You can review the email chain below for reference:I doubt you will be able to cipher the attached deeds as thescans
are not very good and l can barely understand them but the email:chain explains what is happening:
I can say based on the research that the Jehovah's:Witnesses do NOT own:the 30 foot northerly strip and so no attempt
to purchase it from them:would have:any legal standing(they can't sell what they don't own). As to who:actually owns ::
it,nothing definitive has been uncovered showing that it was ever conveyed.to the city county fora public street and
it likely belongs to the heirs of the original estate prior to being sold:off.: Some of the deeds:reserve this strip for road:
purposes but that does not constitute a conveyance or dedication of the land to a specific government entity. l am not
: sure if the city already has a policy in place for handling prescriptive rights issues as.may be the case here,:this can be a
complicated matter to sort:out:and:absent any conveyance documents I believe there are a couple courses of action to
consider.:
1. The:city at a minimum has a claim to a Prescriptive Easement over this fee if it has been:used by the public :.
' maintained by the city fora continuous period of 7 years. Because.this would be for a public right of way;the
prescriptive easement would.cover the entire width of the common rights of way in the area,so in this case
would be:the 30 foot wide strip]in question.
2. The city could.file.a Quiet Title Action.to obtain the right of way in fee,which is essentially a lawsuit asserting
ownership over this strip of land and gives any party.that has a claim to the fee to come forward and present
evidence to the contrary. It is up to a judge to decide the ownership and to quiet the title:

OK, my colleague searched back before 1914 and did not find any road deed:or reservation.:..
The first deed to reserve a road is 3105786::They later realized that wasn't the property.they intended to:convey, and
'un-did' it with a quit claim:deed 3.158917 back to the seller.Since the correction deed says the first deed was:
erroneous,it is arguable whether this is the_first deed to reserve the road or not.

The first non-erroneous deed that reserves.a road is 3221928.
The last deed:to reserve a road is 3530017.
The first deed with the current description(S 200 of N 230) is 4886672. If the previous road reservations were
interpretedto be an easement,these grantors would hold title to that north 30 feet,as their exception of the north 30
feet is:absolute.

have been working•to figure out this road situation.So far,the oldest deed I can find is from 1942, recording number
3221928,for the EH of.the WH of the:NEQ of the NWQ, and it says
"except the north 30 feet and the south 10 feet thereof reserved for road purposes"
I.am working to find the_deed or patent into George Merrick to see if there is any mention of this road or deed out, but I
don't have the resources here to go before1914, so I have had tolask a colleague to look into that. But I suspect from
looking at other properties that NE 12th was originally established With the reservation language quoted above in deeds
out of the Merrick family.

I have completed a cursory analysis of King County Tax Parcel No. 102305-9378, located at 1155 Duvall Ave NE,
Renton WA. In researching the parcel to determine the current boundary locations, I obtained a Deed of Trust
under Auditor's file number 198703180521, which gave an aliquot parcel description of the subject parcel. I
believe this to be the current deed of the parcel and have attached a copy of the deed for reference. The
description given is:
South 200 feet of the north 230 feet of the east half of the west half of the northeast quarter of the north west
quarter of Section 10, Township 23 North, Range 5 E.W.M., in King County, Washington; LESS the south 125 feet of
the west 142.2 feet; and LESS that portion of the east 42 feet as conveyed to County for roads.
I will attempt to break this down into layman's terms and I have included a sketch for reference. First of all we
break down the half, and quarter section calls to determine where we are located. This puts us in the southwest
quadrant of Duvall Ave, and NE 12th Street; the centerline of Duvall Ave is the east boundary line, the west
boundary line is approximately 330 feet west of the Duvall Ave centerline and the Centerline of 12th St. is the
north boundary. We do not have the south parcel line defined at this point.
After we have established these Boundary lines we look at the call "the north 230 feet".This places the south
parcel line 230 feet south of the centerline of NE 12th Next we see that they only own the "South 200 feet of the
north 230 feet" which places the north parcel line 30 feet south of the NE 12th street. This leaves a 30 foot wide
strip of land from the centerline of NE 12th to the North line of the parcel (I cannot determine who owns this strip
from this description, simply that it is not included as part of the parcel being described).
Last we look at the exceptions. The description states "LESS the south 125 feet of the West 142.2 feet, so you
subtract this area from the parcel that was just described. Next the description states "and LESS that portion of
the east 42 feet as conveyed to the County for Roads" which implies that this portion has been conveyed to the
County at an earlier time.
Our concern in analyzing this parcel description was to determine the ownership of the north portion of the
parcel to the section line (NE 12th St. centerline). I am not able to say conclusively who owns this strip in fee,
however it does not appear to belong to the current tax parcel listed above. In order to determine if this was ever
conveyed to the County or City a Title Guarantee or Chain of Title would need to be obtained on the subject
parcel.

Our surveyor has done quite a bit of detective work regarding the southerly half of the west leg of 12th& Duvall, and is
describing what he found in the email below. Bottom line is that the church does NOT own the property, and there are
a couple of options the City has, outlined below.
Please let me know what you decide to do. We'll continue to move forward with design.

