a. Approval of Council meeting minutes of 9/22/2014. Council concur.
b. Administrative Services Department recommends a public hearing be set on 10/20/2014 to

c. City Attorney recommends adopting an ordinance to add subsection RMC 1-2-1.E, clarifing the

f. Community Services Department submits CAG-14-101, Riverview Park Bridge Demolition project;
and requests approval of the project, commencement of a 60-day lien period, and release of
retainage in the amount of $8,768.50 to Imperial Demolition and Earthworks, contractor, if all
required releases are obtained. Council concur.
g. Transportation Systems Division recommends approval of an agreement with KPG, Inc. in the
amount of $148,818.69 for the preliminary design of the Main Ave. S. Downtown Circulation
Project – Phase I (Main Ave. S. and Bronson Way S.). Refer to Transportation (Aviation)
Committee.
h. Utility Systems Division submits CAG-13-178, Misty Cove Lift Station Replacement project; and
requests approval of the project, authorization for final pay estimate in the amount of
$24,692.25, commencement of a 60-day lien period, and release of retained amount of
$39,239.23 to Gary Harper Construction, Inc., contractor, if all required releases are obtained.

SUMMARY OF ACTION:
In compliance with RCW 35A.34, the proposed 2015-2016 Biennial Budget will be submitted to the City
Council on October 6, 2014. This agenda bill identifies the timeline for Council consideration of the
2015-16 proposed budget and sets the date and place for the public hearing on October 20, 2014.
STAFF RECOMMENDATION:
Set a public hearing date of October 20, 2014 to consider the 2015-2016 Budget, with potential
adoption of enabling legislations by November 3rd to establish the 2015-2016 Budget.

This addition to the RMC will avoid the redundant use of the phrase “as it exists or is hereafter
amended,” or an equivalent, that is currently interspersed throughout the code. This amendment will
automatically update the code without numerous repetitive ordinances.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION
1‐2‐1 OF CHAPTER 2, ORDINANCES, OF TITLE 1 (ADMINISTRATIVE) OF THE
RENTON MUNICIPAL CODE, CLARIFYING THE APPLICABILITY OF
MODIFICATIONS TO THE RENTON MUNICIPAL CODE.
WHEREAS, the City recognizes that occasionally, members of the public, applicants,
and/or developers question or argue that the current code provisions or the previous code
provisions apply during a dispute, proceeding or discussion; and
WHEREAS, in an effort to clarify and reduce unnecessary disputes, litigation, and/or
misunderstanding, the City intends to add language to RMC 1‐2‐1 to clarify the interpretation of
code references in Renton Municipal Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
SECTION I. Section 1‐2‐1, Rules of Construction of Ordinances and Amendments, of
Chapter 2, Ordinances, of Title I (Administrative) of the Renton Municipal Code, is amended to
add a new subsection E, entitled “Applicability”, to read as follows:
E. APPLICABILITY:
For the purposes of clarity, brevity and consistency, unless otherwise stated
or superseded by state law or case law, any reference to the Renton Municipal
Code, or any chapter, section or subsection of the Renton Municipal Code, shall
mean and require the application of the most recent amendment, version, or
iteration of the Renton Municipal Code or any of its chapters, sections or
subsections. The preceding sentence takes the place of and eliminates the need

for the use of the phrase, “as it exists or may be amended” or any other phrase
that conveying the same or a similar point.
This subsection applies to existing code provisions as well as future code

SECTION II. This ordinance shall be effective upon its passage, approval, and thirty
(30) calendar days after publication.

SUMMARY OF ACTION:
The Council has previously approved the Sunset Area Redevelopment Plan (“Plan”). The City has
purchased the property for the KCLS library as partial execution of the Plan. The Council, at its Executive
Session on September 15, 2014, discussed the purchase of the property for the city park, which is an
additional element of the Plan.
The source of funding for the purchase will be from higher real estate excise taxes (approximately
$1,000,000), sales tax (approximately $800,000), permit fees (approximately $400,000), and utility tax
audit revenue (approximately $460,000) expected this year. The appropriation will be part of the year-
end budget adjustment.
The Purchase and Sale Agreement between the Renton Housing Authority and the City has been
negotiated and signed by the Mayor. The Council is now asked to concur and approve the authority of
the Mayor to sign the Real Estate Purchase and Sale Agreement.

