LUA 98-040). WHEREAS, under Section 4.2.020 of Chapter 2, Land Use Districts, of Title IV (Development Regulations), of Ordinance No. 4260 known as.the "Code of General Ordinances of the City of Renton," as amended, and the maps and reports adopted in conjunction therewith, the property hereinbelow described has heretofore been zoned as CC (Convenience Commercial); and WHEREAS, the City of Renton initiated a proceeding for change of zone classification of said property. This matter was duly referred to the Planning Commission for investigation, study, and public hearing, and a public hearing having been held thereon on or about June 10, 1998, and said matter having been duly considered by. the Planning Commission, and said zoning request being in conformity with the City's Comprehensive Plan, as amended by Ordinance No. 4734, and the City Council having duly considered all matters relevant thereto,/ and all parties having been heard appearing in support thereof or in opposition thereto; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. The following described property in the City of Renton is hereby rezoned to RM-I (Residential Multi-Family Infill), as hereinbelow specified. Please review the comments and revise the document accordingly. Every attempt is made to do a complete review, however additional comments may be necessary as additional information is submitted. Upon completion please resubmit three blueline copies of the short plat drawing. The face of the plat calls out a note on BM Monument Number 369 and refers to NAD 1983. The correct isformation is: BM Monument Number 369, elevation 101 .368, and NAD 1988 meters. The relationship to a second City of Renton Survey Control Network monument is not shown and state law requires a basis of bearing (WAC 332-130-150 and RCW 58.09.060). This is particularly necessary because of the lack of agreement between the coordinates and the azimuthal bearings shown. See the attachment. The surveyor shall show what was set at the corners of the proposed lots on the short plat drawing. The face of the short plat drawing lists Keith Menges and Michelle Menges as the owners. The drawing provides a space for a notary for the signatures of Ralph Warren and Sanda (please confirm spelling of this name) Warren. Please provide documentation showing when, and by what conveyance, Menges and Warren acquired title. Our response will attempt to clarify aspects of the staff report. Your first statement requests clarification of the access/utility easement along the south property line. The proposed 20 foot access/utility easement extends only across the south property boundary of Lot 1 and does not extend across the inside lot which abuts your property. Therefore, the required yard setbacks would depend on how the applicant decides to orient future construction of the residence on the lot. The location or orientation of a single-family residence is not required with submittal of a short plat application, so staff does not presently know how the applicant plans to orient construction on the lot. If the applicant decides to orient the residence with the front yard toward the south, a 20 foot minimum setback from the property line would apply. If the applicant decides to orient the residence with the front yard facing toward Edmonds Avenue to the west, then the south property boundary would be subject to a side yard setback requirement of a minimum of 5 feet. Your second comment references a statement in the staff report about the predominant lot size in the area of the short plat. Lot sizes vary considerably in the vicinity of the site and it is difficult to estimate a "predominant" lot size. While there are some larger lots around the site; for example, across Edmonds Avenue NE, many of these lots have been recently subdividing into smaller lots. It may be more accurate to say that the proposed short plat lots are consistent with the lot sizes of recently developing properties in the area. The K & M Short Plat proposes lot sizes approximately 6,400 and 5,600 square feet in area. The Residential-8 DU/AC(R-8)Zone allows a 4,500 square foot minimum lot area which was established after considerable planning study and environmental analysis, and after an extensive public hearing process was conducted for adoption of the Comprehensive Plan and Zoning Ordinance. State Law ESHB 1724, adopted in 1995, states that certain matters, including the density of residential development, are not to be revisited during review of a specific project, once it has been analyzed and adopted as part of a GMA Comprehensive Plan and Zoning Ordinance. The 4,500 square foot minimum lot size standard applies to all R-8 zoned areas which is the principal single-family residential zoning district within the City. There would have to be special, extenuating circumstances of a property or an area to allow the City to make an exception from the adopted standards and to essentially not allow an individual property owner the use of his/or her property as is expected and available to other property owners in the City. Access to Lot 2 is proposed via a 15 foot wide access and utility easement running along the south property line of Lot 1, connecting to Edmonds Avenue NE. The site is zoned Residential-8 DU/AC (R-8)which allows detached single family residential homes on lots as small as 4,500 square feet in size. The proposed parcels would meet the minimum lot size and lot dimension requirements. Lots 1 and 2 would be suitable for the construction of a detached single family residential home. The R-8 zone allows for a density range of 5 to 8 dwelling units per acre. The subject proposal for 3 lots would result in a net density of 7.26 dwelling units per acre which meets the R-8 zone density requirements. 