Dear Mr.Zable and Ms. Metz:
As you likely are aware, the City of Renton is proceeding with the Duvall Avenue NE Project. As part of the
project,the City needs to purchase a part of your property and/or certain property rights related to the property
located at 815 Duvall Place NE, Renton and identified as King County Assessor's tax parcel number 143765-
0140.A copy of the map is attached.
By law the City must pay you for the property and/or property rights acquired from you, unless you choose to
donate the land the property to the City.The purpose of this letter to explain to you the basis for the City's offer
in order to reach an agreement with you regarding the purchase of the property needed for this project.
In those cases where property rights being acquired involve a payment of less than $10,000, the City
administratively establishes the amount offered. This administrative offer is based on market research
performed by a person having sufficient understanding of the local real estate market. An administrative offer
of$1,900.00 is being made for your property or property rights.This offer consists of:
• $1,900 for 460 SF Temporary Construction Easement for street improvements.
The basis for this offer is contained in the attached report. Payment for your property and/or property rights
will be made available to you approximately 30 to 45 days after you accept the City's offer,provided that there
are no delays in closing the transaction.
You may wish to employ a professional appraiser or realtor to evaluate the City's offer. If you do so,we suggest
that you employ a well-qualified evaluator so that the evaluation report will be useful to you in deciding

whether to accept the City's offer. The City will reimburse up to $750.00 of your evaluation costs upon
submission of the bills or paid receipts.
Please understand that every effort will be made to come to an agreement regarding this offer. However, if
mutual agreement cannot eventually be reached through a voluntary negotiation,the City acting in the public
interest, may use its right of eminent domain to acquire the property rights for the public use. In conformity
with the Washington State Constitution and laws,the City's legal counsel will file a condemnation suit to obtain
a "Court Order of Public Use and Necessity", and a trial will be held to determine the just compensation to be
paid for the property and property rights acquired. This action is taken to ensure your rights as an individual
property owner and the rights of all City of Renton's taxpayers are equally protected.
If you have personal property presently located on the property being acquired by the City that will need to be
moved, however the City will reimburse you for the cost of moving it through the Relocation Assistance
program.
We have attempted by this letter to provide a concise statement of our offer and summary of your rights.We
hope the information will assist you in reaching a decision. Please feel free to direct any questions you may

TEMPORARY CONSTRUCTION EASEMENT
Duvall Avenue NE Project
This Temporary Construction Easement (the "Construction Easement"), is made and
entered into this 04 day of f"tO1Ct , 2020, by and between John L. Zable, as his
separate estate and Lisa Kirsten Metz, as her separate estate, both unmarried individuals,
("Grantor"), and the City of Renton, a municipal corporation ("City" or "Grantee"), its
successors and assigns.
For Good and Valuable Consideration, receipt of which is hereby acknowledged,
Grantor, as the owner of that certain real property legally described on Exhibit "A" —Entire
Parcel ("Property"), attached hereto and incorporated by this reference, does hereby grant to
the City,a four hundred and sixty(460)square foot temporary easement area for minor clearing
and grubbing and excavation and fill and construction purposes in,on,over,through and across
that portion of the Property described on Exhibit "B" (Easement "Area") and depicted on
Exhibit "C", which are attached hereto and incorporated by this reference, for the purpose of
Temporary Construction Easement;protecting existing public and private improvements in the
immediate vicinity of the Project area; and repairing, restoring and/or reestablishing any
improvements disturbed while undertaking the Project activities described above.
The temporary rights granted in this Construction Easement shall be effective upon
execution by the parties. Grantee and/or its contractors shall provide forty-eight (48) hours
notice to the Grantor of its intent to commence construction. The temporary rights granted to
the Grantee shall automatically terminate and be null and void(i)twenty four(24)months after
the execution of this easement or(ii) upon restoration of any existing improvements disturbed