SUMMARY OF ACTION:
The Washington State Department of Natural Resources Interagency Agreement with the City of Renton
will provide two SoundCorps crews to prune trees along the streets in The Landing. The 330 street trees
were planted in 2008 and this work will improve clearance along streets for trucks, especially street
sweeping equipment, and for pedestrian access down sidewalks. In addition, structural pruning of trees
will occur to leave strong, problem-free branches, remove broken, weakly attached and other problem
branches and to re-establish the main leader of the trunk in an effort to improve tree health and form,
reduce storm damage potential and increase longevity of the trees. Work is anticipated to begin the
week of November 10, 2014 and completed by November 25th. All work will be accomplished from the
ground using hand tools. City staff will be involved with supervision, training and assisting with branch
chipping; chips generated will be used as mulch for other City volunteer projects. While no additional
funding is needed for this project, the value of the work is approximately $20,000.
STAFF RECOMMENDATION:
Adopt the resolution and approve the Mayor and City Clerk to enter into the agreement.

INTERAGENCY AGREEMENT WITH THE CITY OF RENTON
Agreement No. IAA 14-422
This Agreement is between the City of Renton, referred to as the City, and the Washington State
Department of Natural Resources Urban and Community Forestry Program, referred to as DNR.
DNR is under authority of RCW Chapter 43.30 of Washington State, Department of Natural
Resources. DNR and the City of Renton enter into this agreement under Chapter 39.34,
Interlocal Cooperation Act.
The purpose of this Agreement is to provide a Puget SoundCorps (SoundCorps) crew for urban
forestry maintenance and restoration tasks in the City of Renton. SoundCorps is part of the broader
Washington Conservation Corps AmeriCorps program administered by Washington Dept. of
Ecology. SoundCorps crews work on projects that help restore and protect water quality in Puget
Sound.
IT IS MUTUALLY AGREED THAT:
1. Statement of Work. DNR shall furnish SoundCorps crews and the City shall provide all
materials and services, pertinent to performing work set forth in the Attachment A.
2. Period of Performance. The period of performance of this Agreement shall be from
October 1, 2014, to September 30, 2015, unless terminated sooner as provided herein. Both
parties agree that DNR will provide the City one (1) calendar month of crew work within the
period of performance.
3. Payment. DNR provides the services of the SoundCorps crew in exchange for the City’s
matching commitment to the project as described in Attachment B.
4. Rights to Data. Unless otherwise agreed, data originating from this Agreement shall be
‘works for hire’ as defined by the U.S. Copyright Act of 1976 and shall be owned by DNR and
the City. Data shall include, but not be limited to, reports, documents, pamphlets,
advertisements, books, magazines, surveys, studies, computer programs, films, tapes, and/or
sound reproductions. Ownership includes the right to use, copyright, patent, register and the
ability to transfer these rights.

5. Independent Capacity. The employees or agents of each party who are engaged in
performing this agreement shall continue to be employees or agents of that party and shall not be
considered for any purpose to be employees or agents of the other party.
6. Amendments. This Agreement may be amended by mutual agreement of the parties.
Amendments shall be in writing and signed by personnel authorized to bind each of the parties.
7. Termination. Either party may terminate this Agreement by giving the other party 30
days prior written notice. If this Agreement is terminated, the terminating party shall be liable to
pay only for those services provided or costs incurred prior to the termination date according to
the terms of this Agreement.
8. Termination for Cause. If for any cause either party does not fulfill in a timely and
proper manner its obligations under this Agreement, or if either party violates any of the terms
and conditions, the aggrieved party will give the other party written notice of the failure or
violation. The aggrieved party will give the other party 15 working days to correct the violation
or failure. If the failure or violation is not corrected within 15 days, the aggrieved party may
immediately terminate this Agreement by notifying the other party in writing.
9. Disputes. If a dispute arises, a dispute board shall resolve the dispute like this: Each
party to this agreement shall appoint a member to the dispute board. These board members shall
jointly appoint an additional member to the dispute board. The dispute board shall evaluate the
facts, contract terms, applicable statutes and rules, then determine a resolution. The dispute
board’s determination shall be final and binding on the parties. As an alternative to the dispute
board, either of the parties may request intervention by the Governor, as provided by RCW
43.17.330. In this case, the Governor’s process will control the dispute resolution.
10. Governance. This contract is entered into the authority granted by the laws of the State
of Washington and any applicable federal laws. The provisions of this agreement shall be
construed to conform to those laws.
If there is an inconsistency in the terms of this Agreement, or between its terms and any
applicable statute or rule, the inconsistency shall be resolved by giving precedence in the
following order:
(1) Applicable State and federal statutes and rules;
(2) Statement of Work; and
(3) Any other provisions of the agreement, including materials incorporated by
reference.
11. Assignment. The work to be provided under this Agreement and any claim arising from
this agreement can not be assigned or delegated in whole or in part by either party, without the
express prior written consent of the other party. Neither party shall unreasonably withhold
consent.