2. Consistency Short Plat Criteria Approval of a plat is based upon several factors. • The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The proposal is consistent with the Comprehensive Plan Land Use Element designation of Residential Single Family (RS) in that it would provide for the development of single family homes. The K& M Short Plat would provide infill lots consistent with policies of the RS Comprehensive plan designation. The infill development would assist in achieving objectives promoted in the Comprehensive Plan such as reducing sprawl, making more efficient use of public services and infrastructure, and improving opportunities for better public transportation. b) Compliance with the Underlying Zoning Designation The subject property is zoned R-8. This zone allows for the development of single-family homes on legal lots as a primary permitted use. The 2 proposed lots meet the 4,500 square foot minimum lot size requirement and the minimum lot dimension standards of the R-8 zone. The lots are sufficient in area for the development of residences meeting R-8 setback requirements. The R-8 zone allows for a density range of 5 to 8 dwelling units per net acre. The subject proposal for 3 lots would result in a net density of 7.26 dwelling units per acre which is within the allowable density range. c) Compliance with Subdivision Regulations Lot Arrangement: Side lot lines are to be at right angles to street lines, and each lot must have access to a public street or road. Access may be by private access easement street per the requirements of the Street Improvement Ordinance(Code Section 4-34). The proposal complies with this criteria. The side lot lines are proposed at right angles to the street and each lot would have direct access to a public street. The applicant has proposed a 15 foot wide access easement which is inadequate per the City Code. A revised plan illustrating a 20 foot wide easement with a minimum width of 12 feet of pavement will be required. Lots: The size, shape and orientation of lots shall meet the minimum area and width requirements of the applicable zoning classification and shall be appropriate for the type of development and use contemplated. The proposed lots meet the minimum lot size and lot dimension requirements of the R-8 zone and the lots would be appropriate for the development of single family homes. d) Reasonableness of Proposed Boundaries Access: Lot 1 would have direct access from Edmonds Avenue NE. Lot 2 is proposed to be accessed from a 15 foot wide access/utility easement running along the south property line of Lot 1. The Street Improvement Ordinance requires an access easement of a minimum of 20 feet in width, and a paved driveway surface with a minimum width of 12 feet (Section 4-34-5.E.). The applicant should revise the short plat application to meet the required standard. Topography: The site is generally flat with an average slope of about 1.6%. The site is lower than the adjacent street elevation, approximately 1 foot lower than the sidewalk. A Fire Mitigation Fee of$488 per new lot is recommended as a condition of approval to fund future capital improvements for fire facilities. Recreation: The subject parcel is located within a couple of blocks from Mcknight Middle School and a couple of miles from Gene Coulon Park. Staff will recommend as a condition of approval of the short plat that the applicant pay a Parks Mitigation Fee in the amount of$530.76 per each new single family home that would be constructed on the site. This fee would be payable prior to the recording of the short plat. Schools: According to the Renton School District, new development results in 0.76 school-age children per new building lot. Therefore, the proposal is expected to generate between one and two new students. Storm Water: The applicant proposes properly sized on-site infiltration facilities to retain flows generated by new impervious surfaces created by this short plat.. Water and Sanitary Sewer Utilities: No water or sewer main extensions are required to serve the proposed lots. O Compatibility with Surrounding Land Uses The subject proposal would create two building lots, approximately 6,400 and 5,600 square feet in size. Both of the lots exceed the 4,500 square foot minimum lot size of the R-8 zone. There are two existing residences which border the project site to the south. One of the residents has written a letter of concern about the size of the proposed lots impacting their privacy and property values. Both of the adjacent lots are approximately 7,200 square feet in area, and this is the predominant parcel size in the area. The project applicant proposes a 15 foot wide access/utility easement along the south property boundary that would face the adjacent residents. This easement is proposed along the south property boundary because it is the most efficient layout for extension of utilities to serve the lots. The construction of future residences would have to maintain at least a 20 foot setback from the south property line because of the access/utility easement. The adjacent neighbor and/or the applicant may construct a fence along the south property boundary to screen the proposed development from the neighbors to the south. SANITARY SEWER: • This project is located in Aquifer Protection Zone 2. • The sanitary sewer requirements for this project have been coordinated with the engineer and the adjacent project (Austin Estates Plat). The sanitary sewer main design for the Austin Estates project shows the main extended into Edmonds Ave NE with a MH at the end. Two 6" sidesewer stubs will then come out of the MH to the east to serve this new two lot short plat. This proposal for the sanitary sewer has conceptual approval. • The private utility easement shall be located on the south side of the new Lot 1. • Sanitary Sewer System Development