recommended actions will be accepted in a single motion. Any item may be removed for further

a. Approval of Council meeting minutes of 2/10/2014. Council concur.
b. Mayor Law appoints Rich Zwicker to the City Center Community Plan Advisory Board for a three-
year term expiring 8/31/2016. Refer to Community Services Committee.
c. Mayor Law reappoints Martin Regge to the Planning Commission for a three-year term expiring
1/31/2017. Council concur.
d. Mayor Law reappoints the following individuals to the Municipal Arts Commission for three-year
terms expiring 12/31/2016: Bill Huls; Marsha Rollinger; Natalie Gress (youth position); and Paul
Hebron. Council concur.
e. City Clerk reports bid opening on 1/14/2014 for CAG-13-212, Demolition of 820 Building at the
Airport project; 11 bids; engineer’s estimate $824,231.69; and submits staff recommendation to
award the contract to the low bidder, 3 Kings Environmental, Inc., in the amount of $277.490.90.
Council concur.
f. Administrative Services Department recommends adopting a resolution to set the threshold for
state sales tax credit for 2014 at $3,345,000 related to the Benson Hill annexation. Council
concur. (See 8.a. for resolution.)
g. City Attorney Department recommends amending Renton Municipal Code (RMC) 1-3-3 to add
language that will permit the City to attach liens to Chronic Nusiance Premises as defined in
RMC 5-5. Refer to Public Safety Committee.

h. City Attorney Department recommends amending Renton Municipal Code (RMC) 4-8-110.E.12.C.
by reducing the time for the Hearing Examiner to render a written decision from 14 to ten days,
unless a longer period is mutually agreed to in writing by the applicant and the Hearing
Examiner. Refer to Planning & Development Committee.
i. Community and Economic Development Department requests approval to reclassify and fill
a Senior Economic Development Specialist position as a Community Development Project
Manager position, requiring a budget increase of $15,000 for 2014. Council concur.
j. Utility Systems Division recommends approval of a Second Addendum to CAG-64-764, with Soos
Creek Water and Sewer District, detailing certain responsibilities, including cost sharing,
pertaining to continued maintenance and rehabilitation of the remaining portions of the
Cascade Interceptor. Refer to Utilities Committee.
k. Utility Systems Division requests authorization to establish the SR 167 Interchange Direct
Connector/Talbot Hill Sewer Relocation Project and approval of the proposed 2014 Capital
Expenditure in the amount of $1.6 million, which will be reimbursed by the Washington State
Department of Transportation; and approval of a contract in the amount of $145,900 with
Stantec Consulting Services, Inc., for initial engineering services for this project. Refer to
Utilities Committee.

In accordance with Council procedure, bids submitted at the subject bid opening met the following three
criteria: There was more than one bid, the low bid was within total project budget, and there were no
irregularities with the low bid. Therefore, staff recommends accepting the low bid submitted by 3 Kings
Environmental, Inc., in the amount of $277,490.90 for the Demolition of 820 Building at the Airport
project.

SUMMARY OF ACTION:
Each year by March 1st, the City of Renton must report annexation related costs to the State of
Washington to request state sales tax credit funding to assist with annexation. RCW 82.14.415 provides
that cities may impose sales and use tax as a credit against the state sales and use tax to provide for
assistance with these annexation-related costs. This resolution certifies the actual net costs to serve
the Benson Hill Annexation area for the previous fiscal year (2012), sets the funding threshold for the
state's next fiscal year starting July 1, 2013, and that the sales tax credit of one-tenth of one percent
(0.1%) be continued during this period.
STAFF RECOMMENDATION:
Approve the resolution identifying the net cost threshold and setting sales tax rate for 2014.

RESOLUTION NO. _______
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, AUTHORIZING THE
CITY OF RENTON TO IMPOSE A SALES AND USE TAX AS AUTHORIZED BY RCW
82.14.415 AS A CREDIT AGAINST STATE SALES AND USE TAX, RELATING TO
ANNEXATIONS.
WHEREAS, state law authorizes the reallocation of the sales tax already collected by the
state to be remitted to the City to assist with funding the costs of certain newly annexed areas;
and
WHEREAS, in accordance with Chapter 35A.14 RCW, the Council called for a special
election to be held, at which election the question of annexation was presented to the voters of
the Benson Hills Annexation Area; and
WHEREAS, the notice of intention to annex was filed with the King County Boundary
Review Board and subsequently approved; and
WHEREAS, in accordance with Chapter 35A.14 RCW the annexation was put to a vote of
the people in the annexation area; and
WHEREAS, King County Elections certified that the annexation had been approved by
voters; and
WHEREAS, following a favorable vote on the annexation proposition, the Council
adopted its Ordinance annexing said Benson Hill Communities Annexation Area effective March
1, 2008, an annexation area that has a population greater than ten thousand (10,000) people;
and