by the Grantee within the temporary easement area,whichever is later,but in no event later than
December 31, 2022.
The Grantee agrees to hold harmless, indemnify and defend the Grantor from and
against any and all claims,losses or liability,for injuries,sickness or death of persons,including
employees of the Grantee,or damage to property,arising out of the exercise of Grantee's rights
under this Construction Easement or any willful misconduct or negligent act, error, or omission
of the Grantee, its officers, agents, contractors, subcontractors, licensees, or employees, in
connection with the Grantee's activities authorized by this Construction Easement, provided,
however,that:
(a) The Grantee's obligations to indemnify, defend and hold harmless shall not
extend to injuries, sickness, death or damage caused by or resulting from the
sole willful misconduct or sole negligence of the Grantor; and
(b) The Grantee's obligations to indemnify, defend and hold harmless for injuries,
sickness,death or damage caused by or resulting from the concurrent negligence
or willful misconduct of the Grantee and the Grantor, or of the Grantee and a
third party other than an officer, agent, contractor or employee of the Grantee,
shall apply only to the extent of the negligence or willful misconduct of the
Grantee (including an officer, agent, contractor or employee of the Grantee).
Grantee shall, at its sole cost and upon completion of the work within the Easement
Area, fully restore the surface and subsurface of the Easement Area and any public or private
improvements disturbed by or destroyed during the execution of the work, as nearly as
practicable,to the conditions as of the effective date of this easement.
It is the intention of the parties that this document be strictly limited to and for the
purposes expressed.
This Construction Easement and covenants herein shall be recorded with the King
County Recorder,shall run with the land described herein,and shall be binding upon the parties,
their successors, heirs and assigns.
Grantor covenants that it is the lawful owner of the above-described property and has
authority to convey such easement.
It is understood and agreed that delivery of this Construction Easement is hereby tendered
and that the terms and obligations hereof shall not become binding upon the City of Renton,
unless and until accepted and approved hereon in writing by the City of Renton.

BACKGROUND and SUMMARY OF NEGOTIATION
• On February 12,2020 an offer was made to John Zable,the owner,in the amount of$1,900,which
consisted of a 460 square foot temporary construction easement(TCE)for 24 months. During the
meeting the owner stated he would take the paperwork and discuss the offer with his attorney.
• On February 25, 2020 Mr. Zable made a counteroffer of$2,870 based on the highest comparable
used in his AOS package of$39/sf and a thirty (30) day notice of commencement of the TCE.
When asked why he felt this was comparable to his property his response was it would be less
expensive to pay him the additional amount of money than trying to acquire the land through the
court process. I explained that this comparable was much smaller than his property and it provided
all public utilities, which would yield a higher price per square foot. He insisted that I take his
counteroffer and present it to the City and that he will not make any concession until he hears back
from the City.
• On March 4, 2020 I presented a counteroffer to Mr. Zable at $2,208 or $30/sf. Mr. Zable stated
that he and his neighbor were disappointed that the City offered them the lowest comparable and
they feel that their property is worth more than what is being offered by the City. I further explained
that his property was evaluated by an appraiser, who determined the value at $25/sf. I further
explained that he lives on a larger than average lot and is not connected to public sewer unlike the
other properties in the area. I also explained the assessed value of the property is $14/sf and the
City is confident in their number,however, in order to settle they would be willing to offer$30/sf
or$2,208. He stated he would only settle at$2,500.
• March 19, 2020 after further negotiation with the owner and the City, a settlement of$2,500 was
reached.

RECOMMENDATION/JUSTIFICATION
The proposed administrative settlement figure of$2,500.00,which is$600 above the original offer amount
will expeditiously conclude the purchase of the property rights needed within the critical project timeline.
As discussed with the City the proposed settlement is a low dollar amount compared to the risk of litigation
and delays of the project. Time is of the essence, therefore this settlement is recommended, as it is
reasonable and represents prudent use of the public funds. There is fairly high risk of the cost being higher
than the proposed settlement if the purchase is delayed or the matter referred for litigation.
As documented above,I find that proposed settlement request is consistent with the law and is reasonable,
prudent,and in the public interest.