Charges (SDC) fees of $585 per each new lot are required. WATER: • This project is located in Aquifer Protection Zone 2. • There is a 6" watermain in Edmonds Ave NE in the 565 Pressure Zone. • There is a 12" watermain in Edmonds Ave NE from NE 20th St to NE 16th St in the 435 Pressure Zone. • There is a fire hydrant at the SW corner of the intersection of Edmonds Ave NE and NE 20th St off the 12" watermain. • There is a fire hydrant at.the SE corner of the intersection of NE 19th St. and Edmonds Ave NE off the 6" watermain. • All fire hydrants must be capable of delivering a minimum of 1,000 GPM. • The City of Renton Code states that there shall be a fire hydrant no further than three hundred feet from any new construction. GENERAL: • All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a registered Civil Engineer. • Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvement is 5% of the first $100,000 of the estimated construction costs; 4% of anything over $100,000 but less than $200,000, and 3% of anything over $200,000. In response, the K & M Short Plat proposes lot sizes approximately 6,400 and 5,600 square feet in area which complies with the adopted minimum lot size standard. This standard was approved in 1993 with the adoption of the City's Growth Management Act(GMA) Comprehensive Plan and Zoning Ordinance. At that time, the smaller minimum lot size was considered as necessary to accommodate projected population growth for the City. There was an extensive public hearing process conducted for adoption of the Comprehensive Plan and Zoning Ordinance. State Law ESHB 1724, adopted in 1995, states that certain matters, including the density of residential development, are not to be revisited during review of a specific project, once it has been analyzed and adopted as part of a GMA Comprehensive Plan and Zoning Ordinance. On an annual basis in the first quarter of every year the City reviews policies and standards of the Comprehensive Plan and zoning. Your input on this issue would be most welcome at that time. Next, you also expressed concern about the impact of future home construction with regard to your privacy. The project applicant has proposed an access/utility easement adjacent to your common property boundary because this is the most efficient layout for extension of utilities to serve the proposed lots. The future construction of homes would have to maintain a minimum 20 foot setback from the common property line because of the easement. The applicant has indicated a willingness to construct, or share in the cost of constructing, a fence along your common property boundary. The current parcel does not have a house on it. The site lies on the east side of Edmonds Avenue Northeast. The sidewalk along the east side of Edmonds Avenue Northeast is higher than the current lot which prevents any runoff from leaving the site to the west. A small portion (approximately 500 square feet) of the lot in the northeast corner slopes to the northeast. The rest of the lot is a shallow closed depression. The low point of the lot is near the south property line approximately 40 feet from Edmonds Avenue Northeast. The total change in elevation from the high point to the low point about 3 feet. The site is currently covered with grass and has several large fir trees, mostly in the northeast corner of the lot, several cedar trees along the south property line, and several fruit or nut trees scattered around the lot. Downstream Analysis No downstream analysis is necessary for this lot because all the runoff is contained onsite except for a small area in the northeast corner of the lot which will not change with the development of this lot. Site Visit This site was visited on March 29, 1997 . It was a high overcast day. It was dry but there had been showers in the area in the week before. The neighbor to the south was working in her yard. She said she had lived in the house since 1966. She said the adjoining lot has been soggy in the past but she has never seen ponding on the ].ot. Nobody was home in the house to the north of this site. All the houses observed in the area have downspouts draining to the - ground. There is a curb cut in the vertical curb along Edmonds Avenue Northeast near the north property line. Mitigation The soils in this area are classified in the Indianola series which are somewhat excessively drained. Only a small portion of this lot drains offsite and that will not change with the development of this lot. Properly sized onsite infiltration facilities should be able to retain all flows generated from new impervious surfaces created by this short plat. The sanitary sewer main design for the Austin Estates project shows the main extended into Edmonds Ave NE with a MH at the end. Two 6" sidesewer stubs will then come out of the MH to the east to serve this new two lot short plat. Additional fire hydrants may be required. • Water System Development Charges (SDC) fees of $850 per each new lot will be required for this project. STORM DRAINAGE: • The Surface Water System Development Charges (SDC) of $385 per each new lot applies to the proposed project. STREET IMPROVEMENTS: • Sidewalks and curb may be required to be replaced if determined to be in poor condition and if damaged during construction. • Street lighting is not required. GENERAL: • All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a registered Civil Engineer. • Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvement is 5% of the first $100,000 of the estimated construction costs; 4% of anything over $100,000 but less than $200,000, and 3% of anything over $200,000. Half of the fee must be paid upon application for building and construction permits, and the remainder when the permits are issued. There may be additional fees for water service related expenses.