WHEREAS, the Council finds that the true and actual net costs to provide municipal
services to the annexation area totaled Three Million and Seventy-Four Thousand Dollars
($3,074,000) for the City’s fiscal year 2012 and the State’s fiscal year July 1, 2012, to June 30,
2013; and
WHEREAS, the Council finds and determines that the projected net costs to provide
municipal services to the annexation area exceeds Three Million Three Hundred Forty-Five
Thousand Dollars ($3,345,00) for the City’s fiscal year 2014 and the State’s fiscal year July 1,
2014, to June 30, 2015; and
WHEREAS, pursuant to RCW 82.14.415, the City is authorized, under the circumstances
of this annexation, to impose a sales and use tax, with that tax being a credit against the state
tax;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
SECTION I.The above recitals are found to be true and correct in all respects.
SECTION II.The Council does hereby determine the threshold amount in providing
municipal services to the Benson Hill Communities Annexation Area is Three Million Three
Hundred Forty-Five Thousand Dollars ($3,345,000) and that a tax rate of one-tenth percent
(0.1%) shall be continued during the State’s fiscal year starting July 1, 2014, to assist the City in
providing municipal services to the area.
SECTION III.The Mayor is hereby authorized to implement such administrative
procedures as may be necessary to carry out the directions of this Resolution.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION
1-3-3 OF CHAPTER 3, REMEDIES AND PENALTIES, OF TITLE I (ADMINISTRATIVE)
OF THE RENTON MUNICIPAL CODE, BY CLARIFYING THE DEFINITIONS OF
“CALLS FOR SERVICE”, “CHRONIC NUISANCE PREMISES” AND “GENERAL
PUBLIC”, AND AMENDING REGULATIONS REGARDING LIENS.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION I.Subsection 1-3-3.B.4, “Calls for service”, of Chapter 3, Remedies and
Penalties, of Title I (Administrative) of the Renton Municipal Code, is amended as follows:
4. “Calls for service” means calls or communications to 911, including but
not limited to Valley Communications, and/or calls or communications directly to
the Renton Police Department or one of its officers, or the viewing of an offense
by an officer. Calls for service, as that term is used in the definition of “chronic
nuisance premises,” does not include incidents that are unrelated to the chronic
nuisance premises, its resident(s), owner(s), guests, patrons, or calls for general
information.
SECTION II.Subsection 1-3-3.B.5, “Chronic nuisance premises”, of Chapter 3,
Remedies and Penalties, of Title I (Administrative) of the Renton Municipal Code, is amended as
follows:
5. “Chronic nuisance premises”:
a. As it relates to single-family or duplex housing, an individual
apartment unit, or a building, structure or business used for commercial, retail,

or entertainment purposes, or the area within two hundred feet (200') of such
premises, including those regulated by the Liquor Control Board, and including
public, private, commercial or industrial parking lots within two hundred feet
(200’) of such premises, Chronic Nuisance Premises means a property on which
any of the following exists or has occurred:
i. Six (6) or more calls for service occur or exist during any sixty (60)-
day period; or
ii. Ten (10) or more calls for service occur or exist during any one
hundred and eighty (180)-day period; or
iii. Fourteen (14) or more calls for service occur or exist during any
twelve (12)-month period;
b. Any action against a “chronic nuisance premises” and/or its owner,
managing agent or person in control for a violation under subsection B.5.a.i of
this Section does not preclude the use of those nuisances or criminal activities to
find a violation of subsection B.5.a.ii or iii of this Section; and a violation under
subsection B.5.a.i and/or ii of this Section does not preclude the use of those
nuisances or criminal activities to find a violation of subsection B.5.a.iii of this
Section as long as all of the nuisances or criminal activities occurred during the
applicable time period.
SECTION III.Subsection 1-3-3.B.12, “General public”, of Chapter 3, Remedies and
Penalties, of Title I (Administrative) of the Renton Municipal Code, is amended as follows:

12. “General public” means the City of Renton, any of its communities or
neighborhoods, or more than one (1) citizen, neighbor and/or their guest(s).
SECTION III.Subsection 1-3-3.G.6, Lien – Authorized, of Chapter 3, Remedies and
Penalties, of Title I (Administrative) of the Renton Municipal Code, is amended as follows:
6. Lien – Authorized: The City shall have a lien for any monetary penalty,
fee or expense related to any aspect of the abatement of any nuisance or
chronic nuisance premises as well as the revocation of a business license,
abatement investigation or abatement litigation against the premises or real
property where the abatement work was performed. The lien shall be
subordinate to all previously existing special assessment liens imposed on the
same premises or real property and shall be superior to all other liens, except for
state and county taxes, with which it shall be on parity.
a. A lien for any monetary penalty, including the cost of abatement
proceedings under this Chapter, shall be filed for record with the King County
Department of Records and Elections or County Auditor Recorder’s Office
against the premises or real property where the work of abatement was
performed. A lien under this Chapter shall be filed within ninety (90) days from
the later of the date that the monetary penalty is due or the date the work is
completed or the nuisance abated.
b. The lien shall contain sufficient information regarding the criminal
violation, a legal description of the property to be charged with the lien and the
owner of record, and the total amount of the lien.

c. Any lien under this Chapter shall be verified by the applicable
Administrator or law enforcement officer, and may be amended from time to
time to reflect changed conditions or monetary amount.
d. No liens filed under this Chapter shall bind the affected property for a
period longer than ten (10) years, without foreclosure or extension agreed to by
the property owner.
SECTION III.This ordinance shall be effective upon its passage, approval, and thirty
(30) days after publication

Currently the RMC allows 14 days for the hearing examiner to render his/her written decision following
conclusion of all testimony and hearings. The RCW states that a final decision of a hearing examiner
shall be rendered within 10 working days, unless a longer period is mutually agreed to in writing by the
applicant and the hearing examiner. RMC 4-8-110.E.12.c should be revised to comply with state law.
STAFF RECOMMENDATION:
Adopt the ordinance amending RMC 4-8-110.E.12.c reducing the time for the Hearing Examiner to

(DEVELOPMENT REGULATIONS) OF THE RENTON MUNICIPAL CODE, BY
CHANGING THE PERIOD OF TIME IN WHICH THE HEARING EXAMINER SHALL
RENDER A FINAL DECISION TO BE CONSISTENT WITH STATE LAW.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION I.Subsection 4-8-110.E.12.c, Time for Hearing Examiner’s Decision, of
Chapter 8, Permits – General and Appeals, of Title IV (Development Regulations) of the Renton
Municipal Code, is amended as follows:

SUMMARY OF ACTION:
The City and the Soos Creek Water and Sewer District (District) need to enter into a second addendum
of our original Cascade Interceptor Agreement dated March 27, 1964. The purpose of the addendum is
to cover additional rehabilitation work identified as a result of recent closed circuit television work
performed by the City. This additional work will consist of rehabilitating the remaining portions of the
Cascade Interceptor not previously rehabilitated in 2012.
The addendum covers the cost participation by the District at the 80% level that was agreed upon as
part of the first phase rehabilitation work and sets the timing for the improvements for the summer of
2015. The Wastewater Utility will propose this work in its 2015/2016 Capital Improvement Program
submittal as a part of our standard budget process. All other aspects of the agreement will remain
intact

RECOMMENDATION:
Authorize the Mayor and City Clerk to execute the Second Addendum to the
March 27, 1964 Cascade interceptor Agreement: Phase II – Rehabilitation and
Maintenance of the Cascade Interceptor with Soos Creek Water and Sewer District for
the rehabilitation of the remaining portions of the Cascade Interceptor and adopt the
resolution regarding this agreement.
BACKGROUND SUMMARY:
In the summer of 2013, City Wastewater Maintenance staff inspected the Cascade
Interceptor as part of our routine closed circuit television (CCTV) inspection program.
The inspection determined that further degradation to all portions of the interceptor
not previously rehabilitated had occurred. After reviewing the finding with Soos Creek
Sewer and Water District (District), we agreed that is was in our best interest to
rehabilitate the remaining portions of the Cascade Interceptor in the near term.
The Cascade Interceptor had a significant failure in 2010 where the interceptor crosses
SE Royal Hills Drive. The City made emergency repairs to the facility, then entered into
the first addendum with the District and rehabilitated only the most severe sections.
With the updated CCTV information we have determined that the level of degradation