1/31/2020 Called and left a message for John from a phone number I obtained online.
2/3/2020 Received a message from John Zable.
2/4/2020 Called and spoke with John. I explained the project and he stated his neighbor told him
that his property was not needed for the project. I explained the project is in need for a
temporary construction easement, in order to step onto his property to construct the
improvements in the right-of-way. He stated he was okay with that as long as they did not
touch the fence,he installed last year. He stated the fence is on the property line. I inquired
if the fence was surveyed and he stated it was not, but the same fence line has been there
for years. I explained that often times the fence is not on the exact property line,but I will
find out if we have any information regarding the fence line. We scheduled to meet on
2/12/20 at 1pm. He asked if his neighbors have been contacted and I explained I have sent
out request for contact letters to his neighbors but if he happens to see them in the meantime
to please have them give me a call. He stated he would.
2/12/2020 I met with John Zable at his home at 1pm. I presented the offer of$1,900 for a 460 square
foot TCE for a period of 24 months. The package consisted of the offer letter, TCE
document and voucher. I went through the offer letter in detail and explained the $750
statutory allowanced. I showed Mr. Zable some of the preliminary construction plans,
including the sidewalk plan to explain how the improvements would look on the west side
of his property. I explained that although most of the TCE is on the inside of his fence that
it was my understanding the fence would not be disturbed, however, if it was it would be
replaced in similar condition. We also went through the TCE document. Mr. Zable
explained he did have a bad experience with the City with a property his mother had, but
we did not go into detail. He also stated he had reached out this his neighbor Peter Buza
and Mr. Buza stated he would call me after I had met with Mr. Zable. I explained I would
give his time to review the information I left with him and encouraged him to call with any
questions or I would give him a call in a couple of weeks.
2/19/20 I called and spoke with Mr.Zable,who stated he dropped off the documents to his attorney
and has an appointment with her on 2/24/2020 in the late afternoon. He stated he would
give me a call on Tuesday to further discuss.
2/25/2020 Phone call from Mr. Zable,who stated he spoke with his attorney and he wanted to have a
30-day notice of construction added to the TCE. He also stated he wants his property
valued at$39/sf, which was approximately $1,000 above the offer. He stated it would be
cheaper to pay him than going to court. I asked that he submit a counteroffer via email.
Email from Mr. Zable, 'As we discussed, in the last paragraph of the first page of the
contract, please provide 30 days notification. I addition, instead of the amount offered
being based on the lowest comparable, I would like it to be based on the highest
comparable. '
2/27/2020 Emailed counteroffer to Flora Lee,City of Renton and asked to schedule a conference call.
3/3/2020 Left owner a message.
3/4/2020 Received a phone call from John and I explained the City is confident in the offer at $25
per square foot. I further explained that the contractor would only be using about 1 foot
of the TCE which is located on the other side of his fence. He stated he wanted the City to
come back with a new offer and further explained the value the fence and the vineyard on
his property add. I explained we would not be impacting any of his improvements and if
the contract did it would be replaced in like kind. He asks me again to go back to the City
for a better offer.
3/11/2020 Called and left a message for John.
3/13/2020 Spoke with John and stated the City is still confident with their offer however,they would
be willing to settle at 30/sf or $2,208. He stated he would not take less than $2,500 plus
the 30 notice for the TCE. I told him I would discuss this proposal with the City and let
him know.
3/19/2020 Email to John stating the City agreed to settle at $2,500, however, the City will not agree
to the 30-day notice. Further stating, the commencement is on execution of the TCE (the
date the City begins paying for the TCE), the 48 hours is the notice of the contractor
occupying the TCE and beginning of construction. The contractor cannot get any closer
than 48-hour notice before they begin construction on the entire project, and he can get
construction related information from the City's website.

3/20/2020 Scheduled to meet with John on 3/24/2020 at 3pm.

commencement is on execution of the TCE (the date the City begins paying for the TCE), the 48 hours is the notice of the