12. Waiver. A party that fails to exercise its rights under this agreement is not precluded
from subsequently exercising its rights. A party’s rights may only be waived through a written
amendment to his agreement.
13. Severability. The provisions of this agreement are severable. If any provision of this
Agreement or any provision of any document incorporated by reference should be held invalid,
the other provisions of this Agreement without the invalid provision remain valid.
14. Indemnification. DNR shall indemnify, defend and hold harmless the City, its elected
officials, officers, agents, employees and volunteers, from and against any and all claims, losses
or liability, or any portion thereof, including but not limited to attorney’s fees, expenses and court
costs, arising from injury or death to persons, including injuries, sickness, disease or death of
DNR’s own employees or volunteers, or damage to property caused by a negligent act or
omission of DNR, except for those acts caused by or resulting solely from a negligent act or
omission by the City and its officers, agents, employees and volunteers. Should a court of
competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the
event of liability for damages arising out of bodily injury to persons or damages to property
caused by or resulting from the concurrent negligence of DNR and the City, its officers, officials,
employees and volunteers, DNR’S liability shall be only to the extent of DNR’S negligence.
15. Complete Agreement in Writing. This Agreement contains all the terms and conditions
agreed upon by the parties. No other understanding, oral or otherwise, regarding the subject
matter of this Agreement shall be deemed to exist or to bind any of the parties.
16. Contract Management. The Project Coordinator for each of the parties shall be the
contact person for this agreement. All communications and billings will be sent to the project
coordinator.

Attachment A
STATEMENT OF WORK
DNR will sponsor a Puget SoundCorps (SoundCorps) crew to assist with urban forest restoration
and maintenance tasks in the City of Renton. Each restoration project location will include baseline
mapping of the site, to be included in a DNR report to the City. Local projects must be on public
property, and work performed by the crews may not replace workers already in place or contracted
for.
Project locations and activities in the City of Renton include:
The Landing; Park Ave. N, Logan Ave. N, N 10 Place and N 10 St. Street tree pruning to
include structural training, clearance pruning and corrective pruning.
Other sites and/or locations as agreed by the City’s Project Coordinator and the DNR Project
Coordinator. Tasks and activities assigned must pertain to restoring the ecological health and
functionality of the urban forest on the site or location.
Puget SoundCorps (SoundCorps) and Washington Conservation Corps (WCC) crews are covered by
Dept. of Ecology insurance through Labor and Industries while working on project sites and
traveling to work locations.
SoundCorps crews are responsible for the maintenance and repair of any equipment provided by
SoundCorps, WCC and/or Dept. of Ecology.
The City is responsible for the maintenance and repair of any equipment provided by the City and
used by the SoundCorps crew under the direction of City staff.

PROJECT COMMITMENT MATCH
DNR will provide the following items to the City for urban forestry restoration projects that receive
assistance under the Urban Forest Restoration Project:
News release template to assist in building public awareness and event marketing.
Crews to remove and/or control invasive plant material and complete related restoration
tasks including installation of plant materials.
Post-restoration report that includes a description of the project and the work accomplished.
Template for three-year management plan.
Template for annual monitoring report.
The City commits to the following items in consideration for the services of the DNR-sponsored
crew:
Post news releases in advance of the event.
Acquire any permits necessary for project work.
Assist with volunteer registration, sign-in and wavers at restoration events.
Please have photo releases available for volunteers under 18 years of age.
Dispose of plant material removed during project activities (English ivy vines, blackberry
canes, etc.).
Provide any and all plant materials required for project completion.
Develop and implement a three-year maintenance plan for the project site, to include annual
monitoring.
Report monitoring results to the DNR Urban and Community Forestry Program annually for
three years.

"INTERAGENCY AGREEMENT WITH THE CITY OF RENTON".
WHEREAS, the City and the Washington State Department of Natural Resources ("DNR")
are authorized, pursuant to RCW Chapter 39.34, to enter into an interlocal government
cooperative agreement; and
WHEREAS, DNR offered the 2014 Urban Forestry Restoration Grant to communities for
improving water quality reaching Puget Sound; and
WHEREAS, the grant provides Puget SoundCorps crews to assist with projects; and
WHEREAS, The Landing right-of-ways were planted with 330 street trees in 2008 and are
now in need of pruning for clearance, and structural pruning is needed to provide public access
for pedestrians and vehicles. This DNR grant will complete the needed tree pruning along the
streets and sidewalks; and
WHEREAS, it is necessary to document the terms and conditions under which DNR will
provide free labor for this project;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
SECTION I. The above recitals are found to be true and correct in all respects.
SECTION II. The Mayor and City Clerk are hereby authorized to enter into an
interlocal agreement with DNR entitled "Interagency Agreement with the City of Renton".

