The approved 2003 Surface Water Utility Capital Improvement Program budget for this project is $210,000. An additional $44,000 is proposed in the 2003 carry forward budget for a total appropriation of$254,000. MOVED BY CORMAN, SECONDED BY BRIERE,COUNCIL CONCUR IN THE COMMITTEE REPORT.* Responding to Council President Keolker-Wheeler's inquiry regarding why the project is over budget, Councilman Corman explained that the staff estimate used to determine the project budget was preliminary, and when the consultants submitted their estimate, it was higher than the preliminary estimate due to the nature and complexity of the project. Planning/Building/Public Works Administrator Gregg Zimmerman added that with the ongoing development in the Valley,the floodplain elevation might be too high. He explained that when the elevation is too high,property in the floodplain is unbuildable. By readjusting the floodplain elevation, a process that must be approved by FEMA,the floodplain could be reduced resulting in more buildable property. *MOTION CARRIED. Transportation(Aviation) Transportation(Aviation) Committee Chair Persson presented a report Committee regarding the SR-167 Springbrook Creek Culvert replacement project. WSDOT: SR-167 Springbrook Construction permit U030038 was approved for the project pending conditions Creek Culvert Replacement required by the Renton City Council and Board of Public Works. The Board of Project Public Works met on January 22nd and issued an approval of the noise variance subject to meeting the listed mitigation measures indicated in a subsequent January 22nd,2003, letter sent to the Washington State Department of /�c� Transportation(WSDOT). 0 2 1 The Committee met on January 30th and determined other requirements of the SR-167 weekend closure to be accomplished by WSDOT in order to address area business and resident issues. The Committee recommended concurrence in the recommendation of staff to approve the SR-167 closure with the following additional requirements: 1) The SR-167 closure between S.212th St. and SW 43rd St. is approved for all weekends in July and September. It is the preference of the Committee that,if a July weekend is chosen,the weekend of the 25th—27th be a last priority due to the City celebration of Renton River Days. Furthermore,no dates in August will be allowed for the closure. 2) The Committee expressed its preference for using Washington State Patrol officers for flagging traffic at the intersections of SW 41st St. and East Valley Rd., SW 43rd St. and East Valley Rd., and the northbound entrance to SR-167 and S.43rd St. However,the Committee agreed to allow the State Highway Department to provide experienced,trained flaggers to control traffic at these three intersections. The Committee further recommended requiring the State to provide this traffic control at the three intersections at all times as a condition of the permit. February 10,2003 Renton City Council Minutes Page 63 3) Signage with lettering of at least 18 inches high to clearly direct traffic to major businesses and destinations such as IKEA,Valley Medical Center, and Southcenter Mall will be provided by WSDOT. In addition,WSDOT • agrees to leaflet major businesses located within the vicinity of the project prior to the closure. Renton will provide a list of specific businesses and major destinations to be included in WSDOT's distribution at least three weeks prior to the closure. Businesses or public service agencies that require additional written notification include,but are not limited to: Medic One,Renton School District,King County Metro (transit),Valley Communications, and the cities of Renton,Tukwila, and Kent. 4) Signage will be provided to forewarn the traveling public of the SR-167 closure at S. Carr Rd. (Petrovitsky Rd. SE) and Benson Rd. S. This work will require a complete closure of SR-167 for 3 nights and partial closures for 11 nights to intermittently occur during the construction window of June 15th to September 30,2003. The culvert replacement project consists of excavating and backfilling,reconstructing asphalt concrete and median barrier and placing pavement markings. Board of Public Works January 23,2003 Page 2 Justification: The W.S.D.O.T.traffic construction group has determined that performing lane closures during the day would adversely impact freeway flow and city arterials. Thus,W.S.D.O.T.traffic specialists recommend that some work be performed at night when traffic volumes are low enough to handle lane closures, lessening congestion in the vicinity. Acting Chairman Dave Christensen opened the public meeting at 8:30 a.m. Laura Musso-Escude,Acoustic,Air Quality and Energy Specialist,W.S.D.O.T.: Ms.Musso-Escude gave a brief presentation on the basic construction work plan,taking place on SR-167 at approximately milepost 23.64. W.S.D.O.T.has completed notice and mailing of announcement to the public. Amjad Omar,Design Team Leader and Chief Inspector,W.S.D.O.T.: Mr. Omar offered a map and plans showing the SR-167 culvert crossing location at approximately 55th Street S.E. in Renton. Elaborating on the traffic volume factor,Amjad stated that the traffic construction group would allow daytime shoulder closure,but not lane closures. All lane closures must take place at night so as to minimize the impact of the public. The Right-of-Way permit was issued by the City of Renton on 1/21/03 with an open condition that is to be defined in a Transportation Committee meeting with the City of Renton on January 30th of 2003. The early issue of this permit was given with reasoning that all permits for construction are necessary in order for W.S.D.O.T.to acquire federal funds for this project. Karl Hamilton questioned Mr. Omar as to a time frame of nightly closures. One (1)lane closures will begin at 8:00 p.m. Two(2)lane closures will begin at 10:00 p.m. and one(1)full lane closure will occur from 11:00 p.m. on a Friday night to 5:00 