RE: Longacres Campus Lot Line Adjustment Comments
Dear Jill,
Below please find the list of comments and responses for the Longacres Campus Lot Line Adjustment,
1. Comment (page 6): Highlighted property lines appear to straddle an existing private access road.
Provide documentation of road ownership/maintenance and an access easement as applicable.
o Response: The attached recorded 2021 CCR’s, which are currently in place identify the
ponds and storm drainage infrastructure as common area. Section 8c makes clear the
responsibility of the Association to maintain the Common Area which includes the Ponds and
Storm Drainage Infrastructure, and until the Association is formed, Section 7(z) shifts the
Association’s responsibilities and duties on the Declarant.
2. Comment (page 7): Maintenance of pond and drainage facilities is by private party. Identify
easement for private party to access and maintain features.
o Response: The Easement KC recording #20180829000606 provides access for maintenance
to the Storm Pond at the South end of the Site. The easement location and number is on the
Plan and the easement text is included as an attachment to this sheet.
3. Comment (page2): Please Provide this title report – the submitted report is dated August 23, 2023.
o Response: An updated Title Report Dated December 19, 2023 has been submitted with these
revisions and includes the revisions on the Lot Line Adjustment Plan.
4. Comment (page 6): LLA cannot create landlocked parcels that do not abut the ROW or have an
access easement to the ROW.
o Response: The Project Narrative has been modified to include the following text: In addition
to the Longacres Campus Lot Line Adjustment a Reciprocal Temporary Access Easement
Agreement is to be put in place for the Longacres Way. This will allow for access for New
Lots 1, 2, 3, 4 and 18 and New Tract 1 to have access along Longacres Way from the other
parties and be able to connect to SW 16th Street and Oakesdale Avenue SW. This Temporary
Easement will be terminated when the CC&R’s are put in place and in the CC&R’s all lots
within the Longacres Campus will have access and the benefit of using Longacres Way.
5. Comment (page 6): There are existing private storm features and facilities that will cross parcel
lines. Demonstrate who has maintenance responsibility and how the owner has access to rights to
other parcels if needed.
o Response: The attached recorded 2021 CCR’s, which are currently in place identify the
ponds and storm drainage infrastructure as common area. Section 8c makes clear the
responsibility of the Association to maintain the Common Area which includes the Ponds and
Storm Drainage Infrastructure, and until the Association is formed, Section 7(z) shifts the
Association’s responsibilities and duties on the Declarant.
6. Comment: Wetlands and their associated buffers are required to be protected within a Native Growth
Protection Area.
o Response: The Project Narrative has been modified to include the following text: As part of
the Binding Site Plan the Wetlands and Wetland Buffers on the Longacres Campus as shown
in the Lot Line Adjustment Plan will be placed in a native growth protection tract.
For all other comments see updated Lot Line Adjustment Plan.