You can review the email chain below for reference. I doubt you will be able to cipher the attached deeds as the scans
are not very good and I can barely understand them but the email chain explains what is happening.
I can say based on the research that the Jehovah's Witnesses do NOT own the 30 foot northerly strip and so no attempt
to purchase it from them would have any legal standing(they can't sell what they don't own). As to who actually owns
it, nothing definitive has been uncovered showing that it was ever conveyed to the city or county for a public street and
it likely belongs to the heirs of the original estate prior to being sold off. Some of the deeds reserve this strip for road
purposes but that does not constitute a conveyance or dedication of the land to a specific government entity. I am not
sure if the city already has a policy in place for handling prescriptive rights issues as may be the case here,this can be a
complicated matter to sort out and absent any conveyance documents I believe there are a couple courses of action to
consider.
1. The city at a minimum has a claim to a Prescriptive Easement over this fee if it has been used by the public
maintained by the city for a continuous period of 7 years. Because this would be for a public right of way,the
prescriptive easement would cover the entire width of the common rights of way in the area, so in this case
would be the 30 foot wide strip in question.
2. The city could file a Quiet Title Action to obtain the right of way in fee, which is essentially a lawsuit asserting
ownership over this strip of land and gives any party that has a claim to the fee to come forward and present
evidence to the contrary. It is up to a judge to decide the ownership and to quiet the title.

OK, my colleague searched back before 1914 and did not find any road deed or reservation.
The first deed to reserve a road is 3105786.They later realized that wasn't the property they intended to convey, and
'un-did' it with a quit claim deed 3158917 back to the seller. Since the correction deed says the first deed was
erroneous, it is arguable whether this is the first deed to reserve the road or not.
The first non-erroneous deed that reserves a road is 3221928.
The last deed to reserve a road is 3530017.
The first deed with the current description (S 200 of N 230) is 4886672. If the previous road reservations were
interpreted to be an easement,these grantors would hold title to that north 30 feet, as their exception of the north 30
feet is absolute.

I have been working to figure out this road situation. So far, the oldest deed I can find is from 1942, recording number
3221928, for the EH of the WH of the NEQ of the NWQ, and it says
"except the north 30 feet and the south 10 feet thereof reserved for road purposes"
I am working to find the deed or patent into George Merrick to see if there is any mention of this road or deed out, but I
don't have the resources here to go before 1914, so I have had to ask a colleague to look into that. But I suspect from
looking at other properties that NE 12th was originally established with the reservation language quoted above in deeds
out of the Merrick family.

Shane,
A small strip (approximately 5 feet according to King County imap information) of the 30 feet in question is covered with
asphalt paving and is used by the public. The majority is separated from NE 12th with a rock wall, topped with a chain
link fence, and the area behind the fence contains the drain field from the church's septic tank. We don't want to
engage the church in an action to remove their drain field from what appears to be road easement(to whom I don't
know, probably Chicago, Milwaukee St Paul RR) or ROW, whose I don't know. We want to just construct a curb return
where the south edge of NE 12th Street will ultimately be constructed. This is a state funded project so WSDOT won't
have to certify ROW.The State (TIB)expects us to follow the LAG manual, but they don't enforce it.
In the past prescriptive rights status was not adequate(for FHWA) proof of the City's right to occupy. However I have
recently been told of an instance where it has been. Because of the funding source, we shouldn't have to test those
waters if we were to claim a prescriptive right. Unfortunately,the church is occupying a portion of what we need.
Ownership of the 30-foot strip is unknown by me. It isn't included in the NE 12th Street ROW, and it's not included in the
church's title's legal description. Since it wasn't dedicated as a street, I doubt the church can claim underlying
ownership of the south half of NE 12th. The property in question has, however been adversely occupied by the Church
for a long (more than 7 yrs)time, and they have apparently been paying taxes on it (to the extent that churches pay
taxes which is never) if you consider the assessor's map property boundaries. I was thinking of the City taking a quiet
title action, but that might result in perfecting the churches title to it.
I can probably persuade the Church to dedicate the little corner that we need for the project. But since the Church
probably doesn't have title to it, and that corner doesn't have a fence (it does have a rock wall), I was a bit uncertain
about asking for something the church probably doesn't have a right to dedicate. They could quit claim it, and I certainly
would want to discuss relocating the Church's rock wall before doing it. I'm trying to develop a strategy before opening
a discussion with the church. Right now I have no idea who owns or has right to the property in question.
The foregoing is a disjointed stream of consciousness that maybe you can rectify and then give me some advice.

Am I correct that all land at issue has been used as a road for at least 10 years? If yes, I think the City has a prescriptive
easement,at a minimum.

Are there funding requirements forcing this question to be answered with certainty? Short of funding being on the line,
it seems there would be very little risk in making improvements to property we have already been treating as right of
way(and has been dedicated as right of way in private deeds in the past).
If we need absolute certainty as to ownership, a quiet title lawsuit is the only way to get that, but it would be potentially
costly and time consuming(seeing as we don't know who to serve with the lawsuit). So I'd want to know more about
why certainty is needed before advising to start a lawsuit.

The southerly half of the west leg of 12th & Duvall,from Kingdom Hall of Jehovah's Witnesses(church) parcel line to 30
ft north on NE 12th St.,
we couldn't locate any easements or who owns this strip of road (see attached "Exhibit.pdf"):

consultant.