for the remaining un-rehabilitated sections is high enough to rehabilitate the remainder
of the interceptor to reduce the risk of future failures.
The Second Addendum to the original 1964 Cascade Interceptor Agreement covers the
additional work required to rehabilitate the remaining portions of the interceptor. The
addendum covers the cost participation by the District at the 80% level that was agreed
upon as part of the first phase rehabilitation work and sets the timing for the
improvements for the summer of 2015. The Wastewater Utility will propose this work
in its 2015/2016 Capital Improvement Program submittal as a part of our standard
budget process.
Total estimated cost for this project is $700,000. The District’s share is approximately
$560,000 (80%) of the total cost, and the City’s cost is the remaining $140,000. With the
completion of the rehabilitation work, this facility will meet new pipe condition, which
should minimize our need to expend future capital dollars for up to 80 years. In
addition, Wastewater Maintenance staff currently dedicates a significant amount of
time monitoring and cleaning this facility that will be significantly reduced upon
completion of the rehabilitation work.
CONCLUSION:
Executing this addendum and completing the remaining rehabilitation work needed on
the Cascade Interceptor will give the entire reach of the interceptor the equivalent of a
new pipe life of approximately 80 years. It will also reduce current maintenance
required on the older sections of the interceptor. In addition, it reduces our potential
exposure to future failure of the interceptor as occurred in 2010.

SUMMARY OF ACTION:
WSDOT has requested that the City take the lead on the sewer relocation effort required as part of the
WSDOT SR 167 Interchange Direct Connector (IC/DC) Project to best manage the needed improvements,
with full WSDOT funding of the alternatives analysis, design and construction of the necessary
improvements. This project is not an approved capital improvement project in the 2013-2014 budget.
The Administration requests approval of this new wastewater capital improvement project. WSDOT will
reimburse Renton for the cost of design and construction. A consultant agreement with Stantec
Consulting Services, Inc. is also requested to provide engineering services to analyze options for the
Talbot Hill Sewer Relocation Project, adjacent to I-405 from Lake Avenue South to Talbot Road South,
which is required as a part of the WSDOT SR167 IC/DC Project. Stantec Consulting Services, Inc. was
selected from the approved 2014 Architecture and Engineering Roster on the eCityGov Alliance Shared
Procurement Portal. The design phase has an estimated cost of $250,000, and the construction is
estimated at $1,200,000, for a total estimated project cost of $1,600,000, which will be reimbursed by
WSDOT per agreement with the City. The budget adjustment associated with this project would be
included in the upcoming Carry Forward Ordinance.
STAFF RECOMMENDATION:

BACKGROUND SUMMARY:
The Wastewater Utility has been working with WSDOT on their proposed SR167 IC/DC
Project. One of the critical timing elements and portion of work of concern to the City is

the relocation of the City’s existing sewer system on Talbot Hill needed as a result of the
widening proposed by WSDOT.
The relocated sewer work includes potential realignment of our sanitary sewer system
that requires depths in excess of 40 feet. To best facilitate an alternatives analysis
process and to streamline the actual relocation of the City’s sewer system, City staff and
WSDOT have agreed that the best approach would be for the City to manage the effort,
with WSDOT agreeing to reimburse all consultant, design and construction expenses for
the relocation of the sewer system.
The City has received and signed the initial agreement from WSDOT for the alternatives
analysis. Subsequent addendums to that agreement will cover final design services and
contractor construction costs, with WSDOT covering all expenses except for City staff
costs. Since we would have reviewed and inspected the facilities if WSDOT had kept the
lead on this effort, the City is not incurring any additional staff costs than we originally
projected as part of this work.
Total estimated costs for this project are $1,600,000. The initial $150,000 is for the
alternatives analysis, an additional $250,000 for final design and $1,200,000 for
construction. The Wastewater Utility did not have this work originally planned as part
of its 2013/2014 Capital Improvement Program. As such, we are requesting that Council
approve a new Wastewater Utility capital improvement project to relocate the Talbot
Hill Sewer. We are also asking for approval of an expenditure of $1,600,000 along with
identifying the equivalent $1,600,000 in revenue as a result of the direct reimbursement
for these costs by WSDOT. The budget adjustment associated with this project will be
included in the upcoming Carry Forward Ordinance.
Stantec Consulting Services, Inc. was selected from the approved 2014 Architecture and
Engineering Roster on the eCityGov Alliance Shared Procurement Portal.
CONCLUSION:
The City Wastewater Utility taking the lead in this effort is the best alternative for both
the City and WSDOT as it assures that the City gets the improvements it needs and
allows WSDOT to expedite this portion of the work. In order for the Wastewater Utility
to proceed, it is necessary for Council to approve this new capital improvement project,
and authorize the Mayor and City Clerk to execute the contract and to approve the
proposed 2014 capital funding for the Talbot Hill Sewer Relocation Project, in the
amount of $1,600,000.