SUMMARY OF ACTION:
The Community Services Department submits CAG-14-101, Riverview Park Bridge Demolition, for
release of retainage. Work started on July 23, 2014 and was completed on August 29, 2014. The
contractor, Imperial Demolition and Earthworks, completed the terms of their contract by demolishing
and removing the pedestrian bridge over the Cedar River at Riverview Park.
STAFF RECOMMENDATION:

SUMMARY OF ACTION:
The 2015-2020 Six-Year Transportation Improvement Plan includes a new project entitled Main Avenue
South/Downtown Circulation Project (TIP #8). The scope of the project is to improve traffic operations
and circulation, and make pedestrian enhancements on Main Avenue South and Bronson Way South.
This includes providing a new northbound lane on Main Avenue South and Bronson Way South from
South 3rd Street to Mill Avenue South. The intersection of South 2nd Street and Main Avenue South will
be reconfigured to include a pedestrian plaza and
on-street parking will be added where possible.
This consultant agreement authorizes the preliminary engineering to be completed by KPG, Inc.
The budget for preliminary engineering work in 2014 will be included in the 2014 year-end budget

The intersection of South 2nd Street and Main Avenue South will be reconfigured to
include a pedestrian plaza and on-street parking will be added where possible.
The consultant agreement authorizes the preliminary engineering to be completed to
convert Main Avenue South and Bronson Way South to two-way traffic and prepare
recommendations for necessary signal modifications at three intersections to facilitate
the addition of the northbound lane on Main Avenue South.
At the completion of the preliminary engineering work authorized by the agreement,
the City will have received notice if we will be offered a Transportation Improvement
Board (TIB) grant to assist with the construction phase of this project. Before
negotiation of a subsequent agreement to prepare bid documents we will know the
budget available for the construction of the first phase of improvements, depending on
whether we have supplemented our local funds with a TIB grant.
After a thorough assessment of the consultants listed on the Shared Procurement
Portal, KPG, Inc. was selected to provide consulting services for the project design.
KPG, Inc. has considerable background knowledge and familiarity with the area and
factors involved. Additionally, they have particular expertise in signal design and the
conversion of one-way street patterns to two-way traffic that makes them well suited to
take on the design of this project.
The cost proposal as negotiated for this phase of preliminary design is within the budget
and considered reasonable.
The budget for preliminary engineering work in 2014 will be included in the 2014 year-
end budget adjustment. As outlined in the 2015-2020 TIP for the Main Avenue South
Downtown Circulation Project (TIP #8), funding for preliminary engineering comes from
the South Renton Mitigation Reserve via interfund transfer.

SUMMARY OF ACTION:
The project was awarded on November 4, 2013, construction began on February 6, 2014, and was
completed on September 24, 2014. The original contract amount was $820,877.70 and the final amount
is $859,339.02, an increase of $38,461.32, or about 4.7%. The cost increase was due to additional
shoring and dewatering work needed, repair of a mis-marked sewer main that was damaged during
excavation and additional work to locate the existing Misty Cove Condominium’s sewer force main for
decommissioning. The final cost was within the amount budgeted for the project.
The approved 2013/2014 budget for the Misty Cove Lift Station Replacement is $1,200,000. The amount
budgeted for this project is enough to cover the construction costs of this project.
STAFF RECOMMENDATION:
Accept the project, approve the final pay estimate in the amount of $24,692.25, and release the
retainage in the amount of $39,239.23 after 60 days, subject to the receipt of all required
authorizations.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION
1-2-1 OF CHAPTER 2, ORDINANCES, OF TITLE 1 (ADMINISTRATIVE) OF THE
RENTON MUNICIPAL CODE, CLARIFYING THE APPLICABILITY OF
MODIFICATIONS TO THE RENTON MUNICIPAL CODE.
WHEREAS, the City recognizes that occasionally, members of the public, applicants,
and/or developers question or argue that the current code provisions or the previous code
provisions apply during a dispute, proceeding or discussion; and
WHEREAS, in an effort to clarify and reduce unnecessary disputes, litigation, and/or
misunderstanding, the City intends to add language to RMC 1-2-1 to clarify the interpretation of
code references in Renton Municipal Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
SECTION I. Section 1-2-1, Rules of Construction of Ordinances and Amendments, of
Chapter 2, Ordinances, of Title I (Administrative) of the Renton Municipal Code, is amended to
add a new subsection E, entitled "Applicability", to read as follows:
E. APPLICABILITY:
For the purposes of clarity, brevity and consistency, unless otherwise stated
or superseded by state law or case law, any reference to the Renton Municipal
Code, or any chapter, section or subsection of the Renton Municipal Code, shall
mean and require the application of the most recent amendment, version, or
iteration of the Renton Municipal Code or any of its chapters, sections or
subsections. The precedinfi sentence takes the place of and eliminates the need
