prior mechanical defects were claimed or observed. DRIVER 1: ALAGELE, KHALID H. A. I contacted the driver of Unit 1, Khalid H. A. Alagele (DOB: 12/04/1985), in the driver seat of Unit 1. 1 identified Khalid by his valid Washington Driver License. I established Khalid as the driver of Unit 1 by his admission. Khalid was not injured from the collision. PASSENGER: GOLD, ALEJANDRO R. I contacted a passenger of Unit 1, Alejandro R. Gold (DOB: 06/11/1973), standing near Unit 1. 1 identified Gold by his valid United States Passport. I established Gold as the right rear passenger of Unit 1 by his admission. Gold complained of neck and shoulder pain from the collision. Gold denied any previous injury. The Renton Fire Authority responded and evaluated Gold. Gold was treated and released at the scene. UNIT 2: CHEVROLET TAHOE I observed a black/white, marked, City of Renton police vehicle (WA Exempt/ 67607D, Unit 2), in the parking lot of Burger King, parked behind Unit 1. Unit 2 had minor damage to the front push-bumper. The bumper was bent into the leading edge of the hood and was shifted off-center from the driver to the passenger side. Unit 2 was equipped with a siren and roof-mounted emergency lights. No prior mechanical defects were claimed or observed. DRIVER 2: GROZAV, BRYAN V. I contacted Officer B. Grozav standing near Unit 1. 1 established Officer Grozav as the driver and sole occupant of Unit 2 by his admission. Officer Grozav was not injured in the collision. PHOTOGRAPHS I took photographs of both vehicles with my department issued cell phone. I uploaded the photographs to Axon's Evidence.com. PASSENGER STATEMENT: GOLD, ALEJANDRO R. PAGE 3 OF 6 REPORT NO. The following is a summary of our conversation: Gold was the right rear passenger of Unit 1 during the collision. Gold did not know the driver, Khalid, other than he was a Lyft driver (Gold was his fare). Unit 1 drove south on Sunset Boulevard N toward N 3rd Street. The traffic signal turned red, so Khalid slowed Unit 1. The traffic signal then turned green, so Khalid accelerated Unit 1 toward the intersection. Gold saw Unit 2 driving east on N 3rd Street toward Sunset Boulevard N. Gold saw Unit 2's emergency lights flashing and heard the siren. Khalid didn't seem like he noticed Unit 2, so Gold told him to stop. Khalid ignored Gold's warning and drove into the intersection. Unit 2's front end collided with Unit 1's passenger side. Gold believed Khalid was at fault because he didn't stop for Unit 2. This concluded my conversation with Gold. DRIVER STATEMENT: GROZAV, BRYAN V. Officer Grozav refused to provide a statement other than Unit 1 collided with Unit 2. Officer Grozav confirmed he had his emergency lights and siren activated. DRIVER STATEMENT: ALAGELE, KHALID H. A. I spoke with Khalid about the collision. I used a Language Line interpreter (#392160). Khalid spoke some English but was fluent in Arabic. The following is a summary of our conversation: Khalid initially couldn't remember whether he was driving south on Sunset Boulevard N or west on NE 3rd Steet. Khalid later confirmed, by pointing to the road, that he was driving south on Sunset Boulevard N toward N 3rd Street. As Khalid was driving south on Sunset Boulevard N toward the intersection of N 3rd Street, the traffic signal turned red. Khalid stopped Unit 2 before the intersection. Khalid saw a police vehicle driving on the road (Khalid couldn't be more specific) with emergency lights and siren activated, so he let it pass. The traffic signal turned green, so Khalid entered the intersection of Sunset Boulevard N and N 3rd Street. Khalid still saw flashing emergency lights and heard a siren, but thought it was from the unknown police vehicle that had already passed. Khalid's passenger, Gold, was telling him to stop from the backseat. Khalid didn't know why Gold was telling him to stop, so he ignored him. As Unit 1 entered the intersection it was struck on the passenger side from Unit 2. Khalid didn't see Unit 2 prior to the collision. Khalid knew the traffic law states he should stop and pull to the shoulder when approached by an emergency vehicle with flashing emergency lights and sounding siren. Khalid operated the accelerator and brake pedal with two, professionally constructed, metal pushrods that were operated by hand. Khalid had a medical condition that prevented him from using his legs, and he used a wheelchair. Khalid said he had been using the pushrods for "a long time", he was used to them, and they were in good working order. I do not believe these pushrods contributed to the collision. This concluded my conversation with Khalid. AXON DASH CAMERA FOOTAGE I reviewed the Axon dash camera footage from Unit 2. Unit 2 drove east on N 3rd Street toward the intersection of Sunset Boulevard N with emergency lights and siren activated. The traffic signal light was red. Vehicles were accelerating from a stop driving south on Sunset Boulevard N into the intersection of N 3rd Street. Unit 2 slowed nearly to a stop at the intersection. A white Chevrolet truck (driving south on Sunset Boulevard N closest to Unit 2) entered the intersection from the north then stopped for Unit 2. Unit 1 is seen one lane to the east of the Chevrolet truck also accelerating from a stop into the intersection. Unit 1 accelerated into the intersection after the Chevrolet truck, giving Unit 1 a full view PAGE 4 OF 6 REPORT NO. Unit 1 appeared to slow along with the Chevrolet truck, then accelerated into the intersection in front of Unit 2 as Unit 2 entered the intersection. The Chevrolet truck did not move once it had stopped. Unit 2's front push-bar collided with Unit 1's passenger side in the intersection. Unit 1 also had a forward-facing dashboard camera and an interior camera. Khalid didn't have immediate access to review the footage. I sent Khalid an Axon Community Request link for the camera footage. CONCLUSION Khalid operated Unit 1 in violation of RCW 46.61.210, which states in part: Upon the immediate approach of an authorized emergency vehicle...or of a police vehicle properly and lawfully making use of an audible signal only the driver of every other vehicle shall yield the right-of-way and shall immediately drive to a position parallel to, and as close as possible to, the right-hand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the authorized emergency vehicle or organ transport vehicle has passed, except when otherwise directed by a police officer. This was determined after reviewing Officer Grozav's Axon dash camera footage which showed he operated Unit 2 with activated emergency lights and sounding siren, that Officer Grozav slowed nearly to a stop at the intersection for vehicles to yield, Khalid admitted to seeing flashing emergency lights and hearing a siren, and Khalid's passenger told him to stop, but he did not. DISPOSITION I gave Gold and Khalid a business card with the case number for their records. Khalid's vehicle was towed from the scene at his request. This concluded my involvement in this case.