a.m.the following Monday morning. Jim Gray inquired on the possibility of adverse weather impact. Amjad explained that the Springbrook Creek is at it's lowest flow volume during the month of August and that this month does not normally bring any significant amount of rainfall. Weather will also be analyzed and anticipated before confirming specific dates of SR-167 closures. There being no further testimony,Acting Chairman Dave Christensen closed the Public Meeting at 8:50 a.m. Moved by Meckling,seconded by Gray to approve a variance to the Noise Ordinance for fourteen(14)nights to replace the Springbrook Creek Culvert at SR-167,beginning June 15th and to end no later than September 30,2003. A City of Renton Construction/Right-of-Way permit will be required for work in the City of Renton Right-of-Way. 2. Lighting used for nighttime work will be directed away from oncoming traffic and residences or shielded. 3. All haul vehicles shall have rubber bed liners to reduce noise impact. 4. All vehicles will be equipped with ambient sensitive backup warning devices. 5. W.S.D.O.T. shall conduct training on noise mitigation measures with all inspector and contractor personnel. W.S.D.O.T.shall submit certification to the City at completion of said training. In addition to providing training, W.S.D.O.T. shall grant the necessary authorization to have an acoustics expert/inspector onsite at all times to ensure immediate enforcement actions of all mitigation measures. 6. After two substantiated continuing complaints within the area of work are received and reviewed by staff,W.S.D.O.T. shall perform noise level tests at the site of affected residents. If noise levels are above allowed threshold, W.S.D.O.T. shall provide additional mitigation measures such as,but not limited to,shielding of noise source,reducing use of certain equipment,or providing motel accommodations. 7. A 24-hour notification number shall be available to register complaints or voice concerns. 8. The contractor shall notify affected residents, identified by the City of Renton application, about the nighttime work at least seven(7)calendar days in advance of such work. 9. Any material spilled or placed on the roadway surface during operations will be removed by sweeping. No scraping type equipment shall be used. 10. Approval for closure is fourteen(14)nights(3 complete, 11 partial closures),between June 15 to September 30,2003. The work consists of the replacement of an aged weir currently posing a fish passage barrier,with a new Washington Department of Fish&wildlife (WDFW) approved 3-step log weir system. This proposed work is part of a larger, culvert replacement project,which will improve stream flow and fish habitat, while controlling flooding. A Pre-application meeting concerning this project was held with Elizabeth Higgins, Senior Planner, and Paul Lumbert, Plan Reviewer, on December 13, 2001, at the City of Renton. At that time, Elizabeth indicated that an error was made in the previous determination of Non-Designated Shoreline for the project area. Project plans and details were submitted. (Elizabeth has stated that a file has been maintained on this project,with the City of Renton)Since then, a flow restrictor has been added to the plans,to be installed downstream,regulating flow of Springbrook until the City of Kent has completed a project in their jurisdiction. An updated copy of plans is included in this package, along with a copy of the cited City of Renton Municipal Code, applying to this project. The existing weir is a single step weir approximately 2.5 feet tall, and does not have a low flow notch. The existing system does not meet Washington State Depaitiiient of Fish and Wildlife standards, due to its height. The new weir system is composed of three steps, each having a height of 0.75 feet, and a low flow notch. • Additional work will include re-contouring52 lineal feet of channel upstream and 35 feet P downstream of the new culvert, in addition to replanting the stream banks with native vegetation(stream restoration). Stream banks along these limits will be re-contoured to lessen the steepness of slope. The variation in length is a result of the addition of the three step log weir system, along the upstream side of SR 167. Re-contouring is required so that a smooth transition between the new culvert opening and the outer project limit can be achieved. Furthermore, substrate must be removed to make way for the new spawning gravel. Approximately 5 cubic yards of 12 to 24-inch riprap will be placed below the ordinary high water mark(OHWM), and 8 cubic yards above the OHWM at the new weirs (inclusive). The placement of riprap at the weirs is designed to help keep them in place and stabilize the banks. Otherwise, the weir/bank interface could erode during the next high flow event. This activity will have beneficial effects on fish habitat. The project activity will be constructed using BMPs (Best Management Practices) designed to control erosion. Impacts will be minimized, and disturbed areas shall be immediately revegetated. The activity does not appear to be prohibited by the RMC. Per RMC 4-3-050C4, "activities taking place in critical areas and associated buffers, and listed in the Table of Exempt Activity, are exempt from applicable provisions of this section,provided a letter of exemption has been issued,per subsection C4 of this Section". The City of Renton reserves the right to determine activity of shorelines, streams and lakes. The project involves critical area/buffer restoration and enhancement, in addition to habitat improvement and improved stream flow in the City of Renton designated under "Exempt Activity-Conservation, Enhancement ai, aii, and aiii, conserving and preserving fish habitat, and other environmental values". It is therefore our(WSDOT) interpretation of the RMC, that these work activities planned for Springbrook Creek Shoreline will qualify as exempt activities.
